Effect Of Nitrogen On Safflower Physiology And Productivity, Sj Mohamed, Aj Jellings, Mp Fuller Dec 2012

Effect Of Nitrogen On Safflower Physiology And Productivity, Sj Mohamed, Aj Jellings, Mp Fuller

School of Biological and Marine Sciences

Safflower (Carthamus tinctorius L.) is an oil-crop suitable for semi-arid agriculture, but its physiological response to agronomic inputs has yet to be fully evaluated. The effect of fertiliser on the physiology and production of safflower grown in pots filled with standard grade perlite inside a semi-controlled glass house was studied. Plants were initially irrigated with 20-100 ml standard hydroponic solution and then one month after germination plants were irrigated using 50-200 ml complete Hoagland’s solution, supplemented with one of eight levels of nitrogen (0, 25, 50, 75, 100, 125, 150, 175 kg N ha-1) in the form of ammonium nitrate. …

Instructing Juries On Noneconomic Contract Damages, David A. Hoffman, Alexander S. Radus Dec 2012

Instructing Juries On Noneconomic Contract Damages, David A. Hoffman, Alexander S. Radus

Fordham Law Review

Gathering pattern contract jury instructions from every state, we examine jurisdictions’ treatment of noneconomic damages. While the conventional account holds that there is a uniform preference against awards of noneconomic damages, we find four different approaches in pattern instructions, with only one state explicitly prohibiting juries from considering noneconomic losses. Lay juries have considerably more freedom to award the promisee’s noneconomic damages than the hornbooks would have us believe.

We substantiate this claim with an online survey experiment asking respondents about a simple contract case and instructing them using the differing pattern forms. We found that subjects routinely awarded more …

Conflict Minerals Legislation: The Sec’S New Role As Diplomatic And Humanitarian Watchdog, Karen E. Woody Dec 2012

Conflict Minerals Legislation: The Sec’S New Role As Diplomatic And Humanitarian Watchdog, Karen E. Woody

Fordham Law Review

Buried in the voluminous Dodd-Frank Wall Street Reform and Consumer Protection Act is an oft-overlooked provision requiring corporate disclosure of the use of “conflict minerals” in products manufactured by issuing corporations. This Article scrutinizes the legislative history and lobbying efforts behind the conflict minerals provision to establish that, unlike the majority of the bill, its goals are moral and political, rather than financial. Analyzing the history of disclosure requirements, the Article suggests that the presence of conflict minerals in an issuer’s product is not inherently material information and that the Dodd-Frank provision statutorily renders nonmaterial information material. The provision, therefore, …

We present the first multi-wavelength follow-up observations of two candidate gravitational-wave (GW) transient events recorded by LIGO and Virgo in their 2009-2010 science run. The events were selected with low latency by the network of GW detectors (within less than 10 minutes) and their candidate sky locations were observed by the Swift observatory (within 12 hr). Image transient detection was used to analyze the collected electromagnetic data, which were found to be consistent with background. Off-line analysis of the GW data alone has also established that the selected GW events show no evidence of an astrophysical origin; one of them …

The Cultural Analysis Paradigm: Women And Synagogue Ritual As A Case Study, Roberta Rosenthal Kwall Dec 2012

The Cultural Analysis Paradigm: Women And Synagogue Ritual As A Case Study, Roberta Rosenthal Kwall

Cardozo Law Review

This Article develops an original cultural analysis paradigm with significant implications for understanding the relationship between law and culture. It also illustrates how this relationship should inform the normative application of areas of law in which tensions exist between modern sensibilities and traditional practices steeped in cultural perspectives from other times. Indeed, the negotiation between preservation and change confronts all ancient cultural traditions in modernity. The specific application invoked in this Article concerns the issue of women being called to read publicly from the Torah, a subject of serious academic debate among observant Jews. The analysis demonstrates that the virtually …

Discovery About Discovery: Sampling Practice And The Resolution Of Discovery Disputes In An Age Of Ever-Increasing Information, Charles Yablon, Nick Landsman-Roos

Cardozo Law Review

This Article provides the first extended academic consideration of a new practice adopted by an increasing number of courts to resolve e-discovery disputes - the sampling of a small portion of the information sought in backup or other relatively inaccessible files. We provide a comprehensive overview and statistical analysis of contemporary sampling techniques, identifying issues where sampling practice is inconsistent or where additional guidance appears to be required. Our aim is to provide a coherent theoretical approach to the use of sampling, suggesting "best practices" for many unresolved issues, and locating sampling practice within broader contemporary debates about discovery.

Divided We Stand: Defying Hegemony In Theory And Practice, Anne Gregory, Gregor Halff Dec 2012

Divided We Stand: Defying Hegemony In Theory And Practice, Anne Gregory, Gregor Halff

Research Collection Lee Kong Chian School Of Business

The last decade has seen the world becoming increasingly complex. One way of dealing with complexity, according to Schwab (2010a), is to look for certainties or solutions that impose order by simplifying. The authors contend that this is also happening in public relations practice and the academy. They criticise attempts to produce global models which lead to hegemony and argue for maintaining a diversity that reflects reality. They take the cases of the UK and Singapore as respective exemplars where hegemony has succeeded and where it needs to be resisted. They call for a professional and epistemological stand against hegemony.

A National Security Staff For The 21st Century, Jack A. Lecuyer Dr. Dec 2012

A National Security Staff For The 21st Century, Jack A. Lecuyer Dr.

Books, Monographs & Collaborative Studies

View the Executive Summary

Our legacy 1947/1989 national security system is unsuited for the dynamic and complex global security environment that has developed since the end of the Cold War. Over time, the National Security Council has evolved from the very limited advisory group initially imagined by President Truman to that of a vast network of interagency groups that were developed since 1989. These interagency groups view themselves as deeply involved in integrating policy development, crisis management, and staffing for the President. However, the National Security Staff (NSS) and the national security system are relics of the industrial age—vertical stovepipes—in …

Reducing In-Stent Restenosis Through Novel Stent Flow Field Augmentation, Eoin Murphy, Fergal Boyle Dec 2012

Reducing In-Stent Restenosis Through Novel Stent Flow Field Augmentation, Eoin Murphy, Fergal Boyle

Articles

In-stent restenosis (ISR), manifested as a re-narrowing of the arterial lumen post-implantation of a stent, is a detrimental limitation of stent technology. Understanding and consequently devising ways of reducing the frequency of ISR has been a continuing goal of research into improved stent designs. The biological processes that can lead to ISR have been found to be partially flow dependent with the local hemodynamics at the arterial wall of crucial importance. This paper investigates these biological processes and their instigating factors. Furthermore, the history and theory behind three stent technologies which endeavour to reduce ISR rates through stent flow field …

A Combinatorial Solution For Scheduling Spatial Multiplexing In Mimo-Based Ad Hoc Networks, Maggie Cheng, Quanmin Ye

Computer Science Faculty Research & Creative Works

In a MIMO-Based ad hoc network, the conflict relation between transmissions is fundamentally changed due to the multiple packet reception capability of MIMO nodes. a MIMO node can receive from multiple data streams at the same time, which significantly increases data throughput. to fully utilize the additional spectrum capacity enabled by the MIMO technology, it is important that transmissions from different nodes are coordinated. the coordination scheme needs to consider both data stream multiplexing and transmission time scheduling for a maximum performance gain. in this paper, we use an optimization framework to jointly consider MIMO link spatial multiplexing and scheduling …

Traditional Knowledge, Cultural Expression, And The Siren’S Call Of Property, Justin Hughes Dec 2012

Traditional Knowledge, Cultural Expression, And The Siren’S Call Of Property, Justin Hughes

San Diego Law Review

Discussions on international legal norms for the protection of TK/TCE have, in their contemporary form, been ongoing since the late 1990s. In that time, our understanding of key issues for a workable system—subject matter, beneficiaries, rights, or protections—have advanced little, if at all. Indeed, as Michael Brown has observed, “vexing questions of origins and boundaries . . . are commonly swept under the rug in public discussions.” Yet even if all those questions were settled, we also need a clear justification or justifications for a new form of intellectual property on the world stage.

An Overview Of The Schwartz Theory Of Basic Values, Shalom H. Schwartz Dec 2012

An Overview Of The Schwartz Theory Of Basic Values, Shalom H. Schwartz

Online Readings in Psychology and Culture

This article presents an overview of the Schwartz theory of basic human values. It discusses the nature of values and spells out the features that are common to all values and what distinguishes one value from another. The theory identifies ten basic personal values that are recognized across cultures and explains where they come from. At the heart of the theory is the idea that values form a circular structure that reflects the motivations each value expresses. This circular structure, that captures the conflicts and compatibility among the ten values is apparently culturally universal. The article elucidates the psychological principles …

Fiberoptic Intubation In A Paediatric Patient With Severe Temporomandibular Joint (Tmj) Ankylosis, Ali Asghar, Faisal Shamim, Asiyah Aman

Department of Anaesthesia

Craniofacial abnormalities are associated with mandibular hypoplasia, reduced mandibular space with overcrowding of soft tissues and maxillary hypoplasia. Decreased mouth opening and limitation in jaw protrusion are independent predictors of difficult airway in such patients. The relative difficult problem becomes even graver in the paediatric age group because of their small mouth opening and un-cooperativeness. A child with severe temporomandibular joint (TMJ) ankylosis presented with negligible mouth opening and required surgical correction under general anaesthesia. Successful intubation was performed with endotracheal tube size 5.5 mm using an adult 4.3 mm fiberoptic bronchoscope under inhalational as well as topical anaesthesia.

Policy-Making Under Evo Morales: Explaining Ethnopopulist Redistributive Measures In Bolivia, Luis Ferreira

Graduate Program in International Studies Theses & Dissertations

The Evo Morales administration has radically transformed the Bolivian state since his election in 2005. As a result of Morales' indigenous identity and overt ethnic tensions in this state, there is a perception that this factor plays a decisive role in Bolivia's policymaking. However, as the 'renegotiation' of the hydrocarbon industry in 2006 demonstrates, ethnopopulism and political survival provide the most comprehensive approach to predicting the policies of the current Bolivian government.

The resistance to liberalization efforts, the success of redistributive measures and the role identity has had in Bolivia explains why this approach to policy-making has allowed Morales to …

The Role Of Saturated Fatty Acids In Connexin Expression On Endothelial Cells And Eosinophils, Kurt Anthony Ashack Dec 2012

The Role Of Saturated Fatty Acids In Connexin Expression On Endothelial Cells And Eosinophils, Kurt Anthony Ashack

Masters Theses

Eotaxin is a potent chemoattractant for eosinophils that becomes elevated in the tissues in response to inflammation and increased adiposity. Therefore, eosinophil migration into adipose tissue should increase in diet-induced obese individuals, yet it does not. This suggested to us that something within the cellular microenvironment of diet-induced obese individuals might be altering the endothelial leukocyte adhesion molecules (ELAM) such as VCAM-1 or selectins on the endothelial cells, thus preventing eosinophils from entering the inflamed tissue. Connexons are gap junctions in endothelial cells and on immune cells such as macrophages that are composed of connexins and have been shown to …
