This white paper outlines some of the remaining state barriers and a few federal ones and how they prevent disruptive innovations by entrepreneurs and established firms alike that potentially could bring new and more efficient business models to the market. In the case of the legal sector, the barriers we identify not only adversely affect legal innovation, but also impede innovation in other sectors of the economy. Similarly, in health care, pharmaceuticals, K-12 education, the financing of growth businesses, and many consumer services, legal obstructions hinder innovation and the provision of efficient, affordable, high-quality services and products. We conclude by …

Sexing Harris: The Law And Politics Of Defunding Planned Parenthood, Mary Ziegler
Sexing Harris: The Law And Politics Of Defunding Planned Parenthood, Mary Ziegler
Scholarly Publications
The movement to defund Planned Parenthood has opened a new front in the abortion wars. At the state and national level, anti-abortion organizations have campaigned successfully for new legal limitations on Medicaid or Title X reimbursement for Planned Parenthood. Significantly, legal restrictions reach not only abortion but also other services like contraception and cancer screenings. North Carolina, Wisconsin, and Indiana are among the states to have introduced such bans, and the U.S. House of Representatives approved one before the proposal died in the Senate in April 2011.
At first, the novelty of the movement seems to lie in its open …
Teaching Students To Negotiate Like A Lawyer, John M. Lande
Teaching Students To Negotiate Like A Lawyer, John M. Lande
Faculty Publications
Some important stages might include: (1) initial client interview, (2) negotiation of a retainer agreement, (3) developing good working relationships with counterpart lawyers, (4) conducting factual investigation and/or legal research, (5) working with counterparts to plan the negotiation process, (6) resolving discovery disputes, (7) preparing client for negotiations, (8) conducting an ultimate negotiation, (9) engaging a mediator and mediating the matter, and (10) drafting a settlement agreement. This essay suggests that by using both single-stage and multi-stage simulations, instructors can better prepare students for negotiations that they will actually conduct in practice. These suggestions grow out my book, Lawyering with …

The Happiest Place On Earth - The Microbudget Model As A Means To An American National Cinema, John Goshorn
The Happiest Place On Earth - The Microbudget Model As A Means To An American National Cinema, John Goshorn
Electronic Theses and Dissertations
The Happiest Place on Earth is a feature-length film written, directed, and produced by John Goshorn as part of the requirements for earning a Master of Fine Arts in Film & Digital Media from the University of Central Florida. The project aims to challenge existing conventions of the American fiction film on multiple levels – aesthetic, narrative, technical, and industrial – while dealing with a distinctly American subject and target audience. These challenges were both facilitated and necessitated by the limited resources available to the production team and the academic context of the production. This thesis is a record of …
Educating Lawyers For Community, Anthony V. Alfieri
Educating Lawyers For Community, Anthony V. Alfieri
Articles
This Essay is part of an ongoing classroom study and clinical service project addressing the mindful education of law students and the civic training of lawyers. Its purpose is to build a pedagogy of community and public citizenship within an outcome-based, rotation curricular model of legal education sketched out by commonly allied scholars in prior work here in the Wisconsin Law Review and elsewhere. The Essay seeks to advance this earlier curricular work by integrating ethics, education and psychology, and law and religion into a cohesive pedagogical approach to civic professionalism and community engagement. From the springboard of integration next …

Sisters In Law: Black Women Lawyers' Struggle For Advancement, Carla Pratt
Faculty Articles
While the presence of women in law school and the legal profession has improved greatly, the uncomfortable reality is that women tend to occupy positions in the legal profession that subordinate them to men. This reality is even more glaring when the position of black women is examined. Black women carry the burden of multiple consciousness which influences every aspect of their professional lives. Multiple consciousness means that black women must be mindful of their professional identity, their gender and their race in navigating the pipeline to power. This paper will explore the multiple consciousness that intersecting identities invoke and …

What Is A Lawyer? A Reconstruction Of The Lawyer As An Officer Of The Court, Deborah M. Hussey Freeland
What Is A Lawyer? A Reconstruction Of The Lawyer As An Officer Of The Court, Deborah M. Hussey Freeland
Saint Louis University Public Law Review
This paper engages with the central question in legal ethics concerning the lawyer’s role, analyzing this fundamental question in terms of professional identity. Literature in this debate frames the lawyer either as a professional who exists entirely to serve her client (the “standard conception”), or as a professional whose primary duties are to the legal system. I reposit and examine the lawyer’s professional identity as an officer of the court—an identity marginalized by those who favor the standard conception—noting that “standard conception” was coined to draw attention to a supplanting threat to legal professionalism. Providing a uniquely detailed examination of …
Hiv/Aids In The Muslim-Majority Countries: Formula For Low Prevalence, Kaoru Yamaguchi
Hiv/Aids In The Muslim-Majority Countries: Formula For Low Prevalence, Kaoru Yamaguchi
Political Science Theses and Capstones
The Muslim-majority countries long had been considered to be free of HIV/AIDS epidemic because of their strict religious and moral codes. However, the HIV prevalence rates are increasing in some Islamic states, and even more or so rapidly in a several cases that it is no longer valid to assume the Islamic religion protects its followers from the risks of contracting HIV. Contrary to the popular belief concerning the prevention of the HIV/AIDs epidemic, data collected from well-recognized international organizations such as the WHO and Freedom House indicate that democratization, strong government leadership, and wider and equal human rights for …

An Exploratory Study On Social Learning Theory, Social Bond Theory, Experiences With Police And Demographic Effects On College Student Attitudes Toward Police, Tyson Allen Mclean
Graduate Student Theses, Dissertations, & Professional Papers
Research on public attitudes toward police is principally conducted through survey methods focused on analyzing the effects of experiences with police, satisfaction with police services and respondent demographics. Most research collects data from the general public, which overall reports high levels of satisfaction with the police. However, few studies focus on the college student population and fewer integrate theoretical frameworks to explore this complex issue. This research incorporates tenets from social learning and social control theories as a conceptual framework from which the analysis is built. It also explores the role that personal and vicarious contact and demographic influences play …
