Notre Dame Law Review

The article presents information on nature and frequency of bribe solicitation and extortion. It discusses the issues the firms of the U.S. are facing in maintaining agreement with the U.S. Foreign Corrupt Practices Act (FCPA). It states that FCPA bans firms from paying bribes to foreign officials in order to retain or obtain business. It also discusses the problems it imposes on market participants. It suggests federal regulators to provide improved regulatory guidelines to understand FCPA.

Using social contract theory as a foundation I examined the ways in which four multinational corporations use disclosures of corporate social responsibility to present themselves as good corporate citizens. Several factors influence a corporation’s use of CSR: size of the corporation, public visibility, personal commitment of high ranking executives, location of manufacturing operations, and types of stakeholders. There is a significant difference in the responsibilities and obligations Proctor & Gamble, Kimberly-Clark, and Colgate-Palmolive ascribe to themselves as corporate citizens compared to those of SC Johnson. Simplifying network security data to the point that it is readily accessible and usable by a wider audience is increasingly becoming important, as networks become larger and security conditions and threats become more dynamic and complex, requiring a broader and more varied security staff makeup. With the need for a simple metric to quantify the security level on a network, this thesis proposes: simplify a network’s security risk level into a simple metric. The primary goal of this project was to transcribe a 2010 interview with Raul Ceja, a resident of Santa Maria, California who had been a member of the Local 1222 of the Laborers International Union of North America. The interviewee Raul Ceja was born in Guadalupe, California, raised in Nipomo, and was a current resident of Santa Maria, California at the time of the interview. Raul Ceja is known locally and respected for facilitating the United Farm Workers Union’s establishment throughout the Central Coast. Population Status, Habitat Dependence, And Reproductive Ecology Of Bahama Orioles: A Critically Endangered Synanthropic Species, Melissa R. Price, Valerie A. Lee, William K. Hayes

Recent elevation of critically endangered Bahama Orioles (Icterus northropi) to species status prompted us to evaluate their population status, habitat use, and breeding ecology. From surveys, we estimated that at least 141 to 254 individuals remain globally, with 90 to 162, 24 to 44, and 27 to 48 individuals remaining on North Andros Island, Mangrove Cay, and South Andros Island, The Bahamas, respectively. Orioles were observed nesting exclusively in anthropogenic habitat (residential and agricultural land), but home ranges also included nearby pine forest and coppice (dry broadleaf forest). Developing Hybrid Approaches To Predict Pka Values Of Ionizable Groups, Shawn Witham, Kemper Talley, Lin Wang, Zhe Zhang, Daquan Gao, Wei Yang, Emil Alexov

Accurate predictions of pKa values of titratable groups require taking into account all relevant processes associated with the ionization/deionization. Frequently, however, the ionization does not involve significant structural changes and the dominating effects are purely electrostatic in origin allowing accurate predictions to be made based on the electrostatic energy difference between ionized and neutral forms alone using a static structure. On another hand, if the change of the charge state is accompanied by a structural reorganization of the target protein, then the relevant conformational changes have to be taken into account in the pKa calculations. The pKa-cooperative aims to provide a forum for experimental and theoretical researchers interested in protein pKa values and protein electrostatics in general. The first round of the pKa-cooperative, which challenged computational labs to carry out blind predictions against pKas experimentally determined in the laboratory of Bertrand Garcia-Moreno, was completed and results discussed at the Telluride meeting (July 6–10, 2009). This Article provides an overview of the significant cases that have defined state-tribal relations in Alaska as related to Indian child proceedings and further discusses various policies that have been implemented over time. After outlining these cases and shifting policies, the Article examines the current state of the law in Alaska with a focus on State v. Native Village of Tanana, which clarified confusion regarding the inherent jurisdiction held by federally recognized Alaska Native tribes to initiate the Indian Child Welfare Act (ICWA)-defined child custody proceedings. Alvarado Revisited: A Missing Element In Alaska’S Quest To Provide Impartial Juries For Rural Alaskans, Jeff D. May

In Alvarado v. State, the Alaska Supreme Court declared that an impartial jury is a cross section of the community and that the community where the events at issue transpired must be represented in the jury. This decision spurred changes to jury selection procedures and the creation of Criminal Rule 18, an effort to ensure defendants from remote villages are judged by a jury representative of these rural areas. The Alaska Court of Appeals recently addressed an issue of first impression regarding the application of Criminal Rule 18. In Joseph v. State, the defendant was convicted of murdering his …
