Like General Sherman marching toward Atlanta (or Justin Tuck marching toward Tom Brady), Professor Redish, together with Matthew Arnould,1 lays waste to every constitutional theory that he encounters. Originalism, with its “belief that constitutional interpretation should be characterized exclusively by an effort to determine the Constitution’s meaning by means of some form of historical inquiry,”2 generates “an often contrived and opaque veil of historical inquiry”3 that provides “an ideal smokescreen behind which judges may pursue their personal[,] moral, political[,] or economic goals with relative impunity.”4 Nontextual theories, for their part, “permit[] selective …

"In oxygen-deficient or toxic environments in which controlling the hazard is not feasible, workers wear personal protective respirators. Hazard controls include but are not limited to engineering controls, such as ventilation, and substituting less hazardous materials. However, respirator selection and the design of tasks that require respirators are critical issues. Understanding the effects of respirators on human abilities is critical to respirator selection and therefore to the safety and efficiency of workers. This research investigated the effect of respirators on human abilities. Low Frequency Temperature Variability And Native American Horticulture In The Northern Southwest And Eastern Great Basin, James R. Allison

Recent paleoclimatic studies reconstruct low-frequency variability in temperature that may have affected the success of Native American horticulture. Potential effects of this temperature variability include shifts in the range of elevations within which horticulture was viable, and changes in the northern limits of horticulture- based economies. This paper examines radiocarbon dates and other chronological data from Fremont and Puebloan sites in Utah, eastern Nevada, and northwestern Arizona, comparing the low-frequency temperature reconstructions with the timing of expansion and contraction in the northern frontier of maize horticulture and temporal shifts in the elevations of farming settlements.

The Sexual Socialization Of Sexual Offenders: How They Learn About Sexuality And How It Influences Their Future Behaviors, Erin Nicole Ditscheit

Every day, stories of individuals who have been sexually victimized dominate headline news. Despite the large amount of research conducted on sexual offenders, there is no known single etiology for their offense. This study investigates how sexual socialization plays a role in an offender's sexual attitudes and beliefs. Using data from a sample of 71 convicted sexual offenders from a single district in the Midwest, it was found that there is a relationship between certain media sources and negative attitudes towards women and sexuality. Meanwhile, In The West: Early Pueblo Communities In Southeastern Utah, James R. Allison, Winston B. Hurst, Jonathan D. Till, Donald C. Irwin

The early Pueblo settlement of what is now southeastern Utah exhibits patterns that complement and contrast with trends in better-known regions such as southwestern Colorado (see Wilshusen et al., Chapter 2). Shortcomings in the current data limit the detail we can include in this description, but a number of patterns are clear. This chapter elucidates the patterned variability in the area's settlement strategies, the basic trends associated with social organization, and the basic demographic trends through time. We hope to develop, in the end, a basic historical narrative for these last centuries of the first millennium.

The development of English into an international lingua franca is not an inevitable result of globalizing forces. Instead, the “triumph” of the English language and the consequent decline of the world’s linguistic diversity cannot be viewed in isolation of its parallel history of conquest, violence, power and exploitation. Mexican immigrant women report being physically active prior to arrival in the United States. However, with increased years of U.S. residency, this positive lifestyle behavior diminishes, increasing their risk of obesity and chronic disease. A qualitative descriptive design was used to elicit recent Mexican immigrant women’s perceptions of “being physically active” and to describe how living in the United States has influenced their perceptions of being physically active. Three themes were inductively generated: (a) purposeful exercising, (b) being active, and (c) being active with purposeful exercising. The dramatic change in some important aspects of this country after the collapse of New Order Regime, primarily in the political aspect, provided larger opportunity to Indonesian Chinese in constructing their real identity, included to the Indonesian Chinese Muslim. The issue of perspective is intrinsic to historiography. This is evident in the ancient Greco-Roman literary record, specifically the limits placed on its value to modern academics by the ethnographic biases of its authors. However, with the rise of the post-processual approach to archaeology over the past thirty years, modern historians have begun to address this issue. This study seeks to understand how global discourses of sea level rise (SLR) and mangrove ecology influence national climate change adaptation policy to reduce coastal vulnerability in Suriname. A majority of the Surinamese population lives along the low elevation coastal zone and is highly exposed to projected SLR. Failure by the international community to reach agreement on climate change mitigation means that vulnerable coastal communities must adapt. The Suriname coast is predominantly shaped by mudbanks and mangroves which together provide protection against coastal erosion and trap sediments resulting in coastal accretion. This project is a study of musical rhetoric and music composition processes. It asks the questions, "How does the nature of music as sound-in-time affect its rhetorical functions, production, and delivery?" and "How do composers approach the task of communicating with audiences through instrumental music?" I answer these questions by turning to the history of musical rhetoric as practiced in the field of musicology and by interviewing composers themselves about their composition practices--approaches that are both underused in the rhetoric and composition community.

This research within this exegesis has developed out of the idea that pedestrian passage through public urban space is characterised by slippages in the perception of time and the senses. This concept is theoretically framed by Marc Augé’s notion of “non-place” (1995) and Michel de Certeau’s (1984) unconscious phenomenology of walking the city street. This exegesis examines the development of a reflexive unconscious language within a visual arts practice, as a tactics of resistance to controlled pedestrian passage. Background: Obesity and overweight in Africa have been attributed to demogra- phic and nutritional changes that have resulted from urbanization and sedentary lifestyles and increased caloric intake without much physical activities. This has put populations at an increased risk of cardiovascular diseases, Diabetes mellitus, osteoarthritis, dyslipidemia, and cancer. Epidemiological research on sexual difficulties in women has reported high rates of sexual problems and dissatisfaction across the lifespan. Nevertheless, feminist scholars and social science researchers argue that an absence of research exploring women’s subjective interpretations of their sexuality and sexual difficulties exists, since prevalence studies do not address how the range of diverse socio-cultural, relational, biological and psychological processes interact to influence women’s sexuality across the lifespan. The current study aimed to narrow this research dearth by presenting an in-depth, qualitative exploration of heterosexual women’s accounts of their sexual experiences and their perceived sexuality.
