I 4 An I: Why Changing The Standard For Overcoming The Presumption Of Patent Validity Will Cause More Harm Than Good, John A. Morrissett Jan 2012

I 4 An I: Why Changing The Standard For Overcoming The Presumption Of Patent Validity Will Cause More Harm Than Good, John A. Morrissett

Richmond Journal of Law & Technology

Bad facts make bad law. The Supreme Court recently addressed the issue of what constitutes the appropriate standard of proof for invalidating an issued patent. The Patent Act provides a presumption of patent validity. Therefore, a party challenging a patent’s validity bears the burden of overcoming this presumption. However, the Patent Act is silent as to the standard of proof required to satisfy this burden. Despite the Act’s silence, the U.S. Court of Appeals for the Federal Circuit (“Federal Circuit”) has consistently held that the Patent Act’s presumption of validity can only be overcome by a showing of clear and …

Is The Middle East Moving Toward Islamism After The Arab Spring? The Case Study Of The Egyptian Commercial And Financial Laws, Radwa S. Elsaman, Ahmed Eldakak

Richmond Journal of Global Law & Business

The first parliamentary elections that followed the Egyptian Revolution witnessed an unprecedented success for Islamists as they secured an overwhelming majority of seats in parliament, suggesting that they may intend to amend many laws to bring parliament into compliance with Islamic Shari’a. This article addresses legal challenges that will face the new majority if they decide to Islamize laws and regulations related to business and finance. Particularly, the article discusses Islamic money theory, trade, banking systems, consumer protection, insurance, competition, and tax systems. The article analyzes Egyptian business and finance laws to examine whether they comply with Islamic law. It …

Motherhood And The Constitution: (Re)Thinking The Power Of Women To Facilitate Change, Angela Mae Kupenda Jan 2012

Motherhood And The Constitution: (Re)Thinking The Power Of Women To Facilitate Change, Angela Mae Kupenda

Richmond Journal of Law and the Public Interest

However, this essay suggests a different, or additional, approach. Rather than focusing on the many barriers to equality originating from others, this essay focuses on women's power to forge equality. Some of this power is cloaked, unharnessed, and underutilized. This essay is intended to challenge women to reconstitute the power of motherhood as a means of transforming not only families, but also law and society. This essay suggests the power of women to be mothering teachers and teaching mothers. Women have a choice, even an affirmative duty, to unharness their power to facilitate change and shape a status quo of …

Virginia's Expanded Nutrient Trading Law: Will It Help Restore The Chesapeake Bay While Allowing For Growth, Margaret L. Sanner Jan 2012

Virginia's Expanded Nutrient Trading Law: Will It Help Restore The Chesapeake Bay While Allowing For Growth, Margaret L. Sanner

Richmond Journal of Law and the Public Interest

On April 18, 2012, Virginia Governor Bob McDonnell boosted the Commonwealth's pollution-reduction toolbox with an expanded nutrient trading program when he signed H.B. 176/S.B. 77 into law.' Sparked by the issuance of the Chesapeake Bay Total Maximum Daily Load (the "Bay TMDL"), which updated pollution limits for the Chesapeake Bay and tributaries, and the Virginia Chesapeake Bay TMDL Phase I Watershed Implementation Plan (the "Phase I WIP"),2 the expanded nutrient trading program allows myriad new market participants to generate and sell certified "nutrient credits"3 to others to meet existing limits or to offset new pollution from expansion.4 If the program …

Reproductive Freedom And Virginia's 2012 General Assembly Session, Katherine Greenier Jan 2012

Reproductive Freedom And Virginia's 2012 General Assembly Session, Katherine Greenier

Richmond Journal of Law and the Public Interest

While the Governor approved H.B. 462, the mandatory ultrasound bill, H.B. 62, H.B. 1285, and S.B. 637 failed in the General Assembly.37 As introduced this 2012 session, H.B. 1 contained different bill language than the prior years it has been introduced. H.B. 62, H.B. 1285, and S.B. 637 were new bills, not seen in past years. An analysis and overview of these measures sheds light on the increasing attempts and the tactics used by legislators to undermine reproductive freedom.

Spirits, Vitality, And Creation In The Poetics Of Tommaso Campanella And John Donne, Anthony P. Russell Jan 2012

Spirits, Vitality, And Creation In The Poetics Of Tommaso Campanella And John Donne, Anthony P. Russell

English Faculty Publications

In discussions over the meaning of "genius" in the Renaissance, there is at the very least agreement that the term was associated with heightened powers of perception and creativity. Whether defined in terms of Neoplatonic notions of inspiration, Aristotelian/Galenic theories of the humors (and of melancholy in particular), or rhetorical theories of invention, ingegno is acknowledged as having denoted an unusual mental energy and flexibility which facilitated the creative process. It is the psychic mobility with which ingegno was consistently linked that I intend to emphasize here, and in particular its frequent identification with those volatile spirits that were centrally …

Recycling Electronic Wastes In Nigeria: Putting Environmental And Human Rights At Risk, Christine Terada

Northwestern Journal of Human Rights

Unregulated recycling of electronic waste (e-waste) has led to environmental degradation and human rights violationsmost often in developing countries in Asia and Africa where exporting is easy, labor laws are lax, and communities are poor. While the global market for new high-technology electronic products continues to grow, so does the amount of discarded products. This article explores the e-waste trade in Nigeria and discusses how developed countries, as well as the developing countries, must actively end the e-waste trade that exploits human workers and the environment.

On Madison, Muslims, And The New York City Police Department, Eric Lane Jan 2012

On Madison, Muslims, And The New York City Police Department, Eric Lane

Hofstra Law Review

In the years before and after the ratification of the United States Constitution, James Madison offered, unsuccessfully, the view that a formal bill of rights would not safeguard individual liberties in the face of excessive federal power or the failure of the system of checks and balances. An examination of New York City Police Department (“NYPD”) treatment of Muslim-Americans in the years following the September 11, 2001 (“9/11”) attacks reveals the wisdom of Madison’s prediction. Since 9/11, the NYPD has espoused the view that the only way to prevent future terrorist attacks is to closely monitor Muslim communities, in case …

The Rise Of Institutional Law Practice, Thomas D. Morgan Jan 2012

The Rise Of Institutional Law Practice, Thomas D. Morgan

Hofstra Law Review

For generations, the legal profession has assumed that only individual lawyers practice law. Ethical standards have been largely, if not exclusively, directed at individuals, and practice organizations have been regulated to prevent limiting individual lawyer professional judgment. The world in which lawyers now practice makes the individualized model obsolete. The complexity of modern law narrows the breadth of any individual lawyer's practice and makes law firms and other practice organizations inevitable. Firms, in turn, must maintain both ethical compliance and a high level of service quality that is inconsistent with lawyers behaving idiosyncratically. The article explores these developments and suggests …

Statistical And Predictive Modeling Of Automated Meter Reading System Outages, Prasad Prabhakar Shinde Jan 2012

Statistical And Predictive Modeling Of Automated Meter Reading System Outages, Prasad Prabhakar Shinde

Masters Theses

"An Automated Meter Reading (AMR) system is a metering technology that enables power utility companies to receive customers' energy usage data centrally over a communication network. The installed automated meters also provide a daily log of outage events for each customer. A utility company can greatly benefit by using this information for outage management and to improve reliability. However, outage data is frequently corrupted and the outage flags registered by the customers' meters do not necessarily reflect true outages. This thesis focuses on developing methods to analyze outage data and building a model to identify good data versus spurious indications. …

While the poor and the uninsured are at increased risk for tobacco use, up to two thirds of these patients express interest in near-term quitting. Nonetheless, tobacco counseling rates remain low in clinics serving these patients. As part of a larger tobacco intervention project in North Carolina free clinics, we gathered baseline data on patient characteristics in six randomly selected facilities affiliated with the North Carolina Association of Free Clinics. An exit interview was completed by 231 patients; 126 (54%) were tobacco users. Among all patients, 71% had been asked by a clinician about tobacco use in the past 3 …

The Small-School Friendship Dynamics Of Adolescent Depressive Symptoms, Jacob E. Cheadle, Bridget J. Goosby Jan 2012

The Small-School Friendship Dynamics Of Adolescent Depressive Symptoms, Jacob E. Cheadle, Bridget J. Goosby

Department of Sociology: Faculty Publications

Adolescence is a time when depressive symptoms and friendships both intensify. The authors ask whether friendships change in response to depressive symptoms, whether individual distress is influenced by friends’ distress, and whether these processes vary by gender. To answer these questions, the authors use longitudinal Simulation Investigation for Empirical Network Analysis models to study how changes in friendships and depressive symptoms intertwine with each other among all adolescents as well as boy-only and girl-only networks in seven smaller K-12 Add Health schools. The findings indicate that distressed youth are more likely to be socially excluded, though depressive symptoms are also …
