Auctioning The Building Blocks Of Life: Carbon Auction, The Law, And Global Warming, Steven Ferrey Jan 2012

Auctioning The Building Blocks Of Life: Carbon Auction, The Law, And Global Warming, Steven Ferrey

Notre Dame Journal of Law, Ethics & Public Policy

The pursuit of money often clouds or derails even the best intentions. A recurring theme of great literature — the conflict between the pursuit of massive revenue and the best intentions, in this case to control climate change before a world crosses the tipping point of no return — is embodied in the United States' legal requirements on global warming. A legal challenge on the new concept of auctioning rights to emit CO2, a building block of life itself, may determine the future success of carbon control of global warming. Ten Eastern states, taking the lead with their new Regional …

Using Targeting Outcomes Of Programs As A Framework To Target Photographic Events In Nonformal Educational Programs, S. Kay Rockwell Jan 2012

Using Targeting Outcomes Of Programs As A Framework To Target Photographic Events In Nonformal Educational Programs, S. Kay Rockwell

Department of Agricultural Leadership, Education, and Communication: Faculty Publications

Targeting Outcomes of Programs (TOP) is a seven-step hierarchical programming model in which the program development and performance sides are mirror images of each other. It served as a framework to identify a simple method for targeting photographic events in nonformal education programs, indicating why, when, and how photographs would be useful to inform other evaluation strategies. In two case studies, photographs enhanced the formative story of a geoscience project being developed and tested, and contributed to the outcome narrative of a 10-year partnership project between two universities. In both cases, TOP proved to be an efficient and easy-to-use framework. …

Healers And Helpers, Unifying The People: A Qualitative Study Of Lakota Leadership, Kem M. Gambrell, Susan Fritz Jan 2012

Healers And Helpers, Unifying The People: A Qualitative Study Of Lakota Leadership, Kem M. Gambrell, Susan Fritz

Department of Agricultural Leadership, Education, and Communication: Faculty Publications

Previously, scholars have implied that leadership theory is “universal” enough and can be applied systematically regardless of cultural influences in subcultures. Leadership research has limited its scope of discernment to dominant society, implying that nonmainstream individuals will acquiesce and that cultural differences are inconsequential. Therefore, the intention of this study was to address the disparity between current leadership theories and a subgroup perspective. Specifically, this study explored leadership from a Lakota Sioux perspective. In this qualitative grounded theory study, six major and five minor themes surfaced: Traditional Values and Behaviors, Putting Others First, Lakota Leadership Qualities (Men, Women, and Fallen …

The Property Strategy, Thomas W. Merrill Jan 2012

The Property Strategy, Thomas W. Merrill

Faculty Scholarship

My objective in this Article is to offer a description of property as an institution for organizing the use of resources in society. There are several strategies for deciding how valued things will be used, and by whom. “Might makes right” is one approach: we can let a strongman decide these questions. Bureaucratic governance is another: we can create a hierarchical organization and adopt rules and procedures for allocating resources. Group consensus is a third: questions about resource use can be resolved through meetings and discussion among those most closely involved. The claim advanced here is that property is a …

Systems Pluralism And Institutional Pluralism In Constitutional Law: National, Supranational, And Global Governance, Daniel Halberstam Jan 2012

Systems Pluralism And Institutional Pluralism In Constitutional Law: National, Supranational, And Global Governance, Daniel Halberstam

Book Chapters

Constitutions are often seen as creating a closed and hierarchically organized system of law. Constitutional systems are taken as closed to claims of legality from outside the system and as setting forth a hierarchy of norms and institutions that governs within the system. This consolidation of authority, in turn, is predominantly associated with a radical political (re)founding of the state. Politics are framed by law and law is grounded in an act of collective politics on the part of an existing or aspiring community defined by shared histories, norms, processes, and politics.

Aristocratic Dignity?, Donald J. Herzog Jan 2012

Aristocratic Dignity?, Donald J. Herzog

Book Chapters

On the academic lectern, too, we've leveled up. We're interested in good arguments, no matter how base or despicable other cultures might have imagined the speaker. 1£ there still are a lot of white guys in universities, no one takes seriously the claim that universities are theirs by right.

But it would be mistaken to imagine the lectern (or for that matter the public sphere) as a place for nothing but the bloodless give-and-take of reasons. It also is a site for jousting, for thrusts and parries, cutting objections, and even sneers-for the nerd's version of a duel. So I …

Visualizing And Modeling Interior Spaces Of Dangerous Structures Using Lidar, Norbert H. Maerz, T. K. Assebaum, Dustin J. Williams, K. Shea, Yongjian Xi, Xiaoling Li, Ye Duan

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

LIght Detection and Ranging (LIDAR) scanning can be used to safely and remotely provide intelligence on the interior of dangerous structures for use by first responders that need to enter these structures. By scanning into structures through windows and other openings or moving the LIDAR scanning into the structure, in both cases carried by a remote controlled robotic crawler, the presence of dangerous items or personnel can be confi rmed or denied. Entry and egress pathways can be determined in advance, and potential hiding/ambush locations identifi ed. This paper describes an integrated system of a robotic crawler and LIDAR scanner. …

The Health And Housing Specialist: An Emerging Job Classification To Support Aging In Place In Subsidized Housing, Paula C. Carder, Jenny Weinstein, Jacklyn Nicole Kohon Jan 2012

The Health And Housing Specialist: An Emerging Job Classification To Support Aging In Place In Subsidized Housing, Paula C. Carder, Jenny Weinstein, Jacklyn Nicole Kohon

Institute on Aging Publications

As the U.S. population ages, the availability of workers with a basic understanding of aging and health-related services has not kept pace. This is true in traditional health care organizations such as hospitals and primary care clinics as well as in long-term care settings and senior housing, including subsidized housing, the focus of this report. Nearly 1.8 million older persons receive some form of publicly-subsidized rental assistance. Some subsidized housing providers, including those that operate buildings designated for older persons, are developing new systems of service delivery that would either coordinate or provide health screenings, physical activity programs, nutrition programs, …

Mining The Past: A Celebration Of History And Culture In Minnesota's Iron Range, Michael Aasen Jan 2012

Mining The Past: A Celebration Of History And Culture In Minnesota's Iron Range, Michael Aasen

Landscape Architecture Theses

This project examines how the development of brownfields can benefit local communities and ecologies. Reclamation-based design principles are used to propose remediation of contaminated soils and the adaptive reuse of existing structures and landscapes. The focus lies in the creation of a space that exemplifies history and culture while enriching the lives of local residents and attracting future visitors. By strengthening the bond between the past and present, a stronger sense of identity will be formed along with cultural pride.
