A Regulatory Design For Monetary Stability, Morgan Ricks Jan 2012

A Regulatory Design For Monetary Stability, Morgan Ricks

Vanderbilt Law School Faculty Publications

This Article proposes a unified regulatory approach to the issuance of "money-claims"--a generic term that refers to fixed-principal, very short-term IOUs, excluding trade credit. The instability of this market is arguably the central problem for financial regulatory policy. Yet our existing regulatory system lacks a coherent approach to this market. The Article proposes a public-private partnership ("PPP") regime, under which only licensed entities would be permitted to issue money - claims (subject to de minimis exceptions). Licensed moneyclaim issuers would be required to abide by portfolio restrictions and capital requirements. In addition, the government would explicitly insure licensed issuers' outstanding …

Immigration Enforcement And The Fugitive Slave Acts: Exploring Their Similarities, Karla M. Mckanders Jan 2012

Immigration Enforcement And The Fugitive Slave Acts: Exploring Their Similarities, Karla M. Mckanders

Vanderbilt Law School Faculty Publications

Two seemingly different federal enforcement systems that affect the movement of unskilled workers — the 1793 and 1850 Fugitive Slave Acts and current state immigration enforcement policies — have remarkable similarities. Both systems are political stories that are demonstrative of the failure of federalism. The federal government’s current failure to enforce immigration laws has encouraged state and local governments to pass their own laws. Alabama and Arizona have enacted far-reaching laws, which are similar to the federal Immigration and Nationality Act § 287(g) programs. Both have been challenged on constitutional preemption and equal protection grounds. Recent scholarship has focused mainly …

An Investigation Of The Rationality Of Consumer Valuations Of Multiple Health Risks, W. Kip Viscusi, Wesley A. Magat, Joel Huber Jan 2012

An Investigation Of The Rationality Of Consumer Valuations Of Multiple Health Risks, W. Kip Viscusi, Wesley A. Magat, Joel Huber

Vanderbilt Law School Faculty Publications

After developing a conceptual analysis of consumer valuation of multiple risks, we explore both economic and cognitive hypotheses regarding individual risk-taking. Using a sample of over 1,500 consumers, our study ascertains risk-dollar tradeoffs for the risks associated with using an insecticide and a toilet bowl cleaner. We observe the expected positive valuation of risk reductions andfind empirical supportfor a diminishing in the valuation of risk reduction as the extent of the risk reduction increases. We also find evidence of certainty premiums for the total elimination of one risk, but no strong evidence of additional certainty premiums for the elimination of …

Erie And The Rules Of Evidence, Edward K. Cheng Jan 2012

Erie And The Rules Of Evidence, Edward K. Cheng

Vanderbilt Law School Faculty Publications

Jay Tidmarsh offers an intriguing new test for drawing the allimportant line between procedure and substance for purposes of Erie. The Tidmarsh test is attractively simple, yet seemingly reaches the right result in separating out truly “procedural” rules from more substantive ones. Since I am not a proceduralist, in this Response I will leave the Tidmarsh test’s explanatory power and practical workability vis-à-vis general civil procedure rules to others more qualified than I. Instead, I want to focus on the implications of the Tidmarsh test for the Federal Rules of Evidence. Like others in the evidence world, I have long …

Why Crime Severity Analysis Is Not Reasonable: A Comment, Christopher Slobogin Jan 2012

Why Crime Severity Analysis Is Not Reasonable: A Comment, Christopher Slobogin

Vanderbilt Law School Faculty Publications

Jeffrey Bellin’s article, Crime Severity Distinctions and the Fourth Amendment: Reassessing Reasonableness in a Changing World, argues that the severity of the crime under investigation ought to be taken into account in assessing both the reasonableness of searches and whether a government action is a search in the first place. In pursuit of this objective, his article provides the best attempt to date at dealing with the difficult issue of separating serious from not-so serious crimes (he ends up with three categories—grave, serious and minor. He then makes the enticing argument that calibrating the degree of Fourth Amendment protection according …

Match Between Parent And Child Temperament: Implications For Parenting Behaviors And Children's Behavior Problems, Melissa Middleton

Electronic Theses and Dissertations

To examine the relationships among the match between parent and child temperament, parenting behaviors, parenting stress, and young children's behavior problems, the current study investigated the responses of mothers who are raising children between the ages of 3- and 5-years. Mothers completed the Dimensions of Temperament Scale-Revised for Children (Windle & Learner, 1986), the Dimensions of Temperament Scale-Revised for Adults (Windle & Learner, 1986), the Alabama Parenting Questionnaire-Preschool Revision (Clerkin, Marks, Policaro, & Halperin, 2007), the Maternal Emotional Styles Questionnaire (Lagace-Seguin & Coplan, 2005), the Parenting Stress Index-Short Form (Abidin, 1995), and the Child Behavior Checklist (Achenbach & Rescorla, 2000, …

Extending The Local : Documentary Film Festivals In East Asia As Sites Of Connection And Communication, Tit Leung Cheung Jan 2012

Extending The Local : Documentary Film Festivals In East Asia As Sites Of Connection And Communication, Tit Leung Cheung

Lingnan Theses

East Asian cinema is receiving increasing global attention. This attention is not focused merely on the fiction and feature films produced in the region, but also on the documentaries produced there; films such as Petition (2009) by Chinese director Zhao Liang which premiered at Cannes Film Festival in 2009. This attention to East Asian documentary can be traced to the documentary film festivals organised in the region, particularly those that devote their programming to independent documentary productions from the region. These festivals open a window that enables such works to be exhibited for the rest of the world.

But these …

Effect Of Predation Risk And Food Availability On Parental Care And Nest Survival In Suburban And Wildland Florida Scrub-Jays, Joseph M. Niederhauser Jan 2012

Effect Of Predation Risk And Food Availability On Parental Care And Nest Survival In Suburban And Wildland Florida Scrub-Jays, Joseph M. Niederhauser

Electronic Theses and Dissertations

Individual organisms often use cues from their natural environments to determine many behavioral and life-history "decisions." These "decisions" are usually adaptive, i.e. a response to selection, because the environmental cues on which they are based reliably correlate with increased fitness over time. When the selected behavioral response to a natural cue no longer provides a fitness benefit, then selection for a new response may occur but individuals maintaining the previously selected response may suffer reduced survival and reproduction. Especially in human-modified landscapes individuals making a maladaptive behavioral or life-history choice based on those formerly reliable environmental cues may be faced …

Fine-Scale Geographic Variation Of Stable Isotope And Fatty Acid Signatures Of Three Fish Species In The Indian River Lagoon, Fl, Jennifer Fletcher Odom Jan 2012

Fine-Scale Geographic Variation Of Stable Isotope And Fatty Acid Signatures Of Three Fish Species In The Indian River Lagoon, Fl, Jennifer Fletcher Odom

Electronic Theses and Dissertations

The Indian River Lagoon, Florida, is a unique closed “bar built” estuary system that has little interchange with the Atlantic Ocean and which is home to many resident species. Three fish species were investigated to see if their isotopic and fatty acid signatures differed based on geographic location. The goal was to assess the degree of resolution of spatial variation that is possible when using stable isotope and fatty acid signature analysis to interpret feeding habits and potential linkages between feeding habits and health status. Spotted seatrout (n=40), pinfish (n=60) and white mullet (n=60) were collected over a 4 week …

Florida's Paradox Of Progress: An Examination Of The Origins, Construction, And Impact Of The Tamiami Trail, Mark Schellhammer Jan 2012

Florida's Paradox Of Progress: An Examination Of The Origins, Construction, And Impact Of The Tamiami Trail, Mark Schellhammer

Electronic Theses and Dissertations

This study illustrates the impact of the Tamiami Trail on the people and environment of South Florida through an examination of the road’s origins, construction and implementation. By exploring the motives behind building the highway, the subsequent assimilation of indigenous societies, the drastic population growth that occurred as a result of a propagated “Florida Dream”, and the environmental decline of the surrounding Everglades, this analysis reveals that the Tamiami Trail is viewed today through a much different context than that of the road’s builders and promoters in the early twentieth century. While construction projects that aim to prevent, or limit …

The Effects Of Synchronous Online Cognitive Strategy Instruction In Writing For Students With Learning Disabilities, Carrie Straub Jan 2012

The Effects Of Synchronous Online Cognitive Strategy Instruction In Writing For Students With Learning Disabilities, Carrie Straub

Electronic Theses and Dissertations

This study investigates the effects of self-regulated strategy development (Harris, Graham, & Mason, 2009) for cognitive strategy instruction in persuasive writing (POW+TREE) using a synchronous online learning environment for special education students. Participants are four adolescent students with learning disabilities (LD) with low achievement in writing. One undergraduate research assistant delivered instruction using a synchronous online platform (e.g., Adobe Connect) in conjunction with collaborative writing software (e.g., Google Docs word processing). A multiple probe across participants design was used to demonstrate a functional relationship between instruction and number of essay elements (EE). Number of correct minus incorrect word sequences (CIWS) …

Keeping Church Goers Motivated: Church Worship Communication Study, Anne Trelstad Jan 2012

Keeping Church Goers Motivated: Church Worship Communication Study, Anne Trelstad

Electronic Theses and Dissertations

At a time when mainline Protestant churches in America are concerned with stagnant or declining worship attendance (Duin, 2008) a better understanding of worshippers' motivations could help church leaders plan and create positive worship experiences (Katt & Trelstad, 2009). This study extends the scope of the previous research of Katt and Trelstad by employing a larger sample of purposively selected churches. It attempts to more clearly answer the following question more clearly: What types of incidents serve as motivator and de-motivator factors in the church worship service setting? A sample of 105 church members from thirty-eight churches participated in a …

Integrating Differential Global Positioning Systems And Geographic Information Systems For Analysis And Mapping Of Skeletal Dispersals, Brittany Walter Jan 2012

Integrating Differential Global Positioning Systems And Geographic Information Systems For Analysis And Mapping Of Skeletal Dispersals, Brittany Walter

Electronic Theses and Dissertations

Scene mapping is an integral part of processing a forensic scene with scattered human remains. By utilizing the appropriate mapping technique, investigators can accurately document the location of human remains and maintain a precise geospatial record of this evidence at a scene. Global positioning system (GPS) units have been used for years to survey the spatial distribution of large-scale archaeological sites. However, differential global positioning (DGPS) unit now provide decreased positional error suitable for small-scale surveys, such as forensic scenes. Because of the lack of knowledge concerning this utility in mapping a scene, controlled research is necessary to determine the …

Accuracy Of The Peer Informant: What Characteristics Are Related To The Ability To Detect Behavior Problems In Peers?, Brea Anne Lauer Jan 2012

Accuracy Of The Peer Informant: What Characteristics Are Related To The Ability To Detect Behavior Problems In Peers?, Brea Anne Lauer

Electronic Theses and Dissertations

Victimization and rejection by peers leads to and exacerbates behavior problems in children and adolescents. Given the implications of problematic peer relations for adolescents who experience behavior problems, the present study examined factors that may be related to how adolescents perceive peers who exhibit such problems. Specifically, the present study examined the relationship of adolescent peer informants’ socioeconomic status, their prior exposure to psychopathology, their own social competence, and their own behavior problems to their perceptions of peer internalizing and externalizing behavior problems, their liking of individuals who exhibit such problems, and their attributions for the etiology of such problems …

Nonlinear Dynamic Modeling, Simulation And Characterization Of The Mesoscale Neuron-Electrode Interface, Vaibhav Thakore Jan 2012

Nonlinear Dynamic Modeling, Simulation And Characterization Of The Mesoscale Neuron-Electrode Interface, Vaibhav Thakore

Electronic Theses and Dissertations

Extracellular neuroelectronic interfacing has important applications in the fields of neural prosthetics, biological computation and whole-cell biosensing for drug screening and toxin detection. While the field of neuroelectronic interfacing holds great promise, the recording of high-fidelity signals from extracellular devices has long suffered from the problem of low signal-to-noise ratios and changes in signal shapes due to the presence of highly dispersive dielectric medium in the neuron-microelectrode cleft. This has made it difficult to correlate the extracellularly recorded signals with the intracellular signals recorded using conventional patch-clamp electrophysiology. For bringing about an improvement in the signalto-noise ratio of the signals …

Photochemistry And Applications Of Diels-Alder Adducts And Photoacids In Materials Science, Valentine Johns Jan 2012

Photochemistry And Applications Of Diels-Alder Adducts And Photoacids In Materials Science, Valentine Johns

Electronic Theses and Dissertations

In chapter I Photo-retro-Diels-Alder (PrDA) reactions of a variety of Diels Alder (DA) adducts were studied. Experimental results showed that the photoreactivity (quantum yield) depends on the electron-donating ability of the diene component and the electronwithdrawing ability of the dienophile component. The mechanism was studied by trapping the reaction intermediate, O2 quenching and femtosecond time-resolved absorption spectroscopy. All the results support a mechanism that involves a charge-separated intermediate generated from a singlet excited state. The PrDA reaction may find applications in photoresponsive materials, photolithography, drug delivery and mechanistic research. Chapter II shows two applications of the PrDA reaction. The first, …

Perceptions Influencing School Nurse Practices To Prevent Childhood Obesity, Susan Quelly Jan 2012

Perceptions Influencing School Nurse Practices To Prevent Childhood Obesity, Susan Quelly

Electronic Theses and Dissertations

Approximately one-third of children in the United States are overweight or obese with increased risks for numerous physical and psychosocial comorbidities. Schools are ideal environments to address this serious health crisis and school nurses are uniquely positioned qualified healthcare providers to actively participate in childhood obesity prevention (COP). A review of the literature provided findings to identify a gap in the knowledge regarding the association between school nurse COP perceptions and practices. A modified theoretical framework based on Bandura’s health promotion by social cognitive theory guided this study. The purpose of this study was to identify the key perceptions (self-efficacy, …

White And Black Womanhoods And Their Representations In 1920s American Advertising, Lindsey L. Turnbull Jan 2012

White And Black Womanhoods And Their Representations In 1920s American Advertising, Lindsey L. Turnbull

Electronic Theses and Dissertations

The 1920s represented a time of tension in America. Throughout the decade, marginalized groups created competing versions of a proper citizen. African-Americans sought to be included in the national fabric. Racism encouraged solidarity, but black Americans did not agree upon one method for coping with, and hopefully ending, antiblack racism. White women enjoyed new privileges and took on more roles in the public sphere. Reactionary groups like the Ku Klux Klan found these new voices unsettling and worrisome and celebrated a white, nativeborn, Protestant and male vision of the American citizen. Simultaneously, technological innovations allowed for advertising to flourish and …

Electronic Theses and Dissertations

The purpose of this study was to improve my teaching practice, as well as my second grade students' success with two-digit addition concepts, by allowing them to choose the manipulative tools to explore problems and justify solutions. I examined how allowing my students this choice influenced their attitudes, achievement, and explanations of their thought processes. I found that allowing students to choose their own manipulatives had positive influences in all three areas. Pre- and post-test results showed an overall shift toward more positive mathematics attitudes, as well as increased academic achievement with two-digit addition concepts. Students also demonstrated changes in …

License To Deal: Mandatory Approval Of Complex Financial Products, Saule T. Omarova Jan 2012

License To Deal: Mandatory Approval Of Complex Financial Products, Saule T. Omarova

Cornell Law Faculty Publications

This Article explores the possibility of creating a system of mandatory pre-approval of complex financial products as an ex ante solution to the problem of systemic risk containment. Building on the concept of regulatory precaution borrowed from environmental and health law, and elements of pre-CFMA regulation of commodity futures, the Article outlines the broad contours of a new licensing scheme that would place the burden of proving social and economic utility of complex financial instruments on the intermediaries that structure and market them. Fundamentally a thought experiment, this proposal seeks to enrich the current policy debate by expanding the range …

Is Bollywood Unlawfully Copying Hollywood? Why? What Has Been Done About It? And How Can It Be Stopped?, Arjun Shah Jan 2012

Is Bollywood Unlawfully Copying Hollywood? Why? What Has Been Done About It? And How Can It Be Stopped?, Arjun Shah

Emory International Law Review

A popular film favorite among lawyers and law students is the 1992 Oscar-winning comedy, My Cousin Vinny. The film features Joe Pesci as a quick-witted but hapless attorney defending two innocent New York teens from a capital murder charge in the Deep South. It was fitting, then, that a film about law and justice would be used as a guinea pig in Hollywood's most aggressive attempt to enforce its copyrights against unauthorized Bollywood remakes of Hollywood movies.

The Potential Extraterritorial Consequences Of Akamai, Timothy R. Holbrook Jan 2012

The Potential Extraterritorial Consequences Of Akamai, Timothy R. Holbrook

Emory International Law Review

Patent infringement arises when all of the limitations found in a particular claim of a patent are present in a device. For a patented system, the apparatus must have all the required components as delineated in the claim. For a patented method, all of the steps of the method must be performed. Historically, the issue of "who" was the infringer was relatively straightforward because most systems and methods were utilized in discrete, unitary settings. In the modern era, however, particularly with inventions being implemented over the Internet, the issue of "divided infringement" has arisen in two particular contexts.

Stare Decisis And Certiorari Arrive To Brazil: A Comparative Law And Economics Approach, Maria Angela Jardim De Santa Cruz Oliveira, Nuno Garoupa

Emory International Law Review

Two important legal reforms in court procedure have taken place in Brazil recently: súmula vinculante (all courts now have to follow the reasoning of the Supreme Court in similar cases) and requisito da repercussão geral (the Supreme Court only hears cases that are of general importance). These two procedural rules respond to a long debate in the Brazilian legal community on how to address court congestion, the heavy workload of the Brazilian Supreme Court, and the role of the higher courts in establishing case law. We discuss the implications of these two important reforms from the comparative perspective (by explaining …

Conformational And Thermodynamic Properties Modulate The Nulceotide Excision Repair Of 2-Aminofluorene And 2-Acetylaminofluorene Dg Adducts In The Nari Sequence, Vipin Jain, Benjamin Hilton, Satyakam Patnaik, Yue Zou, M. Paul Chiarelli, Bongsup P. Cho Jan 2012

Conformational And Thermodynamic Properties Modulate The Nulceotide Excision Repair Of 2-Aminofluorene And 2-Acetylaminofluorene Dg Adducts In The Nari Sequence, Vipin Jain, Benjamin Hilton, Satyakam Patnaik, Yue Zou, M. Paul Chiarelli, Bongsup P. Cho

Chemistry: Faculty Publications and Other Works

Nucleotide excision repair (NER) is a major repair pathway that recognizes and corrects various lesions in cellular DNA. We hypothesize that damage recognition is an initial step in NER that senses conformational anomalies in the DNA caused by lesions. We prepared three DNA duplexes containing the carcinogen adduct N-(2'-deoxyguanosin-8-yl)-7-fluoro-2-acetylaminofluorene (FAAF) at G(1), G(2) or G(3) of NarI sequence (5'-CCG(1)G(2)CG(3)CC-3'). Our (19)F-NMR/ICD results showed that FAAF at G(1) and G(3) prefer syn S- and W-conformers, whereas anti B-conformer was predominant for G(2). We found that the repair of FAAF occurs in a conformation-specific manner, i.e. the highly S/W-conformeric G(3) and -G(1) …
