Art Concept Pluralism, P.D. Magnus, Christy Mag Uidhir
Philosophy Faculty Scholarship
There is a long tradition of trying to analyze art either by providing a definition (essentialism) or by tracing its contours as an indefinable, open concept (antiessentialism). Both art essentialists and art anti-essentialists share an implicit assumption of art concept monism. We argue that this is a mistake. Species concept pluralism, a well-explored position in philosophy of biology, provides a model for art concept pluralism. We explore the conditions under which concept pluralism is appropriate, and we argue that they obtain for art. Art concept pluralism allows us to recognize that different art concepts are useful for different purposes, and …

In May of 2010 a group of students from the Kent State University Honors College participated in a rare undertaking: presenting a medieval play as part of an international production of the whole play-cycle from which it originates. The students were five hundred years removed from the original context of that play and cycle. The earliest mention of The Chester Cycle comes from a 1422 legal dispute regarding the responsibilities of the guilds that were producing one of the plays in it, the language of which makes clear that the play-cycle was already well-established by that time. Written following Napoleon’s final exile on the Island of St. Helena, The Grand Manifesto of Alexander I was simultaneously a work of royalist and national propaganda and of personal passion. From the French Revolution through Napoleon’s rule, in period of no more than thirty years, both the ideology of the sovereign monarch and the autonomous sovereignty of the European nations were profoundly threatened. In his manifesto, Alexander I protects his own throne both with both carrot and the stick of Christianity: he paints Napoleon as a dangerous monster and refers to his defeat as evidence that the Russians are God’s …

The Dark Side Of The Force: The Legacy Of Justice Holmes For First Amendment Jurisprudence, Steven J. Heyman

Modern First Amendment jurisprudence is deeply paradoxical. On one hand, freedom of speech is said to promote fundamental values such as individual self-fulfillment, democratic deliberation, and the search for truth. At the same time, however, many leading decisions protect speech that appears to undermine these values by attacking the dignity and personality of others or their status as full and equal members of the community. In this Article, I explore where this Jekyll-and-Hyde quality of First Amendment jurisprudence comes from. I argue that the American free speech tradition consists of two very different strands: a liberal humanist view that emphasizes …

The market for video entertainment is growing and becoming more diverse as technology reduces barriers to entry for small, independent moviemakers and distributors and increases consumers’ ability to access the media of their choice. The growing complexity of the market, however, increases transaction costs for new entrants who must obtain licenses to copyrighted music, characters, storylines, or scenes that they incorporate into their movies. The entertainment bonanza offered by new technologies may not be realized in practice because of market failure. The popular music industry is in the middle of a technology-driven revolution. It is clear that the old order has been swept away, but it is not yet clear what form the “new order” will take. The major labels are on life support and will not survive in anything like their previous form. Compact Discs are dead as a distribution medium. Copyright is unenforceable and hence essentially irrelevant except at the margins of the “new order.” Barriers to entry have been reduced dramatically as the costs of producing top-quality recordings have declined by a couple of orders of magnitude. A Study Of The Perceptions And Worldviews Of Mature Age Pre-Service Teachers Aged Between 31 And 53 Years, Matthew B. Etherington

This study presents the perceptions and worldviews of 17 mature age second-career pre-service teachers in career transition. The aim was to explore the experience of becoming a primary school teacher after a first career. The second-career pre-service teachers were enrolled on a fulltime basis at the Ontario Institute for Studies in Education (OISE/UT). The primary data were collected from 17 separate interviews of approximately 1 h; over two separate calendar years, which totalled a five-month interviewing period. The interviewees volunteered to be part of the study and were aged between 31 and 53 and enrolled in two high academic entry-level …
