Kertas ini merupakan hasil kajian yang dijalankan untuk mengenalpasti profil amalan guru dari aspek pengetahuan, pentaksiran dan amalan pedagogi dalam pelaksanaan kurikulum kimpalan berasaskan kompetensi di sekolah-sekolah menengah vokasional. Kajian melibatkan 23 buah sekolah vokasional di Semenanjung Malaysia yang melibatkan 56 responden. Kajian dijalankan menggunakan pendekatan kuantitatif di mana data diperoleh menggunakan soal selidik. Dapatan kajian menunjukkan bahawa tahap pengetahuan isi kandungan guru terhadap terhadap mata pelajaran kimpalan adalah tinggi (min 3.14), tahap amalan pentaksiran adalah sederhana (min 2.88) dan tahap amalan Pedagogi guru juga adalah sederhana (min 2.65). Promoting students' independence in vocabulary learning has Seen one of the instructional goals in language education. Based on the Self-Regulated Learning (SRL) theory from social cognitive learning perspective, learning strategies and motivational beliefs (e.g., self-efficacy, task interest) are the key interrelated factors of SRL, which are crucial for learners' academic performance. This study investigated learners' needs in terms of cognitive and metacognitive strategy use as well as their perceptions and knowledge in vocabulary learning. This article gave a detailed description of a national large scale needs analysis in the reform of the grade 11 English language curriculum in Oman. It highlighted the needs analysis practises of using triangulation of multiple sources (students, teachers, supervisors, heads of department, and textbooks) and multiple methods (questionnaires, interviews, content analysis) in the data collection stage to validate the study findings. The actual grade 11 English Language textbooks (n=4) were first analyzed for writing skills content and then contrasted with the perceived needs of 982 students, 64 teachers, 4 supervisors, and 3 heads of department. This paper summarises the development of liability for medical malpractice in the People's Republic of China, beginning with the establishment of a formal system of administrative liability in 1987, its refinement in 2002, and the broadly contemporaneous judicial recognition of a concurrent tortious liability under general civil law. All these developments may be said to have furthered the interests of patients. The article describes the special Scandinavian patient insurance system which secures compensation for patients in malpractice cases. For all practical purposes, the insurance based systems have replaced ordinary tort law rules in malpractice cases in Scandinavia. Thus, the basic feature of these systems is that proof of fault is not a requirement for obtaining compensation. Other criteria which are more favourable to the patient are applicable. The article concludes that in general the compensations systems have been successful in making it easier for the patients to obtain compensation. The Equal Employment Opportunity Commission ("EEOC") recently asserted that the use of criminal background checks as an employment screening tool may have a disparate impact on African Americans and Hispanics, in violation of Title VII of the Civil Rights Act of 1964. The EEOC and some private claimants have even filed lawsuits against employers claiming disparate impact violations based on statistics that show African Americans and Hispanics are considerably more likely to have criminal records than other racial groups. Background: The nonautonomous maize Ds transposons can only move in the presence of the autonomous element Ac. They comprise a heterogeneous group that share 11-bp terminal inverted repeats (TIRs) and some subterminal repeats, but vary greatly in size and composition. Three classes of Ds elements can cause mutations: Ds-del, internal deletions of the 4.6-kb Ac element; Ds1, ~400-bp in size and sharing little homology with Ac, and Ds2, variably-sized elements containing about 0.5 kb from the Ac termini and unrelated internal sequences. This thesis will examine the Anglo-American press coverage of Germany's secret rearmament between 1933 and 1935, with the aim of pursuing three main objectives:
1. Describe the rearmament process occurring in Germany and how it related to, or influenced, the country's position in international affairs.
2. Investigate the accuracy and objectivity of Anglo-American press coverage of the German rearmament. The Stolen Valor Act (SVA or “the Act”) was enacted to protect against “fraudulent claims” of receipt of military honors or decorations. It does so by criminalizing false verbal or written claims regarding such awards. However, the Act failed to include all of the elements of an anti-fraud measure required by the First Amendment. Most critically, the SVA fails to require actual reliance on the part of the defrauded. Although fraud is generally not protected by the First Amendment, courts cannot construe the SVA as an anti-fraud measure if the statute does not require actual reliance. Therefore, the SVA as …

In Davis v. United States, the United States Supreme Court established a high standard to invoke the Miranda right to counsel, holding that a suspect must make a clear and unequivocal request for an attorney. Two years later, Congress passed the Antiterrorism and Effective Death Penalty Act (AEDPA), which created a highly deferential standard of review for state court judgments challenged under federal habeas corpus jurisdiction. This thesis looks into the use of 3D Finite Element Modeling to determine the transverse design forces for short-span bridges built using the Northeast Extreme Tee with integral deck (NEXT-D) beam. Models were built using either solid elements or shell elements to represent the bridge deck, and the results were compared. The stiffness of the shear keys were taken into account during the modeling process. Results were compared to the AASHTO strip width method for design bridge decks, and the results showed that the strip width method would not be adequate for the design of NEXT-D bridges, so specific live …
