The Plural Of Anecdote Is Not Data: Teaching Law Students Basic Survey Methodology To Improve Access To Justice In Unemployment Insurance Appeals, Faith Mullen

Scholarly Articles

This project is part of Professor Mullen's larger Bellow Scholars research agenda, which concerns access-to-justice issues at the OAH more generally. This project tried to ascertain whether self-represented parties (both employees3 and employers) in unemployment insurance (UI) appeals perceive a need for more legal assistance. For three weeks in November of 2009, law students from The Catholic University of America administered a survey that asked self-represented parties in UI appeals whether, based on their experiences in the hearing, they perceived a need for more legal assistance and whether there were aspects of the hearings that they found particularly challenging. Initially …

Teaching Social Justice Lawyering: Systematically Including Community Legal Education In Law School Clinics, Margaret Martin Barry, A. Rachel Karn, Margaret E. Johnson, Catherine F. Klein, Lisa Vollendorf Martin

Scholarly Articles

There is a body of literature on clinical legal theory that urges a focus in clinics beyond the single client to an explicit teaching of social justice lawyering. This Article adds to this emerging body of work by discussing the valuable role community legal education plays as a vehicle for teaching skills and values essential to single client representation and social justice lawyering.

The Article examines the theoretical underpinnings of clinical legal education, community organizing and community education and how they influenced the authors’ design and implementation of community legal education within their clinics. It then discusses two projects designed …

Autonomy-Mastery-Purpose: Structuring Clinical Courses To Enhance These Critical Goals, Leah Wortham, Catherine F. Klein, Beryl Blaustone

Scholarly Articles

Part I describes the difference in extrinsic and intrinsic motivation and reviews the negative effects of business and educational models assuming extrinsic motivation to be most effective rather than seeking to stimulate intrinsic motivation. Part II describes the Carnegie Foundation's Preparation for the Professions project's call for law schools to focus on law students' sense of identity and purpose as part of their professional education, as well as noting the similar goal that students learn "how to be" as articulated by the Tuning Project of the Bologna process regarding higher education in Europe. Part III provides basics on the theory …

Patent Law As Public Law, Megan M. La Belle Jan 2012

Patent Law As Public Law, Megan M. La Belle

Scholarly Articles

Historically, patent litigation has been viewed and treated primarily as private law litigation, as opposed to public law litigation. This paradigm has begun to shift, however, as various stakeholders have come to acknowledge the profound impact that the patent system – and particularly invalid patents – have on the public at large. Yet, in order for a public law regime to succeed, there must be a host of enforcement mechanisms available, including the opportunity for privately-initiated litigation.

Public interest organizations have played a prominent role in the enforcement of certain public rights, such as free speech, equal protection, and environmental …

The Training, Appointment, And Supervision Of Islamic Lawyers In The Federal Territories Of Malaysia, Amanda Whiting Jan 2012

The Training, Appointment, And Supervision Of Islamic Lawyers In The Federal Territories Of Malaysia, Amanda Whiting

Washington International Law Journal

Although much has been written about the place of Islam, as law and as religion, in Malaysia, considerably less attention has been paid to Islamic lawyers (“peguam syarie”). This article undertakes a preliminary examination of a topic that demands closer scrutiny, relying chiefly upon parliamentary acts, state enactments and the rules made pursuant to them, as well as in-depth oral history interviews with Islamic and secular lawyers that were recorded from May through August 2010. It describes the training and practice of Islamic lawyers in one jurisdiction of the federation of Malaysia—the Federal Territories of Kuala Lumpur, Putrajaya …

The Training, Appointment, And Supervision Of Islamic Judges In Singapore, Muhammad Haniff Hassan, Sharifah Thuraiya Su'ad Ahmad Alhadshi

Washington International Law Journal

Syariah court judges and the decisions they make clearly have an effect on the interpretation and application of Islamic law in contemporary Muslim societies, and the educational background of those who staff these courts obviously informs the way they understand, interpret, and apply the law. To date, however, little research has been done on the educational processes by which Islamic court judges are trained to think about Islamic law. Likewise, the means by which Islamic court judges are appointed and regulated has received little scholarly attention. This article offers a descriptive overview of the training, work, and professional regulation of …

The Korus Fta On Foreign Law Firms And Attorneys In South Korea—A Contemporary Analysis On Expansion Into East Asia, Jeanne John

Northwestern Journal of International Law & Business

South Korea has historically restricted foreign entry into its domestic legal services market, but has finally opened up its market to the practicing attorneys of any country with which it has a free trade agreement. U.S. firms and attorneys have been applying to open offices in Korea since March 2012, when the Korea-U.S. Free Trade Agreement went into effect. The global legal community has been forecasting the moves into Korea as well as the broader effect foreign entry will have on the Korean domestic legal services market. Many point to Germany as the gloomy example of a country whose certain …

The Islamic Legal System In Singapore, Ahmad Nizam Bin Abbas Jan 2012

The Islamic Legal System In Singapore, Ahmad Nizam Bin Abbas

Washington International Law Journal

In a country that is staunchly secular, it would appear to be an anomaly that the Muslim minority are free to practice their personal law when it comes to marriage, divorce, and to a certain extent inheritance. This article seeks to provide a general overview of the introduction and applicability of Muslim law in Singapore, from the colonial administration of the British to the contemporary period. The article also examines the infrastructure developed for implementing the Muslim law in Singapore and explores conflicts in jurisdiction between the country’s Syariah Court and the civil courts. Written from the perspective of a …

The Training, Appointment, And Supervision Of Islamic Lawyers In Singapore, Nik Hasyila Bte Nik Ibrahim

Washington International Law Journal

This article provides a snapshot of the administration of Muslim law as practiced in Singapore through the prism of the legal profession. In particular, it provides a brief background on the role of the legal profession in the administration of justice at the Syariah Court of Singapore. While it is beyond the scope of this paper to urge for institutional and legal reform, the paper nonetheless highlights the absence of a dedicated and specialized training program that can aid lawyers to be familiar with Muslim law and jurisprudence and provide better representation to their clients at the Syariah Court.
