Populism, Politics, And Procedure: The Saga Of Summary Judgment And The Rulemaking Process In California, Glenn S. Koppel
Populism, Politics, And Procedure: The Saga Of Summary Judgment And The Rulemaking Process In California, Glenn S. Koppel
Pepperdine Law Review
The California Constitution gives the primary power to promulgate rules of civil procedure for the state courts to the legislature and the people, leaving the state’s Judicial Council with residual, or secondary, authority to adopt rules of procedure and court administration “when and where the higher authority of the Legislature and the people has not been exercised.” This Article demonstrates how this legislative rulemaking process, referred to herein as “legislative primacy,” does not work because, as of the writing of this article in 1997, it produced ineffective statutory summary judgment law.
Towards A Unionized Professoriat: The Dilemma Of The Profession, Laszlo Hetenyi
Towards A Unionized Professoriat: The Dilemma Of The Profession, Laszlo Hetenyi
Education and Culture
No development since the Morrill Act is likely to produce more dramatic changes in higher education than the current trend towards collective bargaining in the professoriat. In 1966 only eleven institutions beyond the secondary level operated under faculty master contracts; by mid-1975 some 30 colleges and universities found themselves in this situation. Nor is the trend restricted to any one type of institution - only the elite private universities have, thus far, remained largely exempt. State and city systems (SUNY, CUNY, the New Jersey State Colleges), large public universities (Rutgers, Wayne State University), medium-size universities (Oakland University, Central Michigan University), …

Movement In Learning: Revitalizing The Classroom, Marcus Van
Movement In Learning: Revitalizing The Classroom, Marcus Van
MA TESOL Collection
Movement is a vital part of our every day lives, and it is also important for a healthy brain. The following paper examines the shift from movement based learning to a more restrictive rote format, which often has adverse effects on learning. This work discusses the ways in which teachers are under pressure to “teach to the test” instead of creating student-centered classrooms. Some of the side effects of a test-centered approach are low self-esteem (from not meeting strict academic requirements) and behavioral problems in students.
Adding more movement to lessons can provide variation and relief from the rote-only system. …

New Business Competition For A Different Generation Launches In Nevada, Nevada Institute For Renewable Energy Commercialization (Nirec)
Nevada Newsflash
On Nevada Day (October 26), a new competition was announced that is designed to stimulate business formation in the Silver State by offering the state’s largest-ever cash grand prize as an incentive.
The related tagline gets right to the point: “$100,000 cash. Your business idea. A room of investors. 5 minutes. One chance to prove you have what it takes.”
Entrepreneurial Inclination Among Business Students: A Malaysian Study, Yet-Mee Lim, Teck-Heang Lee, Boon-Liat Cheng
Entrepreneurial Inclination Among Business Students: A Malaysian Study, Yet-Mee Lim, Teck-Heang Lee, Boon-Liat Cheng
The South East Asian Journal of Management
Entrepreneurship has been the fundamental topics of discussion among the politicians, economists, and academics. Business creation is especially critical in developing countries to stimulate economic growth. The present study attempts to examine entrepreneurial inclination among students who are a potential source of entrepreneurs. The findings of the present research study indicate that majority of our business students are not entrepreneurial-inclined. They do not seem to possess strong entrepreneurial characteristics and entrepreneurial skills, and they are not keen in starting a new business. The roles of higher institutes of education and the government in promoting entrepreneurship are discussed.

Eccentric Dilation Balloons For Use With Endoscopes, James S. Barthel
Eccentric Dilation Balloons For Use With Endoscopes, James S. Barthel
USF Patents
The dilation balloon of the subject invention preferably comprises a balloon portion mounted about a shaft that, when inflated, produces a configuration comprising a tapered distal end and a proximal end or butt that is substantially flat (preferably truncated) and is adapted to generally conform with the outer contours of an endoscope through which it is introduced when the balloon is pulled back against the endoscope face. The close engagement of the subject balloon catheter and endoscope, when forming a balloon-scope train, enables the scope to more readily navigate strictures and tortuous body lumen, as well as allows the balloon …

A Hybrid Li-Air Battery With Buckypaper Air Cathode And Sulfuric Acid Electrolyte, Yunfeng Li, Kan Huang, Yangchuan Xing
Chemical and Biochemical Engineering Faculty Research & Creative Works
We demonstrate a type of carbon nanotube based buckypaper cathode in a hybrid electrolyte Li-air battery (HyLAB) that showed outstanding discharging performances. the HyLAB has sulfuric acid as the catholyte and a large active electrode area (10 cm 2). the active cathode layer was made from a buckypaper with 5 wt.% Pt supported on carbon nanotubes (Pt/CNTs) for oxygen reduction and evolution. a similar cathode was constructed with a catalyst of 5 wt.% Pt supported on carbon black (Pt/CB). It is demonstrated that sulfuric acid can achieve high discharging current densities while maintaining relatively high cell potentials. the cell with …

2010 School Of Computing Undergraduate Student Survey., Jane Ferris
Conference papers
This paper summaries the findings from a voluntary online survey distributed to all Computer Science undergraduates (part time and full time) of a large Irish third level institute in 2010. The objective of the survey was to investigate, identify and report the cohorts’ personal circumstances, computing interests, preferred learning methods and reasons for selecting Computer Science as a profession. The survey had a good response rate from most student groups. Identified from the two cohorts of part and full time Computer Science undergraduates are typical students, their personal computing interests, learning motivation and the methods of learning they indicate as …
Insights Into The Early Transgressive History Of Lake Bonneville From Stratigraphic Investigation Of Pilot Valley Playa, Ut/Nv, Usa, Kevin A. Rey
Theses and Dissertations
Multiple shallow sediment cores were obtained from Pilot Valley playa, a sub-basin located in the northwestern Bonneville basin. Analysis of stratigraphy, ostracodes, mineralogy, chemistry, total inorganic carbon (TIC), total organic carbon (TOC), and stable isotopes were performed to better place these sediments into proper context with respect to the Lake Bonneville cycle. Results showed Pilot Valley playa contains a nearly full sequence of Lake Bonneville deep-water marl in addition to sediments deposited before and after the Lake Bonneville cycle. Within the marl is a sequence of organic rich algal laminated marl correlated with the Stansbury oscillation. Four 14C ages ranging …

Network-Aware Scheduling Of Mapreduce Framework On Distributed Clusters Over High Speed Networks, Praveenkumar Kondikoppa, Chui Hui Chiu, Cheng Cui, Lin Xue, Seung Jong Park
Computer Science Faculty Research & Creative Works
Google's MapReduce has gained significant popularity as a platform for large scale distributed data processing. Hadoop [1] is an open-source implementation of MapReduce [11] framework, originally it was developed to operate over single cluster environment and could not be leveraged for distributed data processing across federated clusters. At multiple federated clusters connected with high-speed networks, computing resources are provisioned from any of the clusters from the federation. Placement of map tasks close to its data split is critical for performance of Hadoop. In this work, we add network awareness in Hadoop while scheduling the map tasks over federated clusters. We …
