Beliefs Of And Attitudes Toward Sexual Violence By A Diverse Group Of Self-Identified Male Collegiate Athletes, Belinda-Rose James
Beliefs Of And Attitudes Toward Sexual Violence By A Diverse Group Of Self-Identified Male Collegiate Athletes, Belinda-Rose James
USF Tampa Graduate Theses and Dissertations
The objective of this research was to assess the beliefs of and attitudes towards sexual violence among self-identified male, undergraduate, athletes and non-athletes. Research has shown that there is an association between the subculture of athletics and the beliefs and attitudes towards sexual violence. Male, undergraduate, athletes have disproportionately been reported for sexual violence. This study examined common risk factors attributed to perpetration of sexual violence: rape myth acceptance, lower attitudes toward women, reactive aggression, and physical and verbal sexual coercion. Multiple-level risk factors were studied in order to acquire a comprehensive understanding of what possible associations between male collegiate …

Attorneys And Entrepreneurs: Creating Value For Small Business Startups, Laurie A. Lucas, Griffin T. Pivateau
Attorneys And Entrepreneurs: Creating Value For Small Business Startups, Laurie A. Lucas, Griffin T. Pivateau
Texas Wesleyan Law Review
The attorney who understands an entrepreneurial organization at different stages of growth may be better able to anticipate the problems the organization may face over the long term. Legal issues for small businesses, for example, generally include the appropriate choice of business structure, protection and management of intellectual property, and effective management of human resources, which have all been affected by the technologies that are reshaping American society and its workforce. The attorney who understands the stages of smallbusiness growth, even in a general sense, may have a more effective lens" for providing legal assistance to a small business. This …
Juridical Framings Of Immigrants In The United States And France: Courts, Social Movements, And Symbolic Politics, Leila Kawar
Juridical Framings Of Immigrants In The United States And France: Courts, Social Movements, And Symbolic Politics, Leila Kawar
Political Science Faculty Publications
This paper reexamines the engagement of U.S. and French courts with immigration politics, aiming to provide a fuller accounting of how law and immigration politics shape one another. Jurisprudential principles are placed in national and historical context, elucidating the role of rights-oriented legal networks in formulating these arguments during the 1970s and early 1980s. The analysis traces how these judicial constructions of immigrants subsequently contributed to catalyzing a transformation of immigration politics in both countries. Immigrant rights jurisprudence is shown to be produced by, as well as productive of, broader political values, agendas, and identities.

Using The Resource-Based Theory To Determine Covenant Not To Compete Legitimacy, Norman D. Bishara, David Orozco Professor
Using The Resource-Based Theory To Determine Covenant Not To Compete Legitimacy, Norman D. Bishara, David Orozco Professor
Indiana Law Journal
This Article addresses the legitimacy of competing interests involved in the enforcement of covenants not to compete (“noncompetes”). To date, the courts and legislatures have not relied on a principled theoretical framework to identify and assess the competing interests between firms and individuals in this setting. This Article fills the research void by providing a theoretical framework that identifies the legitimacy of these competing claims. The framework integrates managerial research involving the resource-based theory of the firm and the knowledge-based perspective of competitive advantage with the legal analysis and enforcement of noncompete terms. A descriptive framework of the parties’ competing …
Public Interest Litigation In India As A Paradigm For Developing Nations, Zachary Holladay
Public Interest Litigation In India As A Paradigm For Developing Nations, Zachary Holladay
Indiana Journal of Global Legal Studies
Public interest litigation (PIL) in India can serve as a vehicle for creating and enforcing rights and is critical to the sustenance of democracy. PIL in India can address the needs of its citizens when legislative inertia afflicts the Indian National Congress. This Note discusses how PIL in India can serve as a model for other developing nations struggling with legislative inertia and can provide recourse to marginalized and disadvantaged communities. Furthermore, while PIL obscures the traditional boundaries of power in a liberal democratic polity, democracy is in fact strengthened by the expansion of standing to include any citizen who …

Background Paper For Second Workshop On Contract Negotiation Support For Developing Host Countries, Vale Columbia Center On Sustainable International Investment, Humboldt-Viadrina School Of Governance
Columbia Center on Sustainable Investment Staff Publications
The Columbia Center on Sustainable Investment (CCSI) and the Humboldt-Viadrina School of Governance (HSVG) have initiated a process to discuss the desirability and feasibility of mechanisms to provide negotiation support for developing host countries in their negotiations with major investors.
At a first workshop held in October 2011, participants agreed on the need for an expansion of support for developing countries in their contract negotiations.
A second workshop was held at Columbia University in July 2012 that undertook a gap analysis between the existing sources of support for developing countries in relation to complex contracts and the countries’ needs for …

Taking A Cultural Perspective On Intimate Partner Violence, Claire Oxtoby
Taking A Cultural Perspective On Intimate Partner Violence, Claire Oxtoby
Dissertations (1934 -)
Intimate partner violence continues to be a growing social concern associated with extensive physical, emotional, and financial consequences. Previous models of intimate partner violence have failed to recognize the role cultural components may play in the etiology of violence, specifically cultural values, the bi-dimensional process of acculturation, and sociodemographic variables. Prior research has shown these factors all contribute to women‟s perceptions of violence and such perceptions may impact the relationship between exposure and emotional outcomes. The present study examined how women‟s cultural background influences their perceptions of violence and subsequent adjustment. Eighty-six Latina women completed measures assessing cultural values, acculturation …

Journal of Dispute Resolution
While on the surface it seems like any legislation helping Americans keep their homes is a good idea, some critics question the effectiveness of these laws. They cite evidence (to be discussed below) showing foreclosure rates do not improve in states with foreclosure mediation laws. Others argue that while it may only be a short-term fix towards the larger problems that ail our economy, foreclosure mediation has shown to be a positive measure that helps many Americans, especially when the law is properly written. This paper will analyze the recent foreclosure mediation laws, and will explore the effectiveness of this …
Supreme Court Issues Notice To Courts: Bifurcated Proceedings Still Required, Valerie Dixon
Supreme Court Issues Notice To Courts: Bifurcated Proceedings Still Required, Valerie Dixon
Journal of Dispute Resolution
The United States Supreme Court has made its preference for arbitration widely known through continued declarations of its policy to that effect. In KPMG v. Cocchi, the Supreme Court reaffirmed that preference once again. In that case, however, the Court also found a need to issue a reminder to lower courts that its decision in Dean Witter v. Byrd was still the law of the land. One of the most interesting questions arising from this clear reminder to adhere to precedent is why the Supreme Court felt the need to articulate it at all.

Are You Networked Yet? On Dialogues Within European Judicial Networks, Monica Claes, Maartje De Visser
Research Collection Yong Pung How School Of Law
The article examines the modality of judicial dialogue and the practical workings of less institutionalized judicial networks in Europe. Topics discussed include the definition of constitutional pluralism, network, and dialogue, the participation of judges in judicial networks, and the relationship between the Court of Justice of the European Union (CJEU) and the national courts.
