"Deference" Is Too Confusing – Let's Call Them "Chevron Space" And "Skidmore Weight", Peter L. Strauss
Faculty Scholarship
This Essay suggests an underappreciated, appropriate, and conceptually coherent structure to the Chevron relationship of courts to agencies, grounded in the concept of "allocation." Because the term "deference" muddles rather than clarifies the structure's operation, this Essay avoids speaking of "Chevron deference" and "Skidmore deference." Rather, it argues, one could more profitably think in terms of "Chevron space" and "Skidmore weight." "Chevron space" denotes the area within which an administrative agency has been statutorily empowered to act in a manner that creates legal obligations or constraints – that is, its allocated authority. "Skidmore weight" …
Federalism As A Safeguard Of The Separation Of Powers, Jessica Bulman-Pozen
Federalism As A Safeguard Of The Separation Of Powers, Jessica Bulman-Pozen
Faculty Scholarship
States frequently administer federal law, yet scholars have largely overlooked how the practice of cooperative federalism affects the balance of power across the branches of the federal government. This Article explains how states check the federal executive in an era of expansive executive power and how they do so as champions of Congress, both relying on congressionally conferred authority and casting themselves as Congress's faithful agents. By inviting the states to carry out federal law, Congress, whether purposefully or incidentally, counteracts the tendency of statutory ambiguity and broad delegations of authority to enhance federal executive power. When states disagree with …
Dynamic Simulation Of Opioid Misuse Outcomes, Alexandra E. Nielsen, Wayne Wakeland
Dynamic Simulation Of Opioid Misuse Outcomes, Alexandra E. Nielsen, Wayne Wakeland
Complex Systems Faculty Publications and Presentations
The objective of the study was to develop a system dynamics model of the medical use of pharmaceutical opioids, and the associated diversion and nonmedical use of these drugs. The model was used to test the impact of simulated interventions in this complex system. The study relied on secondary data obtained from the literature and from other public sources for the period 1995 to 2008. In addition, an expert panel provided recommendations regarding model parameters and model structure. The behaviour of the resulting systems-level model compared favourably with reference behaviour data (R2=.95). After the base model was tested, logic to …

A Two-Stage Technology Foresight Model With System Dynamics Simulation And Its Application In The Chinese Ict Industry, Hongyi Chen, Wayne Wakeland, Jiang Yu
Complex Systems Faculty Publications and Presentations
Technology foresight is a process that identifies the critical technologies a country or industry needs to develop in order to shape a desired future. In this paper, a two-stage technology foresight approach is proposed. During the first stage, critical technologies are identified and evaluated by nationwide experts through Delphi surveys. In the second stage, a system dynamics simulation model is used to estimate how critical parameter values are likely to impact the attainment of foresight goals. A detailed illustration of this two-stage process is provided by a technology foresight case study in the Chinese information and communication technologies (ICT) industry. …
Spina Bifida Subtypes And Sub-Phenotypes By Maternal Race/Ethnicity In The National Birth Defects Prevention Study, Tunu Ramadhani, Cynthia A Moore
Spina Bifida Subtypes And Sub-Phenotypes By Maternal Race/Ethnicity In The National Birth Defects Prevention Study, Tunu Ramadhani, Cynthia A Moore
Faculty, Staff and Student Publications
Spina bifida refers to a collection of neural tube defects, including myelomeningocele, meningocele, and myelocele (SB(M) ), as well as lipomyelomeningocele and lipomeningocele (SB(L) ). Maternal race/ethnicity has been associated with an increased risk for spina bifida among offspring. to better understand this relationship, we evaluated different spina bifida subtypes (SB(M) vs. SB(L) ) and sub-phenotypes (anatomic level or presence of additional malformations) by maternal race/ethnicity using data from the National Birth Defects Prevention Study. This study is a large, multisite, population-based study of nonsyndromic birth defects. Prevalence estimates were obtained using data from spina bifida cases (live births, fetal …
The Prison Fix: Race, Work, And Economic Development In Elmira, New York, Andrea R. Morrell
The Prison Fix: Race, Work, And Economic Development In Elmira, New York, Andrea R. Morrell
Dissertations, Theses, and Capstone Projects
Based on more than a year of ethnographic and archival research in Elmira, New York and, to a lesser extent, New York City, this dissertation analyzes the social, economic, and political processes through which Elmira, New York was transformed by the construction of the Southport Correctional Facility in 1988 as a project of economic development during a period of massive expansion of the New York State prison system. It focuses on the unfolding of the project of mass incarceration and its impact on the lives of Elmira's citizens and workers, as well as the men incarcerated in Elmira's prisons and …
The Metaphysics Of Improvisation, Tobyn C. Demarco
The Metaphysics Of Improvisation, Tobyn C. Demarco
Dissertations, Theses, and Capstone Projects
In "The Metaphysics of Improvisation," I criticize wrongheaded metaphysical views of, and theories about, improvisation, and put forward a cogent metaphysical theory of improvisation, which includes action theory, an analysis of the relevant genetic and aesthetic properties, and ontology (work-hood).
The dissertation has two Parts. Part I is a survey of the history of many improvisational practices, and of the concept of improvisation. Here I delineate, sketch, and sort out the often vague boundaries between improvising and non-improvising within many art forms and genres, including music, dance, theatre, motion pictures, painting, and literature. In addition, I discuss the concept of …

An Investigation Of The Relationship Among Social Support, Motivation, Perceived Competence, And Pursuit Of A Baccalaureate Degree Among Associate Degree Nurse Graduates, Margaret Joyce Reilly
Dissertations, Theses, and Capstone Projects
The Institute of Medicine Reports of the last ten years highlight the increased complexity of health care and the need for new ways for health providers to respond. While other professional programs have adapted to the growing complexity of the healthcare system and implemented increased educational requirements for entry to practice, notably pharmacy and physical therapy, nursing has not, and remains the least educated among health professionals The growing trend towards a two year Associate Degree as the initial nursing education degree is increasing at the same time that patient needs are becoming more complicated and health care is becoming …

(Re)Forming Italians: Children's Literature In Italy, 1929-1939, Marisa Giorgi
Dissertations, Theses, and Capstone Projects
My dissertation argues for the centrality of children's literature under Fascism as a tool to bring about the ultimate goal of forming the "new" Italian. This project examines the relationship between children's literature, the creation of culture and the transmission of ideology in Fascist Italy. I chose the period 1929-1939 because this decade encompasses the years the regime actively sought consolidation of power and consensus, as well as the years of the fascistization of Italian schools. These novels are conduits of fascist ideology veiled as adventure stories, historical novels, bildungsroman or romantic fiction for children and young adults and deserve …

Global Wreckage And Consumer Illusions: Responses To The Human Effects Of Economic Globalization In Sub-Saharan African Francophone Novels And Films, 1973-2006, Sara C. Hanaburgh
Dissertations, Theses, and Capstone Projects
My study examines a group of nine novels and films set in Ivory Coast, Mali, Senegal, Cameroon and Gabon written and produced between 1973 and 2006 in which "the West" and its international finance network are depicted as the fundamental contemporary world power that wields a destructive dominance over African countries. These forms of control are in many ways similar, yet distinct, from the projects of European imperialism. I analyze consumerism as a major feature of globalization, and discuss the linkage of globalization and the consumer society by looking at various theoretical models, in particular that which Jean Baudrillard conceptualized …
Effects Of Video-Based Peer Modeling On The Question Asking, Reading Motivation And Text Comprehension Of Struggling Adolescent Readers, Kallen E. Tsikalas
Effects Of Video-Based Peer Modeling On The Question Asking, Reading Motivation And Text Comprehension Of Struggling Adolescent Readers, Kallen E. Tsikalas
Dissertations, Theses, and Capstone Projects
Struggling adolescent readers are distinct from others in two important ways: (1) They are adolescents; and (2) they have a history of struggle with reading.
Good pedagogy prescribes that effective programs "meet students where they are." For middle-school students, this means meeting them in adolescence. Adolescents are more concerned with social norms and more susceptible to peer influence than younger children. Additionally, the fact that these youth are still struggling after years of reading instruction suggests that their motivation to persist at reading is likely to have suffered. To fully support and engage such adolescents, reading programs must leverage social …
Social Disorganization And The Public Level Of Crime Control: A Spatial Analysis Of Ecological Predictors Of Homicide Rates In Bogota, Colombia, Gipsy Escobar
Dissertations, Theses, and Capstone Projects
Research in the social disorganization tradition has found community disadvantage to be one of the strongest and most consistent macro-level predictors of homicides in urban areas in the United States (Pratt & Cullen 2005). This dissertation empirically tests the applicability of ecological theories of crime to the spatial distribution of homicides in Bogota, Colombia, while proposing alternative measures of social disorganization that are analogous to those used in the American literature but that are more reflective of both social realities and data availability in Colombia. The study used data from several sources including official homicide figures from the National Institute …
Essays In Health Economics, Leigh Ann Leung
Essays In Health Economics, Leigh Ann Leung
Dissertations, Theses, and Capstone Projects
Health is defined as an individual's mental or physical condition and being healthy means to be free from illness or injury. Health is relevant to both the supply and demand sides of the national economy. On the demand side, consumers derive satisfaction from being healthy. Consumers purchase goods and services to improve their health but also engage in activities that impair health such as smoking or drinking too much. On the supply side, firms produce health care goods and services to meet the market demand for health care derived from consumers' demand for better health. In addition, health augments labor …

The Creeks, Beaches, And Bay Of The Jamaica Bay Estuary: The Importance Of Place In Cultivating Relationships To Nature, Kristen L. Van Hooreweghe
Dissertations, Theses, and Capstone Projects
It is often assumed that people living in urban areas lack connections to the natural world and are the source of environmental problems. This assumption, however, is an oversimplification of urban life. Employing an eco-ethnography, with participant observations, qualitative interviews, and an environmental history, this study examines New York City's Jamaica Bay estuary and surrounding neighborhoods to understand how residents cultivate their relationships to nature in a dense urban setting. Many residents near Jamaica Bay have developed a strong connection to place that is rooted in their regular, embodied experiences living, working, playing, and praying on the Jamaica Bay estuary. …

The Museum Of Modern Art's "What Is Modern?" Series, 1938-1969, Jennifer Tobias
Dissertations, Theses, and Capstone Projects
Between 1938 and 1969, the Museum of Modern Art (MoMA) poses the question of What Is Modern? (WIM) in a series of books, traveling exhibitions, and a symposium. This dissertation argues for the WIM project as a sustained if minimally effective effort to influence popular American perceptions of modern art, architecture, and design, at the same time embodying tensions inherent to the museum and its notions of that modernism.
MoMA is an unquestionable influence on modern art history. WIM is a significant component of this influence, yet scholarship on the series is minimal. Hiding in plain sight, the series offers …
The Work Of The Urban Commons: Limited-Equity Cooperatives In Washington, D.C., Amanda Huron
The Work Of The Urban Commons: Limited-Equity Cooperatives In Washington, D.C., Amanda Huron
Dissertations, Theses, and Capstone Projects
This research theorizes the work of the urban commons through close examination of a group of ten limited-equity housing cooperatives in Washington, D.C. Limited-equity co-ops, or LECs, are a noncommodified resource that is collectively owned and maintained by their members. I argue that LECs are a manifestation of the commons, and that they represent a specific form of the commons - the urban commons. In this research, I ask: how does the urban commons - as manifested in this case by limited-equity housing cooperatives - function? The commons, as I theorize it, is a space that both provides a basis …

Strategic Citizenship: Dual Marginalization And Organized Transnational Political Mobilization Among Ecuadorian And Dominican Migrants, Howard Caro-Lopez
Strategic Citizenship: Dual Marginalization And Organized Transnational Political Mobilization Among Ecuadorian And Dominican Migrants, Howard Caro-Lopez
Dissertations, Theses, and Capstone Projects
What factors define transnational political participation and citizenship for contemporary migrants? This dissertation focused on how and why migrant activists from Ecuador and the Dominican Republic pursued political engagement, how their home country governments influenced migrants‘ political activities, and how migrant organizations shaped their transnational activities. The study found that transnational political participation among these two populations was driven by a dual marginalization narrative, where migrants draw from their personal experiences to conclude that they are marginalized in both the U.S. and in their countries of origin based on their status as migrants. Ecuadorian and Dominican political organization leaders use …
Unintended Consequences: The Impact Of The Court's Recent Cases On Structural Ineffective Assistance Of Counsel Claims, Lauren Sudeall Lucas
Unintended Consequences: The Impact Of The Court's Recent Cases On Structural Ineffective Assistance Of Counsel Claims, Lauren Sudeall Lucas
Faculty Publications By Year
The Supreme Court’s recent Sixth Amendment cases have garnered much attention for their potential impact on ineffective assistance of counsel claims asserted in the context of a criminal case. This short article explores the unintended consequences of these decisions on structural ineffective assistance of counsel claims made in the civil context alleging that systemic deficiencies are likely to lead to right to counsel violations. The article concludes that the Court’s departure from a trial-centered conception of the right to counsel, its willingness to articulate specific pre-trial duties of counsel and its more pragmatic approach towards enforcing the Sixth Amendment will …

Casinos are powerhouses of information gathering and distribution and use their surveillance activities to police, protect, and profit. The private information does not exist in a vacuum; casinos share it with other casinos and, in some cases, law enforcement. But who protects the consumer in the event that the information is breached or the company is sold or files for bankruptcy? Are there restrictions on the information that casinos may share with law enforcement? This Article argues that the intricate, vast amounts of consumer information compiled through casino structured intelligence ("CSI") require greater protection and oversight in the contexts of …

Empirical Evidence That Formative Assessments Improve Final Exams, Carol Springer Sargent, Andrea A. Curcio
Faculty Publications By Year
Despite the recent widespread call for law professors to incorporate more feedback during the semester, there is a relative dearth of empirical evidence about the impact of practice materials and feedback on law student performance. This study begins to fill that gap. Using five ungraded quizzes, a graded midterm, and reflection exercises, this study shows that feedback improved student performance on a cumulative final exam up to a full letter grade compared to a cohort with only a traditional end-of-semester final exam. The study confirms an earlier study showing that learning gains from formative assessments concentrate among those with stronger …

Drawing on data and anecdotal accounts from a wide variety of sources, this Article investigates the law and economics of peripheral labor, so called because low wage, low skill workers on the periphery are excluded from the promotion ladders, job security, and steadily increasing pay available to supervisory and managerial workers in the core. Using the U.S. poultry industry as a case study, this Article describes the terms and conditions of peripheral poultry work: de-skilled jobs, low wages, lack of job security, and negligible prospects for promotion. Worker bargaining power is also highly constrained, as workers have little ability to …

Numerical Computation Of A Certain Dirichlet Series Attached To Siegel Modular Forms Of Degree Two, Nathan C. Ryan, Nils-Peter Skoruppa, Fredrik Stroemberg
Faculty Journal Articles
The Rankin convolution type Dirichlet series D-F,D-G(s) of Siegel modular forms F and G of degree two, which was introduced by Kohnen and the second author, is computed numerically for various F and G. In particular, we prove that the series D-F,D-G(s), which shares the same functional equation and analytic behavior with the spinor L-functions of eigenforms of the same weight are not linear combinations of those. In order to conduct these experiments a numerical method to compute the Petersson scalar products of Jacobi Forms is developed and discussed in detail.
Los Niños Que Se Quedan Atrás: La Doble Moral Sobre El Bilingüismo De Los Niños De Lengua Minoritaria En Las Escuelas Públicas Estadounidenses = The Children Left Behind: The Double Standard Of Bilingualism For Minority Language Children In American Public Schools, Emily Gazda
Honors Papers

Rq-Tech, A Strategic-Level Approach For Conceptualizing Enterprise Architectures, Christine A. Hoyland
Engineering Management & Systems Engineering Faculty Publications
The purpose of this study is to present a system-theoretic based methodology and corresponding model for Enterprise Architecture development. Enterprise Architecture models can assist managers by illustrating the systemic relationships of their business and the impact their decisions can make. Unfortunately, today's modeling practices are proprietary, time-consuming, and generally ineffective as tools for communicating strategic-level planning across and down all levels of the enterprise. This research explored the most significant factors that must be considered when translating authoritative text and rich pictures of business doctrine into semantic models. An ontology, namely RQ-Tech, was used to parse and tag representative samples …

Much like the Quality Revolution did in the 1980's, corporate sustainability has the potential to drive significant changes in the processes and structure of various organizations in the coming decade. With a rapidly growing global population and an ever increasing global demand for resources (Population-Resource-Center, 2012). Sustainability has emerged as one of the primary challenges that organizations will have to deal with in the 21st century. An increasing realization among business executives that profitability by itself is not enough as a measure of success is also driving the increased adoption of sustainable practices in the corporate world (Lowitt and Grimsley, …

Developing effective protection, mitigation, and recovery measures for critical infrastructure (CI) systems is paramount in the wake of increasing natural and manmade hazards, risks, and threats. Influencing protection, rescue, and recovery measures are interplays (i.e., interdependencies) among infrastructure systems. Understanding interdependencies plays an essential role in minimizing and reducing cascading failures among complex interdependent infrastructure systems. This paper asserts that deployment of protection, mitigation, and recovery solutions can have little effect on infrastructure management if infrastructure operators and policymakers have partial understanding of infrastructure interdependencies. Using narrative research, authors illustrate that effective coordination and response for protection, mitigation, and recovery …
