A "Lawyer For All Seasons": The Lawyer As Conflict Manager, Michael T. Colatrella Jr.
A "Lawyer For All Seasons": The Lawyer As Conflict Manager, Michael T. Colatrella Jr.
San Diego Law Review
This interdisciplinary Article explores why interpersonal conflict management principles and skills are essential to good lawyering and, thus, why law schools should teach these principles and skills to all their students. In demonstrating the immense practical value an understanding of interpersonal conflict management principles and skills have in the practice of law, this Article examines case studies involving organizations that have dramatically reduced legal costs, among other benefits, by abandoning a solely legalistic approach to conflict and embracing conflict management principles. The lessons learned from these studies and the interpersonal conflict management principles that underlie them support the idea that …

Practical Training In Law In The Netherlands: Big Law Model Or Clinical Model, And The Call Of Public Interest Law, Richard Wilson
Practical Training In Law In The Netherlands: Big Law Model Or Clinical Model, And The Call Of Public Interest Law, Richard Wilson
Scholarly Articles in Law Reviews & Journals
This article identifies two models now at work in the Netherlands, models that present potentially competing visions of practical training for law graduates seeking entry into the legal profession. The first is the Law Firm School, a new innovation in 2009, designed and funded by 14 major Amsterdam law firms, firms that make up part of what is often called Big Law. The Law Firm School model is embedded within the traditional apprenticeship training for all lawyers, but is available only to associates of the participating firms. The second model is clinical legal education, which ideally is offered as part …

Foreign Language Careers For International Business And The Professions, Ronald C. Cere
Foreign Language Careers For International Business And The Professions, Ronald C. Cere
Global Advances in Business Communication
The U.S. work and market places are becoming more global, multilingual, and multicultural in nature and are making foreign language and cultural studies, particularly those of Asia and Latin America, an important part of career planning and development. Many jobs demand knowledge of one or more languages and their attendant cultures and require experience in international and/or cross cultural areas. They also demand specialized interdisciplinary training such as that offered at many schools, colleges, and universities, and encourage internships that can lead to promising careers. Job sources for foreign language-based careers also abound and with guidance and research can be …
Lawyers Intentionally Inflicting Emotional Distress, Alex B. Long
Lawyers Intentionally Inflicting Emotional Distress, Alex B. Long
Scholarly Works
This article examines the tort of intentional infliction of emotional distress (IIED) as applied to lawyers engaged in the practice of law. IIED claims against lawyers have arisen in a variety of contexts, ranging from a lawyer’s act of disclosing client confidences to a prosecutor to demanding sex from a client in exchange for legal services. Courts have always had difficulty defining the concept of “extreme and outrageous conduct” for purposes of an IIED claim, but IIED claims against lawyers pose even greater definitional problems for courts. In an effort to provide greater clarity, the article advocates that courts should …

Human Trafficking And The Health Care Provider, Patricia A. Crane
Human Trafficking And The Health Care Provider, Patricia A. Crane
Biennial Convention (CONV)
This presentation will address the global and domestic human trafficking. An estimated 20,000 people are trafficked within the U.S. each year, while millions may be trafficked internationally. Trafficking victims are forced, defrauded and coerced into labor and sexual service for profit of others. Traffickers use individual vulnerabilities and immigration status, language ability and poor understanding of U.S. laws to identify future victims. Health care professionals need contemporary and updated information and resources about health risks, screening methods, and identification of trafficked person. Common medical problems will be reviewed and health care needs in different phases of trafficking. Legal and health …
Market-Based Prediction Models As An Aid To Litigation Strategy And Settlement Negotiations, Kris Steckman
Market-Based Prediction Models As An Aid To Litigation Strategy And Settlement Negotiations, Kris Steckman
The Journal of Business, Entrepreneurship & the Law
In his recent book, “Litigation is War,” Fredrick L. Whitmer suggests effective advocacy in litigation mirrors many tactics common in strategic military preparation. On a battlefield or in a courtroom, quantifying the likelihood of uncertainties that may hinder or facilitate a particular line of attack will provide an advantage to the party holding such information. Consider this scenario: you are a plaintiff bringing suit against a corporation for ten million dollars, your trial starts in two weeks, the corporation has offered to settle for one million dollars, but you believe that you deserve more; do you accept? There is no …
