It’s become almost passé to decry our federal trademark dilution laws. The laws – first passed in 1995 and amended in 2006 – protect “famous trademarks” against uses that are likely to dilute their distinctiveness, without regard to any confusion among consumers or competition between the parties. Early critics warned that passage of the anti-dilution statute marked a turning point in trademark law: by giving famous trademark holders rights against even non-confusing uses of their marks, the law created “property”-like rights in trademarks. Vulnerability assessments and penetration testing are two approaches available for use by internet security practitioners to determine the security posture of information networks. By assessing network vulnerabilities and attempting to exploit found vulnerabilities through penetration testing security professionals are able to evaluate the effectiveness of their network defenses by identifying defense weaknesses, affirming the defense mechanisms in place, or some combination of the two. Most of the routing and replication algorithms for Mobile Peer to Peer (M-P2P) networks assume the network to be large and therefore, the architecture and algorithms are designed to be scalable. These algorithms however may not perform well with limited number of nodes in a network such as of UAVs. This thesis explores the relationship between judicial independence and judicial accountability by investigating the question of how selection methods shape state appellate court decisions. I conducted a case study using the states of Tennessee and Kentucky and the judicial selection methods of appointments and elections. I then conducted a sample of cases and did a comparative quantitative analysis of reversal records between the two states in the hopes of finding a statistical difference from my research. Statistical and machine learning is a fundamental task in sensor networks. Real world data almost always exhibit dependence among different features. Copulas are full measures of statistical dependence among random variables. Estimating the underlying copula density function from distributed data is an important aspect of statistical learning in sensor networks. With limited communication capacities or privacy concerns, centralization of the data is often impossible. By only collecting the ranks of the data observed by different sensors, we estimate and evaluate the copula density on an equally spaced grid after binning the standardized ranks at the fusion center. This qualitative study investigates the effect frequent organizational restructure has on employee perceptions. Frequent is defined as two or more restructures in less than eighteen months. For this study, I evaluated findings from ten employees who worked in various industries throughout the Midwest who had experienced at least two restructures in less than eighteen months. Interviews were conducted with individuals to understand their perspective of organizational restructures they've participated in at their company. A quantitative PCR procedure targeting the ?-tubulin gene determined the number of Rotylenchulus reniformis Linford & Oliveira 1940 in metagenomic DNA samples isolated from soil. Of note, this outcome was in the presence of other soil-dwelling plant parasitic nematodes including its sister genus Helicotylenchus Steiner, 1945. The methodology provides a framework for molecular diagnostics of nematodes from metagenomic DNA isolated directly from soil.

International students not only have an economic impact on the United States in the billions of dollars, they culturally enrich college campuses and play a critical role in fostering U.S. foreign relations (NAFSA, 2006). The purpose of this study was to examine international students’ perceptions of the United States as a result of participating in a short-term ESL program at three campuses of a community college district in the Midwest, and to explore the influence of campus cultural attributes (diversity of the student body, breadth of support for international students, and setting) on these perceptions. The vespid fauna of Greater Puerto Rico is reviewed (Hymenoptera: Vespidae). Three new species are described, Ancistrocerus isla Carpenter, Euodynerus jeitita Carpenter and Genaro, and Omicron aridum Carpenter and Genaro. Polistes crinitus americanus (Fabricius, 1775) and P. crinitus multicolor (Olivier, 1792) are both reduced to synonyms of nominotypical P. crinitus (Felton, 1765), revised status; Zeta abdominale hispaniolae (Bequaert and Salt, 1931) and Zeta abdominale ornatum (de Saussure, 1855) are both reduced to synonyms of nominotypical Zeta abdominale (Drury, 1770), revised status; and Zethus rufinodus monensis Bohart and Stange, 1965, and Zethus rufinodus virginicus Bohart and Stange, 1965, are both reduced …

The First Vouchered Milliped Records For Prince Edward Island And Additional New Records From The Maritime Provinces Of Canada (Arthropoda: Diplopoda), Rowland M. Shelley, Mary E. Smith

Four milliped species, substantiated by preserved voucher samples, are reported from Prince Edward Island, Canada. All are introduced European species that now occur widely in both Canada and the United States, and the panglobal Asian paradoxosomatid, Oxidus gracilis (C. L. Koch, 1847), is listed as probable. Choneiulus palmatus (Némec, 1895) (Julida: Blaniulidae) is newly recorded from New Brunswick, and four representatives of the Julidae are cited from Nova Scotia. Discovery of Cylindroiulus punctatus (Leach, 1815) (Julidae) in this province constitutes the second record from both Canada and North America, the other being in Newfoundland.

The American species belonging to the genera Alloblackburneus Bordat and Blackburneus Schmidt (Coleoptera: Scarabaeidae: Aphodiinae) are redescribed and figured. Seven new species are described: Alloblackburneus guadalajarae, A. ibanezbernali; Blackburneus amazonicus, B. sanfilippoi, B. surinamensis, B. teposcolulaensis, B. thomasi. The neotype of Scarabaeus rubeolus Palisot de Beauvois, 1809 is designated. The lectotype of Blackburneus argentinensis (Schmidt, 1909) and of Blackburneus laxepunctatus (Schmidt, 1910) are designated. In the Blackfeet Tribal Court of Appeals, the Court considered a petition for a Writ of Habeas Corpus and considered whether un-arraigned defendants can be held longer than 72 hours. The Court ruled that prolonged incarceration without proper court order violated the defendants due process rights. The Case is dismissed and the defendant is ordered released.

The nBmp2 protein was first identified in a DNA affinity chromatography/mass spectrometry screen designed to detect proteins that interact with a cartilage-specific enhancer element (called D/E) from the type XI collagen gene Col11a2. The transcription factor SOX9, a protein from the Sox (SRY-related HMG box) family, binds to and activates gene expression from this enhancer. nBmp2 has no transcriptional activity of its own on this enhancer, but when co-transfected with SOX9 it increases SOX9's activation of D/E nearly 2-fold. SOX9 also activates cartilage-specific enhancer elements from the Col2a1, Col27a1, and Col9a1 genes. The purpose of this project …

We investigate, through numerical experiments, the viability of three-dimensional transient hydraulic tomography (3DTHT) for identifying the spatial distribution of groundwater flow parameters (primarily, hydraulic conductivity K) in permeable, unconfined aquifers. To invert the large amount of transient data collected from 3DTHT surveys, we utilize an iterative geostatistical inversion strategy in which outer iterations progressively increase the number of data points fitted and inner iterations solve the quasi-linear geostatistical formulas of Kitanidis. In order to base our numerical experiments around realistic scenarios, we utilize pumping rates, geometries, and test lengths similar to those attainable during 3DTHT field campaigns performed at …

Although faculties are more diverse, decentralized, and increasingly isolated in technology-supported modern universities, effective technology use can also foster faculty professional academic development and collegiality. This scoping literature review applied Cooper’s systemic review model and a categorical content analysis technique targeting decentralized collaborative research teams in higher education. Findings indicate technology supports formal and informal university and nonuniversity networks, as well as various collaborative research structures; all contributing to professional academic development. Shared attributes of successful collaborative online teams include a sense of social presence, accountability, institutional and team leadership.
