Is ‘Argument’ Subject To The Product/Process Ambiguity?, G. C. Goddu
Is ‘Argument’ Subject To The Product/Process Ambiguity?, G. C. Goddu
Philosophy Faculty Publications
The product/process distinction with regards to “argument” has a longstanding history and foundational role in argumentation theory. I shall argue that, regardless of one’s chosen ontology of arguments, arguments are not the product of some process of arguing. Hence, appeal to the distinction is distorting the very organizational foundations of argumentation theory and should be abandoned
On A Duty Of Humanitarian Intervention, David Lefkowitz
On A Duty Of Humanitarian Intervention, David Lefkowitz
Philosophy Faculty Publications
Perhaps the most discussed topic amongst just war theorists during the 1990s was the moral (and legal) justifiability of armed humanitarian interventions. Not surprisingly, that changed after the 9/11 terrorists attacks and the invasions of Afghanistan and Iraq, with topics such as the morality of terrorism, torture, and preventive war receiving the lion's share of attention. Nevertheless, for reasons both good, such as the International Commission on Intervention and State Sovereignty's endorsement of a limited duty of intervention in its report, The Responsibility to Protect, and bad, such as the conflict in Darfur, the morality of humanitarian intervention remains …

In most of our decisions as parents or educators concerning how we should talk to children about difficult subjects, the question turns to what degree we should withhold the truth, how much information we should provide, or what details are appropriate. We, as adults, know the answer to the child's question, and the difficulty arises in figuring out what to convey and how. Questions about death and the afterlife are not like this. We - and by "we;' I mean especially educated adults of the Western world - are often as confused about what we should believe about these matters …
Hemebind: A Novel Method For Heme Binding Residue Prediction By Combining Structural And Sequence Information, R. Liu, Jianjun Hu
Hemebind: A Novel Method For Heme Binding Residue Prediction By Combining Structural And Sequence Information, R. Liu, Jianjun Hu
Faculty Publications
Background
Accurate prediction of binding residues involved in the interactions between proteins and small ligands is one of the major challenges in structural bioinformatics. Heme is an essential and commonly used ligand that plays critical roles in electron transfer, catalysis, signal transduction and gene expression. Although much effort has been devoted to the development of various generic algorithms for ligand binding site prediction over the last decade, no algorithm has been specifically designed to complement experimental techniques for identification of heme binding residues. Consequently, an urgent need is to develop a computational method for recognizing these important residues.

Gray-Market Goods And Copyright's Gray Area, James Gibson
Law Faculty Publications
Copyright law generally gives authors no control over the aftermarket for their goods. Suppose I write a book, and I sell you a copy of it. You are free to resell the book, or lend it to a friend, or give it away. That’s because as long as your copy is “lawfully made under this title” (that is, made with my authorization under U.S. law), then copyright has nothing to say about its further distribution – who owns it, who sells it to whom, etc.
This notion is known as the first sale doctrine. It is so named because at …

The recent agreement between big media companies and big Internet service providers (ISPs) concerning online copyright infringement has the law and technology world abuzz. ISPs like Comcast, Verizon, and Time Warner Cable have agreed to implement a system under which subscribers who repeatedly and illegally download copyrighted content will have their Internet access impeded and maybe even terminated.
This is big news, and it will probably receive more attention in this IP Viewpoints series. But the purpose of this column is to put this agreement in context, because much of what the companies have agreed to do appears to be …

No studies have investigated dietary differences between head and neck squamous cell carcinoma (HNSCC) patients with human papillomavirus (HPV)-positive tumors and patients with HPV-negative tumors. This study was designed to investigate the relationship between diet and HPV status in HNSCC patients. Cases of HNSCC were recruited from 2 clinical centers participating in the University of Michigan Head and Neck Specialized Program of Research Excellence (SPORE). HPV tissue genotyping was performed, and epidemiological and dietary data collected. Multivariable logistic regression tested whether pretreatment consumption of 12 selected micronutrients was significantly associated with HPV-positive status in 143 patients newly diagnosed with cancer …

TiO2and Nb-TiO2 were investigated as stable supports for Pt-Ru electrocatalysts towards methanol oxidation. X-ray photo-electron spectroscopy (XPS) data for all these TiO2-based supports show oxidation states of Ti4+, with no Ti3+, suggesting low electronic conductivity. However, the deposition of metal nanoparticles onto the supports at loadings of 60 wt% metal dramatically increased conductivity, making these electrodes (metal particles + support) suitable for electrochemistry even though the supports have low conductivity. For some of these TiO2-based supports, the activity of Pt-Ru towards methanol oxidation was excellent, even surpassing the activity …

An Evidence-Based Toolkit For Human Papillomavirus Vaccine Education Of Female Adolescents In The School Setting, Nancy R. Kloha
DNP Projects
A new vaccine to prevent human papillomavirus infection was approved in 2006 in the United States (U.S.). Uptake of the vaccine has been less than optimal (CDC, 2010c). New venues for promoting vaccine acceptance are needed (Middleman & Tung, 2010). The goal of this capstone clinical project is to create an evidence based toolkit for use by school nurses in educating female adolescents, parents, communities and other healthcare providers about the HPV vaccine.
Schools nurses have daily access to young people in the target group for HPV immunization. A vital component of vaccine acceptance is education of those who are …

The transformation of health care delivery in the United States is accelerating at unbelievable speed. The acceleration is a result of many variables including health care reform as well as the covariation occurring with adjustments in regulations related to resident work hours. The evolving care delivery model has exposed a vulnerability of the health system, specifically in academic medical centers of the United States. Academic medical centers have established a care delivery model grounded and predicated in resident presence and performance. With changes in resident work expectations and reduced time spent in hospitals, an urgent need exists to evaluate and …
The Complex Nature Of Asperger’S Syndrome: Assessing Knowledge And Perceptions Of School Psychologists, Kelly L. Herman
The Complex Nature Of Asperger’S Syndrome: Assessing Knowledge And Perceptions Of School Psychologists, Kelly L. Herman
PCOM Psychology Dissertations
The complex nature of Asperger’s Syndrome (AS) often results in difficulty effectively meeting the needs of individuals with this disorder. Despite advancements in research and increasing focus on this disorder, limited awareness and understanding often result in difficulty identifying and, therefore, adequately supporting individuals with AS. Inadequate or faulty treatment further results from inappropriate diagnosis or failure to recognize psychiatric disorders likely to coexist with AS. This paper provides a literature review of AS and problems resulting from limited awareness, failure to identify or diagnose the disorder, failure to recognize common comorbid conditions, and failure to provide the appropriate supports …

Purpose: Skin prick testing (SPT) is fundamental to the practice of clinical allergy identifying relevant allergens and predicting the clinical expression of disease. Wheal sizes on SPT are used to identify atopic cases, and the cut-off value for a positive test is commonly set at 3 mm. However, the measured wheal sizes do not solely reflect the magnitude of skin reaction to allergens, but also skin reactivity (reflected in the size of histamine reaction) and other random or non-random factors. We sought to estimate wheal sizes exclusively due to skin response to allergens and propose gender-specific cutoff points of atopy. …

African American men have among the highest prostate cancer incidence rates in the world yet rates among their African counterparts are unclear. In this paper, we compare reported rates among black men of Sub-Saharan African descent using data from the International Agency for Research on Cancer (IARC) and the National Cancer Institute Surveillance, Epidemiology, and End Results Program from 1973-2007. Although population-based data in Africa are quite limited, the available data from IARC showed that rates among blacks were highest in the East (10.7-38.1 per 100,000 man-years, age-adjusted world standard) and lowest in the West (4.7-19.8). These rates were considerably …

Objective
This ecologic study tested the hypothesis that census tracts with elevated groundwater uranium and more frequent groundwater use have increased cancer incidence.
Methods
Data sources included: incident total, leukemia, prostate, breast, colorectal, lung, kidney, and bladder cancers (1996–2005, SC Central Cancer Registry); demographic and groundwater use (1990 US Census); and groundwater uranium concentrations (n = 4,600, from existing federal and state databases). Kriging was used to predict average uranium concentrations within tracts. The relationship between uranium and standardized cancer incidence ratios was modeled among tracts with substantial groundwater use via linear or semiparametric regression, with and without stratification …

Optical Cell For Combinatorial In Situ Raman Spectroscopic Measurements Of Hydrogen Storage Materials At High Pressures And Temperatures, Jason R. Hattrick-Simpers, Wilbur S. Hurst, Sesha S. Srinivasan, James E. Maslar
Faculty Publications
An optical cell is described for high-throughput backscattering Raman spectroscopic measurements of hydrogen storagematerials at pressures up to 10 MPa and temperatures up to 823 K. High throughput is obtained by employing a 60 mm diameter × 9 mm thick sapphire window, with a corresponding 50 mm diameter unobstructed optical aperture. To reproducibly seal this relatively large window to the cell body at elevated temperatures and pressures, a gold o-ring is employed. The sample holder-to-window distance is adjustable, making this cell design compatible with optical measurement systems incorporating lenses of significantly different focal lengths, e.g., microscope objectives and single element …

Mechanical Characterization Of Polymer Electrolyte Membrane With Optical Methods, Xinyu Huang, Luis Alva, Jay Neutzler
Faculty Publications
Mechanical properties of polymer electrolyte membrane have important implications in the endurance of many electrochemical energy conversion devices [1]. Mechanical experiments are effective method to reveal discrete damage developed in the membrane by quantifying the change of mechanical strength and toughness. Regular strain measurement methods are overly intrusive to the thin and relatively fragile polymer electrolyte membrane; hence optical-based minimal invasive stress/strain measurement methods are studied.

Theses and Dissertations--Plant and Soil Sciences
Polyadenylation is an essential post-transcriptional modification resulting in a mature mRNA in eukaryotes. Three cis-elements the Far Upstream Element (FUE), Near Upstream Element (NUE), and Cleavage Site (CS) - guide the process of cleavage and polyadenylation with the help of multi-subunit protein complexes cleavage and polyadenylation specificity factor (CPSF), cleavage stimulation factor (CstF) along with cleavage factors and poly(A) polymerase. Protein-protein interactions play an important role in the cleavage and polyadenylation process. WD repeat proteins play an important role in protein-protein interactions and have diverse functions in plant system. In the present study WD repeat proteins AtCstF50 and AtFY were …

Using new corpus resources for Rigvedic poetics, we address various aspects of the poets' treatment of vowel hiatus and pre-vocalic shortening (correption), including their strategies for avoidance of these phenomena in certain contexts. Using observed vs. expected tests, we demonstrate, for one, that hiatus avoidance is correlated with degree of metrical-prosodic juncture. For example, hiatus is actively avoided both at the caesura in trimeter verse and between padãs, but its avoidance is weaker in the latter case. In conducting these tests, we control for a confound (interference) from pre-vocalic shortening, which requires us to address the problem of whether it …

Guerrilla marketing is a means of advertising that relies more on unconventional methods and less on big budgets. The goal is typically to do something that gets the targeted market or demographic talking so that word of mouth does most of the advertising legwork. Guerilla marketing was the technique employed to promote the 2010 Information Faire and Festival, or IF2, a new event sponsored by the Libraries of the College of the Holy Cross which invited students to learn in fun and engaging ways about the many library services and resources available. Self-rated health (SRH) and cardiorespiratory fitness (fitness) are independent risk factors for all-cause mortality. The purpose of this report is to examine the single and joint effects of these exposures on mortality risk. The study included 18 488 men who completed a health survey, clinical examination and a maximal exercise treadmill test during 1987–2003. Cox regression analysis was used to quantify the associations of SRH and fitness with all-cause mortality. There were 262 deaths during 17 years of follow-up. There was a significant inverse trend (ptrend <0.05) for mortality across SRH categories after adjustment for age, examination year, body mass index, physical activity, smoking, alcohol consumption, abnormal ECG, hypertension, hypercholesterolaemia, cardiovascular disease, diabetes and cancer. Adjustment for fitness attenuated the association (p value =0.09). The authors also observed an inverse association between fitness and mortality after controlling for the same covariates and SRH (ptrend = 0.006). The combined analysis of SRH and fitness showed that fit …0.05)>

It has been proposed that Alzheimer's disease is a synaptic failure associated with subtle memory loss during the early stages of the disorder. If this is the case, it should prove useful to elucidate the mechanisms of synaptic plasticity during early stages of the condition. On the other hand, Long Term Potentiation, one of the best-known mechanisms of synaptic plasticity has been recently confirmed absent in Alzheimer's disease patients. This link may lead to focus efforts in early detection of synaptic failure and development of preventive approaches aiming to improve synaptic plasticity. Here we review some new evidence in the …

A New Approach To Nineteenth-Century Religious Exemption Cases, Jud Campbell

Scholars frequently cite early nineteenth-century cases to ascertain the original meaning of the Free Exercise Clause. Previous studies, however, have ignored crucial trends in those decisions, thus leading to mistaken emphasis on the denial of religious accommodation claims. This Note argues that prevailing theological views, skepticism of courtroom declarations of religious belief, and contemporary notions of judicial deference better explain nineteenth-century cases than does a wholesale rejection of judicially enforceable religious exemptions. This novel approach clarifies previously unexplained tensions in early free exercise opinions. It also suggests that the Supreme Court’s holding in Employment Division v. Smith is inconsistent with …
