Does the constitutional protection of commercial speech impair the government's ability to protect and promote public health? Or does the commercial speech doctrine itself enhance consumer education and harness market competition to advance public health? Do First Amendment limitations on regulation of commercial messages unduly retard governmental efforts to safeguard consumers? Or do they properly constrain illiberal paternalism? If the Court has been over-protective of health-related commercial speech, is there a principled place to redraw the line? And how should those governmental agencies entrusted with the power to protect public health and welfare respond to these constitutional constraints?

ABSTRACT A Century of Change in Forest Structure and Fire Regime Condition Class in a Western Montana Ponderosa Pine/Douglas-fir Forest - Restoring historical forest conditions is often a driving force behind forest management activities today. However, determining historical, pre-settlement conditions can be challenging. Utilizing General Land Office (GLO) survey notes to reconstruct historical stand structure is one method to achieve this goal. Original GLO survey notes from 1902 were used to reconstruct historical stand condition in a 2,694 acre ponderosa pine/ Douglas–fir forest. In light of former president George W. Bush’s remarkably low approval ratings during the later years of his administration, the Comedy Central program Lil’ Bush seemed to be a satiric outlet for societal angst. A closer examination of the show, however, reveals that its content is funny, but does more to entertain than it does to criticize. Using the dichotomy of Burke’s comedic and humorous frames as a standard for analysis, this thesis probes the program to determine the nature of its humor. As urban agriculture organizations become increasingly popular, it is important to understand the impact they have on low-income urban communities. Food security and political power are greatly lacking in these areas. Agriculture endeavors, such as community gardens and urban farms, have a significant potential to decrease these deficits. First, this thesis will address how social inequalities, which are products of structural power, prevent the poor from being properly fed and discuss how urban agriculture programs, specifically community gardens, can reduce food insecurity and build a community’s social resources. The purpose of this study was to collect information about the HIV prevention needs of men who have sex with men (MSM) living in Montana. Prevention needs were explored by identifying the environmental factors and behaviors that put MSM at risk for HIV infection, describing the demographic and contextual factors that influence those behaviors, and comparing current prevention needs to existing resources and services. To evaluate the prevention needs, primary qualitative data was collected in the form of four focus groups and nine key informant interviews. HIV-2 tightly regulates several steps of its replication cycle via regulatory elements found within the 5 untranslated region of HIV-2 genomic RNA. Two elements of interest are the 5 UTR intron and the proposed long distance base pairing interaction between the C-box and G-box termed the CGI. This research focuses on the effects of 5 UTR splicing and the CGI in HIV-2 translation and replication. The central hypothesis is that both 5 UTR splicing and the CGI modulate HIV-2 translation and replication. This hypothesis was tested and supported by employing in vitro translation assays, SELEX, and cell culture studies. Results …

This quantitative, non-experimental study described the perceptions of the Deans of the Foreign Affairs Office in public institutions of higher education in China regarding their agreement with, and implementation of, the current national policy concerning the employment of foreign experts. This study utilized a descriptive survey design. Data were collected using a self-designed web-based questionnaire. The sample for this study consisted of 116 participants providing a sample which closely represented the characteristics of the population.

Dogs represent a unique facet of the faunal assemblage at the Bridge River site (EeRl4), a prehistoric aggregated winter housepit village in southern British Columbia’s Middle Fraser Canyon. As part of the Bridge River site investigation of emergent material wealth based status inequality of the hunter-gatherer-fisher economy, the 2008 and 2009 excavation of the village recovered the skeletal remains of domestic dogs within two distinct cache pit features in Housepit 24’s Activity Area 3. The two dogs unearthed from these separate cache pits features show dichotomous roles for man’s best friend; one, possibly as a prized companion, and the other …

Bull trout Salvelinus confluentus are a species of conservation interest and are currently listed as threatened by the U.S. Fish and Wildlife Service. Understanding and conserving the genetic and life history diversity of bull trout populations across their range is critical as conservation, management, and recovery plans are developed. Numerous studies in different regions have shown that local bull trout populations in close geographic proximity are typically very genetically different and evidence for dispersal among neighboring tributary populations is weak. A limitation of Bhutan’s controlled tourism policy of “high value, low impact” is that its benefits have not extended to rural communities in remote places. To provide such opportunities, a pilot project on community-based ecotourism known as the “Nabji Trail” was developed and opened in Jigme Singye Wangchuck National Park (JSWNP) in November 2006. The trail involves a walking tour across six villages including two ethnic groups, Monpa and Khengpa. Several tourism enterprises, including employment as porters, guides, cooks, selling handicrafts and providing cultural entertainment, are offered by local residents to raise income. This study sought to determine the relationship between participation in informal mathematics activities and the formal-to-informal beliefs of university teacher candidates in elementary education. Three classes of preservice teachers participated in the study through their enrollment in a content mathematics course for elementary education majors. Four informal mathematics activities were employed as part of the course requirements. Pre and post formal-to-informal beliefs about mathematics and mathematics instruction were measured using a Likert-scale beliefs assessment instrument used by Collier (1972) and Seaman et al. (2005). APOBEC proteins have evolved in mice and humans as potent innate defences against retroviral infections. APOBEC3G (hA3G) in humans and mouse APOBEC3 (mA3) deaminate cytidine in single-stranded DNA which ultimately results in hypermutation of newly synthesized proviral DNA. Other deaminase-independent mechanisms of inhibition have been identified, such as directly inhibiting reverse transcription. Both HIV and murine leukemia viruses (MuLVs) have evolved mechanisms to evade the action of the APOBEC proteins. HIV encodes the Vif protein which binds to hA3G and facilitates its rapid degradation through the proteasome. The mechanism(s) by which exogenous MuLVs evade mA3 inhibitory activity is unknown.

Trillium ovatum is a long-lived, spring ephemeral that grows in moist forest habitats of the western United States. Extensive investigations of Trillium, including T. ovatum, have been accomplished, yet no prior studies of T. ovatum have been conducted at the eastern edge of its distribution in Montana, where populations experience increased aridity and highly variable climatic conditions as compared to other regions where it occurs. Background: Unintentional falls are an increasing public health problem as incidence of falls rises and the population ages. The Centers for Disease Control and Prevention reports that 1 in 3 adults aged 65 years and older will experience a fall this year; 20% to 30% of those who fall will sustain a moderate to severe injury. Physical therapists (PTs) and other primary care practitioners (PCPs) caring for older adults are usually engaged with these patients after the first injury fall and may have little opportunity to abate fall risk before the injuries occur.

This paper investigates how Christian writers from late antiquity through the twelfth century transformed explanations of encounters with Middle Eastern peoples and lands into a complex theological discourse. Examinations of sermons and narrative sources from antiquity through the first century of Crusades (1096-1192) serve as evidentiary bases because of the polemical way in which Pope Urban II’s 1095 sermon at Clermont defined Muslims. In that sermon, chroniclers recorded that the pope rallied Frankish support for an armed pilgrimage by disparaging Muslims who had overrun Jerusalem and the Holy Sites – calling them a “race utterly alienated from God” (gens …

Sir Thomas More is an important figure in European intellectual history. During his lifetime, he was known throughout Europe as an accomplished thinker, writer, and lawyer. His devotion to the Church, pious lifestyle, and dramatic execution at the hands of Henry VIII made him a Catholic martyr, leading to his canonization in 1935. The facts of his remarkable life, his status among early modern Humanist intellectuals, friendship with Erasmus, his written works, like his famous Utopia, make it unsurprising that numerous scholars have written about More and analyzed his works. Islamic studies scholar Daniel C. Peterson has written a small book that speaks volumes about the man who, in about the year AD 610, while meditating in a cave near Mecca in Arabia, received a prophetic call that led to the establishment of a religion that today is claimed by almost a quarter of the world's inhabitants. It adds to the growing body of research by Peterson and other Latter-day Saint scholars that strengthens the Church's role as a voice of reason in an area rife with misunderstandings and ignorance--the Islamic world.

Most of our histories about Mormons in Missouri speak of dramatic events in the 1830s in the western region of the state. Congratulations to Fred Woods and Thomas Farmer for writing a history of the Latter-day Saints in St. Louis. Woods, a professor of Church History and Doctrine at BYU, and Farmer, a lifetime St. Louis resident, wrote of the LDS presence in St. Louis beginning with early missionaries in 1831 and ending with the St. Louis Stake jubilee in 2008. This Article offers the first legal analysis of desalination, the process of converting saltwater into freshwater. Desalination represents a key climate change adaptation measure because the United States has exploited nearly all of its freshwater resources, freshwater demands continue to grow, and climate change threatens to diminish significantly existing freshwater supplies. However, scholarship has yet to address the legal ambiguities that desalination raises in the context of property, water law, and coastal resource doctrines.

The Supreme Court has recently decided to hear argument in the largest private-employer civil rights case in American history, Dukes v. Wal-Mart Stores, Inc. This historic case involves up to 1.5 million women suing Wal-Mart, one of the largest companies in the world, for alleged gender discrimination in pay and promotions, in violation of Title VII of the Civil Rights Act of 1964. Like many employees who challenge companywide employment discrimination, the plaintiffs in Dukes brought their case as a class action pursuant to Rule 23(b)(2) of the Federal Rules of Civil Procedure and sought injunctive and declaratory relief, …
