Subsidiarity In The Tradition Of Catholic Social Doctrine, Patrick Mckinley Brennan Nov 2012

Subsidiarity In The Tradition Of Catholic Social Doctrine, Patrick Mckinley Brennan

Working Paper Series

This chapter is an invited contribution to the first English-language comparative study of subsidiarity, M. Evans and A. Zimmerman (eds.), Subsidiarity in Comparative Perspective (forthcoming Springer, 2013). The concept of subsidiarity does work in many and varied legal contexts today, but the concept originated in Catholic social doctrine. The Catholic understanding of subsidiarity (or subsidiary function) is the subject of this chapter. Subsidiarity is often described as a norm calling for the devolution of power or for performing social functions at the lowest possible level. In Catholic social doctrine, it is neither. Subsidiarity is the fixed and immovable ontological principle …

Local History Journals And Their Contributions: Where Would We Be Without Them?, Sandra Roff Nov 2012

Local History Journals And Their Contributions: Where Would We Be Without Them?, Sandra Roff

Publications and Research

Since we are in the era of digitization much information is accessible easily, which makes it difficult for researchers to imagine locating manuscripts, ephemera and other local history finds without using the internet. We are only a few decades removed from when this was the norm, and the historian or genealogist searched for the forgotten document on the shelves of a library or in the pages of a local history journal. These local history journals appeared all over the country and struggled for survival. The contributions made by these journals are substantial, with hidden gems of information awaiting discovery by …

Addressing Reading Underachievement In African American Boys Through A Multi-Contextual Approach, Terry Husband Nov 2012

Addressing Reading Underachievement In African American Boys Through A Multi-Contextual Approach, Terry Husband

Reading Horizons: A Journal of Literacy and Language Arts

Much has been written about reading disparities between African American males and other student groups. Interestingly, the majority of this scholarship focuses on African American males at pre-adolescent states of development and beyond. To date, relatively little has been documented relative to improving reading outcomes in African American males in early childhood and elementary contexts. The purpose of this article is to present a multi-contextual framework for improving reading outcomes in African American boys in P-5 contexts specifically. I conclude with a discussion of three important commitments that teachers and administrators must be willing to embrace in order for these …

Exploring Bilingual Books With Five Chinese First Graders: Children’S Responses And Biliteracy Development, Ran Hu, Xiaoning Chen, Xiuping Li Nov 2012

Exploring Bilingual Books With Five Chinese First Graders: Children’S Responses And Biliteracy Development, Ran Hu, Xiaoning Chen, Xiuping Li

Reading Horizons: A Journal of Literacy and Language Arts

This qualitative case study examines how five Chinese first graders responded to bilingual English/Chinese picture books and how bilingual books used during an eight-week study session impacted their bilingual and biliteracy development. Reader response and socio-cultural theories were the theoretical perspectives that underpin this study. Four bilingual picture books were selected for the five participating Chinese children to read during an eight-week period. The researchers specifically sought answers to two questions: (1) How do Chinese children respond to the bilingual books? (2) What impact do the bilingual book study sessions have on children’s bilingual and biliteracy development? The findings suggested …

Signed Language Academic Papers, Risa Shaw, Mary Thumann Nov 2012

Signed Language Academic Papers, Risa Shaw, Mary Thumann

International Journal of Interpreter Education

Signed language academic papers are a new possibility that recent developments in technologies for recording, editing, presenting, and reviewing visual materials have made practical in an academic setting. This article presents guidelines the authors developed for papers specifically in American Sign Language (ASL)interpreting courses; however, signed language academic papers can be effectively used in signed language classes of all levels in any country.

The authors offer rationales for assigning signed language academic papers to bilingual students and suggest style and practical guidelines analogous to guidelines of the American Psychological Association (APA). Recommended guidelines address practical and academic considerations. The recommendations …

An Economic Analysis Of Civil Versus Common Law Property, Yun-Chien Chang, Henry E. Smith

Notre Dame Law Review

The article presents an analysis of civil law property and common law property. It mentions that the civil law system emphasizes on ownership and affects leaseholds whereas common law emphasizes on the estate system. The article identifies fault lines and offers an explanation of transaction cost for common and civil law. It highlights the delineating property rights of civil and common property laws and states that the civil law starts with ownership and common laws starts with feudalism.

Overruling Crawford V. Washington: Why And How, David Crump

Notre Dame Law Review

The article discusses a court case in which decision of Roberts Court on Confrontation Clause was overruled by the Crawford Court. It states that Confrontation Clause provides the right of vigorous cross-examination, right to face-to-face presentation of witnesses and the right to severance to the criminal defendant. It highlights several Payne-Parenthood factors supporting the overruling of Crawford including fewer disturbances in reliance interests, dissenting justices and judicial fudging.

The Metalinguistic Protocol: Making Disciplinary Literacies Visible In Secondary Teaching And Learning, Kerry G. Mcarthur Nov 2012

The Metalinguistic Protocol: Making Disciplinary Literacies Visible In Secondary Teaching And Learning, Kerry G. Mcarthur

Reading Horizons: A Journal of Literacy and Language Arts

Concerns about adolescent literacy continue to be highlighted in regards to the challenges of reading and learning from academic text. Recent efforts to address these concerns have led to an examination of the disciplines and their specialized ways of thinking and using language. In this article I discusses a metalinguistic protocol in a think-aloud process as a framework to use in university content area literacy courses with secondary preservice teachers to examine the language and thinking as it is used in the disciplines of knowledge and to address the implications of disciplinary literacies for teaching and learning in secondary schooling.

Picturing Takings, Lee Anne Fennell Nov 2012

Picturing Takings, Lee Anne Fennell

Articles

Takings doctrine, we are constantly reminded, is unclear to the point of incoherence. The task offinding our way through it has become more difficult, and yet more interesting, with the Supreme Court's recent, inconclusive foray into the arena of judicial takings in Stop the Beach Renourishment. Following guideposts in Kelo, Lingle, and earlier cases, this essay uses a series of simple diagrams to examine how elements of takings jurisprudence fit together with each other and with other limits on governmental action. Visualizing takings in this manner yields surprising lessons for judicial takings and for takings law more generally.

Dynamic Poverty Decomposition Analysis: An Application To The Philippines, Tomoki Fujii Nov 2012

Dynamic Poverty Decomposition Analysis: An Application To The Philippines, Tomoki Fujii

Research Collection School Of Economics

In this paper, we propose a new method of poverty decomposition. Our method remedies the shortcomings of existing methods and has some desirable properties such as time-reversion consistency and subperiod additivity. It integrates the existing methods of growth-redistribution decomposition and sector-based decomposition, because it allows us to decompose poverty change into growth and redistribution components for each group (e.g. regions or sectors) in the economy. We extend our method to have six components and provide an empirical application to the Philippines for the period 1985-2009.

Algorithmic Trading And Changes In Firms Equity Capital, Ekkehart Boehmer, Kingsley Fong, Julie Wu Nov 2012

Algorithmic Trading And Changes In Firms Equity Capital, Ekkehart Boehmer, Kingsley Fong, Julie Wu

Research Collection Lee Kong Chian School Of Business

We use a large sample from 2001 to 2009 that incorporates intraday transactions data from 39 exchanges and an average of 12,800 different common stocks to assess the effect of algorithmic trading (AT) on firms’ capital raising activities. Greater AT reduces net equity issues over the next year, but this is only partly driven by AT’s effect on proceeds from new securities issues. Our findings suggest that the main driver of this relationship is AT’s effect on share repurchases.

Grades Matter In Performance: Morningstar Stewardship Grades And Mutual Fund Performance, Aurobindo Ghosh, Jeremy Goh, Wee Seng Ng Nov 2012

Grades Matter In Performance: Morningstar Stewardship Grades And Mutual Fund Performance, Aurobindo Ghosh, Jeremy Goh, Wee Seng Ng

Research Collection Lee Kong Chian School Of Business

Investors in mutual funds have the unenviable task of disentangling two mutually confounding effects. First, to fathom the future performance of the funds based on current evidence, and second, to assess how well the mutual fund managers will steward their investments under uncertain economic conditions. We corroborate the dependence of weighted risk-adjusted returns (viz. the Star Ratings) on corporate governance score (viz. Stewardship Grade) accounting for fund specific characteristics. We document Stewardship scores Granger cause Star Rating. We propose an objective data-driven corporate governance score based on the components of Stewardship Grade. Both the static and dynamic fixed-effects models show …

Rips, Currents And Snags: Investigating The Delivery Of Educational Goals For Young Australians In The Region Of Gippsland, Victoria. , Tj Lynch

Plymouth Institute of Education

Monash University (Gippsland campus) is situated in Churchill, Latrobe Valley, located in central Gippsland, eastern Victoria. A large percentage of the Gippsland region comprises of a socio-economically disadvantaged population (Figure 1). In Semester One, 2011 as part of the Bachelor of Primary Education course at Monash, it was decided that a pathway be created to achieve these national ideals and goals through the implementation of swimming and water safety education in Primary schools. Swimming and water safety education represents the specific curriculum to be implemented in rural schools, it is representative of any aspect of the curriculum to be delivered. …

Subgame Perfect Implementation Under Information Perturbations, Takashi Kunimoto, Drew Fudenberg, Takashi Kunimoto, Oliver Tercieux Nov 2012

Subgame Perfect Implementation Under Information Perturbations, Takashi Kunimoto, Drew Fudenberg, Takashi Kunimoto, Oliver Tercieux

Research Collection School Of Economics

We consider the robustness of extensive form mechanisms to deviations from common knowledge about the state of nature, which we refer to as information perturbations. First, we show that even under arbitrarily small information perturbations the Moore-Repullo mechanism does not yield (even approximately) truthful revelation and that in addition the mechanism has sequential equilibria with undesirable outcomes. More generally, we prove that any extensive form mechanism is fragile in the sense that if a non-Maskin monotonic social objective can be implemented with this mechanism, then there are arbitrarily small information perturbations under which an undesirable sequential equilibrium also exists. Finally, …

The Labor Supply And Welfare Effects Of Early Access To Medicare Through Social Security Disability Insurance, Kim Nov 2012

The Labor Supply And Welfare Effects Of Early Access To Medicare Through Social Security Disability Insurance, Kim

Research Collection School Of Economics

Social Security Disability Insurance (SSDI) beneficiaries receive a cash benefit and become eligible for health insurance from Medicare two years after their enrollment. Disabled workers who leave the labor force typically lose health insurance from their employers, and they face significant medical expenditure risk as a result of their disability. Therefore, access to Medicare makes SSDI an especially attractive alternative to remaining employed for workers with disabilities. My research is the first to analyze the importance of medical expenditure risk and Medicare in analysis of SSDI, and it addresses the following questions: (1) How does access to Medicare via SSDI …

Schooling, Political Participation, And The Economy, Filipe R. Campante, Davin Chor Nov 2012

Schooling, Political Participation, And The Economy, Filipe R. Campante, Davin Chor

Research Collection School Of Economics

We investigate how the link between individual schooling and political participation is a ected by country characteristics. Using individual survey data, we nd that political participation is more responsive to schooling in land-abundant countries, and less responsive in human capital-abundant countries, even while controlling for country political institutions and cultural attitudes. We propose an explanation that centers on how individuals allocate the use of their human capital. A relative abundance of land (used primarily in the least skill-intensive sector) or a scarcity of aggregate hu- man capital increases both the level of political participation and its responsiveness to schooling, by …
