Release As Remedy For Excessive Punishment, Alexander A. Reinert Apr 2012

Release As Remedy For Excessive Punishment, Alexander A. Reinert

William & Mary Law Review

Although the Eighth Amendment’s prohibition on “cruel and unusual” punishment means different things in different contexts, it plainly forecloses state and federal actors from choosing ex ante to impose a punishment that is either disproportionate or inconsistent with minimum standards of decency. In other words, the Eighth Amendment mandates that no punishment be imposed if the only other choice on the table is an unconstitutional punishment. Although this principle can be gleaned from the disparate strands of Eighth Amendment jurisprudence, its remedial consequence has not been fully implemented. In this Article, I propose that providing a remedy of release from …

Evidence-Based Practice For The Athletic Training Profession, Cailee Elizabeth Welch Apr 2012

Evidence-Based Practice For The Athletic Training Profession, Cailee Elizabeth Welch

Human Movement Studies & Special Education Theses & Dissertations

As evidence-based practice (EBP) becomes a necessity in athletic training, it is essential to recognize current barriers and modes of accessibility to information for enhancement of clinical decision-making. Furthermore, the effectiveness of educational interventions (EI) to enhance knowledge of EBP concepts must be investigated. The aim of Project I was to assess attitudes and beliefs, perceived barriers, and accessibility to resources of EBP among athletic trainers (AT). Project II was designed to investigate the effect of an EI on enhancing AT's knowledge of EBP concepts. Project III explored ATs' experiences of the EI and whether it elicited changes within their …

The Effects Of Personalized Boosters For A Computerized Intervention Targeting College Student Drinking, Abby L. Braitman Apr 2012

The Effects Of Personalized Boosters For A Computerized Intervention Targeting College Student Drinking, Abby L. Braitman

Psychology Theses & Dissertations

Heavy episodic alcohol use within the college student population is both widespread and problematic (Benton et al., 2004; Core Institute, 2006; Hingson, Zha, & Weitzman, 2009; O'Malley & Johnston, 2002; Perkins, 2002; Singleton, 2007). More than 40% of college students report at least one symptom of alcohol abuse or dependence (Knight et al., 2002). Computerized interventions are widely used because of their advantages over in-person interventions. They are more cost-effective and can quickly deliver tailored individual feedback to more students. Computerized interventions can be administered to large groups of students (e.g., incoming students, athletes, fraternities/sororities). However, a (2007) meta-analysis by …

The Dietary Isoprenoid Perillyl Alcohol Inhibits Telomerase Activity In Prostate Cancer Cells, Tabetha Sundin Apr 2012

The Dietary Isoprenoid Perillyl Alcohol Inhibits Telomerase Activity In Prostate Cancer Cells, Tabetha Sundin

Theses and Dissertations in Biomedical Sciences

This is the first evidence that a plant-derived compound–perillyl alcohol regulates telomerase activity via the mammalian target of rapamycin (mTOR) pathway in prostate cancer cells. Telomerase–the enzyme responsible for immortalizing cells through telomeric repeats addition–is de-repressed early in an aspiring cancer cell. We hypothesized that perillyl alcohol regulates hTERT (human telomerase reverse transcriptase) at the translational and post-translational levels via its effects on the mTOR pathway. A rapid suppression of telomerase activity was detected in prostate cancer cell lines (PC-3 and DU145) in response to biologically-relevant concentrations and short incubations of perillyl alcohol or the mTOR inhibitor—rapamycin.

Childhood Obesity: Balancing The Nation's Interest With A Parent's Constitutional Right To Privacy, Denise Cohen Apr 2012

Childhood Obesity: Balancing The Nation's Interest With A Parent's Constitutional Right To Privacy, Denise Cohen

Cardozo Public Law, Policy & Ethics Journal

The note argues that governmental intervention into parental rights regarding childhood obesity is constitutionally justifiable under strict scrutiny, as it serves the compelling interests of both the child's well-being and societal welfare. While the constitutional right to privacy in parenting is fundamental, it is not absolute, and the growing public health crisis of childhood obesity necessitates narrowly tailored measures to hold parents accountable. The analysis proposes that existing legal frameworks, such as neglect statutes, can be effectively applied to address severe cases of childhood obesity, balancing individual rights with public health needs.

S-Comm: Shattering Communities, Hannah Weinstein Apr 2012

S-Comm: Shattering Communities, Hannah Weinstein

Cardozo Public Law, Policy & Ethics Journal

The note argues that the Secure Communities program, initiated by the Department of Homeland Security (DHS) in 2008, operates unlawfully under the Administrative Procedure Act (APA) and raises significant constitutional concerns. By bypassing notice-and-comment requirements and failing to address public concerns, the program has led to racial profiling, pretextual arrests, and widespread detention of noncriminal individuals, undermining its stated goals and eroding community trust in law enforcement. The analysis calls for immediate cessation of the program and congressional funding due to its legal violations and harmful consequences.

Empowered Minds And Sterilized Bodies: The Decisions And Lived Experiences Of Surgically Sterilized Women In Santo Antonio De Jesus, Leah Smith

Independent Study Project (ISP) Collection

During the last several decades, Brazil has experienced a rapid fertility decline from 6 births per woman in 1965 to 1.8 births per woman in 2006. Though Brazil lacks a significant and organized family planning program, this fertility decline has been caused in large part by an extremely high rate of female sterilization. Of the 81 percent of women living in union who use birth control, 29 percent are surgically sterilized, placing Brazil at the third highest rate of female sterilization in the world. This research analyzes the sterilization narratives of 10 women from the city of Santo Antonio de …

Quality And Quantity Of Sleep Study And Its Relationship To The Performance Of Lpga Tour Players, Maria Elena Lopez

Doctoral Dissertations and Master's Theses

The relationship between sleep efficiency and elite level athletic performance that has a definitive and individual measure of performance (like golf, track, & swimming) has never been systematically studied. The extreme and rigorous travel schedules of professional golfers prevent consistent and necessary sleep schedules. The Ladies Professional Golf Association (LPGA) permitted Embry-Riddle Aeronautical University (ERAU) to ask for volunteers at two tournaments during October of 2010 to complete subjective sleep fatigue logs. Analysis of the sleep fatigue logs revealed a relationship between sleep quality and performance (golf score). Subsequent relationships were also found between subjective fatigue and sleep quality, and …

Strawberry Growth, Yield, Fruit Nutrition, And Control Of Verticillium Wilt With Pre-Plant Soil Fumigants, Ozone, And Biological Control, Justin J. Scurich

Master's Theses

Verticillium wilt is a widespread soilborne disease of strawberry historically controlled by soil fumigation with methyl bromide (MB). MB was banned by the United Nations in 1995 and will be completely phased out by 2015. Research has concentrated on alternative methods of disease control without finding a single alternative able to replace MB in widespread disease control and yield increase. For the current study, strawberries were greenhouse grown in container pots filled with soil from both infested and non-infested areas of a commercial strawberry field in Watsonville, CA. Treatments included pre-plant soil fumigation with commercially available formulations of methyl bromide, …

Error Reduction And Effect Of Step Size In Adjustment Calculus For Cam Applications, Sai Siddhartha Nudurupati Apr 2012

Error Reduction And Effect Of Step Size In Adjustment Calculus For Cam Applications, Sai Siddhartha Nudurupati

Department of Mechanical and Materials Engineering: Dissertations, Theses, and Student Research

Any measurement, however carefully done, will never be free from errors. Similarly, machining of cams for automobiles is prone to contain errors. These errors are naturally a part and parcel of cam manufacturing. The nature of deviations of the manufactured cam profile from the theoretical cam determines its usability. Sometimes, allowable deviations in high speed cams may be in the order of 2540 µm. Larger deviations will disqualify the cams for applications.

Velocity and acceleration of the cam are estimated from the measured displacement of the cam follower during quality control implementation. This data helps in eliminating the unfit cams. …
