In Morrison v. National Australia Bank, the U.S. Supreme Court ruled in June 2010 that securities fraud suits could not be brought under Section 10(b) of the Exchange Act against foreign defendants by foreign plaintiffs who bought their securities outside the United States (so called, “f-cubed,” securities litigation). The Court held that Section 10(b) reaches only fraud in connection with the, “purchase or sale of a security listed on an American stock exchange, and the purchase or sale of any other security in the United States.” Congress responded to Morrison with Section 929P of the Dodd-Frank Act, which gives federal …

Recycling The Oil Boom, Benjamin Frick Jan 2011

Recycling The Oil Boom, Benjamin Frick

Architecture Theses

This thesis provides some answers to the question, how can a small community sustainably adapt to a localized oil boom? The typology for this examination to the problem is a recycling center. The theoretical premise/unifying idea that guides the research is, “the small community must adapt to the demand of an oil boom but with a sustainable approach.” The project justifi cation is, “If the small community doesn’t adapt to the demand of an oil boom it is likely to suffer socioeconomic collapse and environmental ruin. A sustainable approach is needed to ensure that the town’s infrastructure can adapt.”

Suburban : Redefining Urban Residential, Steven Bugge Jan 2011

Suburban : Redefining Urban Residential, Steven Bugge

Architecture Theses

Suburbia is being called home to an increasing number of people living in Western societies. In the United States, more people live in the suburbs than the cities they surround, and 75% of all new construction is taking place in the suburbs yet only 5% of these building are designed by architects (“The challenge of Suburbia,” 2004). The effects of suburbia’s stretch across the land has had a drastic affect on American society. Culturally, physically, and psychologically, the American people have developed a way of life that has become detrimental to themselves and their environment. Urban sprawl, also known as …

A Stress-Strain Model For A Two-Phase Ultrafine-Grained Aluminum Alloy, P. S. De, J. Q. Su, R. S. Mishra

Materials Science and Engineering Faculty Research & Creative Works

Two-phase ultrafine-grained (UFG) aluminum alloys with different precipitate and low-angle boundary distributions were examined for their monotonic stress-strain behavior. Precipitates in combination with low-angle grain boundaries were found to determine the deformation micro mechanism. It is proposed that thermally activated vacancy movement plays a central role in this regard. the experimental stress-strain curves matched well with the trend predicted by a modified Blum-Zheng model based on vacancy-assisted dislocation annihilation mechanism. © 2010 Acta Materialia Inc. Hollow Hydroxyapatite Microspheres For Controlled Delivery Of Proteins, H. Fu, M. N. Rahaman, D. E. Day Jan 2011

Hollow Hydroxyapatite Microspheres For Controlled Delivery Of Proteins, H. Fu, M. N. Rahaman, D. E. Day

Materials Science and Engineering Faculty Research & Creative Works

Hollow hydroxyapatite (HA) microspheres were prepared by reacting solid microspheres of a lithium-calcium-borate glass (106-150 microns) for 2 days in K2HPO4 solution (0.02 M; 37°C) and evaluated as a controlled delivery device for a model protein, bovine serum albumin (BSA). the as-prepared HA microspheres had a hollow core with a diameter equal to 0.6 the external diameter, a surface area of V100 m2/g, and a mesoporous shell wall (pore size of ≈13 nm). after loading the hollow HA microspheres with a solution of BSA, release of the BSA into a medium of phosphate-buffered saline (PBS) …

Femtosecond Laser Writing Of Waveguides In Zinc Phosphate Glasses [Invited], Luke B. Fletcher, Jon J. Witcher, Neil Troy, Signo Tadeu Dos Reis, Richard K. Brow, R. M. Vazquez, R. Osellame, Denise M. Krol

Materials Science and Engineering Faculty Research & Creative Works

We have studied the relationship between the initial glass composition and the structural changes associated with laser-induced refractive index modification in a series of Er-Yb doped and undoped zinc phosphate glasses. White light microscopy and waveguide experiments are used together with Raman and fluorescence spectroscopy to characterize the structural changes. The correlation between Raman peak shifts and fluorescence from phosphorus-oxygen hole center (POHC) defects indicates that fs-laser writing results in a depolymerization of the phosphate glass network. The results also show that the exact glass composition should be taken into account when fabricating waveguide devices in phosphate glasses, in order …

Direct Femtosecond Laser Waveguide Writing Inside Zinc Phosphate Glass, Luke B. Fletcher, Jon J. Witcher, Neil Troy, Signo Tadeu Dos Reis, Richard K. Brow, Denise M. Krol

Materials Science and Engineering Faculty Research & Creative Works

We report the relationship between the initial glass composition and the resulting microstructural changes after direct femtosecond laser waveguide writing with a 1 kHz repetition rate Ti:sapphire laser system. A zinc polyphosphate glass composition with an oxygen to phosphorus ratio of 3.25 has demonstrated positive refractive index changes induced inside the focal volume of a focusing microscope objective for laser pulse energies that can achieve intensities above the modification threshold. The permanent photo-induced changes can be used for direct fabrication of optical waveguides using single scan writing techniques. Changes to the localized glass network structure that produce positive changes in …

The Use Of Visuals In Health Education, Ying Yan Vigenia Njoo-Lau Jan 2011

The Use Of Visuals In Health Education, Ying Yan Vigenia Njoo-Lau

Graduate Research Papers

America has a very complex health care system. It is often required a welleducated individual "to obtain, process, and understand basic health information and services needed to make appropriate health decisions" (Nielsen-Bohlman, 2004). It is also required multiple skills, like reading, writing, listening, speaking, mathematic, and decision-making (Safeer & Keenan, 2005).

90 million American adults have limited health literacy to navigate of the health care system in the United States. People with limited health literacy have trouble communicating with their health care providers, understand and adherence of medical information, medical usage. $73 billion health care cost was estimated in 1998 …

Pre-Adulthood Developmental Psycho-Social Influences Behind Women Becoming Engineers In Contemporary Australia, Andrew Ruscoe Jan 2011

Pre-Adulthood Developmental Psycho-Social Influences Behind Women Becoming Engineers In Contemporary Australia, Andrew Ruscoe

Theses : Honours

This study explored the pre-adulthood development of female engineers with a focus on influences behind their career choice. Pre-adulthood encompasses the ages 0. to 23 and includes all development prior to settling on a career (Levinson, Darrow, Klein, Levinson, & McKee, 1979). ,This area of study derives its importance from the continuing low proportion of women in engineering (9.6%; Kaspura, 2009), the gender bias that this may indicate (Burke & Mattis, 2007), and the benefits of increasing the number of women• in engineering (Engineers Australia, 20 I 0). A phenomenological methodology was applied, utilising semi-structured interviews with 10 female graduate, …

A New Legal Theory To Test Executive Pay: Contractual Unconscionability, Lawrence A. Cunningham Jan 2011

A New Legal Theory To Test Executive Pay: Contractual Unconscionability, Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

Lucrative pay to corporate managers remains controversial yet continues to evade judicial scrutiny for legitimacy. Although many arrangements likely would pass the most rigorous scrutiny, it seems equally clear that some would not. Some agreements are not the product of arm’s-length bargaining, can rivet managers on short-term stock prices at the destruction of long-term business value, and can misalign manager-shareholder interests. Yet even such objectionable arrangements are immune from serious legal oversight. In theory, they are open to judicial review under corporate law, but shareholders challenging pay contracts face formidable procedural hurdles in derivative litigation and substantive obstacles from corporation …

Removing Property From Intellectual Property And (Intended?) Pernicious Impacts On Innovation And Competition, F. Scott Kieff Jan 2011

Removing Property From Intellectual Property And (Intended?) Pernicious Impacts On Innovation And Competition, F. Scott Kieff

GW Law Faculty Publications & Other Works

Commentators have poured forth a loud and sustained outcry over the past few years that sees property rule treatment of intellectual property (IP) as a cause of excessive transaction costs, thickets, anticommons, hold-ups, hold-outs, and trolls, which unduly tax and retard innovation, competition, and economic growth. The popular response has been to seek a legislative shift towards some limited use of weaker, liability rule treatment, usually portrayed as “just enough” to facilitate transactions in those special cases where the bargaining problems are at their worst and where escape hatches are most needed. This essay is designed to make two contributions. …

The Dodd-Frank Act: A Flawed And Inadequate Response To The Too-Big-To-Fail Problem, Arthur E. Wilmarth Jr. Jan 2011

The Dodd-Frank Act: A Flawed And Inadequate Response To The Too-Big-To-Fail Problem, Arthur E. Wilmarth Jr.

GW Law Faculty Publications & Other Works

The Dodd-Frank Wall Street Reform and Consumer Protection Act ("Dodd-Frank") was enacted in July 2010. Dodd-Frank's preamble proclaims that one of the statute's primary purposes is to "end 'too big to fail' [and] to protect the American taxpayer by ending bailouts." Dodd-Frank does contain useful reforms, including potentially favorable alterations to the supervisory and resolution regimes for systemically important financial institutions ("SIFIs"). However, Dodd-Frank falls far short of the fundamental reforms that would be needed to eliminate (or at least greatly reduce) the public subsidies that are currently exploited by "too big to fail" ("TBTF") financial institutions.

After briefly describing …

Problems In Human Rights And Large Dams, Dinah L. Shelton, Donald K. Anton Jan 2011

Problems In Human Rights And Large Dams, Dinah L. Shelton, Donald K. Anton

GW Law Faculty Publications & Other Works

This "case study" was intended to be included in Anton & Shelton, Environmental Problems and Human Rights (Cambridge, 2011), but space limitations forced its omission from the printed text. Among large infrastructure projects, damming rivers to provide hydroelectric power have been the source of considerable conflict between governments and the people who are affected by such projects, especially those forced to relocate. In many instances dams are built in pristine natural areas, destroying or degrading nature reserves, indigenous lands and/or archaeological sites. Increasing opposition to large dams has resulted in national and international litigation, as well as substantial changes in …

Economic Transition, Higher Education And Worker Productivity In China, Belton Fleisher, Yifan Yu, Haizheng Li, Seonghoon Kim Jan 2011

Economic Transition, Higher Education And Worker Productivity In China, Belton Fleisher, Yifan Yu, Haizheng Li, Seonghoon Kim

Research Collection School Of Economics

We investigate the role of education on worker productivity and firms' total factor productivity using a panel of firm-level data from China. We estimate the returns to education by calculating the marginal productivity of workers of different education levels based on estimates of the firm-level production function. We also estimate how the education level of workers and CEO contributes to firms' total factor productivity. Estimated marginal products are much higher than wages, and the gap is larger for highly educated workers. Our estimate shows that an additional year of schooling raises marginal product by 30.1%, and that CEO's education increases …

Polymer-Based Photoactive Surface For The Efficient Immobilization Of Nanoparticles, Polymers, Graphene And Carbohydrates, Jing Yuwen Jan 2011

Polymer-Based Photoactive Surface For The Efficient Immobilization Of Nanoparticles, Polymers, Graphene And Carbohydrates, Jing Yuwen

Dissertations and Theses

This thesis focuses on developing a new photocoupling surface, base on polyallyamine (PAAm), to increase the efficiency of the photocoupling agent perfluorophenyl azide (PFPA) in the immobilization of nanoparticles, carbohydrates and graphene. Extensive studies have been carried out in our lab on the covalent immobilization of polymers and graphene using PFPA-functionalized surfaces. Here we show that PAAm-based PFPA surface can be used to efficiently immobilize not only graphene and polymers but also nanomaterials and small molecules. This was accomplished by first silanizing silicon wafers with PFPA-silane followed by attaching a thin film of PAAm by UV radiation. Treating the PAAm …

Evolving Nano-Scale Associative Memories With Memristors, Arpita Sinha Jan 2011

Evolving Nano-Scale Associative Memories With Memristors, Arpita Sinha

Dissertations and Theses

Associative Memories (AMs) are essential building blocks for brain-like intelligent computing with applications in artificial vision, speech recognition, artificial intelligence, and robotics. Computations for such applications typically rely on spatial and temporal associations in the input patterns and need to be robust against noise and incomplete patterns. The conventional method for implementing AMs is through Artificial Neural Networks (ANNs). Improving the density of ANN based on conventional circuit elements poses a challenge as devices reach their physical scalability limits. Furthermore, stored information in AMs is vulnerable to destructive input signals. Novel nano-scale components, such as memristors, represent one solution to …

The Evaluation Of Christmas Bird Counts As An Indicator Of Population Trends And Habitat Selection In Blackbirds And Starlings, Matthew D. Strassburg Jan 2011

The Evaluation Of Christmas Bird Counts As An Indicator Of Population Trends And Habitat Selection In Blackbirds And Starlings, Matthew D. Strassburg

Biological Sciences

Agelaius phoeniceus (red-winged blackbird), Quiscalus quiscula (common grackle), and Sturnus vulgaris (European starling) are three of the most abundant bird species found in North America, and along with Euphagus carolinus (rusty blackbird) and Euphagus cyanocephalus (Brewer’s blackbird), make up a significant proportion of the avian population. Population trends of these four blackbird species and European starlings (EUST)were analyzed from the Christmas Bird Count (CBC) data collected between 1988 and 2008. Population analyses were conducted using linear mixed-effect regressions from the Lmer package of Program R. This approach was effective in modeling the population trends of widespread species with large populations. …

Numerical And Experimental Analysis Of Composite Sandwich Links For The Lcf System, Max Taylor Stephens Jan 2011

Numerical And Experimental Analysis Of Composite Sandwich Links For The Lcf System, Max Taylor Stephens

Dissertations and Theses

Shear links are used as fuse elements in lateral load resisting systems to provide ductility and dissipate seismic energy. These links have traditionally been employed in eccentrically braced frames, but have more recently been suggested for use in the innovative linked column frame system (LCF). Current design specifications for shear links require intermediate web stiffeners to provide out-of-plane web stability so ductility requirements can be achieved. This research focused on moving from discrete transverse web stiffening to continuously stiffened webs in built up shear links. Built up links were designed to yield in shear when subjected to severe cyclic loading, …

Vehicular Ad Hoc Networks, Syed R. Rizvi, Stephan Olariu, Christina M. Oinotti, Shaharuddin Salleh, Mona E. Rizvi, Zainab Zaidi

Computer Science Faculty Publications

(First paragraph) Vehicular ad hoc networks (VANETs) have recently been proposed as one of the promising ad hoc networking techniques that can provide both drivers and passengers with a safe and enjoyable driving experience. VANETs can be used for many applications with vehicle-to-vehicle (V2V) and vehicle-to-infrastructure (V2I) communications. In the United States, motor vehicle traffic crashes are the leading cause of death for all motorists between two and thirty-four years of age. In 2009, the National Highway Traffic Safety Administration (NHTSA) reported that 33,808 people were killed in motor vehicle traffic crashes. The US Department of Transportation (US-DOT) estimates that …

Torture In The Eyes Of The Beholder, Mary-Hunter M. Mcdonnell, Loran F. Nordgren, George Loewenstein Jan 2011

Torture In The Eyes Of The Beholder, Mary-Hunter M. Mcdonnell, Loran F. Nordgren, George Loewenstein

Vanderbilt Journal of Transnational Law

This Article draws upon recent social psychological research to demonstrate the psychological difficulty of distinguishing between torture and enhanced interrogation. We critique the accuracy of evaluations made under the current torture standard using two constructs--reliability and validity--that are employed in the social sciences to assess the quality of a construct or metric. We argue that evaluations of interrogation tactics using the current standard are both unreliable and invalid. We first argue that the torture standard is unreliable because of the marked variation in the manner in which different jurisdictions interpret and employ it. Next, we draw on recent social psychological …

The Double-Helix Double-Edged Sword: Comparing Dna Retention Policies Of The United States And The United Kingdom, Erica S. Deray Jan 2011

The Double-Helix Double-Edged Sword: Comparing Dna Retention Policies Of The United States And The United Kingdom, Erica S. Deray

Vanderbilt Journal of Transnational Law

Forensic scientists have used DNA profiling technologies to link suspects to crimes since Alec Jeffreys first proposed the idea in the 1970s. Recognizing the potential for using DNA databases to solve crimes and to prevent future crimes, England and Wales attempted to greatly expand its DNA database by allowing for the collection and indefinite retention of DNA profiles from arrestees. The European Court of Human Rights, however, issued a ruling in 2008 in the case of S. & Marper v. United Kingdom, advising the United Kingdom to restrict use of DNA profiles from arrestees and to establish time frames for …

Ambivalence And Activism: Employment Discrimination In China, Timothy Webster Jan 2011

Ambivalence And Activism: Employment Discrimination In China, Timothy Webster

Vanderbilt Journal of Transnational Law

Chinese courts have not vigorously enforced many human rights, but a recent string of employment discrimination lawsuits suggests that, given the appropriate conditions, advocacy strategies, and rights at issue, victims can vindicate constitutional and statutory rights to equality in court. Specifically, carriers of the hepatitis B virus (HBV) have used the 2007 Employment Promotion Law to ground legal challenges against employers who discriminate against them in the hiring process. Plaintiffs' relatively high success rate suggests official support for making one prevalent form of discrimination illegal. Central to these lawsuits is a broad network of lawyers, activists, and scholars who actively …

The Origins And Limits Of Originalism: A Comparative Study, Ozan O. Varol Jan 2011

The Origins And Limits Of Originalism: A Comparative Study, Ozan O. Varol

Vanderbilt Journal of Transnational Law

In the debate about originalism in the United States, scholars have devoted scant attention to the question whether the United States stands alone in its fascination with originalism. According to the prevailing view, originalism is distinctively American and the study of comparative originalism is an oxymoron. This Article challenges that conventional view. Drawing on neglected Turkish-language sources, the Article analyzes, as a comparative case study, the use of originalism by the Turkish Constitutional Court (Anayasa Mahkemesi) to interpret the secularism provisions in the Turkish Constitution. Comparing the Turkish version of originalism to American originalism, the Article sheds light on broader …
