Public Perception Of Unmanned Aerial Vehicles, Alice Tam Nov 2011

Public Perception Of Unmanned Aerial Vehicles, Alice Tam

Aviation Technology Graduate Student Publications

This study explored public risk perception of unmanned aerial vehicles (UAV) for civilian commercial operations, including cargo and passenger transportation. Civilian operators are considering the use of UAVs to increase safety while reducing labor costs, but negative perceptions may delay the advancement of these aircraft. To document perception of UAV or UAS aircraft for commercial operations, a questionnaire was distributed to adults (ages 18+) who use commercial air travel. The survey classified age group, gender, and UAV familiarity as demographic variables. This study assessed risk perception of UAVs and its correlation to the variables through statistical analysis to identify whether …

Application Of Asymptotic Expansions For Maximum Likelihood Estimators' Errors To Gravitational Waves From Inspiraling Binary Systems: The Network Case, Salvatore Vitale, Michele Zanolin Nov 2011

Application Of Asymptotic Expansions For Maximum Likelihood Estimators' Errors To Gravitational Waves From Inspiraling Binary Systems: The Network Case, Salvatore Vitale, Michele Zanolin

Publications

This paper describes the most accurate analytical frequentist assessment to date of the uncertainties in the estimation of physical parameters from gravitational waves generated by nonspinning binary systems and Earth-based networks of laser interferometers. The paper quantifies how the accuracy in estimating the intrinsic parameters mostly depends on the network signal to noise ratio (SNR), but the resolution in the direction of arrival also strongly depends on the network geometry. We compare results for 6 different existing and possible global networks and two different choices of the parameter space. We show how the fraction of the sky where the one …

Managing Large Enrollment Courses In Hybrid Instruction Mode, Pooja Khanna Nov 2011

Managing Large Enrollment Courses In Hybrid Instruction Mode, Pooja Khanna

Higher Learning Research Communications

While Indian education system is still debating on values of Gurukal system to imperial western education; the world moves on to the hybrid teaching learning system. Though the western world started hybrid teaching in early 1990’s, it took us good 30 years to follow the Westroes. Even when we have initiated the process in few institutions there is much to understand and do before we actually get to see the success of Hybrid online teaching and learning. This paper set to study the hitches and glitches in Hybrid Instruction system of teaching and learning for large enrollment courses. This new …

Computational Modeling And Simulation Study Of Dermal Wound Healing Proliferative Phase, Le Yang Nov 2011

Computational Modeling And Simulation Study Of Dermal Wound Healing Proliferative Phase, Le Yang

Theses and Dissertations

Dermal wound healing proliferative phase is a complicated physiological process in which many growth factors, cell types and matrix components participate. The process must be well coordinated to restore the structural and functional integrity of tissue injured. Many disorders interrupting healing process result in abnormal healing such as chronic wounds or excessive scarring. Mathematical modeling has been used to investigate many aspects of wound healing. Angiogenesis is pertinent for dermal wound healing since the cellular activities involved in tissue repair requires oxygen and nutrients to be delivered to the wound site. By using a hybrid agent-based model, we investigated the …

The Fatca Provisions Of The Hire Act: Boldly Going Where No Withholding Has Gone Before , Melissa A. Dizdarevic Nov 2011

The Fatca Provisions Of The Hire Act: Boldly Going Where No Withholding Has Gone Before , Melissa A. Dizdarevic

Fordham Law Review

In an effort to crack down on offshore tax evasion, the United States is implementing a new set of information reporting and withholding requirements on foreign banks and other foreign entities. These provisions, known as the Foreign Account Tax Compliance Act (FATCA) provisions of the Hiring Incentives to Restore Employment (HIRE) Act, require thirty percent withholding of the entity’s U.S.-source income, unless they disclose specific information regarding their customers’ identities and account balances. While this may be an effective way to force foreign institutions into compliance, it also raises questions about how it will function within existing tax reporting systems, …

Seeking A Clearer Picture: Assessing The Appropriate Regulatory Framework For Broadband Video Distribution , Adam B. Vanwagner Nov 2011

Seeking A Clearer Picture: Assessing The Appropriate Regulatory Framework For Broadband Video Distribution , Adam B. Vanwagner

Fordham Law Review

This Note examines the appropriate regulatory framework for the distribution of commercial video content over broadband networks. As online video providers such as Netflix and Hulu expand, they are beginning to compete directly with the video services of major cable and telecommunications companies. Frequently, these companies also serve as a customer’s Internet service provider, leaving them in the position of carrying these competitive services over their broadband networks. This conflict has led to calls for regulation that would protect nascent online video services from feared anticompetitive actions by the major providers. In April 2010, against the backdrop of this expanding …

"Moral Monsters" Under The Bed: Holding Corporations Accountable For Violations Of The Alien Tort Statute After Kiobel V. Royal Dutch Petroleum Co., Mara Theophila Nov 2011

"Moral Monsters" Under The Bed: Holding Corporations Accountable For Violations Of The Alien Tort Statute After Kiobel V. Royal Dutch Petroleum Co., Mara Theophila

Fordham Law Review

The Alien Tort Statute (ATS) provides foreign plaintiffs with the sole means of obtaining jurisdiction in U.S. courts for alleged human rights abuses. These plaintiffs increasingly seek to hold corporations accountable for complicity in some of the most notorious violations of international law occurring overseas. Prior to 2010, U.S. courts routinely entertained ATS claims against corporations without question. Yet, the U.S. Court of Appeals for the Second Circuit in Kiobel v. Royal Dutch Petroleum Co. recently held that the ATS does not provide foreign plaintiffs redress against corporate entities. The Second Circuit relied solely on international law in making this …

Computers As Castles: Preventing The Plain View Doctrine From Becoming A Vehicle For Overbroad Digital Searches , James Saylor Nov 2011

Computers As Castles: Preventing The Plain View Doctrine From Becoming A Vehicle For Overbroad Digital Searches , James Saylor

Fordham Law Review

The plain view doctrine is based on the practical logic that an officer need not turn a blind eye to evidence that is immediately apparent as incriminating when he is lawfully present, where the object can be seen, and where he has a legal right to access that object. However, in the context of digital searches, this basic logic is stretched to a point that directly conflicts with the original purposes of the Fourth Amendment. The immense amount of data present on computers makes these searches much more intrusive. Officers employ search methods and techniques to access files that involve …

Giving Arbitration Some Credit: The Enforceability Of Arbitration Clauses Under The Credit Repair Organizations Act , Genevieve Hanft Nov 2011

Giving Arbitration Some Credit: The Enforceability Of Arbitration Clauses Under The Credit Repair Organizations Act , Genevieve Hanft

Fordham Law Review

In today’s economy, the effects of a bad credit report are devastating to consumers. Individuals with poor credit history are often crippled in their ability to purchase even the smallest item, and consequently turn for help to credit repair organizations advertising services that cure bad credit. Frequently, however, these organizations merely accept high fees from customers already in dire financial straits, without improving their financial standing. To combat these predatory practices, Congress passed the Credit Repair Organizations Act (CROA), which imposes several requirements on credit repair organizations. One such provision mandates that credit repair organizations give a form to each …

Blanket Policies For Strip Searching Pretrial Detainees: An Interdisciplinary Argument For Reasonableness , Daphne Ha Nov 2011

Blanket Policies For Strip Searching Pretrial Detainees: An Interdisciplinary Argument For Reasonableness , Daphne Ha

Fordham Law Review

In 2010, the U.S. Courts of Appeals for the Third and Ninth Circuits joined the U.S. Court of Appeals for the Eleventh Circuit in upholding the constitutionality of blanket strip search policies in correctional institutions. As a result, more government officials across the country can strip search arrestees and pretrial detainees as a matter of routine procedure without any reasonable suspicion that the detainees have contraband. These detainees include individuals without criminal histories who are arrested for traffic or other minor offenses, and who have done nothing to suggest that they are attempting to smuggle contraband into correctional facilities. This …

The Modern Common Law Of Foreign Official Immunity , Beth Stephens Nov 2011

The Modern Common Law Of Foreign Official Immunity , Beth Stephens

Fordham Law Review

In Samantar v. Yousuf, 130 S. Ct. 2278 (2010), decided in June 2010, the U.S. Supreme Court held that the Foreign Sovereign Immunities Act (FSIA), the federal immunity statute, does not protect foreign government officials sued in U.S. courts. The decision resolved longstanding splits among the circuits and between the circuits and the Executive Branch on an issue that is key to international relations and hotly contested around the world: When are government officials immune from suit in the courts of a foreign state? The Court remanded to the lower court to determine whether common law immunity protects foreign officials …

Labor Values Are First Amendment Values: Why Union Comprehensive Campaigns Are Protected Speech , Charlotte Garden Nov 2011

Labor Values Are First Amendment Values: Why Union Comprehensive Campaigns Are Protected Speech , Charlotte Garden

Fordham Law Review

Corporate targets of union “comprehensive campaigns” increasingly have responded by filing civil Racketeer Influenced and Corrupt Organizations Act (RICO) lawsuits alleging that unions’ speech and petitioning activities are extortionate. These lawsuits are the descendants of the Supreme Court’s unexplained treatment of much labor speech as less worthy of protection than other types of speech. Starting from the position that speech that promotes democratic discourse deserves top-tier First Amendment protection, I argue that labor speech—which plays a unique role in civil society—should be on an equal footing with civil rights speech. Thus, even if union advocacy qualifies as legal extortion, the …

U.S. Energy Sanctions And The Race To Prevent Iran From Acquiring Weapons Of Mass Destruction , Quinton Cannon Farrar Nov 2011

U.S. Energy Sanctions And The Race To Prevent Iran From Acquiring Weapons Of Mass Destruction , Quinton Cannon Farrar

Fordham Law Review

The United States has used economic sanctions targeting the energy sector that is so vital to Iran’s economy with varying degrees of intensity since the Iran Hostage Crisis of 1979. By and large, the sanctions did not have their intended effect. By 2010, Iran was the foremost state-sponsor of terrorism and was on the brink of acquiring the capability to develop nuclear weapons—a phenomenon that could have cataclysmic repercussions for American interests in the Middle East and beyond. In July 2010, Congress passed and President Obama signed the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010, in an effort …

Walk This Way: Do Public Sidewalks Qualify As Services, Programs, Or Activities Under Title Ii Of The Americans With Disabilities Act? , Sarah Jones Nov 2011

Walk This Way: Do Public Sidewalks Qualify As Services, Programs, Or Activities Under Title Ii Of The Americans With Disabilities Act? , Sarah Jones

Fordham Law Review

In 2005, 54.4 million people in the United States reported some degree of disability. For many of these people—particularly the 13.5 million Americans who use wheelchairs, canes, crutches, or walkers—the issue of sidewalk accessibility is not merely one of convenience, but of civil rights and public safety. Faced with public sidewalks that are impassable due to disrepair, physical obstacles, or an absence of curb ramps, many individuals with disabilities are forced to choose between remaining housebound or traveling in the streets—posing a danger to both themselves and drivers. However, as disability activists push to resolve these shortcomings with an eye …

A Tale Of Three Sovereigns: The Nebulous Boundaries Of The Federal Government, New York State, And The Seneca Nation Of Indians Concerning State Taxation Of Indian Reservation Cigarette Sales To Non-Indians , Amanda M. Murphy Nov 2011

A Tale Of Three Sovereigns: The Nebulous Boundaries Of The Federal Government, New York State, And The Seneca Nation Of Indians Concerning State Taxation Of Indian Reservation Cigarette Sales To Non-Indians , Amanda M. Murphy

Fordham Law Review

This Note examines the conflict between New York State and the Seneca Nation of Indians regarding the taxation of cigarette sales to non-Indians on Indian reservations. In 1994, the United States Supreme Court found New York’s taxation scheme facially permissible without providing boundaries or guidance for the state’s subsequent enforcement. Seventeen years after the Court’s decision, no taxes have been collected on these sales. The issue involves conflicting spheres of federal, state, and tribal control. From 1965 to 1994, the Supreme Court balanced these competing interests, creating precedent that has failed to provide a definitive solution to this crisis. The …

The Twombly Standard And Affirmative Defenses: What Is Good For The Goose Is Not Always Good For The Gander , Anthony Gambol Nov 2011

The Twombly Standard And Affirmative Defenses: What Is Good For The Goose Is Not Always Good For The Gander , Anthony Gambol

Fordham Law Review

The United States district courts disagree as to whether the plausibility pleading standard for claims first described by the United States Supreme Court in Bell Atlantic Corp. v. Twombly also extends to affirmative defenses pled by defendants in federal courts. The divergent opinions result from conflicting interpretations of the language of the Federal Rules of Civil Procedure, standards of preferred practice, and notions of fairness. This Note examines the district courts’ arguments in deciding whether the Twombly standard extends to affirmative defenses. It identifies the quiddities of the courts’ reasoning through an analysis of their decisions and, based upon this …
