Damned If You Do, Doomed If You Don't: Patenting Legal Methods And Its Effect On Lawyers' Professional Responsibilities, Stephanie L. Varela

Florida Law Review

This Note argues patent protection should not extend to legal methods because of the professional responsibilities lawyers owe to the profession and to clients. Part II explains why legal methods merit discussion today. To appreciate the effects legal method patents could have on the legal profession, Part II then presents an overview of pertinent patent law and explains how legal methods are likely eligible for patent protection. Part III raises the question whether legal methods should receive patent protection in light of social and economic considerations. Does A Cartel Aim Expressly? Trusting Calder Personal Jurisdiction When Antitrust Goes Global, Larry Dougherty

This Note suggests that while Calder jurisdiction fits well with some types of antitrust allegations, the Calder analogy weakens when charges of broad-based anticompetitive conduct collide with the long-arm statutes of particular states. The risk of forcing the analogy too far, of course, is a violation of due process. Part II of this Note reviews the facts and holding of Calder, and some of the key cases that followed it. Sea ice is believed to be a major factor shaping gene flow for polar marine organisms, but it remains unclear to what extent it represents a true barrier to dispersal for arctic cetaceans. Bowhead whales are highly adapted to polar sea ice and were targeted by commercial whalers throughout Arctic and subarctic seas for at least four centuries, resulting in severe reductions in most areas. Both changing ice conditions and reductions due to whaling may have affected geographic distribution and genetic diversity throughout their range, but little is known about range-wide genetic structure or whether it differed in the past. …

Economic and population growth as well as global macroeconomic policies are contributing to increasing global greenhouse gas (GHG) emissions. Climate change effects are more pronounced in cold regions such as the ‘Three Poles’ (the Arctic, the Antarctic and the Hindu Kush-Himalaya regions) than anywhere else. The Three Poles are rich in natural resources but the extraction of resources is degrading ecosystems and processes, and affecting species. "Digital Stone" as a concept is based on the fusion of CAD technologies with traditional stone carving.

Digital Stone Exhibition featured four digital sculptors: Bruce Beasley, Jon Isherwood, Robert Michael Smith and Kenneth Snelson, who designed five sculptures each utilizing CAD technologies. All sculptures in this exhibition were designed and developed first in virtual space of software programs. Physical models were printed by rapid prototype machines which became a metaphorical "hand" of the computer to produce an actual sculpture from the virtual sculpture. This thesis investigates the problem of “dead zones” in large bodies of water, specifically in the Chesapeake Bay. Using readily available weather and environmental research from several summer tropical cyclones, this thesis analyzes the possible impact of such storms on the Chesapeake Bay’s ecology and health as a body of water, looking at levels of different nutrients and the growth of algal blooms.

Paleoseismicity Of The Guoqiong Segment Of The Yushu Fault Following The Mw6.9 14 April 2010 Yushu Earthquake, Qinghai Province, China, Taylor Armstrong

The Mw6.9 (Ms7.1) April 14, 2010 Yushu earthquake and aftershocks devastated Yushu Tibetan Autonomous Prefecture (Qinghai Province, China), killed ~3,000 people, injured 12,000 people, and caused extensive damage throughout the region. The earthquake swarm occurred in the central region of the Tibetan Plateau, within the Banyan Har Mountain Range along the Ganzi-Yushu fault system. The focal mechanism for the main shock indicated left-lateral, strike-slip movement with two pulses of rupture along a WNW-ESE-striking, near-vertical fault causing surface ruptures to occur along several segments of the Yushu fault. Novel Strategies To Improve Metabolic Parameters And Precondition Diabetic Hearts Against Ischemia/Reperfusion Injury, Amit Varma

Insulin resistance and chronic hyperglycemia promote vascular damage, increase circulating levels of inflammatory cytokines and lead to increased morbidity and mortality. MicroRNAs (miRs) -103/107 have been shown to negatively regulate insulin sensitivity and glucose homeostasis. Based on complimentary binding profiles, the downstream target gene of miR-103/107 is caveolin-1 (Cav-1). We hypothesized that daily administration of the phosphodiesterase-5 inhibitor tadalafil (TAD) ± the curcumin analogue (HO-3867) will attenuate inflammation, improve metabolic parameters and reduce infarct size after ischemia/reperfusion injury (IRI). Furthermore, we propose that TAD therapy will reduce myocardial expression of miR-103/107 and increase mRNA and protein levels of its target …

Do Low-Mercury Terrestrial Resources Subsidize Low-Mercury Growth Of Stream Fish? Differences Between Species Along A Productivity Gradient, Darren M. Ward, Keith H. Nislow, Carol L. Folt

Low productivity in aquatic ecosystems is associated with reduced individual growth of fish and increased concentrations of methylmercury (MeHg) in fish and their prey. However, many stream-dwelling fish species can use terrestrially-derived food resources, potentially subsidizing growth at low-productivity sites, and, because terrestrial resources have lower MeHg concentrations than aquatic resources, preventing an increase in diet-borne MeHg accumulation. We used a large-scale field study to evaluate relationships among terrestrial subsidy use, growth, and MeHg concentrations in two stream-dwelling fish species across an in-stream productivity gradient.
