Defying Borders: Transforming Learning Through Collaborative Feminist Organizing And Interdisciplinary, Transnational Pedagogy, Terri Carney, Margaretha Geertsema Sligh, Ann M. Savage, Ageeth Sluis

Scholarship and Professional Work - LAS

The authors provide a case study of how a group of faculty members was able to initiate a transformation in student learning and institutional structures at a small university in the Midwestern U.S. through the introduction of collaborative feminist organizing and pedagogy. It details faculty-led initiatives that set the stage for innovative teaching and learning, and it describes the authors' experience in the face of resistance when introducing a global women's human rights course into the university's new core curriculum. Because of its divers, interdisciplinary and transnational content, this course challenged deeply ingrained disciplinary and pedagogical borders of both traditional …

Luis Goytisolo's Teoría Del Conocimiento As Postmodern Autobiography, Terri Carney Jan 2012

Luis Goytisolo's Teoría Del Conocimiento As Postmodern Autobiography, Terri Carney

Scholarship and Professional Work - LAS

Dancing The Numinous: Sacred And Spiritual Techniques Of Contemporary American Belly Dancers, Jeana Jorgensen Jan 2012

Dancing The Numinous: Sacred And Spiritual Techniques Of Contemporary American Belly Dancers, Jeana Jorgensen

Scholarship and Professional Work - LAS

In this paper, I explore how contemporary American practitioners of belly dance (as Middle Eastern dance and its many varieties are often called in the English-speaking world) conceptualize not only the spiritual dimensions of their dance, but also how the very notion of performance affects sacred and spiritual dance practices. Drawing on interviews with this community, I describe the techniques of sacred and spiritual belly dancers, how these dancers theorize performance, and how the conflicts inherent to patriarchal mind-body dualism are resolved in these practices. My purpose here is twofold: to document an emergent dance tradition and to analyze its …

Queering Kinship In ‘The Maiden Who Seeks Her Brothers', Jeana Jorgensen

Scholarship and Professional Work - LAS

The fairy tales in the Kinder- und Hausmiirchen, or Children's and Household Tales, compiled by Jacob and Wilhelm Grimm are among the world's most popular, yet they have also provoked discussion and debate regarding their authenticity, violent imagery, and restrictive gender roles. In this chapter I interpret the three versions published by the Grimm brothers of ATU 451, "The Maiden Who Seeks Her Brothers," focusing on constructions of family, femininity, and identity. I utilize the folkloristic methodology of allomotific analysis, integrating feminist and queer theories of kinship and gender roles. I follow Pauline Greenhill by taking a queer view of …

Sex, Work, And The Feminist Erasure Of Class, Brooke M. Beloso Jan 2012

Sex, Work, And The Feminist Erasure Of Class, Brooke M. Beloso

Scholarship and Professional Work - LAS

In this essay, I trace the contemporary feminist debate on prostitution to the period in which Catharine MacKinnon and Gayle Rubin deemed Marxism inadequate to the task of theorizing women’s oppression. In seeking to surmount this perceived inadequacy, both thinkers counterposed alternative theoretical frameworks for analyzing women’s oppression that nonetheless relied upon certain of Marxism’s central tenets. In a reliance that took the form of strikingly similar translations of Marxism foregrounding what came to be known as radical feminism (in the case of MacKinnon) and queer theory (in the case of Rubin), both theorists problematically render class as, respectively, gender …

Sudado De Raya: An Ancient Peruvian Dish, Robert Bradley Jan 2012

Sudado De Raya: An Ancient Peruvian Dish, Robert Bradley

School of Art & Design Faculty Publications

This article delineates the ancient culinary origins of a stew made from ray meat, which remains popular to this day in villages on Peru's North Coast. The major components of the dish (ray meat, chicha beer, ají pepper, and mococho edible seaweed) are thoroughly discussed in reference to the pre-Columbian record and the preparation of the recipe. The ancient Peruvian tradition of fishing is outlined and numerous references are made to maritime imagery in the art of the prehispanic Moche people. The cultural tradition and architecture of the Moche serve as a backdrop for the entire discussion.

Volume 3: Ethnographies Of Islam : Ritual Performances And Everyday Practices, Baudouin Dupret, Thomas Pierret, Paulo G. Pinto, Kathryn Spellman-Poots

Exploring Muslim Contexts

This comparative approach to the various uses of the ethnographic method in research about Islam in anthropology and other social sciences is particularly relevant in the current climate. Political discourses and stereotypical media portrayals of Islam as a monolithic civilisation have prevented the emergence of cultural pluralism and individual freedom.

This book counters such discourses by showing the diversity and plurality of Muslim societies and by promoting reflection on how the ethnographic method allows the description, representation and analysis of the social and cultural complexity of Muslim societies in the discourse of anthropology.

Feminist Legal Realism, Mae C. Quinn Jan 2012

Feminist Legal Realism, Mae C. Quinn

Journal Articles

This Article begins to rethink current conceptions of two of the most significant legal movements in this country1—Legal Realism and Feminist Jurisprudence. The story of Legal Realism has been retold for decades. Authors have dedicated countless books,2 law review articles,3 and blog posts4 to the subject. Legal and other scholars repeatedly have attempted to define better the movement and ascertain its adherents. Although the usual suspects— Karl Llewellyn, Roscoe Pound, and Jerome Frank—are almost always a part of the conversation, surprisingly few agree on the totality of Realism’s personage or parameters. The lists of those considered realists— and there are …

Social Context Of Disclosing Hiv Test Results In Tanzania, Joe Lugalla, Stanley Yoder, Huruma Sigala, Charles Madihi Jan 2012

Social Context Of Disclosing Hiv Test Results In Tanzania, Joe Lugalla, Stanley Yoder, Huruma Sigala, Charles Madihi

Institute for Educational Development, East Africa

This study sought to understand how individuals reveal their HIV test results to others and the ways in which social relations affect the disclosure process. The data were collected through open-ended interviews administered in Swahili to informants who had just been tested for HIV and to those who were living with HIV in Dar es Salaam and Iringa regions. Analysis shows that social relations influence the decisions individuals make about disclosure. Most people preferred to reveal their HIV status to close family members. Most also mentioned the fear of being rejected and discriminated against as major reasons for not disclosing …

Transnational Comparisons: Theory And Practice Of Comparative Law As A Critique Of Global Governance, Peer Zumbansen Jan 2012

Transnational Comparisons: Theory And Practice Of Comparative Law As A Critique Of Global Governance, Peer Zumbansen

Comparative Research in Law & Political Economy

A project seeking to assert and contrast the ‘practice’ of comparative law in distinction from the well-known and longstanding theoretical critique of the field is itself in need to define the meaning of practice. The following chapter, written for a volume edited by Jacco Bomhoff and Maurice Adams, takes up this challenge in two steps. In a first one, it revisits comparative law’s seemingly eternal self-doubt regarding its target of inquiry and its method. I will suggest that there is a great promise for comparative legal studies in the context of transnational legal pluralism as a methodological approach to the …

Polygamy And The Predicament Of Contemporary Criminal Law, Benjamin L. Berger Jan 2012

Polygamy And The Predicament Of Contemporary Criminal Law, Benjamin L. Berger

Comparative Research in Law & Political Economy

This piece steps back from the substantive debate about whether polygamy out to be prohibited by the criminal law, or about the presence or absence of harms that inhere in the practice, asking instead what the debate discloses about the conceptual structure of contemporary criminal law itself. The paper proceeds from two observations about the current debate regarding the constitutionality of the criminalization of polygamy: first, that the issue has generated a degree of anxiety and attention disproportionate to the prevalence of the phenomenon and, second, what one might call a “strange bedfellows” puzzle – the fact that groups of …

The Aesthetics Of Religious Freedom, Benjamin L. Berger Jan 2012

The Aesthetics Of Religious Freedom, Benjamin L. Berger

Comparative Research in Law & Political Economy

What influence might legal aesthetics have on the shape of religious freedom? Focusing on time and space as foundational elements of the perception of phenomena, this paper argues that these aesthetic intuitions are an under-examined and yet elemental component of what conditions and shapes religious freedom in liberal constitutional orders. If one takes law to be a cultural form, attention to these basic facets of legal perception is essential to understanding law’s encounter with religion. Drawing from a range of examples in the Canadian jurisprudence, this paper shows that legal approaches to religious diversity, multiculturalism, tolerance, and accommodation are all …

Rethinking The Nature Of The Firm: The Corporation As A Governance Object, Peer Zumbansen Jan 2012

Rethinking The Nature Of The Firm: The Corporation As A Governance Object, Peer Zumbansen

Comparative Research in Law & Political Economy

This article attempts to bridge two discourses — corporate governance and contract governance. Regarding the latter, a group of scholars has recently set out to develop a more comprehensive research agenda to explore the governance dimensions of contractual relations, highlighting the potential of contract theory to develop a more encompassing theory of social and economic transactions. While a renewed interest in the contribution of economic theory for a concept of contract governance drives one dimension of this research, another part of this undertaking has been to move contract theory closer to theories of social organization. Here, these scholars emphasize the …

Lochner Disembedded: The Anxieties Of Law In A Global Context, Peer Zumbansen Jan 2012

Lochner Disembedded: The Anxieties Of Law In A Global Context, Peer Zumbansen

Comparative Research in Law & Political Economy

This paper explores, in an inevitably cursory manner, some of the main challenges facing a legal theory of transnational governance today. In part building on and responding to William Twining’s identification of key problems of law in a global context (2009, 2012), the following essay adopts a two-fold approach. One element is to suggest a conceptual architecture, which captures law in its transformational state through a focus on 'actors, norms, and processes.' Secondly, the essay proposes 'case studies' as a central methodological device to explore the nature, scope, function of governance – both legal but also non-legal governance – in …

Transnational Private Regulatory Governance: Ambiguities Of Public Authority And Private Power, Peer Zumbansen Jan 2012

Transnational Private Regulatory Governance: Ambiguities Of Public Authority And Private Power, Peer Zumbansen

Comparative Research in Law & Political Economy

The continuing proliferation of transnational private regulatory governance challenges conceptions of legal authority, legitimacy and public regulation of economic activity. The transnational law merchant or, lex mercatoria, is a case in point in this context, as it represents a laboratory for the exploration of “private” contractual governance in a context, in which the assertion of public or private authority has itself become contentious. The ambiguity surrounding many forms of today’s contractual governance in the transnational arena echoes that of the far-reaching transformation of public regulatory governance, which has been characteristic of Western welfare states over the last few decades. What …

Using Critical Race Theory To Analyze How Disney Constructs Diversity: A Construct For The Baccalaureate Human Behavior In The Social Environment Curriculum, Amy Cappiccie, Janice Chadha, Muh Bi Lin, Frank Snyder Jan 2012

Using Critical Race Theory To Analyze How Disney Constructs Diversity: A Construct For The Baccalaureate Human Behavior In The Social Environment Curriculum, Amy Cappiccie, Janice Chadha, Muh Bi Lin, Frank Snyder

Faculty Publications - College of Social Work

Utilizing the basic tenets of critical race theory, the authors draw upon the expertise of multicultural scholars to raise consciousness and facilitate BSW classroom dialogue about microagressions perpetrated in Disney animations. Microaggressions pervade our media partly because they typically operate outside the thresh-old of the dominant culture’s conscious awareness. Our main consciousness-raising method is to expose social work students to microagressions depicted in Disney animations and then use the classroom as a counterspace to process the experience. We note that utilizing critical race theory to become conscious of microaggressions within Disney animations is the first step toward eradicating them.

Sea-Level Rise And Its Impact On Vulnerable States: Four Examples, Ann Powers

Elisabeth Haub School of Law Faculty Publications

This article first examines the physical, cultural, and economic backgrounds of four vulnerable states—Tuvalu, Seychelles, Maldives, and Bangladesh—and discusses the extent to which each might be affected by sea-level rise. It then considers, in turn, the legal implications of the current rules on maritime delimitation under UNCLOS for the states, along with their efforts to adapt to sea-level rise.
