Mixed Method Collaboration In The Built Environment, Dermot Kehily Nov 2012

Mixed Method Collaboration In The Built Environment, Dermot Kehily

Conference papers

The built environment discipline or inter-discipline is a relatively new field in academic research. Its subject matter however is based on the traditional disciplines of the construction and property industries. Determining your ontological position and epistemological approach based on the researchparadigm of one of these fields’ may not provide an adequate solution to your research objectives. This paper outlines that framing your research within the broader confines of the built environment; drawing from related fields in an integrated manner may provide a more successful outcome.Arguments whether the built environment is an academic discipline or even the range of subjects thatmake up …

Stock Market Efficiency In The S&P 500 With Respect To Day Of The Week, Zachary James Rodenbarger Nov 2012

Stock Market Efficiency In The S&P 500 With Respect To Day Of The Week, Zachary James Rodenbarger

Lingnan Journal of Banking, Finance and Economics

Theoretically speaking, we assume that markets are efficient and that investors should not be able to earn abnormal returns without privately held information. The fact that fund managers beat the market can simply be explained as luck. However, realistically speaking, the markets involve humans that do not always make rational decisions, which can lead to market inefficiencies. This paper looks into one such inefficiency which regards trading day of the week in the S&P 500 through three different forecasting periods coming before, during, and after the financial crisis of 2008. Theoretically we would expect to find no pattern or correlation …

The Global Financial Tsunami : 2008, Juan Manuel Chaves Echeverri Nov 2012

The Global Financial Tsunami : 2008, Juan Manuel Chaves Echeverri

Lingnan Journal of Banking, Finance and Economics

In 2008 a series of bankruptcies of financial institutions led the United States and the principal economies of the world into a recession of great magnitude that required exceptional government intervention.

It started on September 14th when Lehman Brothers announced that it was entering into chapter 11 bankruptcy. After this, there was intervention in recognized multinational corporations like Fannie Mae, Freddie Mac, and American International Group. There were also the bank failures of Washington Mutual and Citigroup.

The main cause of this crisis was the excessive level of leverage of the financial industry, which had its roots in the real …

Student Speech Rights In The Digital Age, Mary-Rose Papandrea Nov 2012

Student Speech Rights In The Digital Age, Mary-Rose Papandrea

Florida Law Review

For several decades courts have struggled to determine when, if ever, public schools should have the power to restrict student expression that does not occur on school grounds during school hours. In the last several years, courts have struggled with this same question in a new context—the digital media. The dramatic increase in the number of student speech cases involving the Internet, mobile phones, and video cameras begs for a closer examination of the scope of school officials’ authority to censor the expression of minors as well as the scope of juvenile speech rights generally. This Article takes a close …

The Gunslinger To The Ivory Tower Came: Should Universities Have A Duty To Prevent Rampage Killings?, Ben "Ziggy" Williamson Nov 2012

The Gunslinger To The Ivory Tower Came: Should Universities Have A Duty To Prevent Rampage Killings?, Ben "Ziggy" Williamson

Florida Law Review

Virginia Tech was not the first university rampage killing for which victims or their families sought compensation, nor is it likely to be the last. Because the current state of the law is unclear, this Note explores whether universities should have a duty to identify and thwart students that pose a threat to the lives of other students. Part II traces the history of university rampage killings and the sparse legal history surrounding them. In light of that sparse legal history, Part III considers the Tarasoff case and its progeny, which impose upon some professionals a duty to protect third …

The Case For Overturning Williams V. Florida And The Six-Person Jury: History, Law, And Empirical Evidence, Alisa Smith, Michael J. Saks Nov 2012

The Case For Overturning Williams V. Florida And The Six-Person Jury: History, Law, And Empirical Evidence, Alisa Smith, Michael J. Saks

Florida Law Review

After 700 years of common-law history and nearly 200 years of constitutional history, the Supreme Court concluded that the constitutionally permissible minimum jury size could not be inferred from the language or the history of the Constitution. The answer, said the Court in Williams v. Florida, could be found only through a “functional analysis” of the performance of smaller juries (that is, empirical examination of the behavior of different-sized juries). The Court implicitly abandoned that analysis in Ballew v. Georgia, when it held that juries with fewer than six members were unconstitutional—a decision based on nothing more than …

The Ubiquity Of Greed: A Contextual Model For Analysis Of Scienter, Ann Morales Olazábal, Patricia Sanchez Abril Nov 2012

The Ubiquity Of Greed: A Contextual Model For Analysis Of Scienter, Ann Morales Olazábal, Patricia Sanchez Abril

Florida Law Review

Some securities fraud plaintiffs contend that greed—in the form of perpetuating a prestigious executive position, ensuring a gainful bonus, or maintaining the appearance of corporate profitability—is a bona fide motive evidencing scienter. But currently, no single judicial standard or analytical rubric guides the analysis of whether allegations of greed indicate scienter in these cases. The Private Securities Litigation Reform Act of 1995 (PSLRA) requires that the complaint state “with particularity” facts giving rise to a “strong inference” that the defendant acted with the scienter required for the cause of action. Plaintiffs have long established scienter through “motive and opportunity” pleading: …

Tort Arbitrage, Robert J. Rhee Nov 2012

Tort Arbitrage, Robert J. Rhee

Florida Law Review

The economic models of bargaining and tort law have not been integrated into a coherent theory that reflects the empirical world. This Article models the interaction of settlement dynamics and the economic theory of negligence. It shows that tort claims are systematically devalued during settlement relative to the legal standard. Central to this thesis is a proper conception and accounting of cost. Cost is typically viewed as the transaction cost of litigation processing. Cost, however, encompasses more than this. Each dispute has a cost of resolution, defined as the discounting effect of risk on legal valuation. A spread between the …

Prevalence And Correlates Of Receiving Cigarettes As Gifts And Selecting Preferred Brand Because It Was Gifted: Findings From The Itc China Survey, Li-Ling Huang, Jim Thrasher, Yuan Jiang, Qiang Li, Geoffrey T. Fong, Anne Ck Quah

Faculty Publications

Background: Giving cigarettes as gifts is a common practice in China, but there have been few systematic studies of this practice. The present study was designed to estimate the incidence of receiving cigarettes as gifts, correlates of this practice, and its impact on brand selection in a representative sample of urban adult smokers in China.

Methods: Data were analyzed from Wave 2 of the International Tobacco Control (ITC) China Survey, where 4843 adult urban smokers were interviewed in six major Chinese cities between October 2007 and January 2008. The incidence of most recent cigarette acquisition due to gifting and the …

Lessons Learned From The Virginia Tech Tragedy, Marcus L. Martin Nov 2012

Lessons Learned From The Virginia Tech Tragedy, Marcus L. Martin

Journal of Collective Bargaining in the Academy

On April 16, 2007, Seung Hui Cho, a psychologically disturbed student at Virginia Tech, shot to death 32 students and faculty, wounded 17 more, and then killed himself. Three days later, Virginia Governor Tim Kaine appointed a panel to review the events leading up to this tragedy; the handling of the incident by public safety officials, emergency services providers, and the University; and the services subsequently provided to families, survivors, caregivers and the community.

Four Trends That Affect Public Higher Education, Matthew Goldstein Nov 2012

Four Trends That Affect Public Higher Education, Matthew Goldstein

Journal of Collective Bargaining in the Academy

In 2008, public universities, entrusted with the same important public mission that they have always had, are challenged to meet that mission in a very different marketplace. I refer not simply to what is happening in Albany, for those of us here in New York, but to what is happening nationally and globally. This year’s conference theme is “New Models,” and in that spirit, I’d like to offer four trends that push us to rethink established models of public higher education, and discuss how those trends will affect our futures and our collective bargaining.

Developing Business Acumen In Chinese Business School Graduates, Rajaram Veliyath, Bonnie Stivers, Joe Hair, Teresa Joyce, Marko Sarstedt

Journal of Emerging Knowledge on Emerging Markets

This study assessed the importance of knowledge, skills, abilities (i.e., KSAs) and competencies for managerial success in China’s market economy. Business students at a major Chinese university were surveyed over a five year period, initially in 2001 and later in 2006, five years after China’s entry into the World Trade Organization (WTO). Using Partial Least Squares (PLS), the explained variances in business acumen and social motivation skills were higher after China’s WTO entry. The results were reversed for communication skills. The results confirmed the predictive relevance of entrepreneurial behavior and adaptability in the model. Overall, the results suggest an enhanced …

Stigma And Barriers To Accessing Mental Health Services Perceived By Air Force Nursing Personnel, Stephen Hernandez

Nursing ETDs

This descriptive study assessed stigma and barriers to accessing mental health services in a convenience sample (N = 211) of Air Force nursing personnel, including 111 officers, 98 enlisted, and 2 of unknown grade, to answer the following research questions: (1) What are the perceived levels of stigma and barriers to accessing mental health services for Air Force nursing personnel? and (2) Does military grade affect perceived levels of stigma and barriers to accessing mental health services for officer and enlisted Air Force nursing personnel? The hypotheses were that there would be no difference between officer and enlisted Air Force …

Research Brief: "Risk And Resilience In Military Families Experiencing Deployment: The Role Of The Family Attachment Network", Institute For Veterans And Military Families At Syracuse University

Institute for Veterans and Military Families

This brief details the military families attachment network model to demonstrate how family relationships are impacted during deployment and reintegration. The model shows that returning veterans face concerns with intimate relationships, which often result in poor communication, intimacy problems, domestic violence and other issues. The authors of this article address specific needs within attachment relationships among military families. These families would benefit from increased federal funding for research that examines adult attachment styles and parent-child attachment relationships in military families. Further research should also include the experiences of single parents who are deployed.
