In the Supreme Court's recent decision on GPS surveillance, United States v. Jones, five justices authored or joined concurring opinions that applied a new approach to interpreting Fourth Amendment protection. Before Jones, Fourth Amendment decisions had always evaluated each step of an investigation individually. Jones introduced what we might call a "mosaic theory" of the Fourth Amendment, by which courts evaluate a collective sequence of government activity as an aggregated whole to consider whether the sequence amounts to a search. This Article considers the implications of a mosaic theory of the Fourth Amendment. It explores the choices and puzzles that …

Cyberattacks are capable of penetrating and disabling vital national infrastructure, causing catastrophic economic harms, and approximating the effects of war, all from remote locations and without the use of conventional weapons. They can be nearly impossible to attribute definitively to their sources and require relatively few resources to launch. The United States is vulnerable to cyberattacks but also uniquely capable of carrying out cyberattacks of its own. To do so effectively, the United States requires a legal regime that is well suited to cyberattacks' unique attributes and that preserves executive discretion while inducing the executive branch to coordinate with Congress. …

A classical wound may be defined as a disruption of tissue integrity. Wounds, caused by trauma from accidents or surgery, that close via secondary intention rely on the biological phases of healing, i.e., hemostasis, inflammation, proliferation, and remodeling (HIPR). Depending on the wound type and severity, the inflammation phase begins immediately after injury and may last for an average of 7–14 days. Concurrent with the inflammation phase or slightly delayed, cell proliferation is stimulated followed by the activation of the remodeling (maturation) phase. The latter phase can last as long as 1 year or more, and the final healed state …

[T]his Article sketches out the emerging public domain. Part III considers three conceptual questions for structuring use of the public domain, focusing on the extent to which the public domain should be viral; on whether we should insist that the public domain be accessed only through the original artifacts embodying it; and on whether private appropriability incentives for distribution of public domain scans match overall social interests. In setting the stage for Moral Foundations Theory (MFT), Jon Haidt (2004) identified five foundations of intuitive ethics: 1) harm/care; 2) fairness/reciprocity; 3) ingroup/loyalty; 4) authority/respect; 5) and purity/sanctity. Each foundation could have implications for the content of marketing messages, but this research is the first attempt to test those implications in specific markets with specific products. This research explores the practical, promotional uses of John Haidt’s Moral Foundation Theory. Haidt’s work shows a strong relationship between his moral foundations and political orientation. The ability of exogenous growth hormone (GH) to increase milk yield through insulin-like growth factor-1 (IGF-I) in dairy cows is well characterized. However, recent studies utilizing mammary epithelial cell lines indicate a direct effect of GH on mammary epithelial cells (MEC). To test if these observations are relevant in vivo and if this response differs between dairy breeds, three mammary models were utilized. Mammary explants from a lactating Jersey cow were cultured in classical lactogenic media (dexamethasone, insulin, and prolactin) with 0 or 10 ng/mL of recombinant bovine GH for 12h. Wastewater treatment lagoons and high rate algae ponds (HRAPs) can provide cost effective wastewater treatment, but they commonly have high effluent concentrations of total suspended solids (TSS). In this thesis algae pond effluent was treated in a beaker testing apparatus (mixed and aerated) with various mixtures of activated sludge and primary effluent simulating differing activated sludge aeration basin compositions then was allowed to settle to assess settleability. Song production in songbirds is controlled by parts of the brain known as the song control regions (SCRs). During spring, gonads increase in size, males sing to attract mates, and SCRs become larger. This neuroplasticity is controlled by the change in day length and increased plasma testosterone (T) levels. Plasma T can be reduced by stress through the production of corticosterone (CORT), through the production of beta-endorphin, or through direct effects on the testes via the nervous system. Peripheral arterial occlusive disease (PAOD) is an ischemic disease characterized by narrowing of the peripheral arteries due to the accumulation of atherosclerotic plaque in the inner lining of the vessels, which disrupts blood flow to downstream tissues. Blood can be redirected into collateral vessels, natural bypasses around arterial occlusions, causing shear-induced outward remodeling of the vessels. The enlarged vessels facilitate transfer of increased blood flow to downstream tissues. The remodeling process, however, may impair vasodilation, which in turn may cause or contribute to intermittent claudication- transient pain brought on by locomotion. The site of Hierakonpolis is considered to have played an important role in the development of the Egyptian state, which formed at end of the fourth millennium BC. Archaeological evidence suggests that, for the Middle and Late Predynastic periods (ca. 3900-3200 BC), Hierakonpolis may be characterized as having experienced the following: a growth in both settlement and population size, an increased reliance on cereal agriculture, development of craft specialization, and the presence of a Social hierarchy as interpreted from an observed increase in the differentiation of mortuary behavior. Soybean vein necrosis disease (SVND) is widespread in major soybean-producing areas in the U.S. The typical disease symptoms exhibit as vein clearing along the main vein, which turn into chlorosis or necrosis as season progresses. Double-stranded RNA isolation and shot gun cloning of symptomatic tissues revealed the presence of a new tospovirus, provisionally named as Soybean vein necrosis associated virus (SVNaV). The presence of the virus has been confirmed in 12 states: Arkansas, Illinois, Missouri, Kansas, Tennessee, Kentucky, Mississippi, Maryland, Delaware, Virginia and New York. The purpose of this study was to examine musical thought among members of the Congolese Mennonite Church. Established and governed by missionaries, the music practices of the Church were initially modeled after Western services, which consisted of church choirs and four-part hymn singing. Congolese who chose to convert to Christianity had to adapt to a new musical system, which included not only properties of musical sound, but also concepts surrounding the music making experience, including what music is and what it has the power to accomplish. This essay is framed by conflict between Christianity and Darwinian science over the history of the world and the nature of original human personhood. Evolutionary science narrates a long prehuman geological and biological history filled with vast amounts, kinds, and distributions of apparently random brutal and pointless suffering. It has also unveiled an original human person with animal psychosomatic heredity. This narrative seems to discredit Christianity's (Augustinian) metanarrative of the Fall-Paradise Lost and Paradise Regained. The author contends that the Augustinian story and its character of Adam are implausible, anyway, for reasons of theology and apologetics. He proposes that Christians …

Metabolizable protein (MP) is the true protein absorbed by the intestine, supplied by rumen undegradable protein (RUP) and microbial crude protein (MCP). This research was focused on evaluating the effect of dried distillers grains with solubles (DDGS) on the nature and supply of MP, with emphasis during lactation.
Experiment 1 evaluated the use of DNA markers and the effects of fermentation time and DDGS on rumen microbial growth

Atmospheric carbon dioxide is increasing year on year, mainly as a result of burning fossil fuels. Although carbon dioxide dissolves in the oceans, mitigating atmospheric effects, it does result in a reduction of the alkalinity of sea water; an effect termed Ocean Acidification (OA). The subsequent changes in carbon chemistry will most likely affect marine photosynthetic organisms in a number of ways; including the ability of organisms to build calcium carbonate shells or skeletons (calcification) and primary production. Cholesterol is the precursor to a unique class of lipophilic signaling molecules called steroid hormones that initiate the development of sexual characteristics, reactions to stress, and maintenance of metabolism, among many other functions. Although much progress has been made in understanding the function of these signaling hormones, we do not fully understand how a single steroid can cause many distinct, tissue-specific responses. Drosophila melanogaster is an effective model for understanding steroid hormone action because of its simplicity. As non-point source pollution, storm water runoff is one of the main contributors to stream impairment in the United States. The United States Environmental Protection Agency (USEPA) requires Municipal Separate Storm Sewer Systems (MS4s) to obtain a permit under the National Pollution Discharge Elimination System (NPDES) to manage this pollution. Magnetic resonance elastography (MRE) is a potentially transformative imaging modality allowing local and non-invasive measurement of biological tissue mechanical properties. It uses a specific phase contrast MR pulse sequence to measure induced vibratory motion in soft material, from which material properties can be estimated. Compared to other imaging techniques, MRE is able to detect tissue pathology at early stages by quantifying the changes in tissue stiffness associated with diseases. The purpose of this research is to help identify whether or not race plays a role in how much Environmental Education (EE) is being taught in elementary schools throughout the region. This study takes place in two rural elementary schools, less than 20 miles apart, in Northeast Nebraska; one with a mostly white population and the other mostly Native American. The researcher interviewed 7 teachers total at both schools in order to gain information about EE in the classroom and the extent to which it is being taught. The genus Manfreda Salisb. of Asparagaceae is a genus of potential horticultural interest and is currently subject to breeding efforts at the University of Arkansas. A lack of taxonomic clarity however undermines the classification of potential inter - and intrageneric hybrids. The study aims to assess existing species delimitation within the genus Manfreda employing morphology while investigating the potential utility of Consortium for the Barcode of Life Plant (CBOL) DNA Barcodes for identification of specific taxa and an External Transcribed Spacer (ETS) - Internal Transcribed Spacer (ITS) DNA barcode for developed hybridized taxa.
