Leveling Up To Immersive Dispute Resolution (Idr) In 3-D Virtual Worlds: Learning And Employing Key Idr Skills To Resolve In-World Developer-Participant Conflicts, Lucille M. Ponte
Leveling Up To Immersive Dispute Resolution (Idr) In 3-D Virtual Worlds: Learning And Employing Key Idr Skills To Resolve In-World Developer-Participant Conflicts, Lucille M. Ponte
University of Arkansas at Little Rock Law Review
This article proposes a new conflict resolution approach called "immersive dispute resolution" (IDR) through the use of existing communication and graphical technology in 3-D virtual worlds as well as the collaborative and strategic thinking skills virtual world participants acquire in digital experiences. Specifically, this article begins by discussing research on learning in virtual worlds, with an emphasis on key collaborative conflict resolution skills accumulated through play in virtual environments. Next, this article discusses current dispute resolution processes available in certain 3-D worlds which fail to leverage the technology or collaborative skills available in these environments, and finishes with a call …
An Empirical Study Of Predispute Mandatory Arbitration Clauses In Social Media Terms Of Service Agreements, Michael L. Rustad, Richard Buckingham, Diane D’Angelo, Katherine Durlacher
An Empirical Study Of Predispute Mandatory Arbitration Clauses In Social Media Terms Of Service Agreements, Michael L. Rustad, Richard Buckingham, Diane D’Angelo, Katherine Durlacher
University of Arkansas at Little Rock Law Review
This Article is the first empirical study of the use of predispute mandatory arbitration clauses by social networking sites (SNSs) and sheds light on whether SNSs are using arbitration clauses strategically in order to complete a "liability-free" zone in cyberspace. Our empirical findings reveal that SNS arbitration clauses contravene many of the basic principles deemed indispensable for a fundamentally fair process for consumers to obtain civil recourse for recognized torts and remedies for contract disputes. Congress needs to prohibit predispute mandatory arbitration clauses in terms of service agreements and privacy policies.
Expanding The Horizons Of Horizontal Inquiry Into Rights Consciousness: An Engagement With David Engel, Michael W. Mccann
Expanding The Horizons Of Horizontal Inquiry Into Rights Consciousness: An Engagement With David Engel, Michael W. Mccann
Indiana Journal of Global Legal Studies
This Comment interprets and reflects on the key features of David Engel's argument about the importance of balancing vertical models of rights diffusion with horizontal ethnographic studies of how rights consciousness develops out of practical experience in everyday social contexts. The primary focus is on endorsing the general argument and amplifying some understated or undeveloped dimensions of Engel's position. In particular, this reflection makes the case for: 1) expanding the range of subjects and contexts subjected to horizontal study, including especially greater attention to "haves" and elite actors; 2) studying subjects expected to have high rights consciousness as well as …

Punishment Without Culpability, John F. Stinneford
Punishment Without Culpability, John F. Stinneford
UF Law Faculty Publications
For more than half a century, academic commentators have criticized the Supreme Court for failing to articulate a substantive constitutional conception of criminal law. Although the Court enforces various procedural protections that the Constitution provides for criminal defendants, it has left the question of what a crime is purely to the discretion of the legislature. This failure has permitted legislatures to evade the Constitution’s procedural protections by reclassifying crimes as civil causes of action, eliminating key elements (such as mens rea) or reclassifying them as defenses or sentencing factors, and authorizing severe punishments for crimes traditionally considered relatively minor.

How Not To Criminalize Cyberbullying, Lyrissa Barnett Lidsky, Andrea Garcia
How Not To Criminalize Cyberbullying, Lyrissa Barnett Lidsky, Andrea Garcia
UF Law Faculty Publications
This essay provides a sustained constitutional critique of the growing body of laws criminalizing cyberbullying. These laws typically proceed by either modernizing existing harassment and stalking laws or crafting new criminal offenses. Both paths are beset with First Amendment perils, which this essay illustrates through 'case studies' of selected legislative efforts. Though sympathetic to the aims of these new laws, this essay contends that reflexive criminalization in response to tragic cyberbullying incidents has led law-makers to conflate cyberbullying as a social problem with cyberbullying as a criminal problem, creating pernicious consequences. The legislative zeal to eradicate cyberbullying potentially produces disproportionate …

Distributional Survey And Habitat Associations Of Crayfishes In Three River Basins In Kansas, Ryan Lee Pinkall
Distributional Survey And Habitat Associations Of Crayfishes In Three River Basins In Kansas, Ryan Lee Pinkall
Master's Theses or Doctor of Nursing Practice
Kansas represents the western most edge of high crayfish diversity in North America. The most recent comprehensive survey of crayfishes in Kansas was conducted over 50 years ago and resulted in a list of seven species. Subsequently, three species were added sporadically. The most recent summary of crayfishes in Kansas included 10 species and suggested the highest diversity to be located in the northeastern portion of the state. I surveyed crayfishes in three river basins in Kansas during the summers of 2009, 2010, and 2011: Kansas-Lower Republican, Missouri, and Upper Republican. Sites were selected based on stream order and partitioned …

Several plants species in the genus Ardisia contained various biologically active compounds. Ram Yai orPilangkasa (Ardisia elliptica Thunb.) has been used in traditional medicines. The objective of this study was to evaluatethe safety of ethanolic extract of A. elliptica fruit in animal models by oral administration. Acute toxicity test in miceby gavage the extract at each dose of 2.5 g/kg twice revealed no abnormal signs, mortality and gross lesion of vitalorgans. Subchronic toxicity study was investigated in one hundred Wistar rats separated into five groups, each oftwenty (ten males and ten females). Two control groups received distilled water and 0.5% …
Color In Context: Psychological Context Moderates The Influence Of Red On Approach- And Avoidance-Motivated Behavior, Brian P. Meier, Paul R. D'Agostino, Andrew J. Elliott, Markus A. Meier, Benjamin M. Wilkowski
Color In Context: Psychological Context Moderates The Influence Of Red On Approach- And Avoidance-Motivated Behavior, Brian P. Meier, Paul R. D'Agostino, Andrew J. Elliott, Markus A. Meier, Benjamin M. Wilkowski
Psychology Faculty Publications
A basic premise of the recently proffered color-in-context model is that the influence of color on psychological functioning varies as a function of the psychological context in which color is perceived. Some research has examined the appetitive and aversive implications of viewing the color red in romance- and achievement-relevant contexts, respectively, but in all existing empirical work approach and avoidance behavior has been studied in separate tasks and separate experiments. Research is needed to directly test whether red influences the same behavior differently depending entirely on psychological context.
The present experiment was designed to put this premise to direct test …

The Institution Matching Canon, Aziz Huq
The Institution Matching Canon, Aziz Huq
Public Law and Legal Theory Working Papers
This Article identifies and analyzes a transsubstantive tool of constitutional doctrine that to date has escaped scholarly attention. The Article terms this device the “institution matching” canon. It can be stated briefly as follows: When the government makes a decision that may impinge upon a liberty or equality interest—which may or may not be directly judicially enforced otherwise—a court should determine whether the component of government that made the decision has actual competence in and responsibility for the policy justifications invoked to curtail the interest. If not, the court should reject the government action but leave open the possibility of …
The Role Of Numerical Competence In A Specialized Predatory Strategy Of An Araneophagic Spider, Ximena J. Nelson, Robert R. Jackson
The Role Of Numerical Competence In A Specialized Predatory Strategy Of An Araneophagic Spider, Ximena J. Nelson, Robert R. Jackson
All Peer-Reviewed Publications
Although a wide range of vertebrates have been considered in research on numerical competence, little is known about the role of number-related decisions in the predatory strategies of invertebrates. Here, we investigate how numerical competence is expressed in a highly specialized predatory strategy adopted by the small juveniles of Portiaafricana when practicing communal predation, with the prey being another spider, Oecobius amboseli. Two or more P. africana juveniles sometimes settle by the same oecobiid nest and then share the meal after one individual captures the oecobiid. Experiments were designed to clarify how these predators use number-related cues in conjunction with …
Engaging With Tradition: Mechanisms, Strategies, And Tactics, Michael Edwards
Engaging With Tradition: Mechanisms, Strategies, And Tactics, Michael Edwards
Center for Gender & Sexuality Law
The relationships between tradition and social justice are complex and contingent, conditioned by many factors including social context, individual attachments and mechanisms of transmission and re-enactment. These relationships may be positive, negative or neutral from the perspective of LGBT concerns, and they may be approached in a variety of different ways according to the goals and circumstances at hand. The Engaging Tradition Project aims to explore these patterns in order to establish when and why tradition forms a barrier to the achievement of gender and sexual justice, and to identify how tradition can be deployed in positive ways by activists …

Shorter Migration Distances Associated With Higher Winter Temperatures Suggest A Mechanism For Advancing Nesting Phenology Of American Kestrels Falco Sparverius, Julie A. Heath, Karen Steenhof, Mark A. Foster
Biology Faculty Publications and Presentations
Global climate change has affected avian migration patterns and nesting phenology. Changes in one phase of a bird's cycle will most likely affect other stages, but few studies focus simultaneously on multiple life-history events. We used western North American ringing records and Christmas Bird Counts to examine whether changes in migration patterns were concordant with advancing American kestrel Falco sparverius nesting phenology. Consistent with previous findings, male kestrels migrated shorter distances than female kestrels, and kestrels nesting in southern latitudes migrated shorter distances than kestrels nesting in more northern areas. In addition, kestrel migration distance decreased significantly from 1960 to …
Sensitivity Of Circumpolar Deep Water Transport And Ice Shelf Basal Melt Along The West Antarctic Peninsula To Changes In The Winds, Michael S. Dinniman, John M. Klinck, Eileen E. Hofmann
Sensitivity Of Circumpolar Deep Water Transport And Ice Shelf Basal Melt Along The West Antarctic Peninsula To Changes In The Winds, Michael S. Dinniman, John M. Klinck, Eileen E. Hofmann
CCPO Publications
Circumpolar Deep Water (CDW) can be found near the continental shelf break around most of Antarctica. Advection of this relatively warm water (up to 2 degrees C) across the continental shelf to the base of floating ice shelves is thought to be a critical source of heat for basal melting in some locations. A high-resolution (4 km) regional ocean-sea ice-ice shelf model of the west Antarctic Peninsula (WAP) coastal ocean was used to examine the effects of changes in the winds on across-shelf CDW transport and ice shelf basal melt. Increases and decreases in the strength of the wind fields …

A Large-Scale Mathematical Model Of The Rat Pulmonary Circulation And The Effect Of Chronic Hypoxia, Loolu Rafeeq
A Large-Scale Mathematical Model Of The Rat Pulmonary Circulation And The Effect Of Chronic Hypoxia, Loolu Rafeeq
Master's Theses (2009 -)
Mathematical models are useful for developing understanding of the behavior of complex biological systems. Recent work on a “physiome” project is aimed at using computational modeling to analyze integrative biological function by developing a simulation system for hypothesis testing (Borg & Hunter, 2003). To date, extensive work on cardiovascular, endocrine and nervous system models has been undertaken. Our objective here is to contribute to this effort by further developing a comprehensive integrative model of the pulmonary circulation. A computational model of the dog pulmonary circulation was originally developed by Haworth et al. (Haworth S. T., 1996; Haworth, Linehan, Bronikowski, & …
Three Theories Of Copyright In Ratings, James Grimmelmann
Three Theories Of Copyright In Ratings, James Grimmelmann
Cornell Law Faculty Publications
Are ratings copyrightable? The answer depends on what ratings are. As a history of copyright in ratings shows, some courts treat them as unoriginal facts, some treat them as creative opinions, and some treat them as troubling self-fulfilling prophecies. The push and pull among these three theories explains why ratings are such a difficult boundary case for copyright, both doctrinally and theoretically. The fact-opinion tension creates a perverse incentive for raters: the less useful a rating, the more copyrightable it looks. Self-fulfilling ratings are the most troubling of all: copyright’s usual balance between incentives and access becomes indeterminate when ratings …
Continual Passage Of Staphylococcus Epidermidis In Subinhibitory Levels Of The Biocide Triclosan Results In A Marked Increase In The Minimum Inhibitory Concentration, Antibiotic Resistance, And Ethidium Bromide Resistance, William T. Moore
Master's Theses or Doctor of Nursing Practice
Triclosan is a multi-purpose biocide that is used in many personal care products, including antibacterial hand soaps and toothpastes. The wide usage of triclosan fosters its dispersal into the enviro11l11ent, which might contribute to the ability of microorganisms to become resistant to triclosan in addition to certain other biocides and clinical antibiotics. The aim of this study was to evaluate whether long-term exposure of two strains of Staphylococcal epide]'midis to subinhibitory concentrations of triclosan would select for resistant mutants, and whether their ability to form polysaccharide biofilms lends to this resistance. This study also aimed to determine whether a mutation …
A Plea For Freedom: Enslaved Independence Through Petitions For Freedom In Washington D.C. Between 1810 And 1830, Trevor J. Shalon
A Plea For Freedom: Enslaved Independence Through Petitions For Freedom In Washington D.C. Between 1810 And 1830, Trevor J. Shalon
Department of History: Dissertations, Theses, and Student Research
Between 1810 and 1830, over 190 petitions for freedom by African Americans went through the District Court of Washington D.C. The free African American community which had emerged following the American Revolution had been restricted in the beginning of the nineteenth century and the rights granted to free and enslaved African Americans were retracted. The methods by which enslaved African Americans had used to obtain their freedom were eliminated and more innovative methods would needed in order to continue the expansion of the free community.
As the nineteenth century progressed, as other methods were eliminated, the number of petitions issued …
Mechanisms Of Group Ii Intron Loss From The Mitochondrial Cox2 Gene Of Plants, Nancy J. Hepburn
Mechanisms Of Group Ii Intron Loss From The Mitochondrial Cox2 Gene Of Plants, Nancy J. Hepburn
Department of Agronomy and Horticulture: Dissertations, Theses, and Student Research
It has been 35 years since the discovery of introns. Although fundamental aspects of their function and evolutionary origins have been widely studied, the mechanisms of intron loss are still an unresolved evolutionary mystery. Previously proposed mechanisms of intron loss include exonization, random genomic deletion and retroprocessing. The mitochondrial genomes of land plants have been characterized by widespread intron loss. In angiosperms, two introns located in the cox2 gene display a particularly variable intron distribution, indicating frequent loss. We took advantage of the frequent intron loss from cox2 to investigate the possible mechanisms of loss from this gene. The first …
Toward A Situational Model For Regulating International Crimes, Andrew K. Woods
Toward A Situational Model For Regulating International Crimes, Andrew K. Woods
Law Faculty Scholarly Articles
The international criminal regime, as currently conceived, relies almost exclusively on the power of backward-looking criminal sanctions to deter future international crimes. This model reflects the dominant mid-century approach to crime control, which was essentially reactive. Since then, domestic criminal scholars and practitioners have developed and implemented new theories of crime control—theories notable for their promise of crime prevention through ex ante attention to community and environmental factors. Community policing crime prevention through environmental design, and related "situational" approaches to crime control have had a significant impact on the administration of domestic criminal law.
This Article evaluates the implications of …

"The Need For Nature: Exploring Youth Leadership Development Through Outdoor Activities", Margaret A. Dudley
Capstone Collection
Youth are increasingly spending more time indoors. A young person spends hours in front of different screens, tuned out to their natural surroundings. When numerous studies have linked spending time outdoors to physical, mental, and emotional health, this increase in indoor time is disturbing. Youth living in apartment complexes in the Western Suburbs of Minneapolis do not have a lot of natural outdoor space close to their homes or transportation to parks, to enrich creativity and promote independence. This paper explores what has been called, the nature-deficit disorder, among youth today, and how one organization, the CONECT (Community Organizations Networking …
