Gat, Solvay, And The Centralization Of Patent Litigation In Europe, Marketa Trimble Jan 2012

Gat, Solvay, And The Centralization Of Patent Litigation In Europe, Marketa Trimble

Emory International Law Review

As business has become global, so have disputes about patents, patent infringement, and patent validity. In many ongoing disputes between patent holders and alleged infringers, parties are engaging in parallel court proceedings in multiple countries to litigate infringements of parallel patents and to contest the validity of patents. Concentrating litigation involving identical inventions and identical or similar conduct into one national or multinational court could result in faster, more efficient, and more consistent enforcement of patents.

Promises And Perils Of New Global Governance: A Case Of The G20, Sungjoon Cho, Claire R. Kelly

Chicago Journal of International Law

In the wake of the 2008 financial crisis, a new global governance structure emerged. During and subsequent to the crisis, the G20 emerged as a coordinating executive among international governance institutions. It set policy agendas and prioritized initiatives. Working through the Financial Stability Board, the G20 coordinated with other governance institutions and networks to set standards, monitor enforcement and compliance, and aid recovery. Its partners included the International Monetary Fund, the Basel Committee on Banking Supervision, the Organisation for Economic Cooperation and Development, the World Trade OrganiZation, the International Association of Insurance Supervisors and the International Organization of Securities Commissions. …

A Bright Idea: A Bright-Line Test For Extraterritoriality In F-Cubed Securities Fraud Private Causes Of Action, Jennifer Mitchell Coupland Jan 2012

A Bright Idea: A Bright-Line Test For Extraterritoriality In F-Cubed Securities Fraud Private Causes Of Action, Jennifer Mitchell Coupland

Northwestern Journal of International Law & Business

Whether a foreign or American claimant has a private right of action in so-called ―Foreign-Cubed‖ or ―Foreign-Squared‖ claims under Section 10(b) of the Securities Exchange Act of 1934 (Exchange Act) and Securities and Exchange Commission (SEC) Rule 10b-5 has been the subject of much debate among U.S. courts, Congress, and the international community. Historically, these cases have been heard in the United States if the conduct had a substantial effect in the United States or on U.S. citizens (the effects test), or if the fraudulent or wrongful conduct occurred in the United States (the conduct test). However, in June 2010, …

Culpa In Contrahendo In European Private International Law: Another Look At Article 12 Of The Rome Ii Regulation, Najib Hage-Chahine

Northwestern Journal of International Law & Business

Precontractual liability is liability that arises out of a harmful conduct that occurs during the formation period of a contract. Where the harmful conduct occurs during international negotiations, a conflict of laws issue arises. The determination of the applicable law to precontractual liability can be a complex and tedious task, which is why the European Legislature has provided a special conflict-of-law rule in Article 12 of the Rome II Regulation on the applicable law to non-contractual obligations. Through this provision, the European Legislature aims to achieve uniformity between EU Member States, while providing an appropriate conflicts rule. The present essay …

The Sword Of Damocles: Revisiting The Question Of Whether The United Nations Security Council Is Bound By International Law, Joy Gordon Jan 2012

The Sword Of Damocles: Revisiting The Question Of Whether The United Nations Security Council Is Bound By International Law, Joy Gordon

Chicago Journal of International Law

This Article considers whether the United Nations Security Council is bound by international humanitarian law in the context of Chapter VII, which authorizes the Council to use force in response to aggression, threats to peace, and breaches of the peace. In the early 1990s, the Council took unprecedented measures that were seen by many as overreaching, raising the possibility that the leading institution of global governance might abuse its power. At the present moment, it seems that the matter is resolved politically and judicially. But it is not resolved constitutionally, and the abuse of power by the Security Council remains …

A Quantitative Examination Of Extreme Facial Pain Expression In Neonates: The Primal Face Of Pain Across Time, Martin Schiavenato, Carl L. Von Baeyer Jan 2012

A Quantitative Examination Of Extreme Facial Pain Expression In Neonates: The Primal Face Of Pain Across Time, Martin Schiavenato, Carl L. Von Baeyer

Nursing Faculty Scholarship

Many pain assessment tools for preschool and school-aged children are based on facial expressions of pain. Despite broad use, their metrics are not rooted in the anatomic display of the facial pain expression. We aim to describe quantitatively the patterns of initiation and maintenance of the infant pain expression across an expressive cycle. We evaluated the trajectory of the pain expression of three newborns with the most intense facial display among 63 infants receiving a painful stimulus. A modified “point-pair” system was used to measure movement in key areas across the face by analyzing still pictures from video recording the …

Justice Owen J. Roberts On 1937, Edward L. Carter, Edward E. Adams Jan 2012

Justice Owen J. Roberts On 1937, Edward L. Carter, Edward E. Adams

Faculty Publications

The motivations for Supreme Court Justice Owen J. Roberts’ so-called “switch in time that saved nine” in 1937 remain largely obscured. For much of the past 75 years, judges, lawyers and scholars have discussed—including recently in this journal—why Justice Roberts would vote to uphold minimum-wage legislation in March 1937 when he had voted to invalidate similar legislation in June 1936. Given that President Franklin D. Roosevelt unveiled his court-packing plan on February 5, 1937, externalists have ascribed political motivations to Roberts and the Court. Internalists, meanwhile, have pointed to legal reasons for the switch. However, with the exception of a …

Null Convention Logic Applications Of Asynchronous Design In Nanotechnology And Cryptographic Security, Jun Wu Jan 2012

Null Convention Logic Applications Of Asynchronous Design In Nanotechnology And Cryptographic Security, Jun Wu

Doctoral Dissertations

"This dissertation presents two Null Convention Logic (NCL) applications of asynchronous logic circuit design in nanotechnology and cryptographic security. The first application is the Asynchronous Nanowire Reconfigurable Crossbar Architecture (ANRCA); the second one is an asynchronous S-Box design for cryptographic system against Side-Channel Attacks (SCA). The following are the contributions of the first application: 1) Proposed a diode- and resistor-based ANRCA (DR-ANRCA). Three configurable logic block (CLB) structures were designed to efficiently reconfigure a given DR-PGMB as one of the 27 arbitrary NCL threshold gates. A hierarchical architecture was also proposed to implement the higher level logic that requires a …

A Review Of National Msw Generation Assessments In The United States, David J. Tonjes, Krista L. Greene Jan 2012

A Review Of National Msw Generation Assessments In The United States, David J. Tonjes, Krista L. Greene

Technology & Society Faculty Publications

Municipal solid waste (MSW) is generated in very large quantities (probably, between 200 and 400 million tonnes per year) in the United States (US). MSW is generated at millions of places and there is no one precise, general definition for MSW that is generally applied, despite US Environmental Protection Agency efforts. As an element of both commerce and politics, reporting may be framed towards particular ends. Therefore, the two best known assessments of the quantity of US MSW production differ by approximately 50%. The assessors understand some of the reasons for the differences, but our analysis suggests that there are …
