Switching To Prophylactic Injunctions, Tracy A. Thomas Jan 2012

Switching To Prophylactic Injunctions, Tracy A. Thomas

Akron Law Faculty Publications

This essay highlights the significance of John Golden’s work on patents to the field of Remedies more generally. In his important new article, Injunctions as More (or Less) Than ‘Off Switches’: Patent-Infringement Injunctions’ Scope (Texas Law Review), Golden proves my thesis: prophylactic injunctions are, and should be, common, normal types of equitable relief. His careful and detailed analysis of the type and frequency of injunctions issued in patent infringement cases exposes the myth that prophylaxis is illegitimate. Steeped in details of patent law, Golden’s work nevertheless contributes significantly to the broader transsubstantive questions of the metes and bounds of equitable …

Online Communities Driving Guideline Adoption In National Health Care Initiatives: An Examination Of The Door-To-Balloon Alliance Online Community, Alexander Nazem Jan 2012

Online Communities Driving Guideline Adoption In National Health Care Initiatives: An Examination Of The Door-To-Balloon Alliance Online Community, Alexander Nazem

Yale Medicine Thesis Digital Library

Research suggests that health care organizations struggle to implement evidence-based guidelines. In the wake of this observation, national quality improvement initiatives have increasingly sponsored online communities (OCs) in which organizations and professionals can seek guidance from their peers on the many challenges that accompany the shifts in practice caused by guideline adoption.

In this paper, I examine the effect of participation in an OC on hospitals' implementation of evidence-based guidelines. I hypothesize that hospitals whose staff utilize OCs are more successful at achieving guideline implementation, leading ultimately to greater clinical outcome improvement. This hypothesis was tested using data from the …

Accessibility To Public High Schools And School Performance In Metropolitan Baton Rouge, Louisiana 1990-2010, Shaun E. Williams Jan 2012

Accessibility To Public High Schools And School Performance In Metropolitan Baton Rouge, Louisiana 1990-2010, Shaun E. Williams

LSU Master's Theses

Education policies developed to initiate improvements to public school systems across Louisiana often result in a continuation or intensification of salient yet overlooked accessibility challenges. The public high school and its students have been particularly susceptible to these actions which have been sustained for decades within the state despite the increasing awareness of individual and community hardships connected to high school level inadequacies. Beyond isolated district studies or aggregate state reports, limited focus has been placed on student accessibility to public high schools or on responses of students and communities to processes which alter their access to area high schools. …

The Constitution Of Cádiz In Florida, M C. Mirow

Faculty Publications

The article explores the vibrant constitutional community that existed in St. Augustine and the province of East Florida in the final decade of Spanish control of the area. Based on relatively unexplored primary sources, it reveals a great deal of unknown information about the importance of the Constitution in Florida immediately before the territory was transferred to the United States. The article provides full description of the Constitution's promulgation in 1812 and a second promulgation of the Constitution in 1820 (something unknown in the general literature). It also addresses the construction of the St. Augustine monument to the Constitution erected …

Jockin' Jay-Z: A Praxis-Oriented Autoethnography Towards Possiblizing Change In Black Male Performativity, Bryant A. Payne

Research Papers

This paper strives to understand how my own conceptions (reflexivity) and embodiment (engagement) of a particular rapper, Jay-Z, contributes towards my subjectivity and art. My research answers, “What does my own experience and embodiment of Jay-Z tell me about my own black masculinity and art in the hip-hop generation?” To answer this question, I use what Toyosaki calls “praxis-oriented autoethnography.” I show what my relationship with Jay-Z tells me about my black masculinity, culture, and becoming within the hip-hop generation.

The Perception Of School Board Members And Their Role In Improving College And Career Readiness, Sara Elaine Farris Jan 2012

The Perception Of School Board Members And Their Role In Improving College And Career Readiness, Sara Elaine Farris

Online Theses and Dissertations

The national focus of graduating America's students ready for college and a career has heightened the importance of and the need for school board members to rethink their purpose on what and how they spend their time. Improving the college and career readiness of K-12 students will need school boards that are willing to receive the training to ensure that district leadership and schools are using the appropriate strategies that will impact college and career readiness.

School boards have always recognized student achievement as central to their role in governing public schools; however, the impact they actually have on promoting …

Constructing Evil: U.S. Media Discourse And The Iranian State Murder Of Neda Agha-Soltan, Justin Turner Jan 2012

Constructing Evil: U.S. Media Discourse And The Iranian State Murder Of Neda Agha-Soltan, Justin Turner

Online Theses and Dissertations

On June 20, 2009, one image became not only a symbol of unbridled state violence, but a rallying cry for a movement contesting the disputed election of hardline Iranian President Mahmoud Ahmadinejad. The particular image in question was of Neda Agha-Soltan, a 26 year old woman whose murder was recorded by cellphone camera during a political protest and subsequently posted to social media networks showing a graphic fist-hand account of the savagery of a state crime. Media discourse presented the idea that Neda's murder was committed by the Iranian government unafraid to implore repressive measures to control its population. The …

Do We Have A Debt Collection Crisis? Some Cautionary Tales Of Debt Collection In Indiana, Judith Fox Jan 2012

Do We Have A Debt Collection Crisis? Some Cautionary Tales Of Debt Collection In Indiana, Judith Fox

Journal Articles

The Federal Trade Commission, in 2009, raised issues about debt collection practices and called on jurisdictions to investigate local practices that may be abusive to consumers. This article is the beginning of a larger study of debt collection practices in Indiana. It examines debt collection cases filed in Indiana courts in a three month period of 2009 and 2011 While most research on this issues has been in small claims court systems, this article suggests that the same, if not greater, consumer abuses exist in other courts. The research shows a pattern of large, national debt collection firms moving away …

Illich (Via Cayley) On Prisons, Giovanna Shay Jan 2012

Illich (Via Cayley) On Prisons, Giovanna Shay

Faculty Scholarship

This Article considers whether, more than a dozen years after publication of Cayley’s book "The Expanding Prison: The Crisis in Crime and Punishment and the Search for Alternatives," Illich’s theories help us to make sense of America’s “prison-industrial complex.” The Author concludes that our current situation reflects in part the dynamics of his theory of “counterproductivity,” but that Illich did not take sufficient account of the salience of race and class in American criminal punishment.

Teaching The Four Gospels: Five Considerations, Gaye Strathearn Jan 2012

Teaching The Four Gospels: Five Considerations, Gaye Strathearn

Faculty Publications

Speaking of the Bible, the Prophet Joseph Smith declared, “He who reads it oftenest will like it best.”1 One of the challenges any teacher of the New Testament faces is being able to engender in his or her students a desire to read the Bible often enough that they will come to appreciate its rich doctrinal teachings and its powerful testimony of Jesus Christ. The four New Testament Gospels, in particular, are a treasure trove of information about his life, ministry, teachings, Atonement, and Resurrection, much of which is not available anywhere else in scripture. The purpose of this paper …

Rethinking Sustained Competitive Advantage From Human Capital, Benjamin Campbell, Russell Coff, David Kryscynski Jan 2012

Rethinking Sustained Competitive Advantage From Human Capital, Benjamin Campbell, Russell Coff, David Kryscynski

Faculty Publications

The strategy literature often emphasizes firm-specific human capital as a source of competitive advantage based on the assumption that it constrains employee mobility. This paper first identifies three boundary conditions that limit the applicability of this logic. It then offers a more comprehensive framework of human capital-based advantage that explores both demand- and supply-side mobility constraints. The critical insight is that these mobility constraints have more explanatory power than the firm-specificity of human capital.

Too Many Cooks Spoil The Broth: How The Tragedy Of The Anticommons Emerges In Organizations, Matthew W. Mccarter, Shirli Kopelman, Thomas A. Turk, Candace Ybarra

ESI Working Papers

In organizations, conflict often revolves around commons resources because they are critical for influence, performance, and organizational survival. Research on property rights, territoriality, and social dilemmas suggests that to reduce such conflict, organizations should facilitate the (psychological) privatization of commons resources. We complement these three literatures by drawing from the legal, organizational, and social psychology literatures to model how psychologically privatizing organizational commons resources – to prevent a tragedy of the commons (an overuse problem) – can lead to the emergence of equivalently problematic tragedy in organizations: the tragedy of the anticommons (an underuse problem). Our model contributes to these …

Interpreting The Culture Of Ubuntu: The Contribution Of A Representative Indigenous African Ethics To Global Bioethics, Leonard T. Chuwa Jan 2012

Interpreting The Culture Of Ubuntu: The Contribution Of A Representative Indigenous African Ethics To Global Bioethics, Leonard T. Chuwa

Electronic Theses and Dissertations

Ubuntu is a worldview and a way of life shared by most Africans south of Sahara. Basically Ubuntu underlines the often unrecognized role of relatedness and dependence of human individuality to other humans and the cosmos. The importance of relatedness to humanity is summarized by the two maxims of Ubuntu. The first is: a human being is human because of other human beings. The second maxim is an elaboration of the first. It goes; a human being is human because of the otherness of other human beings. John Mbiti combines those two maxims into, "I am because we are, and …

Academic Freedom, Intellectual Diversity, And The Place Of Politics In Geography, Reecia Orzeck Jan 2012

Academic Freedom, Intellectual Diversity, And The Place Of Politics In Geography, Reecia Orzeck

Faculty Publications - Geography, Geology, and the Environment

This paper examines the conservative critique of higher education in the USA. I argue, first, that the right's call for greater “intellectual diversity” in American higher education should be understood as an attack on the professional self-regulation and disciplinary autonomy that are central to academic freedom in this country. Second, I suggest that the right's politicization of politics in the academy brings to light the importance of our developing a vision of the university that accounts for rather than disavows the political nature of the work we do.

Securing Access To Lower-Cost Talent Globally: The Dynamics Of Active Embedding And Field Structuration, Stephan Manning, Joerg Sydow, Arnold Windeler

Management and Marketing Faculty Publication Series

This article examines how multinational corporations (MNCs) shape institutional conditions in emerging economies to secure access to high-skilled, yet lower-cost science and engineering talent. Based on two in-depth case studies of engineering offshoring projects of German automotive suppliers in Romania and China we analyze how MNCs engage in ‘active embedding’ by aligning local institutional conditions with global offshoring strategies and operational needs. MNCs thereby contribute to the structuration of field relations and practices of sourcing knowledge-intensive work from globally dispersed locations. Our findings stress the importance of institutional processes across geographic boundaries that regulate and get shaped by MNC activities.

Debt And Discipline: Neoliberal Political Economy And The Working Classes, Tayyab Mahmud Jan 2012

Debt And Discipline: Neoliberal Political Economy And The Working Classes, Tayyab Mahmud

Kentucky Law Journal

Over the last three decades, neoliberal restructuring of the economy created a symbiosis of debt and discipline. New legal regimes and strategic use of monetary policy displaced Keynesian welfare, facilitated financialization of the economy, broke the power of organized labor, and expanded debt to sustain aggregate demand. Public laws and policies created afield of possibility within which financial markets extended their reach and brought ever-increasing sections of the working classes and the marginalized within the ambit of the credit economy. Reordered public policies and new norms of personal responsibility demarcated the horizon within which the economically vulnerable pursued strategies of …
