This article gives an overview of current medical malpractice law in South Africa. The following aspects are covered: The overall scheme for preventing and redressing medical errors and adverse events, including regulation, criminal and civil liability, and social and private insurance, and the relationships among these various systems; the details of the applicable liability and compensation systems, including criteria defining qualification for compensation, causation and "loss of chance," liability for failure to obtain informed consent, as well as matters of proof and gathering of evidence. In March 2010, the U.S. Department of the Interior issued a final rule regarding the disposition of culturally unidentifiable human remains under the Native American Graves Protection and Repatriation Act (NAGPRA). The rule is controversial, as some commentators argue that the Secretary of the Interior lacks the authority under the statute to regulate these remains. This Note analyzes the legitimacy of the final rule in light of federal administrative law precedent as well as the origin and purpose of NAGPRA. Part II of this Article summarizes the current R&D crisis confronting the pharmaceutical industry and the accompanying drop-off in innovative output from this important technological sector. Part III explains Mr. Armitage's "view from industry," which attributes a significant causative effect to unpredictability in the patent system. Part IV provides two Lilly case studies involving generic challenges to two of the company's important drugs, Gemzar and Strattera, in which the company has suffered as a result of this unpredictability. In the nearly thirty years since the Federal Circuit's first published decision, the court has decided numerous cases that have produced a rich patent jurisprudence. This Article seeks to evaluate that jurisprudence from several perspectives. Part II summarizes the Federal Circuit's patent history in terms of the court's judges, the external factors that have shaped its patent jurisprudence, and the overall success of the court in light of Congress's intent. Part III then evaluates the Federal Circuit's general stance on whether to uphold the PTO's grant or denial of a patent, or a district court's decision to invalidate a patent, …

Part A
The use of nonionic associative thickeners was proposed for personal care applications. Various limitations of current rheology modifiers used in personal care were discussed. Nonionic associative polymers were examined as both thickeners and emulsifiers. The structure/property relationship for nonionic polymers and their ability to thicken and emulsify were fully examined. Results showed an increase in thickening efficiency for nonionic associative polymers with higher log(P) (partition coefficient) values. This was due to the formation of smaller aggregates and increased bridging between aggregates. The connection between oil polarity, log(P) of the associative polymer, and emulsion stability showed no relationship however; …

Reducing High-Risk Drinking In Mandated College Students: Evaluation Of Two Personalized Normative Feedback Interventions, Diana M. Doumas, Camille Workman, Diana Smith, Anabel Navarro

This study evaluated the efficacy of two brief personalized normative feedback interventions aimed at reducing heavy drinking among mandated college students (N = 135). Students were randomly assigned to one of two conditions: web-based assessment with self-guided personalized normative feedback (SWF) or web-based assessment with counselor-guided personalized normative feedback (CWF). Results indicated students in the CWF condition reported significantly greater reductions in weekly drinking quantity and binge drinking frequency than those in the SWF group at follow-up (M = 8 months). Students in the CWF group also reported significantly greater reductions in estimates of peer drinking from baseline to the …

The purpose of our project is to use various persuasive techniques in order to determine the most effective method to persuade students about the HPV vaccination and the negative effects of the HPV virus. An important component of public health message design is determining the most effective types of messages for a particular audience. The results of this study are intended to be an aid to the creators of health messages regarding HPV and the HPV vaccination, with the ultimate goal of increasing the effectiveness of public health messages to adolescents in regards to these issues.

The Design And Manufacture Of A Microfluidic Reactor For Synthesis Of Cadmium Selenide Quantum Dots Using Silicon And Glass Substrates, Peter Gonsalves

A microfluidic reactor for synthesizing cadmium selenide (CdSe) quantum dots (QDs) was synthesized out of silicon and Pyrex glass. Microfabrication techniques were used to etch the channels into the silicon wafer. Holes were wet-drilled into Pyrex glass using a diamond-tip drill bit. The Pyrex wafer was aligned to the etched silicon wafer and both were anodically bonded to complete the microfluidic reactor. Conditions for anodic bonding were created by exposing the stacked substrates to 300V at ~350oC under 5.46N of force. Bulk CdSe solution was mixed at room temperature and treated as a single injection. The syringe containing …

This master’s project was conducted under the direction of the Central Coast Regional Water Quality Control Board (Water Board) to assist with augmenting their Basin Plan. An investigation of the current practices for identifying and managing groundwater recharge areas was conducted, and strategies for protecting water quality by managing land uses in groundwater recharge areas were developed. Data sources included a review of agency documents, websites, and maps; interviews with stakeholders, and literature research. Data from these sources provided the foundation on which to base strategies for maintaining and improving groundwater quality in the Central Coast Hydrologic Region. This project …

We conducted an experiment to investigate effects of species, water (W), and nitrogen (N) on competition among little bluestem (Schizachyrium scoparium), sideoats grama (Bouteloua curtipendula), and indiangrass (Sorghastrum nutans). All biomass parameters and the root:shoot ratio of little bluestem were reduced by the presence off 1 of 2 other species, and its shoot biomass and total biomass were both increased by addition of N. Root and shoot biomass of sideoats grama were reduced by the presence of indiangrass and its total biomass was reduced by the presence of itself, whereas its shoot biomass was increased by addition of W at …

Assessing The Role Of Conspecific Attraction In Habitat Restoration For Henslow’S Sparrows In Iowa, Jennifer A. Vogel, Rolf R. Koford, David L. Otis

The presence of conspecific individuals may provide important cues about habitat quality for territorial songbirds. We tested the ability of a conspecific song playback system to attract Henslow’s sparrows to previously unoccupied restored habitat. We successfully attracted Heslow’s sparrows to 3 of 7 treatment plots using conspecific song playbacks and we found no Henslow’s sparrows in control plots. The addition of social cues using playback systems in restored grassland habitats may aid conservation efforts of Henslow’s sparrows to available habitat.

Recently, the Nearctic river otter (Lontra canadensis) has been re-colonizing portions of eastern North Dakota. The landscape in eastern North Dakota is dominated by agricultural fields and pastures, habitats which have received little research attention related to otter habitat use. During 2008, we searched shorelines to detect otter latrines, which is a common method for determining otter presence. Generally, latrines are locations along bodies of water where otters deposit scats, urine, and glandular secretions for olfactory communication, and groom, wrestle, and play, which may mat vegetation. In the northeastern United States, inland riverine system studies have shown latrines …

White-tailed jackrabbits (Lepus townsendii) are common on the prairie, and an important species in prairie food webs (Lim 1987). Although it has been suggested that jackrabbits have cyclic populations (Donoho 1972, Gross et al. 1974, Anderson and Shumar 1986), there is concern that a general downward trend exists in populations in the Northern Great Plains (Feldhamer et al. 2003). Disease incidence in white-tailed jackrabbits is poorly known (Feldhamer et al. 2003), but may be an important factor in population changes. Understanding resource selection by elk (Cervus elaphus) at multiple spatial scales may provide information that will help resolve the increasing number of resource conflicts involving elk. We quantified vegetation at 412 sites where the precise location of elk was known by direct observation and 509 random sites in the Black Hills of South Dakota during 1998– 2001. We obtained stand level variables from geographic information system coverages for a 250 m buffer around elk and random sites. Accidental deaths of bats by entanglement on plants and barbed wire are common (McNicholl 1988, Norquay et al. 2010). It has been hypothesized these incidents involve miscalculations by bats on how close they fly to plants or barbed wire or when chasing insects highly concentrated around vegetation (Norquay et al. 2010). Once the bats hit the plants or barbed wire, they become entangled and or impaled while struggling to free themselves. The earliest reports involved little brown bats (Myotis lucifugus) and unidentified bats entangled on burdock, Arctium sp. (Lyon 1925, Little 1925). The least weasel (Mustela nivalis) is a circumboreal species, occurring in North America from Alaska to the Appalachian Mountains (Jones et al. 1983). In the Great Plains, the least weasel recently expanded its range southward through Nebraska (Benedict et al. 2000) and Kansas (Choate et al. 1979, Bailey and Terman 1986) into Oklahoma (Clark and Clark 1988). Also, in recent decades, the least weasel has expanded from eastern and central Nebraska into western Nebraska (Benedict et al. 2000). Common reed, Phragmites australis, has long been a component of Northern Plains wetlands, but impending invasion by the non-native P. australis haplotype M may displace native haplotypes in the future. To increase understanding of historical Phragmites occurrence, we developed a geographic information system (GIS) protocol to improve the georeferencing of specimens from South Dakota herbaria, and mapped the distribution of Phragmites relative to geology, physiographic regions, and water bodies. There were 91 Phragmites herbarium specimens from South Dakota and adjacent Wyoming. Phragmites collections occurred in nearly all physiographic regions of the state, with concentrations occurring in the Prairie Coteau of …

Floodplain interactions are a critical riverine ecosystem function, including zooplankton transfer. Floodplain alternations have had an assumed impact on zooplankton productivity. I assessed floodplain wetland and main channel densities of crustaceous zooplankton, alluding to organism transfer in the Missouri River, North Dakota. Significant t-test differences (P < 0.05) were present between backwater and channel habitat zooplankton densities in 83, 75, 83, and 50% of the sample periods for cyclopoid copepods, copepod nauplii, Daphnia spp., and Bosmina spp. respectively, suggesting the presence of uncoupled zooplankton dynamics during portions of each annual cycle. Two relationships with increased flows were found, including a biologically significant decrease (P = 0.09) of backwater copepod nauplii numbers and a significant increase (P = 0.02) in the channel density of Daphnia spp. During the highest flow periods, fewer significant differences in zooplankton densities were present between the backwater and channel habitats, indicating moderate homogenization.

The R graphics engine has new support for rendering raster images via the functions rasterImage() and grid.raster(). This leads to better scaling of raster images, faster rendering to screen, and smaller graphics files. Several examples of possible applications of these new features are described.

The R package DEoptim implements the Differential Evolution algorithm. This algorithm is an evolutionary technique similar to classic genetic algorithms that is useful for the solution of global optimization problems. In this note we provide an introduction to the package and demonstrate its utility for financial applications by solving a non-convex portfolio optimization problem.
