Framing Terrorism: How The Tampa Tribune And Tampa Bay Times Portrayed Sami Al‐Arian In 2001, Wendy Biddlecombe
Framing Terrorism: How The Tampa Tribune And Tampa Bay Times Portrayed Sami Al‐Arian In 2001, Wendy Biddlecombe
USF St. Petersburg campus Master's Theses (Graduate)
This study examines the framing of Sami Al‐Arian in 2001 by the local, mainstream Tampa Bay press, and compares this portrayal to the outcome of Al‐ Arian’s 2005 trial. In the weeks after the 9/11 attacks, both the Tampa Tribune and Tampa Bay Times covered Al‐Arian in a negative and stereotypical manner, in sharp contrast with the outcome of a 2005 trial that acquitted Al‐Arian of the most serious charges of aiding known terrorists. The theoretical base of this paper is framing, stereotype, and the social construction of reality, and finds the way the press portrayed Al‐Arian had a direct …

Copyright’S Merger Doctrine As A Solution To Conflicts Between Copyright Law And Freedom Of Speech, Russell Hasan
Copyright’S Merger Doctrine As A Solution To Conflicts Between Copyright Law And Freedom Of Speech, Russell Hasan
Cardozo Arts & Entertainment Law Journal (AELJ) Blog
Some academics have raised concerns that copyright law might be in conflict with First Amendment free speech law. Some scholars fear that copyright law might restrict the free flow of information in the marketplace of ideas. The typical answer to such concerns, embodied in the Supreme Court cases Harper & Row Publishers Inc. v. Nation Enterprises and Eldred v. Ashcroft, is that copyright law contains internal doctrinal mechanisms, namely the idea-expression dichotomy and fair use, which alleviate free speech concerns. Copyright law protects only expressions, not ideas or facts; so where free speech might encourage an idea or fact to …

A Minimal Participatory Condition On Democratic Right, Jeremy Bendik-Keymer
A Minimal Participatory Condition On Democratic Right, Jeremy Bendik-Keymer
Faculty Scholarship
There are two problems that plagued the construction of representation in the U.S. constitution leading up to its ratification, and these two problems could conceivably be addressed through a single, practical condition on democratic participation. The first problem is the problem of poor judgment. The second problem is the problem of remote representation. In this essay, I will propose that both problems be partially but substantially addressed through a minimum participatory condition on democratic right. Let me first set up each problem textually.
