The Past And Its Impact On The Present: The Development Of Gender And Ethnic Identity In Kingston's "Woman Warrior", Mukherjee's "Jasmine" And Kincaid's "Lucy", Rachel M. Puckett Dec 2012

The Past And Its Impact On The Present: The Development Of Gender And Ethnic Identity In Kingston's "Woman Warrior", Mukherjee's "Jasmine" And Kincaid's "Lucy", Rachel M. Puckett

Theses and Dissertations - UTB/UTPA

This thesis analyzes three immigrant narratives and exemplifies the impact that the past has on the main character’s cultural and gender development. During the course of each narrative reflections of the past intrude on the present immigrant experience and remind the characters of who they are and where they came from. Kingston’s Woman Warrior revolves around her cultural past and the psychological impression that her mother’s immigrant experience has left on her. In Jasmine Mukherjee’s main character embarks on a self-reflecting journey that highlights the past that influences her ever changing identity. Finally, in Lucy a young woman is determined …

Functionalism’S Military Necessity Problem: Extraterritorial Habeas Corpus, Justice Kennedy, Boumediene V. Bush, And Al Maqaleh V. Gates, Richard Nicholson Dec 2012

Functionalism’S Military Necessity Problem: Extraterritorial Habeas Corpus, Justice Kennedy, Boumediene V. Bush, And Al Maqaleh V. Gates, Richard Nicholson

Fordham Law Review

The U.S. Supreme Court has struggled over the last 150 years to definitively answer the question of whether the U.S. Constitution applies beyond the borders of the territorial United States. Because the Constitution is silent on the issue, the burden has fallen on the judiciary to establish the contours of the doctrine. At times, the Court has espoused formulistic theories limiting constitutional application to territorial sovereignty, while at others it has looked to more objective, practical solutions that reach beyond the borders.

In 2008, the Supreme Court held in Boumediene v. Bush that the application of the Suspension Clause of …

Determining Diversity Jurisdiction Of National Banks After Wachovia Bank V. Schmidt, Michael Podolsky Dec 2012

Determining Diversity Jurisdiction Of National Banks After Wachovia Bank V. Schmidt, Michael Podolsky

Fordham Law Review

Prior to the U.S. Supreme Court’s decision in Wachovia Bank v. Schmidt, some courts held, for diversity jurisdiction purposes, that national banks were citizens of each and every state in which they had a branch. In Schmidt, the Supreme Court made it clear that this approach was incorrect, but failed to provide an alternative one. Not surprisingly, in the wake of that decision another court split developed. While some courts have found that national banks are citizens only of the state listed on their charters as their main office, others have found that national banks are also citizens …

Unearthing The Public Interest: Recognizing Intrastate Economic Protectionism As A Legitimate State Interest, Katharine M. Rudish Dec 2012

Unearthing The Public Interest: Recognizing Intrastate Economic Protectionism As A Legitimate State Interest, Katharine M. Rudish

Fordham Law Review

In Oklahoma, a person must complete sixty-credit hours of undergraduate training and embalm twenty-five bodies before being legally licensed to sell caskets in the state. In Louisiana, in order to sell caskets, one must operate a fully licensed funeral establishment, defined as a place dedicated to preparing bodies for burial. In recent years, these states and others have faced legal challenges to casket sale restrictions by individuals who wish to sell caskets directly to the public, yet who are unable to do so as they are not licensed funeral directors. Courts have grappled with whether these state regulations, which in …

Natural Law, Slavery, And The Right To Privacy Tort, Anita L. Allen Dec 2012

Natural Law, Slavery, And The Right To Privacy Tort, Anita L. Allen

Fordham Law Review

In 1905 the Supreme Court of Georgia became the first state high court to recognize a freestanding “right to privacy” tort in the common law. The landmark case was Pavesich v. New England Life Insurance Co. Must it be a cause for deep jurisprudential concern that the common law right to privacy in wide currency today originated in Pavesich’s explicit judicial interpretation of the requirements of natural law? Must it be an additional worry that the court which originated the common law privacy right asserted that a free white man whose photograph is published without his consent in a …

This paper studies the importance of visualization for discerning and interpreting patterns of data and its application for solving real problems, such as anomaly detection and data management. There are various ways to realize visualization to cater to the needs of numerous real life applications. Depending on needs, a combination of some of these ways may be required for presenting an effective visualization. The authors present visualization schemes for anomaly detection/condition monitoring and data management by leveraging network techniques and combining them with modern techniques such as sensor, database, mobile communication, GPS and GIS techniques. Two case studies are presented …

Cross-Lingual Identification Of Ambiguous Discourse Connectives For Resource-Poor Language, Lanjun Zhou, Wei Gao, Binyang Li, Zhongyu Wei, Kam-Fai Wong Dec 2012

Cross-Lingual Identification Of Ambiguous Discourse Connectives For Resource-Poor Language, Lanjun Zhou, Wei Gao, Binyang Li, Zhongyu Wei, Kam-Fai Wong

Research Collection School Of Computing and Information Systems

The lack of annotated corpora brings limitations in research of discourse classification for many languages. In this paper, we present the first effort towards recognizing ambiguities of discourse connectives, which is fundamental to discourse classification for resource-poor language such as Chinese. A language independent framework is proposed utilizing bilingual dictionaries, Penn Discourse Treebank and parallel data between English and Chinese. We start from translating the English connectives to Chinese using a bi-lingual dictionary. Then, the ambiguities in terms of senses a connective may signal are estimated based on the ambiguities of English connectives and word alignment information. Finally, the ambiguity …

An Extensible Framework For Selecting Incremental Innovations, Arcot Desai Narasimhalu Dec 2012

An Extensible Framework For Selecting Incremental Innovations, Arcot Desai Narasimhalu

Research Collection School Of Computing and Information Systems

There are several innovation methodologies reported in the literature starting from simple concepts such as technology push and market pull all the way to Disruptive innovation. Almost all these methods do not provide for customizability and extensibility. The method described in this paper is called Quick and Dirty Innovation Method or QaDIM in short to represent the fact that the method can be used rather easily to identify incremental innovation opportunities. The paper will first describe the basic concept, and then proceed to give a sample framework before proceeding to describe the extensibility. The method allows firms and individuals to …

Use Of Rss Feeds To Push The Online Content To Users, Dan Ma Dec 2012

Use Of Rss Feeds To Push The Online Content To Users, Dan Ma

Research Collection School Of Computing and Information Systems

Many websites use Really Simple Syndication (RSS) feeds to actively push their online content to users rather than waiting for users to pull the content passively. In this paper, I construct a theoretical game model to study the profitability of an RSS-PUSH delivery mechanism. The model assumes a general profit structure for websites and heterogeneous users. To access valuable online content, users incur a variety of costs. They choose either to visit the website in the conventional way (the PULL model) or, if it is supported by the website, to use RSS (the PUSH model). Interestingly, I show that although …

Ibinhunt: Binary Hunting With Inter-Procedural Control Flow, Jiang Ming, Meng Pan, Debin Gao Dec 2012

Ibinhunt: Binary Hunting With Inter-Procedural Control Flow, Jiang Ming, Meng Pan, Debin Gao

Research Collection School Of Computing and Information Systems

Techniques have been proposed to find the semantic differences between two binary programs when the source code is not available. Analyzing control flow, and in particular, intra-procedural control flow, has become an attractive technique in the latest binary diffing tools since it is more resistant to syntactic, but non-semantic, differences. However, this makes such techniques vulnerable to simple function obfuscation techniques (e.g., function inlining) attackers any malware writers could use. In this paper, we first show function obfuscation as an attack to such binary diffing techniques, and then propose iBinHunt which uses deep taint and automatic input generation to find …

Diffusion Of Software Features: An Exploratory Study, Ferdian Thung, David Lo, Lingxiao Jiang Dec 2012

Diffusion Of Software Features: An Exploratory Study, Ferdian Thung, David Lo, Lingxiao Jiang

Research Collection School Of Computing and Information Systems

New features are frequently proposed in many software libraries. These features include new methods, classes, packages, etc. These features are utilized in many open source and commercial software systems. Some of these features are adopted very quickly, while others take a long time to be adopted. Each feature takes much resource to develop, test, and document. Library developers and managers need to decide what feature to prioritize and what to develop next. As a first step to aid these stakeholders, we perform an exploratory study on the diffusion or rate of adoption of features in Java Development Kit (JDK) library. …

Lagrangian Relaxation For Large-Scale Multi-Agent Planning, Geoffrey J. Gordon, Pradeep Varakantham, William Yeoh, Hoong Chuin Lau, Ajay S. Aravamudhan, Shih-Fen Cheng Dec 2012

Lagrangian Relaxation For Large-Scale Multi-Agent Planning, Geoffrey J. Gordon, Pradeep Varakantham, William Yeoh, Hoong Chuin Lau, Ajay S. Aravamudhan, Shih-Fen Cheng

Research Collection School Of Computing and Information Systems

Multi-agent planning is a well-studied problem with various applications including disaster rescue, urban transportation and logistics, both for autonomous agents and for decision support to humans. Due to computational constraints, existing research typically focuses on one of two scenarios: unstructured domains with many agents where we are content with heuristic solutions, or domains with small numbers of agents or special structure where we can provide provably near-optimal solutions. By contrast, in this paper, we focus on providing provably near-optimal solutions for domains with large numbers of agents, by exploiting a common domain-general property: if individual agents each have limited influence …

Eliciting Usable Gestures For Multi-Display Environments, Teddy Seyed, Chris Burns, Mario Costa Sousa, Frank Maurer, Anthony Tang Dec 2012

Eliciting Usable Gestures For Multi-Display Environments, Teddy Seyed, Chris Burns, Mario Costa Sousa, Frank Maurer, Anthony Tang

Research Collection School Of Computing and Information Systems

Multi-display environments (MDEs) have advanced rapidly in recent years, incorporating multi-touch tabletops, tablets, wall displays and even position tracking systems. Designers have proposed a variety of interesting gestures for use in an MDE, some of which involve a user moving their hands, arms, body or even a device itself. These gestures are often used as part of interactions to move data between the various components of an MDE, which is a longstanding research problem. But designers, not users, have created most of these gestures and concerns over implementation issues such as recognition may have influenced their design. We performed a …

Agent-Based Virtual Humans In Co-Space: An Evaluative Study, Yilin Kang, Ah-Hwee Tan, Fiona Fui-Hoon Nah Dec 2012

Agent-Based Virtual Humans In Co-Space: An Evaluative Study, Yilin Kang, Ah-Hwee Tan, Fiona Fui-Hoon Nah

Research Collection School Of Computing and Information Systems

Co-Space refers to interactive virtual environment modelled after the real world in terms of look-and-feel, functionalities and services. We have developed a 3D virtual world named Nanyang Technological University (NTU) CoSpace populated with virtual human characters. Three key requirements of realistic virtual humans in the virtual world have been identified, namely (1) autonomy: agents can function on their own; (2) interactivity: agents can interact naturally with players; and (3) personality: agents can exhibit human traits and characteristics. Working towards these challenges, we propose a brain-inspired agent architecture that integrates goal-directed autonomy, natural language interaction and human-like personality. We conducted an …

Critical Success Factors Of Location-Based Services, Natalie J. P. Chin, Keng Siau

Research Collection School Of Computing and Information Systems

Location-based services evolved with the advancement in mobile technology and wireless technology. Researchers have studied location-based services in terms of privacy, trust, and user acceptance. Statistics suggest the percentage of location-based services users is still relatively low. Therefore, the main objective of this study was to gain a comprehensive and holistic understanding of the critical success factors of location-based services. The electronic brainstorming approach was used to gather the opinions of an expert group of practitioners, researchers, and users on the critical success factors of location-based services. Through grouping similar factors together based on past literature, 15 categories of critical …

South Africa’S First Five Years On The United Nations Human Rights Council, Eduard Christiaan Jordaan Dec 2012

South Africa’S First Five Years On The United Nations Human Rights Council, Eduard Christiaan Jordaan

Research Collection School of Social Sciences

In June 2011, the United Nations Human Rights Council (HRC) adopted its first resolution on sexual orientation and human rights. Resolution 17/19 expressed grave concern at violence and discrimination committed against people because of their sexual orientation and tasked the UN High Commissioner for Human Rights to report on such abuses. In a body marred by regional bloc voting, Resolution 17/19 passed with support from states in all five of the official regions of the UN. South Africa was widely praised for leading such a progressive resolution through the Council, especially in the face of considerable pressure from African and …

Simultaneous Induction Of Nkg2d And Nkg2d Ligand For Promoting Immune Surveillance By Il-12 Plus Doxorubicin Treatment, Jiemiao Hu Dec 2012

Simultaneous Induction Of Nkg2d And Nkg2d Ligand For Promoting Immune Surveillance By Il-12 Plus Doxorubicin Treatment, Jiemiao Hu

Dissertations and Theses (Open Access)

NKG2D (natural killer group 2, member D) and its ligands interaction in tumor microenvironment directs tumor infiltrating immune cells to recognize tumor cells, stimulate cytotoxic effector immune cells, and therefore eradicate tumor cells. IL-12, a cytokine produced by antigen presenting cells, has remarkable antitumor effect by activating innate and adaptive immunity. Doxorubicin, a commonly used chemotherapeutic agent also boosts the host antitumor immune response to cause tumor cell death. Our previous publication suggests that IL-12 plus doxorubicin enhances NKG2D function-dependent inhibition of tumor progression and promotes CD8+T cells infiltrating into tumors. The purpose of this study is to …

Neural Responses To Food Pictures And Their Association With Dietary Intake, Edward Christenson

Theses and Dissertations

BACKGROUND: Food-related visual cues may affect eating behavior and energy intake. The purpose of this study was to determine the neural response to pictures of food and whether or not the neural responses were associated with energy intake. METHODS: Using a cross-sectional design, 60 adults participated in this study. Each participant reported to the laboratory in a fasted state, were fitted with a 128-electrode electroencephalogram (EEG) net, and were shown pictures grouped into three categories: high-calorie foods, low-calorie foods, and distractor pictures. These pictures were shown in random order. Furthermore, participants were shown these pictures in one passive condition and …

The Incredible Shrinking Confrontation Clause, Jeffrey Bellin Dec 2012

The Incredible Shrinking Confrontation Clause, Jeffrey Bellin

Vanderbilt Law School Faculty Publications

Sharp turns in the Supreme Court's recent Confrontation Clause jurisprudence have left scholars reeling from conflicting emotions: exhilaration, despair, denial, and soon, perhaps, cynical acceptance. While most commentators celebrated the demise of the incoherent Ohio v. Roberts framework, their excitement largely faded as the Court's decisions in Davis v. Washington and Bryant v. Michigan revealed nascent flaws in the evolving doctrine and sharply curtailed the newly revitalized confrontation right.

Recent scholarship strives to reanimate the jurisprudence by expanding the doctrinal definition of "testimonial" statements - the sole form of evidence Associate Professor, William & Mary Law School. I would like …

Stranger Of The House: The Evolution Of Sensation's New Man, Laura Mogel Dec 2012

Stranger Of The House: The Evolution Of Sensation's New Man, Laura Mogel

All Theses

While Elaine Showalter argues that the 'crisis in masculinity' occurs with the emergence of the New Woman and the fin de sicle, this thesis suggests that men, specifically here wealthy men, were in crisis long before these phenomena due to their dissolved understanding of their place and position amidst immense changes in Victorian England. An interrogation of 1860s sensation fiction, and specifically Wilkie Collins's Basil and Mary Elizabeth Braddon's Lady Audley's Secret, suggests that men grappled with their position and masculinity prior to the fin de sicle as evidenced by the heroine-prescribed social deaths of Basil and George Talboys. After …

To Kill A Vampire?: Through The Hearth, Charlsie Lamos Dec 2012

To Kill A Vampire?: Through The Hearth, Charlsie Lamos

All Theses

Long before Dracula was terrorizing English families, Emily Brontë's Heathcliff captivated Victorian audiences. Critics such as James Twitchell propose that Emily Brontë carefully creates the possibility of Heathcliff as a metaphorical vampire, using his unknown parentage and his physical descriptions throughout the novel as evidence for this claim. Indeed, my thesis examines how Heathcliff exhibits characteristics of the vampire in his decimation of the English families in the novel by consuming the Earnshaw's and Linton's properties, monies, and women. In Brontë's and Bram Stoker's novels, the vampires prey upon humanity, consuming property, lives, and bloodlines. However, although vampires are often …

Measuring Learning Through Cross Sectional Testing, Steve Lovett, Jennie Johnson Dec 2012

Measuring Learning Through Cross Sectional Testing, Steve Lovett, Jennie Johnson

Management Faculty Publications

The measurement of student learning is becoming increasingly important in U.S. higher education. One way to measure learning is through longitudinal testing, but this becomes especially difficult when applied to cumulative learning within programs in situations of low persistence. In particular, many Hispanic Serving Institutions (HSIs) find themselves in such situations. Cross sectional testing is a pragmatic alternative, so long as maturity and selection effects can be estimated. The purpose of this paper is to demonstrate the utility and mechanics of measuring learning through cross sectional testing.

Characteristics Of Public Alternative High Schools Specifically For Students Placed At-Risk: A National Study Using The 2003-04 And 2007-08 Schools And Staffing Survey, Masashi Izumi Dec 2012

Characteristics Of Public Alternative High Schools Specifically For Students Placed At-Risk: A National Study Using The 2003-04 And 2007-08 Schools And Staffing Survey, Masashi Izumi

Dissertations

In this study I investigated determinants of the average daily attendance (ADA) and graduation rate of public alternative high schools specifically for students placed at-risk by analyzing the nationally representative data from Schools and Staffing Surveys of 2003-04 and 2007-08. I built three models via successive block entry, predicting the ADA and graduation rate by (a) student demographics, (b) staffing characteristics, and (c) school processes. Through multiple regression analyses on ADA, I found (a) a positive relationship between career technical education and ADA; and (b) a negative relationship between teacher-student ratio and ADA. Through the set of multiple regression analyses …

Analyses Of Consumer Perceptions, Farmer Challenges, Polyamine, And Amino Acid Content Of Organic And Conventional Fresh Produce Grown In South Carolina, Emily Steinberg

All Dissertations

Execution of the USDA organic standards led to more support for local food as distinct from organic food. The current study was conducted to examine fresh produce perceptions and purchasing decisions of S.C. consumers. Four-hundred and eight S.C. consumers were surveyed at S.C. grocery stores. More than one-third of the S.C. consumers not knowing about the 'certified S.C. grown' program suggest that the S.C. Department of Agriculture (SCDA) may want to improve the promotion of their program. Eighty-five percent of consumers indicated that they would choose local over organic. This information would be useful to local S.C. produce farmers who …

Principals' Experiences Regarding Culturally Responsive Leadership Preparation And Practices That Promote Academic Achievement Of African American Students, Monica Brown Dec 2012

Principals' Experiences Regarding Culturally Responsive Leadership Preparation And Practices That Promote Academic Achievement Of African American Students, Monica Brown

All Dissertations

Culturally responsive education improves the educational success of ethnically diverse students (Gay, 2002). The research presented states the case of the need of culturally responsive leadership preparation programs that influence the practice of culturally responsive principals. Emerging evidence has found that preparation programs impact the efficacy of future school leaders (Darling-Hammond, LaPointe, Meyerson, Orr, & Cohen, 2007; Jackson & Kelly, 2002). A large body of literature points to persistent achievement gaps for children of color and especially for African American males and demands that school leadership preparation attend to issues of cultural competence (Dantley, 2005; Evans, 2007; Lopez, Magdeleno, & …

The Contribution Of Poly(Adp-Ribose)Polymerase-1 Activity In The Nucleotide Excision Repair Pathway, Brenee S. King Dec 2012

The Contribution Of Poly(Adp-Ribose)Polymerase-1 Activity In The Nucleotide Excision Repair Pathway, Brenee S. King

Biomedical Sciences ETDs

Exposure to ultraviolet radiation (UVR) promotes the formation of UVR-induced, DNA helix distorting photolesions such as (6-4) pyrimidine-pyrimidone photoproducts (6-4 PPs) and cyclobutane pyrimidine dimers (CPDs). Effective repair of such lesions by the nucleotide excision repair (NER) pathway is required to prevent DNA mutations and chromosome aberrations. Poly(ADP-ribose)polymerase-1 (PARP-1) is a zinc-finger protein with well documented involvement in base excision repair (BER). PARP-1 is activated in response to DNA damage and catalyzes the formation of poly(ADP-ribose) subunits (PAR) that assist in the assembly of DNA repair complexes at sites of damage. In this dissertation, I present evidence for PARP-1 contributions …

Energy Conserving Privacy Enhancing Algorithms For Resource-Constrained Devices, Michael Groat Dec 2012

Energy Conserving Privacy Enhancing Algorithms For Resource-Constrained Devices, Michael Groat

Computer Science ETDs

Resource-constrained devices such as wireless sensor networks, body area networks, or smart phones collect confidential and sensitive information about their users. Traditional solutions to protect these data, such as encryption, consume a significant amount of resources to be viable. In this dissertation, I present two energy efficient information collection protocols based on the notion that by relaxing the definition of privacy, such as using indistinguishability, energy use can be reduced. The first protocol, multi-dimensional negative surveys (MDNSs), protects multivariate categorical data by perturbing sensed values to something other than what was actually sensed, and transmits the perturbed values to a …

Grand Theft Auto Loans: Repossession And Demographic Realities In Title Lending, Nathalie Martin Dec 2012

Grand Theft Auto Loans: Repossession And Demographic Realities In Title Lending, Nathalie Martin

Faculty Scholarship

This Article analyzes empirical data on one of America's fastest growing credit products, the title loan. A title loan is a high-interest, deeply oversecured, consumer loan, in which the consumer uses an unencumbered automobile as collateral for a non-purchase money loan. Title loans are made based solely on equity in a car. If a customer has insufficient income to pay the payments under the loan, typically interest-only payments at 300% per annum or more, the lender repossesses the vehicle, many of which have GPS trackers installed for this purpose. Not surprisingly, the repossession rates for title loans are higher than …

The Impact Of Low, Moderate, And High Military Family Mobility School District Transfer Rates On Graduating Senior High School Dependents' Achievement And School Engagement, Jeffrey K. Rippe Dec 2012

The Impact Of Low, Moderate, And High Military Family Mobility School District Transfer Rates On Graduating Senior High School Dependents' Achievement And School Engagement, Jeffrey K. Rippe

Student Work

The results of this study suggest that there were no significant differences in the academic performance of military dependents' with low (n = 20), moderate (n = 20), and high (n = 20) mobility school district transfer rates compared to non-military control students (n = 20) before completing high school. The findings were not consistent with some past research on student mobility. The research school district takes the goal of the Interstate Compact, which is to replace the widely varying treatment of transitioning military students with a comprehensive approach that provides a uniform policy in every school …
