Vital Tooth Whitening Effects On Oral Health-Related Quality Of Life In Older Adults, Ann M. Bruhn, Michele L. Darby, Gayle B. Mccombs, Carleen M. Lynch
Dental Hygiene Faculty Publications
Purpose: The purpose of this study was to determine if vital tooth whitening affects oral health-related quality of life (OHRQOL) in adults age 50 years and older, and if tooth whitening causes increased participation in social activities.
Methods: Using a 2 group, single blind, randomized, pre-test, multiple post-test design, 62 participants were enrolled. The experimental group used a whitening product twice daily for 3 weeks. The control group used no whitening products. The Oral Health Impact Profile (OHIP) served as the pre- and post-test measure. The OHIP measures OHRQOL on 7 subscales: functional factors, psychological disabilities, psychological discomforts, physical disabilities, …

Oil Pulling: An Ancient Practice For A Modern Time, Gina M. Bekeleski, Gayle Mccombs, W. Lee Melvin
Dental Hygiene Faculty Publications
The practice of oil pulling or oil swishing is a time-honored Indian folk remedy that involves swishing edible oil in the mouth for oral and systemic health benefits. Oil pulling offers a naturalistic approach to oral health care for a growing body of individuals who desire alternative and complementary medicine. The purpose of this paper was to summarize published research on the effectiveness of oil pulling on oral health. Literature was retrieved from 1992-2011 through databases including Cumulative Index to Nursing and Allied Health Literature (CINAHL), Education Resources Information Center (ERIC), Medical Literature Analysis and Retrieval System Online (MEDLINE), and …
Aggregation And Law, Eric A. Posner, Ariel Porat
Aggregation And Law, Eric A. Posner, Ariel Porat
Coase-Sandor Institute for Law & Economics Research Paper Series
If a plaintiff brings two claims, each with a 0.4 probability of being valid, the plaintiff will usually lose, even if the claims are based on independent events, and thus the probability of at least one of the claims being valid is 0.64. If a plaintiff brings two independent claims, and each of them is too weak to justify a remedy, the plaintiff will usually lose, even if the claims are jointly powerful enough to justify a remedy. Thus, as a general rule courts refuse to engage in what we call factual aggregation (the first case) and normative aggregation (the …
The Effect Of European Starlings And Ambient Air Temperature On Salmonella Enterica Contamination Within Cattle Feed Bunks, James C. Carlson, Jeremy W. Ellis, Shelagh K. Tupper, Alan B. Franklin, George M. Linz
The Effect Of European Starlings And Ambient Air Temperature On Salmonella Enterica Contamination Within Cattle Feed Bunks, James C. Carlson, Jeremy W. Ellis, Shelagh K. Tupper, Alan B. Franklin, George M. Linz
Human–Wildlife Interactions
European starlings (Sturnus vulgaris) are a known risk factor for the occurrence of microorganisms that are pathogenic to cattle and humans in concentrated animal feeding operations (CAFOs). Starling use of CAFOs is known to vary in response to weather; starling control operations on CAFOs often are timed to coincide with favorable environmental conditions to maximize take. The totality of this information suggests that disease risks in CAFOs associated with starlings may be influenced by environmental factors, such as temperature. In this study, we assessed the risk of Salmonella enterica contamination of cattle feed by modeling the interaction between …

The Impact Of Berguis V. Thompkins On The Eroding Miranda Warnings And Limited-English Proficient Individuals: You Must Speak Up To Remain Silent, Brenda L. Rosales
The Impact Of Berguis V. Thompkins On The Eroding Miranda Warnings And Limited-English Proficient Individuals: You Must Speak Up To Remain Silent, Brenda L. Rosales
UC Law Journal of Race and Economic Justice
Miranda v. Arizona requires law enforcement to warn defendants of their right to remain silent and give defendants an explanation that anything said can and will be used against the defendant in court. However, Berghuis v. Thompkins turned Miranda upside down by requiring defendants to unambiguously invoke their right to remain silent or be legally presumed to have waived their rights. Meaning that a defendant's yes or no answer to any question, including questions unrelated to the case, may be interpreted as a knowingly and intelligent waiver of the defendant's Miranda rights.
This note will address how the lower standard …

Out For Blood: Employment Discrimination, Sickle Cell Trait, And The Nfl, Chika Duru
UC Law Journal of Race and Economic Justice
Recently, numerous athletes, particularly football players, have fallen ill and some have even died from exercise related health complications linked to the sickle cell trait they carry. Not surprisingly, the affected athletes' families or estates have received large court judgments in connection with their injuries, and after a few such judgments at the collegiate athletic level, the National Collegiate Athletic Association recently instituted mandatory sickle cell trait testing for every incoming division I student-athlete.
Though the mandatory sickle cell trait testing appears permissible at the collegiate level, this article examines the potential consequences of a similar policy at the professional …
From The Oppressed To The Terrorist: Muslim-American Women In The Crosshairs Of Intersectionality, Sahar F. Aziz
From The Oppressed To The Terrorist: Muslim-American Women In The Crosshairs Of Intersectionality, Sahar F. Aziz
UC Law Journal of Race and Economic Justice
In the post-9/11 era, Muslim women donning a headscarf in America find themselves trapped at the intersection of bias against Islam, the racialized Muslim, and women. In contrast to their male counterparts, Muslim women face unique forms of discrimination not adequately addressed by Muslim civil rights advocacy organizations, women's rights organizations, or civil liberties advocates.
This article examines how the September 11th attacks adversely impacted the lives of headscarved Muslim women in ways different than Muslim men. Ten years after 9/11, there is a plethora of literature about what has become known as "post-9/11 discrimination." Most of the discussion focuses …

The Aspiring Attorney With Adhd: Bar Accommodations Or A Bar To Practice, Neha M. Sampat, Esme V. Grant
UC Law Journal of Race and Economic Justice
This article is the first in the academic literature to examine how a strict application of the childhood history requirement reduces the likelihood that applicants will receive ADHD accommodations on the bar exam based on race, sex, socioeconomic status, location, and age. A significant number of state bars, including in the largest legal markets of New York and California, require the bar applicant to provide a well-documented childhood history of ADHD symptoms. Many of the factors making it impractical or impossible to obtain childhood history documentation disproportionately affect people of minority backgrounds, legally protected classes, and other populations significantly underrepresented …

United States V. Duro: Farmworker Housing And Agricultural Law Constructions, Guadalupe T. Luna
UC Law Journal of Race and Economic Justice
This article seeks to addresses how the nation's food production systems produce negative conditions for foreign-born Indigenous people employed for their labor. The article will utilize the case of the migrant Pur6pecha, on the Torres Martinez Desert Cahuilla Indian Reservation in U.S. v. Duro . It will deeply examine the wide array of agricultural laws and policies that are available and aid growers and producers while not requiring that growers or producers to provide habitual farmworker housing. After discussing in detail the lack of adequate housing options for immigrant farmworkers throughout the nation and highlighted by the U.S. v. Duro …
The Connection Between Permanency And Education In Child Welfare Policy, Kele Stewart
The Connection Between Permanency And Education In Child Welfare Policy, Kele Stewart
UC Law Journal of Race and Economic Justice
This article explores the relationship between permanency, the dominant child welfare policy, and the educational needs of children in out-of-home care. The child welfare system has traditionally focused on finding children a permanent home. Education and other aspects of a child's well-being receive less attention. The failure to address children's educational needs is alarming given their poor academic performance. Studies show that compared to their peers from similar backgrounds, children in out-ofhome care perform below grade level, have lower test scores and high school completion rates, and have more disciplinary problems. These educational deficits contribute to challenges faced by former …

Creating New Categories: Anglo-American Radical Feminism's Constitutionalism In The Streets, Yxta Maya Murray
UC Law Journal of Race and Economic Justice
This note examines the struggles of youths who must leave state foster care systems (called "aging out" of foster care) upon turning eighteen years old. Thousands of young people age out of foster care systems each year. Foster care systems have traditionally abandoned children upon their eighteenth birthday, without providing aged-out youth real assistance in obtaining employment, health services, or basic shelter. Most commonly, these young adults do not have sufficient resources or support to allow them to transition into safe and stable lives. The majority of these older youths either get incarcerated, become homeless, or are forced to depend …
A Deregulatory Framework For Alleviating Concentrated African-American Poverty, Benjamin Zimmer
A Deregulatory Framework For Alleviating Concentrated African-American Poverty, Benjamin Zimmer
UC Law Journal of Race and Economic Justice
America's urban poor have become more geographically concentrated and isolated, of which, African Americans comprise the majority. Governmental efforts to combat concentrated poverty have consisted primarily of new government interventions in the housing market: subsidies, mandates, and other programs and regulations designed to compel socio-economic or racial integration. All the while, a separate set of government interventions in the form of tax expenditures, education financing, and land-use controls are largely responsible for the perpetuation of concentrated African-American poverty in the first place.
It is time to consider that a successful approach to poverty de-concentration and residential integration must begin by …
California Eviction Protections For Victims Of Domestic Violence: Additional Protections Or Additional Problems, Rebecca Licavoli Adams
California Eviction Protections For Victims Of Domestic Violence: Additional Protections Or Additional Problems, Rebecca Licavoli Adams
UC Law Journal of Race and Economic Justice
In 2011, California Code of Civil Procedure section 1161.3 (Section 1161.3) came into effect providing victims of domestic violence with an affirmative defense against a landlord's eviction action if resulting from an act of domestic violence. Domestic violence victims often are faced with homelessness due to lease provisions that allow eviction due to a violent or criminal act occurring in their rental unit or because of noise complaints from other tenants. After a victim is evicted the victim may have difficulty finding a new rental due to credit issues or a criminal history directly relating to the domestic violence.

Perception Of Resistance As A Predictor Of Self-Blame In College Women Who Have Experienced Sexual Assault, Mary Ashton Phillips
Perception Of Resistance As A Predictor Of Self-Blame In College Women Who Have Experienced Sexual Assault, Mary Ashton Phillips
Electronic Theses and Dissertations
The aim of this study was to examine the relationship between resistance and perception of resistance during sexual assault and feelings of self-blame in college aged women. The literature has shown that self-blame has uniformly negative effects on a victimized woman's emotional and psychological health, including poor adjustment, and higher levels of sexual dissatisfaction, depression and global distress. Behaviors and situations during and after the experience that correlate with self-blame that have been studied include alcohol use and knowing the perpetrator. Although other studies have been done showing that resistance is lower during those situations, no one has looked at …
Plume Dispersion Modeling Of Chlorine Gas Released Due To Ballistic Attack On Chlorine-Carrying Railway Tanker, Anna Claire Chapman
Plume Dispersion Modeling Of Chlorine Gas Released Due To Ballistic Attack On Chlorine-Carrying Railway Tanker, Anna Claire Chapman
Electronic Theses and Dissertations
Hazardous dense gases such as chlorine are often transported throughout the United States in their liquid form in pressurized railway tankers. These tankers can hold up to 90 tons of liquid chlorine. A high-powered, ballistic attack on a chlorine-carrying tanker could cause devastating outcomes for the surrounding population and environment. This particular terrorist attack was modeled and analyzed by varying a large number of weather parameters and by varying terrain in order to provide specific concentration data at different distances from the source. Data was compiled to provide first responders with a reliable reference for such an emergency so that …
Pregnancy As 'Disability' And The Amended Americans With Disabilities Act, Jeannette Cox
Pregnancy As 'Disability' And The Amended Americans With Disabilities Act, Jeannette Cox
School of Law Faculty Publications
The recent expansion of the Americans with Disabilities Act’s (ADA) protected class invites reexamination of the assumption that pregnant workers may not use the ADA to obtain workplace accommodations. The ADA’s scope now includes persons with minor temporary physical limitations comparable to pregnancy’s physical effects. Accordingly, the primary remaining justification for concluding that pregnant workers may not obtain ADA accommodations is that pregnancy is a physically healthy condition rather than a physiological defect. Drawing on the social model of disability, this Article challenges the assumption that medical diagnosis of “defect” must be a prerequisite to disability accommodation eligibility. The social …
An Enduring Oddity: The Collateral Source Rule In The Face Of Tort Reform, The Affordable Care Act And Increased Subrogation, Adam Todd
School of Law Faculty Publications
Today, despite significant legislative changes in healthcare insurance, tort reform, and subrogation, the collateral source rule has remained in force in many jurisdictions even in the face of rising health insurance costs. This Article argues that as long as health insurance markets are fragmented, the collateral source rule will continue to play an important normative role in the administration of the tort injury compensation process. The rule also helps deter tortious behavior, supports the insured's contractual expectations, is consistent with distributive fairness, and ensures that those engaging in risky activities bear the full cost of injuries. The collateral source will …
Expanding The Federal Common Law?: From Nomos & Physis And Beyond, Sam Kalen
Expanding The Federal Common Law?: From Nomos & Physis And Beyond, Sam Kalen
Marquette Law Review
The Supreme Court’s decision in AEP v. Connecticut, as well as litigation involving the threat posed by Asian Carp, reflect an emerging trend of testing the federal judiciary’s willingness to expand the federal common law to include claims for interstate environmental threats. There is an assumption, including by the Supreme Court, that a federal common law for public nuisance exists, and that the pressing question is whether to expand that common law. This article challenges that assumption. The article illustrates that the widely shared view about the persistence of a federal common law for interstate pollution overlooks the Supreme Court’s …
Justification For Creating An Ombudsman Privilege In Today's Society, Ryan Spanheimer
Justification For Creating An Ombudsman Privilege In Today's Society, Ryan Spanheimer
Marquette Law Review
Due to ever-increasing court congestion and contemporary policy favoring the resolution of disputes outside the courtroom, now more than ever a privilege for communications with an ombudsman is needed. Although statistics demonstrate that an ombudsman can quickly and effectively resolve disputes, courts have been inconsistent in recognizing such a privilege. This failure to consistently recognize a privilege for communications with an ombudsman places practicing ombudsmen in a catch-22. Ombudsmen are left to decide between disregarding standards of practice they have sworn to follow, most notably that ombudsmen keep communications in confidence, on the one hand, or of violating a court …

A Comprehensive And Individual Perspective: A New Model For Assessing Missionary Needs In Order To Prevent Burnout, Kyra Schellenberger
A Comprehensive And Individual Perspective: A New Model For Assessing Missionary Needs In Order To Prevent Burnout, Kyra Schellenberger
Senior Honors Theses
In the last 20-30 years, missionary burnout has become a popular topic in the missionary care and support community. Although much research has been done on the issue, few studies have provided a comprehensive approach to the study and appropriate care of these missionaries. The goal of this research was to present a model that more accurately represented missionary struggles while incorporating past findings on missionary burnout. Four retired missionaries were interviewed about their experiences on the field, and their estimation of the model’s relevancy and helpfulness. Despite similar experiences amongst the participants, the responses further confirmed the individual nature …
