Tax Compliance And Norm Formation Under High-Penalty Regimes, Susan C. Morse Jan 2012

Tax Compliance And Norm Formation Under High-Penalty Regimes, Susan C. Morse

Connecticut Law Review

Skepticism about the potential of moral appeals relating to tax compliancefor example, as applied to large groups of individual taxpayers outside a wartime context-has resulted in the absence of a theory about how government communication can further tax compliance. This Article fills that gap. It provides a theory of tax compliance and norm formation under high-penalty regimes from the starting point of a noncompliance norm. The theory explains the roles of and mutually reinforcing relationships between, the compliance mechanisms of deterrence, separation, and reputation signaling. The success of these mechanisms depends on the presence of (i) taxpayer perception of penalty …

Reducing The Regulatory Role Of The Fda: Promoting Patient Autonomy To Choose Avastin And Other Cancer Drugs Note, Sara J. Ray Jan 2012

Reducing The Regulatory Role Of The Fda: Promoting Patient Autonomy To Choose Avastin And Other Cancer Drugs Note, Sara J. Ray

Connecticut Law Review

On November 18, 2011, the Food and Drug Administration (FDA) revoked accelerated approval of the breast cancer indication for Avastin, a cancer drug manufactured by Genentech. The FDA claims that Avastin, when used to treat metastatic breast cancer, does not provide a benefit that justifies the serious and potentially life-threatening risks associated with its use. The agency concluded that there was insufficient evidence that Avastin would help women with breast cancer live longer or improve their quality of life. This decision has sparked controversy and debate among women who want to keep Avastin available as an option to treat their …

Finding New Power In The Wind, The Earth, And The Sun: A Survey Of The Regulation Of Alternative Energy Generated On American Indian Reservations Int He United Sates And First Nation Reserves In Canada Note, Jessica A. R. Hamilton

Connecticut Law Review

Investment in renewable energy resources is becoming increasingly essential for the governments of both the United States and Canada as they search for viable alternatives to traditional, and often foreign-controlled, energy resources. The potential contributions of American Indians and First Nations in the energy sector have been long undervalued and hitherto largely untapped, despite their influence and control over huge areas of undeveloped land perfectly suited to multiple forms of renewable energy-- including hydroelectric, solar, wind generation, and geothermal energy. Due to the unique legal history of American Indian Tribes and First Nations, however, any renewable energy project on their …

Limiting Principles And Empowering Practices In American Indian Religious Freedoms, Kristen A. Carpenter Jan 2012

Limiting Principles And Empowering Practices In American Indian Religious Freedoms, Kristen A. Carpenter

Connecticut Law Review

Employment Division v. Smith was a watershed moment in First Amendment law, with the Supreme Court holding that neutral statutes of general applicability could not burden the free exercise of religion. Congress’s subsequent attempts, including the passage of Religious Freedom Restoration Act and Religious Land Use and Institutionalized Persons Act, to revive legal protections for religious practice through the legislative and administrative process have received tremendous attention from legal scholars. Lost in this conversation, however, have been the American Indians at the center of the Smith case. Indeed, for them, the decision criminalizing the possession of their peyote sacrament was …

Small-Scale Aid Donors, Agribusiness, And The Zambian Export Sector, John R. Ledgerwood, Stephen N. Morgan Jan 2012

Small-Scale Aid Donors, Agribusiness, And The Zambian Export Sector, John R. Ledgerwood, Stephen N. Morgan

Publications

Production of high value agriculture and natural products has become a key instrument in economic development programs to accomplish the dual objectives of raising rural incomes and conserving valuable environmental resources. Rapid growth in global demand for organic and natural products has provided a strong economic incentive for small scale aid agencies to expand into this niche market. Through this analysis we investigate the economic impact that aid funded agricultural production has had on rural residents of Zambia and how this development strategy allows small scale aid donors to capitalize on the business and export opportunities in the Central African …

The Political Speech Of Charities In The Face Of Citizens United: A Defense Of Prohibition, Roger Colinvaux Jan 2012

The Political Speech Of Charities In The Face Of Citizens United: A Defense Of Prohibition, Roger Colinvaux

Scholarly Articles

The Supreme Court’s decision in Citizens United v. Federal Election Commission makes a Supreme Court challenge to the tax law rule that prohibits charities from involvement in political activities more likely, and a reexamination of the political speech of charities necessary. Part I of the Article surveys the history of the political activities prohibition in order to emphasize that it was not a reactionary policy but quite considered, and that there are strong State interests supporting it, including protection of the definition of charity from further dilution. Part II of the Article analyzes Citizens United in detail and argues that …

Uptake Of Single-Walled Carbon Nanotubes Conjugated With Dna By Microvascular Endothelial Cells, Joseph Harvey, Lifeng Dong, Kyoungtae Kim, Jacob Hayden, Jianjie Wang

College of Health and Human Services

Single-walled carbon nanotubes (SWCNTs) have been proposed to have great therapeutic potential. SWCNTs conjugated with drugs or genes travel in the systemic circulation to reach target cells or tissues following extravasation from microvessels although the interaction between SWCNT conjugates and the microvascular endothelial cells (ECs) remains unknown. We hypothesized that SWCNT-DNA conjugates would be taken up by microvascular ECs and that this process would be facilitated by SWCNTs compared to facilitation by DNA alone. ECs were treated with various concentrations of SWCNT-DNA-FITC conjugates, and the uptake and intracellular distribution of these conjugates were determined by a confocal microscope imaging system …
