"Sell's" Conundrums: The Right Of Incompetent Defendants To Refuse Anti-Psychotic Medication, Christopher Slobogin

The Supreme Court's 2003 decision in Sell v. United States declared that situations in which the state is authorized to forcibly medicate a criminal defendant to restore competency to stand trial "may be rare." Experience since Sell indicates that this prediction was wrong. In fact, wittingly or not, Sell created three exceptions to its holding (the dangerousness, treatment incompetency, and serious crime exceptions) that virtually swallow the right to refuse. Using the still-on-going case of Jared Loughner as an illustration, this essay explores the scope of these exceptions and the dispositions available in those rare circumstances when none of them …

The present research was constructed with the aim to assess happiness within college students. The research hypotheses were 1.) Students of "belief' faith will experience higher levels of classic happiness than will students not of faith or of "activity" faith, 2.) Students of "belief' faith will experience higher levels of life satisfaction and purpose in life than will students not of faith or of "activity" faith. 3.) The Relationship Between Cyberbullying And Depression In Adolescents, Meredith Mcdermott

The current study examined the relationship between cyberbullying and depression in high school students, and the relationship between help seeking, parental involvement, and depression. One hundred twenty seven high school students, 43% male and 57% female, between I 4 to 18 years of age, completed a self-report survey. Results indicated that the more experiences students had with cyberbullying, the more likely they were to report symptoms of depression. At an alpha level of .01, results showed that there was a significant positive relationship between bullying and depression, r(125) = .42,p

The purpose of this study was to identify and analyze faculty, staff, and students' perception of the site visitors who were involved with the 2011-2012 Athletic Training Educational Program (ATEP) Site Visits in Illinois. The perceptions from multiple universities were compared to determine whether there was perceived site visitor subjectivity during each institution's site visit. The problem that arises is that verification of standards is a very subjective task. Most site visitors think that the program they are affiliated with is the best (Price, 2011 ); therefore, it is difficult to accurately state that personal bias is left at the …

A new concept called orthorexia nervosa has recently become more prevalent in scientific journal articles. Orthorexia nervosa has been defined as a fixation on eating only healthy foods, spending hours ruminating on meals, and an obsession with proper nutrition (Bratman, 1997). Several studies have attempted to investigate this concept, establish prevalence rates, and determine whether orthorexia is a disorder. Some studies have found an association between eating disorders, anxiety, and orthorexia as well as posited risk factors such as higher body-mass index, level of education, and sex. Autism is a complex disorder, affecting a person's ability to socialize, process information, and communicate effectively. Often, persons with autism struggle with sensory system deficits that compound their isolation. As college campuses welcome an increasing number of students with Asperger's Syndrome (AS) or High Functioning Autism (HF A), student affairs professionals must learn to adapt their skills to challenge and support this population. Establishment of a consistent bedtime routine is often recommended to parents of toddlers. Few studies have investigated the efficacy of implementing a bedtime routine, without additional behavioral intervention. Sixty-one parents and their toddler (ages 18- 48 months, n = 61) were given written information regarding a positive bedtime routine to examine the effects on bedtime-resistance and improving parent mood. This study found that institution of a consistent nightly bedtime routine with non sleep-disordered toddlers may improve some aspects of bedtime resistance (i.e., calling out), increase sleep duration during the night, and improve parent's negative mood. However, there was no change …

The silver carp, Hypophthalmichthys molitrix, is an invasive species that has received increased attention due to the proximity of the population in the Illinois River to the economically important Great Lakes and the species ability to dominate the aquatic biomass of an ecosystem. We sought to assess the population demographics of silver carp on two different river ecosystems, the Illinois River and Wabash River. The Illinois River is channelized and dammed for commercial barges, whereas the Wabash River is the longest free flowing river east of the Mississippi River and is still connected to its natural flood plain. This article describes the results of a national survey pertaining to school psychologists’ knowledge and use of evidence-based, social-emotional learning (SEL) interventions. For the study, 331 school psychologists responded to a survey that listed (a) techniques for identifying SEL interventions, (b) 16 SEL programs that have been identified by more than one source as having strong evidence for their effectiveness, and (c) factors that school psychologists may use for deciding on a program to use in their schools. Tormented: Antigay Bullying In Schools, Ari Ezra Waldman

This Article begins a theoretical and empirical discussion on bullying and cyberharassment of all students, but particularly gay and lesbian youth. Despite the recent spate of bullying-related suicides, I argue that antibullying proposals that include harsh criminal punishments for egregious cases of bullying and cyberbullying in schools lack validity as a matter of legal theory and practice. In fact, it is what makes criminalization so initially attractive — that is, the public’s emotional and retributive need for punishments equal to bullying tragedies — that ultimately leaves the proposal devoid of reason. Criminalization proposals only satisfy retributive aims and are unlikely …

While federal circuit courts play an essential role in defining what the Constitution means, one would never know it from looking at most constitutional scholarship. The bulk of constitutional theory sees judge-made constitutional law through a distorted lens, one that focuses solely on the Supreme Court with virtually no attention paid to other parts of the judicial hierarchy. On the rare occasions when circuit courts appear on the radar screen, they are treated either as megaphones for communicating the Supreme Court’s directives or as tools for implementing the theorist’s own interpretive agenda. Both approaches would homogenize the way circuit courts …
