Democracy Promotion: Done Right, A Progressive Cause, Rosa Brooks Jan 2012

Democracy Promotion: Done Right, A Progressive Cause, Rosa Brooks

Georgetown Law Faculty Publications and Other Works

By the beginning of the Obama Administration, democracy promotion had become a rather tarnished idea, and understandably so. Like Islam or Christianity, much blood has been shed beneath its banner. It may be true that democracies don’t go to war with one another, but they certainly go to war, and their wars kill people just as dead as the wars undertaken by illiberal regimes. Anyone on the political left can tell the story: During the Cold War, the United States fought endless proxy wars and engaged in a great deal of overt and covert mischief, all in the name of …

The Struggle For Legal Philosophy (Vis-À-Vis Legal Education): Methods And Problems, Imer Flores Jan 2012

The Struggle For Legal Philosophy (Vis-À-Vis Legal Education): Methods And Problems, Imer Flores

Georgetown Law Faculty Publications and Other Works

The article challenges the empirical claim that suggests that the legal skills needed to successfully practice law are not--and cannot be--learned at law schools, and contrasts it with the conceptual claim that indicates that the legal tasks needed for practicing law presuppose a legal theory--or at least requires a link between theory and practice. Hence, the dual claim--empirical and conceptual--is that legal philosophy is an important part of a legal curriculum and necessary to bridge, rather than to deepen, the existing gap between theory and practice.

The Problem About The Nature Of Law Vis-À-Vis Legal Rationality Revisited: Towards An Integrative Jurisprudence, Imer Flores Jan 2012

The Problem About The Nature Of Law Vis-À-Vis Legal Rationality Revisited: Towards An Integrative Jurisprudence, Imer Flores

Georgetown Law Faculty Publications and Other Works

In this paper the author argues, following Frederick Schauer, that attempting to move theoretically from-the-necessary-to-the-important may hinder our understanding of law. He further argues that attempting to move from-the-important-to-the-necessary may well be a more promising route for advancing our understanding of law as an interpretive practice which is not merely important or valuable but morally important or valuable and even necessary, as Ronald Dworkin has advocated. The authors argument also draws on the insights of Oliver Wendell Holmes Jr., who by discussing the important, but apparently neither necessary nor sufficient aspects of legal practice, integrated both logic and experience into …

The Cathedral Engulfed: Sea-Level Rise, Property Rights, And Time, J. Peter Byrne Jan 2012

The Cathedral Engulfed: Sea-Level Rise, Property Rights, And Time, J. Peter Byrne

Georgetown Law Faculty Publications and Other Works

Sea-level rise will require many new initiatives in land use regulation to adapt to unprecedented climate conditions. Such government actions will prompt regulatory and other takings claims, and also will be shaped by apprehension of such claims. This article analyzes the categories of land use regulations and other government initiatives likely to be enacted to adapt to sea-level rise and anticipates the takings claims that may be brought against them. In addition to hard and soft coastal armoring, the article considers regulations intended to force or induce development to retreat from rising waters. Retreat regulations present difficult takings problems, because …

Can Vermont Put The Nuclear Genie Back In The Bottle: A Test Of Congressional Preemptive Power?, Hope M. Babcock Jan 2012

Can Vermont Put The Nuclear Genie Back In The Bottle: A Test Of Congressional Preemptive Power?, Hope M. Babcock

Georgetown Law Faculty Publications and Other Works

Even before the nuclear core meltdowns at the Fukushima Daiichi nuclear reactors in Japan re-stoked public anxiety about nuclear energy, Vermont’s Senate, under the auspices of Vermont Act No. 160, voted to block continued operation of Vermont Yankee Nuclear Power Plant after the expiration of its forty-year operating license. This article examines whether a state can legislatively override a permit issued by the Nuclear Regulatory Commission extending the license of a power plant. The author places this question within a broader federalism context, in which states assert their sovereign rights to regulate the environment in the shadow of federal mandates. …

Microstructure And Mechanical Properties Of Silicon Carbide-Titanium Diboride Ceramic Composites, Derek Scott King Jan 2012

Microstructure And Mechanical Properties Of Silicon Carbide-Titanium Diboride Ceramic Composites, Derek Scott King

Masters Theses

"The microstructure, hardness, fracture toughness, Young's modulus, strength and Weibull modulus of silicon carbide-titanium diboride (SiC-TiB₂) ceramics were studied. First, SiC-TiB₂ ceramics with 15 vol.% TiB₂ particles were processed using two green processing methods, spray drying (ST) and ball milling (SiC-15TiB₂). In addition, SiC-TiB2 ceramics with TiB₂ contents ranging from 0 to 100 vol.% were produced to determine a TiB₂ content that produced the best combination of mechanical properties. From spray drying, segregation of the TiB₂ particles in ST led to a granule-like microstructure and spontaneous microcracking in the final ceramic. In ceramics containing 20 and 40 vol.% TiB₂, the …

A Novel Cantilever For Bi-Harmonic Atomic Force Microscopy, Muthukumaran Loganathan Jan 2012

A Novel Cantilever For Bi-Harmonic Atomic Force Microscopy, Muthukumaran Loganathan

Masters Theses

"Tapping mode (TM) AFM is a popularly used AFM technique in which an oscillating sharp tip mounted on a micro cantilever is used to probe the surface of interest with nanoscale resolution by making intermittent (tapping) contact with the surface. Any change in surface profile affects the tip amplitude, and is detectable only if it results in an amplitude change that is significant enough to be measured by the laser detector. Hence, it is desirable to have a micro cantilever that is sensitive to surface changes so as to provide sharper images and better surface resolution.

In the first part …

Experimental Feasibility Study Of A Passive Radio Frequency Identification-Based Distributed Beamforming Framework And Radio Frequency Tag Design For Achieving Dynamic Beamforming, Pratim Shah Jan 2012

Experimental Feasibility Study Of A Passive Radio Frequency Identification-Based Distributed Beamforming Framework And Radio Frequency Tag Design For Achieving Dynamic Beamforming, Pratim Shah

Masters Theses

"Passive UHF RFID tags works on the principle of backscattering mechanism. In realistic environment, there are multiple objects and tags that create complex, multipath propagation scenarios with numerous null-points, reduced read range and read rate.

In general, the RF frontend of tags could be controlled such that the negative effects of multipath propagation are reduced or even inverted thus implementing a virtual beamforming. The theoretical framework of beamforming in RFID system, using additional tags as virtual antenna arrays, has been discussed before. The presented study evaluates the feasibility of such beamforming in passive RFID systems. Moreover, it synthesizes an appropriate …

Transient Growth And Instability Control Using Iteration-Varying Filter Ilc In Flexible Dual Flywheel System, Tong Mu Jan 2012

Transient Growth And Instability Control Using Iteration-Varying Filter Ilc In Flexible Dual Flywheel System, Tong Mu

Masters Theses

"In the field of precision motion control, many industrial systems have flexible modes. This is especially true for very high performance nanopositioning systems where traditional bearing systems are replaced with flexible structures in order to eliminate sliding friction. The precision motion control is difficult in flexible systems because the rapid phase transition around the resonant frequency must be accurately modeled in order to actively control the resonant motion. In order to experimentally study the effectiveness of various control algorithms on flexible systems, a dual-flywheel flexible system is constructed. The mechatronics system design strategy is presented in this thesis. The control …

Depth Profiling Of Pahs Treated With Activated Carbon Using In-Situ Spme, Ryan D. Stringer Jan 2012

Depth Profiling Of Pahs Treated With Activated Carbon Using In-Situ Spme, Ryan D. Stringer

Masters Theses

"Novel and efficient methods to measure the bioavailability of hydrophobic organic contaminants (HOCs) in contaminated sediments will play an important role in the acceptance of alternative sediment remediation strategies. In this project, solid phase microextraction (SPME) fibers, protected in perforated steel tubes, were used as in situ passive samplers to measure the treatment of activated carbon (AC) in polycyclic aromatic hydrocarbon (PAH) contaminated sediment. Contaminated sediment was treated with two modes of AC waterjet amendment. In the first treatment, a single 2-min injection was shot into the center of a test vessel and in the second treatment, multiple 7-sec injections …

Determination Of Linear Attenuation Coefficients Of Chemically Bonded Phosphate Ceramics, Jason Joseph Pleitt

Masters Theses

"Chemically Bonded Phosphate Ceramics (CBPCs) is a composite based material formed in a manner similar to cements. CBPCs have shown to be a good structural material with excellent thermal resistance properties. They have also been shown to have potential as a radiation shield. By incorporating various powders into the ceramic the improvement in its radiation shielding properties are examined. The method for obtaining the linear attenuation coefficients for CBPCs as well as MCNP simulated results for gamma and neutrons are presented"--Abstract, page iv.

Unified Knowledge Model For Stability Analysis In Cyber Physical Systems, Tamal Paul Jan 2012

Unified Knowledge Model For Stability Analysis In Cyber Physical Systems, Tamal Paul

Masters Theses

"The amalgamation and coordination between computational processes and physical components represent the very basis of cyber-physical systems. A diverse range of CPS challenges had been addressed through numerous workshops and conferences over the past decade. Finding a common semantic among these diverse components which promotes system synthesis, verification and monitoring is a significant challenge in the cyber-physical research domain. Computational correctness, network timing and frequency response are system aspects that conspire to impede design, verification and monitoring. The objective of cyber-physical research is to unify these diverse aspects by developing common semantics that span each aspect of a CPS. The …

Vehicle Path Verification Using Wireless Sensor Networks, Gerry W. Howser Jan 2012

Vehicle Path Verification Using Wireless Sensor Networks, Gerry W. Howser

Masters Theses

"Path Verification is a problem where a verifier would like to determine how closely a vehicle actually traversed a path that it claims to have traversed. This problem has critical significances in terms of vehicle mobility. Mobile nodes can be patrols officers or cab drivers, while respective verifiers can be police dispatchers or cab operators. In this paper, we design a sensor network assisted technique for vehicle path verification. In our design, a number of static wireless sensors placed in road segments will serve as witnesses and certify vehicles as they move. Post movement, these witness certificates will be utilized …

A Digitally Implemented Practical Photovoltaic Simulator With A Double Current Mode Controller, Jie Ang Zhao Jan 2012

A Digitally Implemented Practical Photovoltaic Simulator With A Double Current Mode Controller, Jie Ang Zhao

Masters Theses

"This thesis presents a microcontroller- and DC-DC converter-based photovoltaic (PV) simulator which emulates the output characteristic of a PV module. The current-voltage (IV) characteristic of a PV module is implemented as a look-up-table that generates an output reference current based on a measured output voltage. The control mechanism is based on a double current mode controller that consists of a predictive current mode controller and a proportional-integral (PI) controller arranged in an inner loop and outer loop configuration. The PI controller is designed based on classical phase margin and gain margin criteria to ensure system stability. The performance of the …

Investigation Of The Effects Of Shrinkage, Creep, And Abrasion On Self-Consolidating Concrete And High Volume Fly Ash Concrete For Use In Transportation Related Infrastructure, Brian Timothy Tucker Jan 2012

Investigation Of The Effects Of Shrinkage, Creep, And Abrasion On Self-Consolidating Concrete And High Volume Fly Ash Concrete For Use In Transportation Related Infrastructure, Brian Timothy Tucker

Masters Theses

"Concrete specimens were fabricated for shrinkage, creep, and abrasion resistance testing. Variations of self-consolidating concrete (SCC), high volume fly ash concrete (HVFA), and conventional concrete were studied. The results were compared to previous similar testing programs and used to determine the adequacy of the materials for use in practice. These two concrete variations offer significant benefits when used as replacements to conventional concrete. Because of the respective properties of both types of concrete, both economic and environmental benefits are achieved with the use of both. The lower labor costs of SCC and the lower material cost of HVFA lead to …

Evaluation Of The Reagan And Lamotte Sandstones In Southwestern Missouri For Carbon Dioxide Sequestration, Todd Jeffrey Miller Jan 2012

Evaluation Of The Reagan And Lamotte Sandstones In Southwestern Missouri For Carbon Dioxide Sequestration, Todd Jeffrey Miller

Masters Theses

"Carbon dioxide sequestration has been proposed as a way to reduce anthropogenic carbon dioxide emissions. Several characteristics are required in order for a geologic formation to be suitable for sequestration. There must be an impermeable confining layer to restrain CO₂ migration toward the surface, the porosity and permeability must be high enough to allow for long term injection and substantial storage capacity, and the formation must be strong enough for long term injection to occur without inducing fractures. In this work, The Reagan and Lamotte Sandstones near Springfield, Missouri were evaluated for the potential for carbon dioxide sequestration. The Derby-Doe …

Investigation Of Geosteering In Non-Trivial Geological Settings, Anuroop Pandey Jan 2012

Investigation Of Geosteering In Non-Trivial Geological Settings, Anuroop Pandey

Masters Theses

"The well placement technology has advanced to a stage where we can explore small tolerance targets such as thin reservoirs. Well placement with geosteering, which is the real time adjustment of the well path based on the geological responses to place and maintain the well within the best part of the reservoir, is the technology that has made this progress possible. Geosteering however can get very complex with the increasing heterogeneities of the formations and there is no fixed methodology to devise a steering strategy in such complex geological settings. To accommodate this challenge, we investigated three methods to verify …

Path Planning For General Mazes, Grant Gilbert Arthur Rivera Jan 2012

Path Planning For General Mazes, Grant Gilbert Arthur Rivera

Masters Theses

Path planning is used in, but not limited to robotics, telemetry, aerospace, and medical applications. The goal of the path planning is to identify a route from an origination point to a destination point while avoiding obstacles. This path might not always be the shortest in distance as time, terrain, speed limits, and many other factors can affect the optimality of the path. However, in this thesis, the length, computational time, and the smoothness of the path are the only constraints that will be considered with the length of the path being the most important. There are a variety of …

Stochastic Model For Solar Sensor Array Data, Faris Alfaris Jan 2012

Stochastic Model For Solar Sensor Array Data, Faris Alfaris

Masters Theses

Statistical approaches are often used in time series analysis, for example, to predict the future trend of a time series. Trend forecasting can be applied in many time related parameters such as: solar radiation, generation of electricity and other variables related to time series to improve the efficiency and to set the design requirements. Since the design of any solar energy system requires knowledge of the availability of solar radiation data at the location of interest. Therefore, this research seeks the application of a statistical model to fit the solar radiation time series and predict the future values. There are …

The Tragedy Of The Carrots: Economics & Politics In The Choice Of Price Instruments, Brian Galle Jan 2012

The Tragedy Of The Carrots: Economics & Politics In The Choice Of Price Instruments, Brian Galle

Georgetown Law Faculty Publications and Other Works

Externalities are one of the most fundamental market-failure justifications for government action, and pigouvian taxes and subsidies are standard tools for correcting them. Even so, neither the legal nor economic literatures offer any comprehensive account of when policy makers should prefer one to the other. This Article takes up that task. Prior efforts to distinguish between “carrots” and “sticks” have generally been limited to the context of pollution regulation, and I show here that even those are incomplete. I also extend the analysis to the case of positive externalities, where there is no prior literature to speak of. Overall I …

Bankruptcy, Backwards: The Problem Of Quasi-Sovereign Debt, Anna Gelpern Jan 2012

Bankruptcy, Backwards: The Problem Of Quasi-Sovereign Debt, Anna Gelpern

Georgetown Law Faculty Publications and Other Works

This Feature considers the debts of quasi-sovereign states in light of proposals to let them file for bankruptcy protection. States that have ceded some but not all sovereign prerogatives to a central government face distinct challenges as debtors. It is unhelpful to analyze these challenges mainly through the bankruptcy lens. State bankruptcy posits an institutional fix for a problem that remains theoretically undefined and empirically contested. I suggest a way of mapping the problem that does not work back from a solution. I highlight the implications of sovereign immunity, immortality, concurrent authority, macroeconomic policy, and democratic accountability for quasi-sovereign debt …

The Structural Role Of Private Enforcement Mechanisms In Public Law, J. Maria Glover Jan 2012

The Structural Role Of Private Enforcement Mechanisms In Public Law, J. Maria Glover

Georgetown Law Faculty Publications and Other Works

The American regulatory system is unique in that it expressly relies upon a diffuse set of regulators, including private parties, rather than upon a centralized bureaucracy, for the effectuation of its substantive aims. In contrast with more traditional conceptions of private enforcement as an ad hoc supplement to public law, this Article argues that private regulation through litigation is an integral part of the structure of the modern regulatory state. Private litigation and the mechanisms that enable it are not merely add-ons to our regulatory regime, much less are they fundamentally at odds with it.

Yet mechanisms of enforcement attendant …

The Federal Rules Of Civil Settlement, J. Maria Glover Jan 2012

The Federal Rules Of Civil Settlement, J. Maria Glover

Georgetown Law Faculty Publications and Other Works

The Federal Rules of Civil Procedure were originally based upon a straightforward model of adjudication: Resolve the merits of cases at trial and use pretrial procedures to facilitate accurate trial outcomes. Though appealing in principle, this model has little relevance today. As is now well known, the endpoint around which the Federal Rules were structured — trial — virtually never occurs. Today, the vast majority of civil cases terminate in settlement. This Article is the first to argue that the current litigation process needs a new regime of civil procedure for the world of settlement

This Article begins by providing …

Novice Principals’ Perceptions Of Effective Leadership Practices And Their Principal Preparation Programs, Melissa Y. Wilson Jan 2012

Novice Principals’ Perceptions Of Effective Leadership Practices And Their Principal Preparation Programs, Melissa Y. Wilson

Theses and Dissertations

The purpose of this study was to examine novice principals’ perceptions of effective leadership practices and the elements of their principal preparation program that prepared them for the role of school leader. A mixed-methods study was utilized by the researcher to gather quantitative data through the use of an online survey and to gather qualitative data through subsequent focus-group interviews to address the proposal’s three research questions: (a) What are the differences (if any) between the perceptions of novice elementary, middle, and high school principals regarding the five instructional leadership practices identified by Kouzes and Posner (2003; i.e., challenging the …

Energy And Animals: A History Of Conflict, Alexandra B. Klass Jan 2012

Energy And Animals: A History Of Conflict, Alexandra B. Klass

San Diego Journal of Climate & Energy Law

Environmental groups, federal and state agencies, and others who support the development of renewable energy have struggled in recent years with the adverse impacts of such development on animals and animal habitat. Although renewable energy development has the benefit of creating energy without the greenhouse gas emissions associated with traditional energy development, it does so through an intensive use of land, including federal public lands, thus competing with habitats for protected species and other wildlife. Conflicts between energy and animals, of course, are nothing new. Congress, agencies, and courts have attempted for decades to balance the public interest in domestic …

Port And Coastal State Control Of Atmospheric Pollution, Michael W. Reed Jan 2012

Port And Coastal State Control Of Atmospheric Pollution, Michael W. Reed

San Diego Journal of Climate & Energy Law

Controlling atmospheric pollution which originates beyond national borders always presents difficult issues. The problems are multiplied when the source is a merchant vessel, registered under a foreign flag of convenience and operating seaward of state and federal sovereign limits. Nevertheless, international law provides alternative approaches through which the coastal sovereign may protect its onshore environmental interests.

The purpose of this paper is to lay out the problems, both factual and legal, and discuss means by which they may be resolved. California is used as a case study. The state has long suffered from excessive air pollution. Congress acknowledged the state?s …

The Politics Of Clean Energy: Moving Beyond The Beltway, Joseph P. Tomain Jan 2012

The Politics Of Clean Energy: Moving Beyond The Beltway, Joseph P. Tomain

San Diego Journal of Climate & Energy Law

This Article argues that the United States can achieve a new and smart energy policy and that we are taking active steps in this direction. Off of the Hill, at 1600 Pennsylvania Avenue, there is clear thinking about clean energy. Consider President Obamas choice for Secretary of Commerce, John Bryson. Bryson has been the CEO of a public electric utility, a founder of the Natural Resources Defense Council, and sits on the boards of such organizations as Boeing and Disney and clean energy firms like Coda Automotive and BrightSource Energy exactly the right job description for a clean energy advocate. …
