Engendering The History Of Race And International Relations: The Career Of Edith Sampson, 1927–1978, Gwen Jordan

Chicago-Kent Law Review

Edith Sampson was one of the leading black women lawyers in Chicago for over fifty years. She was admitted to the bar in 1927 and achieved a number of firsts in her career: the first black woman judge in Illinois, the first African American delegate to the United Nations, and the first African American appointed to the North Atlantic Treaty Organization. Sampson was also a pro-democracy, international spokesperson for the U.S. government during the Cold War, a position that earned her scorn from more radical African Americans, contributed to a misinterpretation of her activism, and resulted in her relative obscurity …

Taking The English Right To Counsel Seriously In American Civil Gideon Litigation, Scott F. Llewellyn, Brian Hawkins Apr 2012

Taking The English Right To Counsel Seriously In American Civil Gideon Litigation, Scott F. Llewellyn, Brian Hawkins

University of Michigan Journal of Law Reform

Courts have rejected a right to counsel for indigent civil litigants under the U.S. Constitution. But in some American states, that right arguably already exists as a matter of common law, albeit derived from centuries-old English common and statutory law. This Article analyzes the viability of arguments for incorporating the old English right to counsel in the twenty-seven American states that continue to recognize old English common and statutory law as a source of binding authority. Such "originalist" arguments may be appealing to judges who are more willing to revive a historically based right than establish a new right based …

Employment Law—The Elusive Enforceability Of Employment Covenants Not To Compete In Arkansas, Victoria J. Malony Apr 2012

Employment Law—The Elusive Enforceability Of Employment Covenants Not To Compete In Arkansas, Victoria J. Malony

University of Arkansas at Little Rock Law Review

Generally speaking, a covenant not to compete , or noncompete agreement, is a promise in an employment contract not to engage in the same type of business for a stated time in the same market as the employer. When these agreements are found by courts to be unenforceable, it leaves employers vulnerable to competitors. On the other hand, when they are enforced, employees may be unable to find work in the industry in which they are most experienced.

Because of the conflicts inherent in covenants not to compete, many courts have struggled to create a rule that can be fairly …

Friending And Following: Applying The Rules Of Professional Conduct To Social Media, Andy Taylor Apr 2012

Friending And Following: Applying The Rules Of Professional Conduct To Social Media, Andy Taylor

University of Arkansas at Little Rock Law Review

Despite the strong tradition in the law of not advertising for legal services, the Model Rules of Professional Conduct as well as the Arkansas Rules of Professional Conduct recognize that the interest in expanding public information about legal services trump that tradition. However, that is not the case in many states where, in some cases, lawyers have been advised to avoid certain types of interactive websites or risk what has been dubbed a "one-click ethics violation."

This article seeks to explain how attorneys can use social networking sites without violating any rules of professional conduct. Additionally, the article proposes a …

Of its funds, the state allocated $8.3 million for rapid re-housing of families who were living in shelters or motels.

This report explores the experiences of 486 of these families who received rapid re-housing assistance …

What's Love Got To Do With It: Securing Access To Justice For Teens, Lisa V. Martin Apr 2012

What's Love Got To Do With It: Securing Access To Justice For Teens, Lisa V. Martin

Faculty Publications

During the past 15 years, researchers have documented the pervasiveness, severity, and lasting impact of dating violence on American adolescents. Studies also have shown teens to be firmly resistant to disclosing abuse to adults. Nonetheless, civil protection orders - the civil legal remedy most commonly relied upon to redress intimate partner violence in adult relationships - often remain inaccessible to abused teens. State protection order statutes exclude teens from their protections by restricting rights to standing by age and the relationship between the parties. When states grant teens standing, they often deter teens from pursuing the protections extended to them …

Marketing To The Base Of The Pyramid: A Corporate Responsibility Approach With Case Inspired Strategies, Nicholas Santos, Gene R. Laczniak Apr 2012

Marketing To The Base Of The Pyramid: A Corporate Responsibility Approach With Case Inspired Strategies, Nicholas Santos, Gene R. Laczniak

Marketing Faculty Research and Publications

The economic and political outcomes of market globalization continue to be complex. As international corporations engage developing markets, they increasingly find consumers who lack market sophistication, meaningful purchasing options and economic leverage. Such conditions are ripe for the exploitation of these market segments but also can be mitigated by enlightened managers willing to thoughtfully consider their ethical and professional obligations to vulnerable consumers. This paper builds on a normative ethical framework, labeled the integrative justice model (IJM) for impoverished markets that was introduced in the marketing and public policy literature. Specifically, the paper will extend the normative ethics of the …

Reform That Understands Our Seniors: How Interdisciplinary Services Can Help Solve The Capacity Riddle In Elder Law, Thomas Richard Stasi Apr 2012

Reform That Understands Our Seniors: How Interdisciplinary Services Can Help Solve The Capacity Riddle In Elder Law, Thomas Richard Stasi

University of Michigan Journal of Law Reform

This Note suggests an interdisciplinary approach to assist in determinations of legal capacity. It also urges an amendment to the Model Rules and current law firm business models, so attorneys can better approach capacity challenges. While this Note does not presume to resolve the problems faced by capacity determinations, the purpose is to offer functional alternatives to the current working models. Part I reviews the Model Rules' treatment of capacity issues, detailing attorneys' conflicting ethical duties and the ambiguous methodology for capacity evaluations. Part II examines the customary processes that attorneys presently follow for seeking diagnostic evaluations and highlights their …

Client Confidentiality And The External Regulation Of The Legal Profession: Reporting Requirements In The United States And United Kingdom, Maria Castilla Apr 2012

Client Confidentiality And The External Regulation Of The Legal Profession: Reporting Requirements In The United States And United Kingdom, Maria Castilla

Cardozo Public Law, Policy & Ethics Journal

The note examines the dual role of lawyers as both zealous advocates for their clients and guardians of justice, highlighting the tension this creates, particularly in the context of corporate scandals. It critiques the notion that lawyers should solely serve their clients and suggests a more active role in preventing misconduct. The analysis compares regulatory approaches in the U.S. and the U.K., noting that the U.S. relies more on self-regulation while the U.K. emphasizes external oversight, reflecting differing societal perceptions of lawyers' roles.

Facades Of Justice, Norman W. Spaulding Apr 2012

Facades Of Justice, Norman W. Spaulding

Michigan Law Review

Representing Justice is a book of encyclopedic proportions on the iconography of justice and the organization of space in which adjudication occurs. Professors Judith Resnik and Dennis Curtis have gathered a provocative array of images, ranging from the scales of the Babylonian god Shamash-"judge of heaven and earth"-on a 4,200-year-old seal (pp. 18- 19 & fig. 23), and a 600-year-old painting of Saint Michael weighing the souls at the Last Judgment with sword and scales in hand (p. 23 fig. 25) to the tiny Cook County Courthouse in Grand Marais, Minnesota, 110 miles north of Duluth (p. 372 fig. 226), …

Taking Action Against Gender-Based Violence: Bringing Men And Women Together In Wentworth Through The Prevention In Action Movement, Silpa Srinivasulu

Independent Study Project (ISP) Collection

This project is an exploration with the KwaZulu Natal Network on Violence against Women and its activities and relationship with grassroots-level organizers regarding the Prevention in Action movement in Wentworth to unite men and women in a movement to end gender violence and protect health and safety. Gender-based violence is a particularly tragic health and justice issue in South Africa. While most interventions attempt to raise awareness and empower women to stand up against gender violence, recently organizations have understood the need to engage men in the dialogue, mobilize them to take action, and foster true changes in social norms …

Teaching Social Justice Lawyering: Systematically Including Community Legal Education In Law School Clinics, Margaret Martin Barry, A. Rachel Camp, Margaret E. Johnson, Catherine F. Klein, Lisa V. Martin

All Faculty Scholarship

There is a body of literature on clinical legal theory that urges a focus in clinics beyond the single client to an explicit teaching of social justice lawyering. This Article adds to this emerging body of work by discussing the valuable role community legal education plays as a vehicle for teaching skills and values essential to single client representation and social justice lawyering. The Article examines the theoretical underpinnings of clinical legal education, community organizing and community education and how they influenced the authors’ design and implementation of community legal education within their clinics. It then discusses two projects designed …
