Incorporating technology into the physical education curriculum is becoming a popular strategy in which teachers can assess, motivate, and provide feedback to students regarding their physical activity participation during class. The purpose of this exploratory study was to gain a greater understanding of high school students’ perceptions of using heart rate monitors during physical education class. Qualitative data were collected through focus groups with students who had utilized heart rate monitors during the previous year of physical education class. This study analyzed responses to career-related questions from a survey of experienced Canadian Certified Management Accountants (CMAs), relative experts in the field of management accounting, to address how mentoring affects turnover intentions and career plateau tendency of male and female accounting professionals in industry. In this regard, we used structural equations modeling to build and test a framework illustrating the impact of mentoring and career-related factors. Results indicate that fostering a mentoring environment within an organization can strengthen CMAs perceptions of their careers and employers. There are very few minority teachers in pk-12 schools today even though research indicates that minority teachers are beneficial in classrooms. Teacher education programs are working to bring more teachers of color into the field, but few minority recruitment and retention programs have been evaluated. In these situations behavioral assessments are frequently conducted and current practice adamantly supports the use of functional behavioral assessments (FBA) in addressing challenging behaviors among students. This study examines the assessment methods and personnel most frequently included in the FBA process in a Midwestern regional education agency through the review of completed assessments in a one year period. In this qualitative case study, I explored how Maggie, the teacher, and her students used language to advance students' conceptual understanding of mathematics in a reform-based mathematics classroom. Specifically I sought to describe how Maggie's reform-based mathematics classroom environment impacted the quantity and quality of mathematical language spoken by her students. Maggie's eighth-grade mathematics classroom was observed during a course of study on data and statistics. Three semi-structured interviews with Maggie, artifacts provided by her, and fourteen 52-minute classroom lessons, supported with field notes, were analyzed.

S. 41 (1957), the Supreme Court announced its commitment to a liberal pleading regime in federal civil cases, and for decades thereafter was steadfast in resisting ad hoc heightened pleading rules adopted by lower courts. Thus, from 1957 until a few years ago, most litigants could count on surviving a motion to dismiss a complaint for failure to state a claim so long as their pleading provided some minimal notice to the defendant of the nature of their claim. The formation of cracks in concrete is a normal phenomenon. However, effective control and prevention of the formation of cracks is the key for successful life of concrete structures. Specifically, cracks represent a path of least resistance for moisture and corrosive ionic agents from de-icing salts to reach embedded steel in concrete. Commercial wireless sensor networks utilizing crack gauge sensors can be applied for crack monitoring in the common concrete structure. Beginning with the Water Quality Act of 1987, requirements were put in place to control sediment run off from construction sites, which typically meant silt fences were installed and maintained on job sites. In 2009, when Aggregate Industries was fined $2.7 million by the Environmental Protection Agency (EPA) for poor management of concrete wash water, the disposal of concrete wash water became a significant issue. Following the EPA guidelines, the Minnesota Pollution Control Agency (MPCA) currently allows the dumping of excess concrete on the job sites, but requires control of all water used to wash concrete ready mix trucks, delivery …

The Rising Bar For Persecution In Asylum Cases Involving Sexual And Reproductive Harm, Fatma E. Marouf

This Article argues that there is a rising bar for establishing persecution in U.S. asylum cases involving sexual and reproductive' harm. Analyzing recent cases, the Article shows that adjudicators tend to apply a higher standard for physical harm in these types of cases and largely overlook nonphysical harm, including psychological suffering and the intangible harm caused by deprivation of equality, autonomy, and privacy. The Article focuses specifically on two types of cases where these patterns appear: (1)female genital mutilation (FGM); and (2) involuntary insertion of an intrauterine device (IUD). Micromachined free standing nanogap with metal electrodes is presented. The gap size is as small as 17 nm, and can be reduced further with electrostatic or piezoelectric actuation. The nanoscale gap is fabricated by industrial standard optical lithography and anisotropic wet chemical Si etching. Electron transport between the metal electrodes with optical stimulus enhancing photon-electron coupling (plasmon) is presented.

This paper demonstrates an acoustic sensor that can resolve atomic force microscopy (AFM) tip blunting with a frequency sensitivity of 0.007%. The AFM tip is fabricated on a thin film piezoelectric aluminum nitride (AlN) membrane that is excited as a film bulk acoustic resonator (FBAR). We demonstrate that cutting 0.98 μm off of the tip apex results in a resonance frequency change of 0.4MHz at 6.387GHz. This work demonstrates the potential for in-situ monitoring of AFM tip wear.

The use of arbitration to resolve international investment disputes clearly represents an improvement over “gunboat diplomacy” and its implicit threat of violent confrontation. Nonetheless, investors, States and other stakeholders have begun to express dissatisfaction with some elements of arbitration in the international investment treaty context. First, arbitration proceedings can be quite lengthy, and their transaction costs seem to be increasing. Second, parties’ compliance is not guaranteed. Some States suggest they may refuse to abide by arbitral awards. This Article makes two overarching arguments. First, strategy is a major driver of legal evolution. Most scholarship and commentary on cyber-attacks capture only one dimension of this point, focusing on how international law might be interpreted or amended to take account of new technologies and threats. The focus here, however, is on the dynamic interplay of law and strategy – strategy generates reappraisal and revision of law, while law itself shapes strategy – and the moves and countermoves among actors with varying interests, capabilities, and vulnerabilities. Most chloroplast proteins are encoded in the nucleus and translated in the cytosol with an N-terminal cleavable transit peptide, which can be recognized by the translocon at the outer envelope membrane of chloroplasts (Toc complex). The core Toc complex is composed of two GTPases, Toc159 and Toc34, and the Toc75 channel. atToc159, atToc132 and atToc120 are homologues of the Toc159 family in Arabidopsis, and have been shown to assemble into structurally and functionally distinct Toc complexes. When performance is excused there remains the question of how to treat any payments or expenditures that were made prior to the occurrence of the contract-frustrating event. In Chandler v. A wearable computer interface with split button configuration was constructed using Arduino Lilypad components on the front of a vest with the goal of assessing its usability in an activity involving at least one hand. A sample of twelve men and eight women ages 18 to 62 participated in a usability study of the vest. The prevention of childhood obesity during the formative years is necessary because dietary patterns influenced by parents are developed early. A major obstacle to healthy feeding patterns in children is television advertising. In the public debate over the program, many of its proponents have defended it by focusing on what is sometimes called the “free-rider” problem. Gingival abscess, also known as parulis, is defined as a localized, acute inflammatory lesion that may arise from a number of sources, including microbial plaque infection, trauma, and foreign body impaction. It often presents as a smooth, fluctuant, red-color swelling and can occasionally be painful. It is generally limited to marginal and interdental gingiva. Based on its location it has been classified as a type of periodontal abscess which does not involve any attachment loss. The payment card industry in the United States has come under increasing scrutiny in recent years. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 reflects a high-water mark of congressional influence for the industry, altering bankruptcy procedures largely for the benefit of card issuers. Since that point, Congress has turned repeatedly to rein in perceived abuses in the industry. The most substantial and direct response to the perception of abuse is the Credit Card Accountability Responsibility and Disclosure Act of 2009. EPA will soon propose performance standards under Section 111 of the Clean Air Act for greenhouse gas pollution from the two largest emitting stationary source sectors – fossil-fueled power plants and petroleum refineries. The form these standards will take remains unclear. A key issue that will shape the effectiveness of the regulations is the degree to which they enable regulated entities to use flexible approaches to achieve the standards.
