Obamacare: The Birds Still Sing As Freedom Erodes, John S. Hoff

Notre Dame Journal of Law, Ethics & Public Policy

The article discusses the impact of the U.S. health care bill signed into law by U.S. President Barack Obama in 2010. When provisions begin to take effect in 2014, government spending will reportedly increase such that it would expand the deficit and Americans' freedom will be reduced. The new system turns health insurance companies into government agents with the government determining the premiums, benefits and types of policies to be issued.

The presence of the insurance provider, in a doctor-patient relationship, contributes to health care inefficiency. It advises the regulation of insurance companies, catastrophic health care to be the government's responsibility, and the inclusion of tort reform to bring down insurance costs.

Key To Health Care Reform: Changing How Care Is Delivered, Stephen M. Shortell

Notre Dame Journal of Law, Ethics & Public Policy

The article focuses on the lack of provisions of the 2010 Patient Protection and Affordable Care Act (PPACA) for controlling the rising costs of health care despite insurance coverage for more Americans. Successful health care reform must reportedly aim to improve the quality, outcomes and patient's experience of care in order to improve the overall health of the population and slow down costs. The framework to achieve a fundamental change in health care delivery is presented.
