Technical Standards For Admission To Medical Schools: Deaf Candidates Don't Get No Respect, Michael A. Schwartz Jul 2012

Technical Standards For Admission To Medical Schools: Deaf Candidates Don't Get No Respect, Michael A. Schwartz

College of Law - Faculty Scholarship

Medical schools utilize a set of technical standards used to screen applicants with disabilities, and one of the standards, which deals with communication, requires the applicant to be capable of speech and hearing. To the extent that medical schools exclude an applicant with a hearing impairment on the ground that the applicant cannot hear and speak, such exclusion would be (and should be) a violation of federal law. Schools must engage in an individualized assessment of how a Deaf medical candidate would satisfy the communication standard. The notion of an “undifferentiated graduate,” where all graduates qualify for practice in any …

“School Sponsorship” And Hazelwood’S Protection Of Student Speech: Appropriate For All Curriculum Contexts? (White Paper), Adam Hoesing Jul 2012

“School Sponsorship” And Hazelwood’S Protection Of Student Speech: Appropriate For All Curriculum Contexts? (White Paper), Adam Hoesing

Nebraska Law Bulletin (Selected Issues)

This article addresses whether and to what extent the First Amendment protects student speech when students select or discuss a particular topic as part of curriculum that allows students to freely and sovereignly choose their desired substantive topic. Specifically, this article addresses the applicability of the First Amendment protection provided by Hazelwood School District v. Kuhlmeier, protection that allows a school to censor speech “in school-sponsored activities so long as [the school’s] actions are reasonably related to legitimate pedagogical concerns.” Part II provides and explains the pertinent federal jurisprudence, obligatorily starting with Tinker v. Des Moines Independent Community School District, …

'How's My Doctoring?' Patient Feedback's Role In Assessing Physician Quality, Ann Marie Marciarille Jul 2012

'How's My Doctoring?' Patient Feedback's Role In Assessing Physician Quality, Ann Marie Marciarille

Faculty Works

A society-wide consumer revolution is underway with the rise of online user-generated review websites such as Yelp, Angie’s List, and Zagat. Service provider reviews are now available with an intensity and scope that attracts increasing numbers of reviewers and readers. Health care providers are not exempt from this new consumer generated scrutiny though they have arrived relatively late to the party and as somewhat unwilling guests.

The thesis of this article is that online patient feedback on physicians is relevant and valuable even though it is also uncomfortable for health care providers. This is because the modern physician-patient relationship is …

Early Human Vocalization Development: A Collection Of Studies Utilizing Automated Analysis Of Naturalistic Recordings And Neural Network Modeling, Anne Sanda Warlaumont Jul 2012

Early Human Vocalization Development: A Collection Of Studies Utilizing Automated Analysis Of Naturalistic Recordings And Neural Network Modeling, Anne Sanda Warlaumont

Electronic Theses and Dissertations Archive

Understanding early human vocalization development is a key part of understanding the origins of human communication. What are the characteristics of early human vocalizations and how do they change over time? What mechanisms underlie these changes? This dissertation is a collection of three papers that take a computational approach to addressing these questions, using neural network simulation and automated analysis of naturalistic data. The first paper uses a self-organizing neural network to automatically derive holistic acoustic features characteristic of prelinguistic vocalizations. A supervised neural network is used to classify vocalizations into human-judged categories and to predict the age of the child …

Becoming Isis: Myth, Magic, Medicine, And Reproduction In Ancient Egypt, Chrystal Elaine Goudsouzian Jul 2012

Becoming Isis: Myth, Magic, Medicine, And Reproduction In Ancient Egypt, Chrystal Elaine Goudsouzian

Electronic Theses and Dissertations Archive

In ancient Egypt, sexuality, fertility, and the conception of children was of central importance not just to personal identity, but also to family and social structure. Because of the significance of birth in both the physical world and in the spiritual realm, references to reproduction, including fertility, conception, pregnancy, and childbirth, can be found in a wide variety of textual sources. Specifically, mythic events and scenarios, including those in magical spells, medico-magical spells, and funerary texts, reflected Egyptian reproductive conceptions and practices. Further, the Egyptians employed and called on these mythic episodes and archetypes to create divinely charged myth-mirroring space, …

The Rhetorical Situation Of Facebook, Justin L. Suiter Jul 2012

The Rhetorical Situation Of Facebook, Justin L. Suiter

Electronic Theses and Dissertations Archive

The online social network Facebook is a site of ocnsiderable rhetorical activity. Because it exists at the frontier of Web 2.0 or "new media" technology, this rhetorical activity has certain novel features that require an expansion of the concept of rhetorical situation. I apply Lloyd Bitzer's original theory of rhetorical situation to the context of Facebook in order to highlight the ways in which technological advances and shifts in theory necessitate a broader understanding of rhetorical situations. I argue that two of Bitzer's three essential elements, constraints and audience, are applicable to Facebook but must be adapted to suit its …

The Freedom Faith Speeches Of Prathia L. Hall: Uncovering A Hybrid Rhetoric Of Protest, Mittie K. Carey Jul 2012

The Freedom Faith Speeches Of Prathia L. Hall: Uncovering A Hybrid Rhetoric Of Protest, Mittie K. Carey

Electronic Theses and Dissertations Archive

Cultural hybridity is most prevalently revealed in cultures where racism starkly exists, according to Homi K. Bhabba. The Jim Crow culture if the South during the Civil Rights Movement was one such culture. To Bhabba, a hybridized racial identity emerges when two polarized cultures are thrown together. I alter his perspective by arguing that a hybridized rhetoric of protest emerged in the South before and during the Civil Rights Movement, as evinced by the freedom faith expressions of activist, womanist, professor, lecturer, and preacher Prathia L. Hall (1940-2002). Hall first coined the phrase, freedom faith, in 1997, but described it …

Preliminary Investigations Toward A Theory Of Pattern For Technology Design, Annalisa Aguilar Jul 2012

Preliminary Investigations Toward A Theory Of Pattern For Technology Design, Annalisa Aguilar

Organization, Information and Learning Sciences ETDs

It is argued that today's scarcity of computer tools compatible with human experience derives from an antiquated dualistic model of mind, as passed down through the mid-20th century, during the early development of the computer and artificial intelligence, and up to the present day. Rather than settle for technology as inevitable and instead of depending upon worldviews that are no longer aligned with current empirical findings on human cognition, this thesis renders a broad imperative for a design theory informed by an ecological understanding of mind in society, with a worldview that reflects the historical development of technology as tools, …

A Fuzzy Based Load Frequency Control And Load Shedding Scheme For Islanded Distribution Network Connected With Mini-Hydro /Javed Ahmed Laghari, Ahmed Laghari Javed Jul 2012

A Fuzzy Based Load Frequency Control And Load Shedding Scheme For Islanded Distribution Network Connected With Mini-Hydro /Javed Ahmed Laghari, Ahmed Laghari Javed

Student Works (2010-2019)

Mini hydro power plant (MHPP) based DG is cost effective and environmental friendly resource for rural electrification schemes. The DG can be connected in parallel with grid to supply the increased load demand. However, in utility practice when load disturbance occurs in grid, DG is tripped-off. Due to this, DG capacity is not utilized efficiently. In order to utilize the DG capability, islanding need to be done. The islanding has a considerable advantage such as reliability improvement, blackout reduction. However, islanding operation is a challenging issue; if there is any unbalanced between load demand and power generation, the system frequency …

Interviewing The Interpretive Researcher: An Impressionist Tale, Rebecca K. Frels, Anthony J. Onwuegbuzie Jul 2012

Interviewing The Interpretive Researcher: An Impressionist Tale, Rebecca K. Frels, Anthony J. Onwuegbuzie

The Qualitative Report

In this manuscript, we describe the use of debriefing interviews for interviewing the interpretive researcher. Further, we demonstrate the value of using debriefing questions as part of a qualitative research study, specifically, one doctoral student’s dissertation study. We describe the reflexivity process of the student in her study and the debriefing data that were coded via qualitative coding techniques. Thus, we provide an exemplar of the debriefing process and the findings that emerged as a result. We believe that our exemplar of interviewing the interpretive researcher provides evidence of an effective strategy for addressing the crises of representation and legitimation …

Lnle do the well-meaning faculty members of Whitten College understand that TV executive Matt Cobb is, in truth, a high-level corporate snoop and trouble-shooter. Cobb is the protaganist of five novels by William DeAndrea. A sixth is coming soon.
