The Constitutional Bond In Military Professionalism: A Reply To Professor Deborah N. Pearlstein, Diane H. Mazur Jan 2012

The Constitutional Bond In Military Professionalism: A Reply To Professor Deborah N. Pearlstein, Diane H. Mazur

UF Law Faculty Publications

The Soldier, the State, and the Separation of Powers is important and very persuasive. (In this Response, I will call it Separation of Powers to distinguish it clearly from The Soldier and the State,7 the classic work on civil–military relations referenced in the title.) Professor Pearlstein asks the right questions and reaches the right conclusions—no small task when law professors have typically deferred to expertise in other fields, if not avoided the subject entirely.8 What do we mean by civilian control of the military? Where is the line between a military that offers its professional expertise to civilian decision makers …

Nonbelievers And Government Speech, Caroline Mala Corbin Jan 2012

Nonbelievers And Government Speech, Caroline Mala Corbin

Articles

In the past few years, nonbelievers have become much more prominent in the United States. But while their visibility has increased, they are still a small minority, and they remain disliked, distrusted, and not truly American in the eyes of many. As a result, many nonbelievers are hesitant about disclosing their views, and those who do often face hostility and discrimination.

This Article argues that government religious speech such as "In God We Trust" or a Latin cross war memorial violates the Establishment Clause in part because it exacerbates the precarious position of nonbelievers in this country. One of the …

Grts And Graphs: Monitoring Natural Resources In Urban Landscapes, Todd R. Lookingbill, John Paul Schmit, Shawn L. Carter Jan 2012

Grts And Graphs: Monitoring Natural Resources In Urban Landscapes, Todd R. Lookingbill, John Paul Schmit, Shawn L. Carter

Geography and the Environment Faculty Publications

Environmental monitoring programs are an important tool for providing land managers with a scientific basis for management decisions. However, many ecological processes operate on spatial scales that transcend management boundaries (Schonewald-Cox 1988). For example, adjacent lands may influence protected-area resources via edge effects, source-sink dynamics, or invasion processes (Jones et al. 2009). Hydrologic alterations outside management units also may have profound effects on the integrity of resources being managed (Pringle 2000). The impacts of climate change are presenting challenges to resource management at local-to-global scales (Karl et al. 2009). This potential disparity between ecological and political boundaries presents an interesting …

Looking Beyond The Bang For More Bucks: A Legislative Gift To Fund Wildlife Conservation On Its 75th Anniversary, Katie Spidalieri Jan 2012

Looking Beyond The Bang For More Bucks: A Legislative Gift To Fund Wildlife Conservation On Its 75th Anniversary, Katie Spidalieri

Cleveland State Law Review

The concept of hunter-supported wildlife conservation behind the Pittman-Robertson Act has been termed the North American Model of Wildlife Conservation. Since 1937, the Pittman-Robertson Act and this unique Model have been recognized as “the oldest and most successful wildlife management program in the nation’s history."This Note will argue that the government’s historical preoccupation with hunting overlooks the potential to extend the Model’s reach to the great outdoor industry prevalent in America. Specifically, the Model can be resuscitated if additional categories of outdoorsmen, like campers, hikers, and birdwatchers, are included as financial stakeholders in wildlife conservation. To broaden the conservation tax …

Differences In Romantic Relationship Satisfaction And Health As A Function Of Pet Preference, Jenna Rae Trisko Jan 2012

Differences In Romantic Relationship Satisfaction And Health As A Function Of Pet Preference, Jenna Rae Trisko

Theses and Dissertations

Despite some evidence of personality differences between self-identified "cat people" and "dog people," there is a lack of research on how these groups differ in terms of the quality of their human relationships or whether people who own dogs or cats (or both) differ in the health benefits associated with pet ownership. This study was used to examine the relationship between pet preferences, level of satisfaction and type of attachment participants had in their current romantic relationships. This study was also used to explore whether overall health, depression, perceived stress, and physical activity levels differed as a function of pet …

Development Of An Accurate Benchmarking System For Microwave Breast Imaging, Camerin C. Hahn Jan 2012

Development Of An Accurate Benchmarking System For Microwave Breast Imaging, Camerin C. Hahn

Theses and Dissertations

This thesis is a discussion of the design and implementation of benchmarking system for microwave imaging systems. The current benchmarking tools for microwave imaging setups are not adaptable. A novel method for of the development of a dielectric phantom using regression analysis is presented. This is followed by a discussion of the design of a novel sensor for the purpose of in vivo dielectric properties measurements. The goal is to provide information for microwave tomography algorithms and phantom development based on in vivo dielectric properties of breast tissues

Through the progress of this research two major novel advances have been …

Phylogeography And Habitat Associations Of Franklin's Gulls In Their United States Breeding Range, Annmarie Krmpotich Jan 2012

Phylogeography And Habitat Associations Of Franklin's Gulls In Their United States Breeding Range, Annmarie Krmpotich

Theses and Dissertations

The Franklin's Gull (Leucophaeus pipixcan) is a long distance migrant which is listed as a species of concern by U.S. state wildlife management agencies and in the Northern Prairie and Parkland Waterbird Plan for the U.S. and Canada. The designation of this status is due to few, isolated breeding colonies and unknown population dynamics. Few attempts have been made to address the unknown population dynamics or to quantify habitat use at breeding sites of this species. Recognizing there is a need for this information; this thesis uses deoxyribonucleic acid (DNA) evidence to show the relationships of Franklin's gull breeding colonies …

American Indian participants completed an additional form-Northern Plains Biculturalism Inventory-revised (NPBI-R). It was hypothesized that American Indian participants from the reservation sample would have higher SOGS scores than participants …

Identifying Locations Of Highly Eroded Agricultural Land In The Devils Lake Basin, Nd Using Gis Terrain Analysis Modeling, Matthew J. Dinger Jan 2012

Identifying Locations Of Highly Eroded Agricultural Land In The Devils Lake Basin, Nd Using Gis Terrain Analysis Modeling, Matthew J. Dinger

Theses and Dissertations

Soil erosion modeling using terrain analysis holds great potential due to the simplicity of the models, and the ease in running the analysis in a GIS. Terrain analysis of the upper Devils Lake basin was conducted using a 3-meter Light Detection and Ranging-derived digital elevation model. Portions of the Mauvais Coulee and Calio Coulee watersheds in the basin were analyzed to evaluate soil erosion potential and determine if terrain analysis was an accurate tool for modeling erosion in this fairly flat landscape. The analysis used slope, flow accumulation, and stream power index (SPI) within a GIS to identify highly eroded …

Hyperbranched And Polydimethylsiloxane Based Membranes For Co2 Capture, Willie Wesley Wells Jan 2012

Hyperbranched And Polydimethylsiloxane Based Membranes For Co2 Capture, Willie Wesley Wells

Theses and Dissertations

As we continue to come to terms with a warming planet created, in part, by our dependence on fossil fueled power plants, there is a great and urgent need for cost effective methods of isolating and capturing greenhouse gasses. Among the many methods currently being explored for CO2 separation, membranes have proven to be a promising solution. This thesis examines three types of possible membranes: composite layer membranes, hyperbranched membranes and dense film membranes. In addition to examining the permeance of each type, the study explored various membrane formation techniques and how that affects the permeability of specific membrane types. …

This study looks at the muscle composition of the Ames dwarf mouse compared to the normal mouse by analyzing two muscles, extensor digitorum longus (EDL) and soleus (Sol).

Methods: Researchers harvested hind limb muscles from Ames dwarf mice and normal mice. The fours muscles were EDL, Sol, Gastrocnemius/Plantaris, and tibialis anterior (TA). EDL and Sol were sliced and stained with …

Moral Conversion, Liturgy And The Preface To Eucharistic Prayer For Reconciliation Ii, Thomas Ryan Jan 2012

Moral Conversion, Liturgy And The Preface To Eucharistic Prayer For Reconciliation Ii, Thomas Ryan

Theology Papers and Journal Articles

Anecdotal evidence suggests that, amongst the Eucharistic Prayers in the Roman Catholic liturgy, the laity find the Second Eucharistic Prayer for Reconciliation the most attractive. This article attempts to address the question: what is there about this Prayer that is so appealing and why? The focal point is the first thing people hear in this Eucharistic Prayer, namely, the Preface. There seems to be something special, if not unique, about the Preface to EP RII.

This article will focus mainly on the Preface of EP RII in terms of its theme, tone, tempo and as a template. In preparing to …

Reasserting Humanity Through The Liberatory Gaze, Melissa Crum Jan 2012

Reasserting Humanity Through The Liberatory Gaze, Melissa Crum

Journal of Social Theory in Art Education

The act of critically looking can be a method used to consider alternative ways of conceptualizing marginalized cultures and ethnicities. By engaging in a series of inquiries about the subject of an image, the spectator can form a more comprehensive representation of the subject, thus preparing post-secondary students to discuss and interpret visual culture. From the perspective of an African-American female artist and educator’s travels to Brazil, this work proposes that a self-reflective educator’s personal narratives and insight can assist in creating an arts-based critically-thinking learning atmosphere. Such an atmosphere encourages students to move beyond the realms of their cultural …

(De)Fencing The Cultural Commons Through A (De)Constructive Media Art Curriculum, Steven Ciampaglia Jan 2012

(De)Fencing The Cultural Commons Through A (De)Constructive Media Art Curriculum, Steven Ciampaglia

Journal of Social Theory in Art Education

Rampant consolidation in the media industry has led to an ever-increasing push to extend the breadth and scope of copyright law. A deliberate and systematic effort to restrict access to cultural texts that were previously accessible has led to a creative climate that is increasingly intimidating to young artists. The personal computer provides students the ability to re-open these texts and reclaim their right to fairly use the cultural artifacts of their surroundings as building blocks of expression. The personal computer can deconstruct closed media texts into malleable parts of visual language that students can reconstruct into new texts. These …

The Terror Of Creativity: Art Education After Postmodernism, Jan Jagodzinski Jan 2012

The Terror Of Creativity: Art Education After Postmodernism, Jan Jagodzinski

Journal of Social Theory in Art Education

This essay addresses two problematics. The first concerns the question of creativity, which has become a key signifier for art and its education in the 21st century. I try to situate this interest in creativity within the broader context of neoliberalism and capitalist designer capitalism. The second problematic addresses the term ‘after postmodernism,’ which has left us in a state of relativity by rejecting universality. My interest is to show how these two problematics are at play in the well-known documentary film, Waiting for Superman, directed by Davis Guggenheim. An attempt is made to expose the structure of this film …

In Ovo Selenium (Se) Injection Of Incubating Chicken Eggs: Effects On Embryo Viability, Tissue Se Concentration, Lipid Peroxidation, Immune Response And Post Hatch Development, Lizza M. Macalintal Jan 2012

In Ovo Selenium (Se) Injection Of Incubating Chicken Eggs: Effects On Embryo Viability, Tissue Se Concentration, Lipid Peroxidation, Immune Response And Post Hatch Development, Lizza M. Macalintal

Theses and Dissertations--Animal and Food Sciences

Studies were conducted to investigate the effects of in ovo injection of selenium (Se) either as seleno-methionine (Se-Met) or sodium selenite (Na2SeO3) into the yolk of incubating eggs on tissue Se concentration, embryo livability, lipid peroxidation, immune response and growth performance. When white-shelled eggs were injected with 0.1ml of solutions providing 0, 2.5, 5, 10 or 20 μg Se/egg, no detrimental effects on embryo viability at 20 days of incubation were noted. The effects on tissue Se concentrations suggested that Se-Met and Na2SeO3 were metabolized differently by the chick embryo. In a subsequent …

Foraging And Roosting Behaviors Of Rafinesque's Big-Eared Bat (Corynorhinus Rafinesquii) At The Northern Edge Of The Species Range, Joseph S. Johnson Jan 2012

Foraging And Roosting Behaviors Of Rafinesque's Big-Eared Bat (Corynorhinus Rafinesquii) At The Northern Edge Of The Species Range, Joseph S. Johnson

Theses and Dissertations--Animal and Food Sciences

Bat populations in the eastern United States are currently declining at unprecedented rates as a result of habitat loss, commercial wind energy development, and white-nose syndrome. Effective conservation of these declining populations requires knowledge of several aspects of summer and winter ecology, including daytime habitat use (day-roost selection and social behaviors), nocturnal habitat use (foraging habitat selection, prey selection, and prey abundance), and winter hibernation (torpor) patterns. This dissertation addresses these questions for Rafinesque’s big-eared bat (Corynorhinus rafinesquii), a species of conservation concern in the southeastern United States. Kentucky represents the northern edge of the range of Rafinesque’s …

Fecal and …

Evaluating The Effects Of Maternal And Progeny Dietary Supplementation Of Selenium Yeast And Vitamin E On The Performance Of Broiler-Breeder Hens And Performance And Meat Quality Of Progeny, Anthony D. Quant Jan 2012

Evaluating The Effects Of Maternal And Progeny Dietary Supplementation Of Selenium Yeast And Vitamin E On The Performance Of Broiler-Breeder Hens And Performance And Meat Quality Of Progeny, Anthony D. Quant

Theses and Dissertations--Animal and Food Sciences

The objectives of these experiments were to evaluate the effects of selenium (Se) and vitamin E (Vit.E) supplementation in maternal and progeny diets on the performance of breeder hens and the performance and meat quality characteristics of progeny.

Inclusion of Se, as Se yeast, in the diets of developing broiler breeder pullets resulted in greater Se accumulation of Se (P<0.01) in liver, pancreas, and breast tissues than when Se yeast was not provided. Improving the overall Se status of breeder pullets in the early stages may help maintain adequate tissue Se concentrations during egg production.

Maternal supplementation of Se yeast and Vit.E increased the liver and breast Se concentration (P<0.05) of newly hatched chicks compared to the chicks originating from hens not receiving dietary Se. At 7d of age, Se yeast supplementation in either the chick or maternal diet increased breast and liver Se concentrations (P<0.01). At 14d of age, breast and liver Se concentrations remained the highest for chicks supplemented with Se yeast (P<0.01), however there was no effect of maternal Se supplementation. Vitamin E supplementation in either the chick or maternal diets did not affect the liver Vit.E concentrations of chicks at 7 or 14d of age.

Supplementing broiler diets with Se yeast and Vit.E improved the meat quality characteristics of raw and marinated breast fillets. The Se …

Influence Of Dietary Selenium Supplementation Form On Hepatic Transcriptome Profiles Of Maturing Beef Heifers, Zhi Zhang Jan 2012

Influence Of Dietary Selenium Supplementation Form On Hepatic Transcriptome Profiles Of Maturing Beef Heifers, Zhi Zhang

Theses and Dissertations--Animal and Food Sciences

Our objective was to know how the hepatic transcriptome expression of growing beef (Angus-cross) heifers (0.5 kg gain/day) was affected by the feeding of different sources of dietary (3 mg/day) Se supplements: inorganic Se (ISe, sodium selenite), organic (OSe, Sel-Plex®), or a blend (1.5 mg:1.5 mg) of ISe:OSe (Mix), compared to the adequate but non-Se supplemented “Control”. The biopsied hepatic tissues of these four groups heifers collected at day 168 (when liver Se assimilation had stabilized) after supplements of Se, was subjected to the microarray analysis to assess Se treatment effects.

The results suggest that there were clear differences in …

In Defense Of Mandatory Curves, Joshua M. Silverstein Jan 2012

In Defense Of Mandatory Curves, Joshua M. Silverstein

University of Arkansas at Little Rock Law Review

This article sets forth the first comprehensive defense of mandatory curves. It begins with a case study of one law school. That institution lacked formal grade normalization policies during the period of the case study. As a result, the school suffered from dramatic grade disparities. This article contains a list and statistical analysis of the most significant disparities. The statistical analysis supports the conclusion that the grade disparities were caused by differences in teacher grading philosophy, and not by student merit or any other factor.

Next, this article presents several arguments in favor of mandatory curves. The most crucial is …

A Brief Summary Of Decisions From The Arkansas Supreme Court Affecting Gays And Lesbians, Anthony L. Mcmullen Jan 2012

A Brief Summary Of Decisions From The Arkansas Supreme Court Affecting Gays And Lesbians, Anthony L. Mcmullen

University of Arkansas at Little Rock Law Review

Half of Arkansans believe that sex-sex relationships should not be afforded legal recognition, including recognition in the form of a civil union or domestic partnership. Further, Arkansas is one of thirty states to constitutionally define marriage as the legal union between a man and a woman. Nonetheless, the gay and lesbian civil rights movement has been afforded protection in the courts through Arkansas Supreme Court decisions protecting same sex couples' rights.

Starting in 2002, the Arkansas Supreme Court has provided at least some protection to same sex couples and their families through decisions where the Court could have declined to …
