California Eviction Protections For Victims Of Domestic Violence: Additional Protections Or Additional Problems, Rebecca Licavoli Adams Jan 2012

California Eviction Protections For Victims Of Domestic Violence: Additional Protections Or Additional Problems, Rebecca Licavoli Adams

UC Law Journal of Race and Economic Justice

In 2011, California Code of Civil Procedure section 1161.3 (Section 1161.3) came into effect providing victims of domestic violence with an affirmative defense against a landlord's eviction action if resulting from an act of domestic violence. Domestic violence victims often are faced with homelessness due to lease provisions that allow eviction due to a violent or criminal act occurring in their rental unit or because of noise complaints from other tenants. After a victim is evicted the victim may have difficulty finding a new rental due to credit issues or a criminal history directly relating to the domestic violence.

Pregnancy As 'Disability' And The Amended Americans With Disabilities Act, Jeannette Cox Jan 2012

Pregnancy As 'Disability' And The Amended Americans With Disabilities Act, Jeannette Cox

School of Law Faculty Publications

The recent expansion of the Americans with Disabilities Act’s (ADA) protected class invites reexamination of the assumption that pregnant workers may not use the ADA to obtain workplace accommodations. The ADA’s scope now includes persons with minor temporary physical limitations comparable to pregnancy’s physical effects. Accordingly, the primary remaining justification for concluding that pregnant workers may not obtain ADA accommodations is that pregnancy is a physically healthy condition rather than a physiological defect. Drawing on the social model of disability, this Article challenges the assumption that medical diagnosis of “defect” must be a prerequisite to disability accommodation eligibility. The social …

Expanding The Federal Common Law?: From Nomos & Physis And Beyond, Sam Kalen Jan 2012

Expanding The Federal Common Law?: From Nomos & Physis And Beyond, Sam Kalen

Marquette Law Review

The Supreme Court’s decision in AEP v. Connecticut, as well as litigation involving the threat posed by Asian Carp, reflect an emerging trend of testing the federal judiciary’s willingness to expand the federal common law to include claims for interstate environmental threats. There is an assumption, including by the Supreme Court, that a federal common law for public nuisance exists, and that the pressing question is whether to expand that common law. This article challenges that assumption. The article illustrates that the widely shared view about the persistence of a federal common law for interstate pollution overlooks the Supreme Court’s …

Mediated Processes In Writing For Publication: Perspectives Of Chinese Science Postdoctoral Researchers In America, Mimi Li Jan 2012

Mediated Processes In Writing For Publication: Perspectives Of Chinese Science Postdoctoral Researchers In America, Mimi Li

English Faculty Research

Sociocultural theory provides an explanatory framework for understanding human activity in the community of practice. This paper aims to address science researchers’ scholarly writing for publication processes from a sociocultural perspective. The author conducts a study via in-depth reflective interviews with three Chinese science postdoctoral researchers in America in an attempt to find their specific mediated actions and dynamic processes in writing for publication. In light of Engeström’s (1987, 1999) activity system, this paper, drawing on the interview data, explores the four mediating factors: objects/goals, artifacts, community, and roles, which afford and constrain the goings-on in the researchers’ writing for …

Interrogating The Spaces Of Personal Photography : Women, Identity, And The Cultural Formation Of Photographic Practice, Christine Garceau Jan 2012

Interrogating The Spaces Of Personal Photography : Women, Identity, And The Cultural Formation Of Photographic Practice, Christine Garceau

Dissertations, Master's Theses and Master's Reports - Open

Personal photographs permeate our lives from the moment we are born as they define who we are within our familial group and local communities. Archived in family albums or framed on living room walls, they continue on after our death as mnemonic artifacts referencing our gendered, raced, and ethnic identities. This dissertation examines salient instances of what women “do” with personal photographs, not only as authors and subjects but also as collectors, archivists, and family and cultural historians. This project seeks to contribute to more productive, complex discourse about how women form relationships and engage with the conventions and practices …

Using Contingent Valuation To Estimate Willingness To Pay For Improved Water Source In Rural Uganda , Steven G. Wright

Dissertations, Master's Theses and Master's Reports - Open

This research was conducted in August of 2011 in the villages of Kigisu and Rubona in rural Uganda while the author was serving as a community health volunteer with the U.S. Peace Corps. The study used the contingent valuation method (CVM) to estimate the populations’ willingness to pay (WTP) for the operation and maintenance of an improved water source. The survey was administered to 122 households out of 400 in the community, gathering demographic information, health and water behaviors, and using an iterative bidding process to estimate WTP. Households indicated a mean WTP of 286 Ugandan Shillings (UGX) per 20 …

Outings In The Queer South: Representations Of Male Homosexuality In The Short Fiction Of Eudora Welty, Ramona Wanlass Jan 2012

Outings In The Queer South: Representations Of Male Homosexuality In The Short Fiction Of Eudora Welty, Ramona Wanlass

Electronic Theses and Dissertations

This thesis investigates Welty's four short story collections and treats the stories as separate entities that are intimately connected to each other by a theme that evolves over and yet transcends the forty odd years that seem to separate them--namely Welty's theme of male homosexual desire. I will examine Welty's story collections using a theoretical framework that incorporates a history of homosexuality in the South and investigates such themes as travel, identity, reactions to heterosexual coupling, and traces Welty's own experiences through the experiences of her fictional male characters. Welty's work spans several decades but in a discussion of her …

Hope In Environmental Philosophy, Lisa Kretz Jan 2012

Hope In Environmental Philosophy, Lisa Kretz

Open Access Publishing Support Funded Articles

Ecological philosophy requires a significant orientation to the role of hope in both theory and practice. I trace the limited presence of hope in ecological philosophy, and outline reasons why environmental hopelessness is a threat. I articulate and problematize recent environmental publications on the topic of hope, the most important worry being that current literature fails to provide the necessary psychological grounding for hopeful action. I turn to the psychology of hope to provide direction for conceptualizing hope and actualizing hoped for states of affairs. If positive moral action is the goal, hope is a vital concept for underwriting ecological …

The Massachusetts Elder Economic Security Index (2011), Gerontology Institute, University Of Massachusetts Boston Jan 2012

The Massachusetts Elder Economic Security Index (2011), Gerontology Institute, University Of Massachusetts Boston

Gerontology Institute Publications

The Elder Economic Security StandardTM Index measures the income that Massachusetts’ seniors need to maintain independence and meet their basic living expenses in the community. The Elder Index uses an income measure that reflects the actual expenses for basic needs of older adults, and includes cost estimates for housing, food, medical care, transportation, and household essentials. Elder Index values are calculated for each state, on a county-by-county basis, providing policy makers and individuals a benchmark for determining what income or governmental supports are needed in their communities.

The Schools Ain’T What They Used To Be And Never Was – 21st Century Schools, Learners, And Teachers, Colleen Kawalilak, Jim Paul

Northwest Journal of Teacher Education

This writing presents our views, as university teacher educators and scholars, concerning some issues pertaining to the readiness of contemporary Canadian education to move forward, well, with confidence and competence, into the mid-21st Century. We posit that all which is possible, educationally, lives in the give and take between Canadian education‘s geo-political, economic and linguistic past, the current functioning of contemporary schools as contested learning and teaching sites, and the increasing impacts of globalisation. We draw from guiding adult education principles in support of an enriched and expanded commitment to teacher professional development as a pathway to sustainable education reform.

“Community Building Makes It Nice For Everybody”?: Elementary Teachers’Understandings And Practices Of Classroom Management, Hillary Merk Jan 2012

“Community Building Makes It Nice For Everybody”?: Elementary Teachers’Understandings And Practices Of Classroom Management, Hillary Merk

Northwest Journal of Teacher Education

This qualitative research study explored elementary teachers’ understandings and practices of classroom management, particularly in regard to their own and students’ power, race, gender, and social class. In the first theme, the community building framework “makes it nice for everybody”, I work to understand how these white, middleclass teachers embrace this approach due to their race, gender, and class, which engender their desire for pleasantry. The second theme, “hard kids are hard kids”: a common sense ideology of difference, emerged from these teachers’ understandings of how race, gender, social class, and power influence student behavior and their classroom management practices.

She Wears The Masks: Bluefacing In Nilaja Sun's Black And Blue And La Nubia Latina, Patricia Herrera

Theatre and Dance Faculty Publications

This article examines how Nilaja Sun explicitly employs the minstrelsy traditions of blackface to push the conceptual limits of racial identity, and expand the nodes of intersection within diasporic identities. The act of bluing up, as opposed to blacking up, is Sun's way of provoking her audience to think more expansively about the performance of racialized identity outside of black and Latino paradigms, and toward a more complicated and not-clearly discernible Afro-Latino hybrid subjectivity. Sun uses what I call bluefacing, a performance tactic that magnifies the constrictive and monolithic perceptions of blackness and Latinidad as a means of generating …

The 2011 Libyan Revolution And Gene Sharp's Strategy Of Nonviolent Action : What Factors Precluded Nonviolent Action In The 2011 Libyan Uprising, And How Do These Reflect On Gene Sharp's Theory?, Siobhan Lynch Jan 2012

The 2011 Libyan Revolution And Gene Sharp's Strategy Of Nonviolent Action : What Factors Precluded Nonviolent Action In The 2011 Libyan Uprising, And How Do These Reflect On Gene Sharp's Theory?, Siobhan Lynch

Theses : Honours

This thesis explores impediments to regime change using the strategy of nonviolent action, through an integrated examination of consensual power theory as articulated by Gene Sharp and Antonio Gramsci, and by incorporating James Scott’s theory that observable consent in the public discourse can belie a private realm of resistance to a system of domination. Using the context of the 2011 Libyan uprising, this thesis analyses the reality of consensual power in Libya to explain what factors precluded nonviolent action succeeding in the 2011 revolution.

Critically evaluating the theories, this study examines a wide range of information about the historical, political, …

Russian Spirituality And The Theology Of Negation, Mikhail Epstein Jan 2012

Russian Spirituality And The Theology Of Negation, Mikhail Epstein

Russian Culture

Toward the end of the twentieth century Russian culture found itself at a crossroads which cannot be ascribed to any political election but which rather presupposed a radical change in its religious and social orientation. Two somewhat opposing theses will be developed in this article. First I will discuss the processes of secularization in Russian culture and the necessity of a third, neutral zone between the "sacred" and the "profane." Next, the dangers of social neutralization in culture and the necessity of retaining elements of the dual model along with the introduction of intermediate elements will be presented. We will …

An American Mess: How Colorblind Racism Prevents An Enlightened Conversation On Race In Television Media, Nathaniel Phillipps

McNair Poster Presentations

This project aims to demonstrate how the current racial ideology in America is portrayed through television media. It is primarily guided by the work of Eduardo Bonita-Silva and his masterful examination of post-civil rights racism in the United States in his book Racism Without Racists. From a firm understanding of the ideology of this new racism -- its frames, styles, and storylines -- the content of two televisions shows are analyzed to identify the racial ideology and the representations of people of color within.

Scandal (ABC) is progressive in the sense that it has a Black female lead, and two …
