A Visa To "Snitch": An Addendum To Cox And Posner, Eleanor Marie Brown Jan 2012

A Visa To "Snitch": An Addendum To Cox And Posner, Eleanor Marie Brown

GW Law Faculty Publications & Other Works

Cox and Posner’s landmark contribution is the first article to have highlighted the challenges of information asymmetry in immigration screening. While Cox and Posner have undoubtedly made a significant contribution, there is a critical oversight in their framework: they do not discuss the importance of targeted ex post mechanisms of screening educational elites. This Essay is an attempt to remedy Cox and Posner’s omission. Why is this oversight so problematic? In the post-9/11 world, U.S. immigration policy currently finds itself on the horns of a dilemma. While immigrant educational elites are critical to U.S. economic growth, terrorist networks have stepped …

Lessons In Loyalty: American Patriotism And Education In The Progressive Era, Cody Dodge Ewert Jan 2012

Lessons In Loyalty: American Patriotism And Education In The Progressive Era, Cody Dodge Ewert

Graduate Student Theses, Dissertations, & Professional Papers

Beginning in the late-nineteenth century an assortment of actors, alongside school administrators and teachers, pressed for the inclusion of national symbols, myths, and rituals in American schools. Amid a flurry of educational reform in the half-century following the Civil War, a nascent patriotic education movement recast schools’ relationship with the nation’s past in an attempt to shape its future. This mobilization began at the local and state levels, but through aggressive promotion patriotic education was a nationwide force by 1920, with several states adopting legal standards requiring outward expressions of patriotism in schools. Promoters of patriotic education sought to entrench …

Covenant Nation: The Politics Of Grace In Early American Literature, Justin M. Scott-Coe Jan 2012

Covenant Nation: The Politics Of Grace In Early American Literature, Justin M. Scott-Coe

CGU Theses & Dissertations

The argument of this dissertation is that a critical reading of the concept of "covenant" in early American writings is instrumental to understanding the paradoxes in the American political concepts of freedom and equality. Following Slavoj Zizek's theoretical approach to theology, I trace the covenant concept in early American literature from the theological expressions and disputes in Puritan Massachusetts through Jonathan Edwards's Freedom of Will and the essays of Ralph Waldo Emerson, showing how the covenant theology of colonial New England dispersed into more "secular" forms of what may be called an American political theology. The first chapter provides an …

Post-Reform Medicaid Before The Court: Discordant Advocacy Reflects Conflicting Attitudes, Nicole Huberfeld Jan 2012

Post-Reform Medicaid Before The Court: Discordant Advocacy Reflects Conflicting Attitudes, Nicole Huberfeld

Law Faculty Scholarly Articles

The United States Supreme Court heard two Medicaid cases this term that raise major questions about the program and the tensions it creates between the federal and state governments. On October 3, 2011, the Court heard oral arguments in Douglas v. Independent Living Center of Southern California, a dispute between California and its Medicaid providers regarding reimbursement cuts resulting from California's budget crisis. The Medicaid providers argued that the proposed cuts are so extreme as to violate federal law and thus the Supremacy Clause of the United States Constitution. Their contention hinged on the Equal Access Provision of the Medicaid …

Civic Engagement Of Community College Students: A Qualitative Research Study On Community College Curriculum And Civic Engagement, Landon P. Shephard Jan 2012

Civic Engagement Of Community College Students: A Qualitative Research Study On Community College Curriculum And Civic Engagement, Landon P. Shephard

Electronic Theses and Dissertations

Social scientists claim young United States (U.S.) citizens have become disengaged in civic life which jeopardizes democracy (White et al., 2007; CIRCLE & Carnegie, 2003, p.8). As a nation, the U.S. has failed to teach students the skills, knowledge, and abilities necessary for democratic life (White et l., 2007). Social scientists claim young U.S. citizens have become disengaged in civic life since the 1980s (Colby, 2007; CIRCLE & Carnegie, 2003, p.4). Compared to past generations, young citizens in the United States are less engaged in political life and lack an understanding of what it means to be an active and …

Professional Identity Development In Online Christian Theological Education: A Case Study Of Preparing Pastoral Practice Through Discursive Activity, Rovina L. Hatcher Jan 2012

Professional Identity Development In Online Christian Theological Education: A Case Study Of Preparing Pastoral Practice Through Discursive Activity, Rovina L. Hatcher

Theses and Dissertations--Curriculum and Instruction

The purpose of this dissertation study was to explore the professional preparation of students in online classes at a Christian theological seminary. Concerns of theological education involve the capacity or incapacity of community development and somatic or embodied learning in online education. Using a theoretical framework drawn from communities of practice (Wenger, 1998), professional clergical preparation (Foster, Dahill, Golemon, & Tolentino, 2005), and Gee’s (2000-2001) dimensions of identity development, the researcher focused the analyses on students’ written texts located in the discussion board fora of the online courses. These records were examined for indications of formation of the professional identity …

Faustian Figures: Modernity And Male (Homo)Sexualities In Spanish Commercial Literature, 1900-1936, Jeffrey Zamostny Jan 2012

Faustian Figures: Modernity And Male (Homo)Sexualities In Spanish Commercial Literature, 1900-1936, Jeffrey Zamostny

Theses and Dissertations--Hispanic Studies

I contend in this study that commercial novels and theater from early twentiethcentury Spain often present male (homo)sexual characters as a point of constellation for anxieties regarding modernization in Madrid and Barcelona. In works by Jacinto Benavente, Josep Maria de Sagarra, El Caballero Audaz (José María Carretero), Antonio de Hoyos y Vinent, Carmen de Burgos, Álvaro Retana, Eduardo Zamacois, and Alfonso Hernández-Catá, concerns about technological and socioeconomic change converge upon hustlers and blackmailers, queer seducers, and chaste inverts. I examine these figures alongside an allegorical interpretation of Goethe’s Faust in Marshall Berman’s book All That is Solid Melts into Air: …

The Impact Of Dakota Missions On The Development Of The U.S.-Dakota War Of 1862, Daphne D. Hamborg Jan 2012

The Impact Of Dakota Missions On The Development Of The U.S.-Dakota War Of 1862, Daphne D. Hamborg

All Graduate Theses, Dissertations, and Other Capstone Projects

This thesis explores the relationships between three groups of people on the mid-nineteenth century Minnesota frontier: evangelical Protestant missionaries, the Dakota who converted to the Christian faith and lifestyle taught by these missionaries, and the Dakota who remained traditional in their outlook and lifestyle. It does this through an analysis of the impact of these relationships on the development of the U.S.-Dakota War of 1862. As is made clear through the use of both primary and secondary sources, the missionaries helped create tensions within the Dakota community, tensions expressed through shifting social structures, argument, alienation, and, at times, violence. As …

Grave Exclamations: An Analysis Of Tombstones And Their Use As Narrative Of Self, Lacey Jae Ritter Jan 2012

Grave Exclamations: An Analysis Of Tombstones And Their Use As Narrative Of Self, Lacey Jae Ritter

All Graduate Theses, Dissertations, and Other Capstone Projects

We establish our selves through narratives--with others and by ourselves--during life. What happens, however, when a person dies? The following paper looks at the way narratives about the deceased's selves are created by the bereaved after their loved ones have died. The paper focuses on the narratives created on the deceased's tombstones, as these are available to the public and last the longest of all final declarations of the person's identity (i.e., obituaries, funeral programs, eulogies). Because I am interested in the way narratives of the self are constructed postmortem, a symbolic interactionist approach was used. The study focuses on …

Identification By Spirit Alone: Community-Identity Construction In Galatians 3:19-4:7, Susaan Liubinskas Jan 2012

Identification By Spirit Alone: Community-Identity Construction In Galatians 3:19-4:7, Susaan Liubinskas

The Asbury Journal

Interpretations of Paul's letter to the Galatians have tended to focus on its theological content, particularly Paul's attitude toward the Law and Judaism Moreover, the question of how the theological portion of the epistle relates to the paraenetic section (Gal 5:13---6:10) continues to vex interpreters. However, the author notes that the position of Jews and Gentiles within the Christian churches is ultimately a question of identity. Accordingly, the goal of this study is to perform a sociological analysis of Gal 3:19--4:7, drawing upon aspects of social identity theory, in order to analyze Paul's method of constructing community identity in terms …

Shaping The Future Past: Finding History, Creating Identity In The Kwan Hsu Papers, Lisa Chere' Donnelly Jan 2012

Shaping The Future Past: Finding History, Creating Identity In The Kwan Hsu Papers, Lisa Chere' Donnelly

Dissertations and Theses

Dr. Kwan Hsu was neither a superstar nor a celebrity. Her name does not come up in conversations about important contributors to her field of biophysics nor is she instantly recognizable for her contributions to Portland State University's international program or the state of Oregon's business ties with China. Yet she was a contributor, a cog-in-the-wheel, at the very least, in all of these areas and more. She was a peripheral member of a well-known Chinese family, but few in the United States know of or perhaps have interest in, but otherwise, she had no great connections or family ties …

Early Oligocene Continental Climate Of The Palaeogene Basin (Hungary And Slovenia) And The Surrounding Area, Boglarka Erdei, Torsten Utescher, Lilla Hably, Julia Tamás, Anita Roth-Nebelsick, Michaela Grein

Turkish Journal of Earth Sciences

This paper concentrates on the Early Oligocene palaeoclimate of the southern part of Eastern and Central Europe and gives a detailed climatological analysis, combined with leaf-morphological studies and modelling of the palaeoatmospheric CO_2 level using stomatal and \delta^1^3C data. Climate data are calculated using the Coexistence Approach for Kiscellian floras of the Palaeogene Basin (Hungary and Slovenia) and coeval assemblages from Central and Southeastern Europe. Potential microclimatic or habitat variations are considered using morphometric analysis of fossil leaves from Hungarian, Slovenian and Italian floras. Reconstruction of CO_2 is performed by applying a recently introduced mechanistic model. Results of climate analysis …

Lay Versus Medical Analysis: A Conflict Centered On The Disciplinary And Professional Identity Of Psychoanalysis, Sam Yoder Jan 2012

Lay Versus Medical Analysis: A Conflict Centered On The Disciplinary And Professional Identity Of Psychoanalysis, Sam Yoder

University Honors Theses

The psychoanalytic conflict surrounding lay and medical analysis was a prominent conflict within both the European and American psychoanalytic communities. This thesis is an analysis of that conflict from the time period of 1900-1940. I argue that this conflict is an expression of two conflicting ideas for the disciplinary identity of psychoanalysis. Lay analysts believed that psychoanalysis should be a distinct discipline and be used in a multidisciplinary context. Medical analysts believed that through aligning psychoanalysis with medicine it would obtain professional legitimacy. This thesis also covers concepts of professionalization in disciplines.

A Study Of The Management Of Opioid Prescriptions Among Patients With A History Of Substance Abuse, Kara G. Veeder Jan 2012

A Study Of The Management Of Opioid Prescriptions Among Patients With A History Of Substance Abuse, Kara G. Veeder

MUSC Theses and Dissertations

Prescription opioid abuse is the fastest-growing drug problem in the United States and has been declared an epidemic by the U.S. White House Office of National Drug Control Policy. Immediate release (IR) opioids, especially hydrocodone and oxycodone, are abused or misused most commonly. Dentists are only second to family physicians in the number of IR opioid prescriptions written. Just under ten percent of the population in the United States in 2010 were classified with substance dependence or abuse in 2009. This study poses the following questions: 1. Do patients with a personal or family history of substance abuse manage prescription …

Irish American Women: Forgotten First-Wave Feminists, Sally Barr Ebest Jan 2012

Irish American Women: Forgotten First-Wave Feminists, Sally Barr Ebest

Journal of Feminist Scholarship

Numerous books have been written about American feminism and its influence on education and society. But none have recognized the key role played by Irish American women in exposing injustice and protecting their rights. Certainly their literary heritage, inherent knowledge of English, and membership in the single largest ethnic group gave them an advantage. But their dual positions as colonized, second-class citizens of their country and their religion gave them their political edge, a trait that has been evident since the Irish first stepped off the boat and that continues to this day. This essay focuses on the first wave …

Rural Inheritance: Gender Disparities In Farm Transmission, Hannah Haksgaard Jan 2012

Rural Inheritance: Gender Disparities In Farm Transmission, Hannah Haksgaard

Faculty Publications

Farmers are farmers' sons. Notable in our modern day, heralded by many as a gender-neutral society, it is farmers' sons, not farmers' daughters, who become farmers and take over ownership and management of the family farm. It has long been true that agricultural knowledge and land have passed through generations of men. In contrast, daughters, even today, are neither considered to be farmers nor likely to inherit family farmland. This Article begins by chronicling how farmland is inherited (by sons) then discusses why the pattern of excluding women continues. There have been substantial legal changes in the United States impacting …

Rebels, Settlers And Violence: Rebellion In Western Munster 1641-2, Christopher Sailus Jan 2012

Rebels, Settlers And Violence: Rebellion In Western Munster 1641-2, Christopher Sailus

LSU Master's Theses

This study challenges current historical assumptions about the nature, scope, and timeframe of the 1641 Irish Rebellion in Kerry, Clare, and Limerick counties in western Munster. Placing the start of the popular rebellion in these counties around 1 January 1642, the beginning of unrest is set several months further back. In the process of analyzing the actions of popular and organized rebels alike, the motivations for rebellion are characterized as political and social rather than religious. In turn, seventeenth-century Irish society was transformed from the traditional narrative of a rigid, religiously-divided society into something far more complex and amorphous, with …

Shoreline Changes In Point Pelee, Canada: An Airphoto-Based Analysis, Abdullah Bamasoud

Theses and Dissertations (Comprehensive)

Shoreline retreat has significant consequences for Point Pelee National Park’s (PPNP) ecological and economic systems. In this study, the shoreline changes of PPNP are examined in terms of their rates, their relationship to natural and anthropogenic influences, and methods for predicting shoreline positions.

The rates of shoreline change are analyzed for the period 1959-2004 using ortho-airphotos. The eastern shoreline of the Park exhibited varying recession in both rising and falling Lake Erie water level, especially in the Northeast Beach, where it averaged -3.14 m˖y-1. The western shoreline of the Park generally exhibited accretion and had an inverse relationship with Lake …
