Notre Dame Law Review

The article discusses the durability of information and knowledge and the application of intellectual property (IP) law to those issues. The author states that creativity and innovation are a product of knowledge which should be regulated by IP law in the 21st century. He argues that some forms of knowledge are inherently excluded from IP law protection which seems to favor creativity over stability and durability. In his opinion, older forms of knowledge fall under tangible property law.

The last fifty years have seen the further expansion of the role of media during times of war. Although no longer dominated by large-scale propaganda agencies as during the two world wars, the media nevertheless have become ever more integral to the planning and conduct of wars. This article applies the concept of mediatization in an attempt to capture the ever-increasing role of the media during war times as part of an ongoing and accelerating historical process. It uses a comparative analysis to highlight the commonalities of this process as well as to emphasize national particularities. The article argues that …

Occasionally, criminals correctly interpret the law while courts err. Litigation pursuant to the federal Armed Career Criminal Act (ACCA) includes numerous examples. The ACCA imposes harsher sentences upon felons in possession of firearms with prior "violent felony" convictions. Over time, courts defined "violent" so contrary to its common meaning that it eventually came to encompass driving under the influence, unwanted touching, and the failure to report to correctional facilities. However, in a series of recent decisions, the Supreme Court has attempted to clarify the meaning of violent in the context of the ACCA and, in the process, excluded such offenses. …

For at least the past thirty years, scholarship on international relations has been bewitched by a simple proposition: the polarity of the international system is a central cause of great power strategies and politics. The number of "poles" (dominant countries) in the system is like an invisible fence that shapes states as if they were dogs with electronic collars or a Skinner box that conditions national "rats." The United States Naval War College (NWC) in Newport, Rhode Island hosted the Fleet Arctic Operations Game (FAOG) on 13-16 September 2011. The FAOG was developed and executed under the sponsorship of Commander, Second Fleet (C2F) initially and then Commander, U.S. Fleet Forces (USFF) following the integration of the two staffs. The purpose of the FAOG was to identify gaps that limit sustained maritime operations in the Arctic and recommend DOTMLPFP actions in order to inform United States Navy leadership. Following the events of September 11, 2001, the U.S. Government began improving security in large population centers and near potential highvalue terrorist targets. Included in these efforts was the development of a more robust border security program, with an emphasis on reducing the threat of terrorist infiltration at America's borders. However, nearly a decade after 9/11, terrorism and organized crime continue to pose significant threats to the United States. As many of these threats emanate from other nations, improved border security helps mitigate these threats. Until the 1980s, Mexico enjoyed relative freedom from violence. Ruthless drug cartels existed, but they usually abided by informal rules of conduct hammered out between several capos and representatives of the dominant Institutional Revolutionary Party (PRI), which ruled the country until the 1990s. Relying on bribes, the desperados pursued their illicit activities with the connivance of authorities. In return for the legal authorities turning a blind eye, drug dealers behaved discretely, shunned high-tech weapons, deferred to public figures, spurned kidnapping, and even appeared with governors at their children’s weddings. Unlike their Colombian counterparts, Mexico’s barons did not seek elective office. …

This monograph holds that an aura of mythology has surrounded conventional academic and military perceptions of British performance in the realm of irregular warfare. It identifies 10 myths regarding British counterinsurgency performance and seeks to puncture them by critically assessing the efficacy of the British way of counterinsurgency from the much-vaunted, yet over-hyped, Malayan Emergency to the withdrawal of combat troops from Iraq in 2009. It challenges perceptions of the British military as an effective learning institution when it comes to irregular warfare and critically assesses traditional British counterinsurgency strategic maxims regarding hearts and minds and minimum force.

The focus of this study was to explore the historical underpinnings of culturally specific "healing" strategies associated with returning formerly abducted children in northern Uganda, post captivity in the Lord's Resistance Army rebel group. Although studies exist that examined both individualistic and collective approaches to aid in the reintegration process for youth who escape the war, there is minimal literature focusing on the cultural implications of Western therapeutic interventions for former child combatants in northern Uganda. This study was undertaken to explore the experience transitioning out of the military for veterans of the wars in Afghanistan and Iraq, Operation Enduring Freedom and Operation Iraqi Freedom. The study paid particular attention to the role of meaning in life in this transition. Twelve veteran participants were recruited to participate in this qualitative study through posting of call for participants through veterans organizations, craigslist volunteer ads, and snowball sampling methods. The study collected demographic information, military service history, responses to the Meaning in Life Questionnaire, and qualitative responses to a semi-structured interview consisting of six questions.
