Judges' Awareness, Understanding, And Application Of Digital Evidence, Gary C. Kessler
Judges' Awareness, Understanding, And Application Of Digital Evidence, Gary C. Kessler
Security Studies & International Affairs - Daytona Beach
"As digital evidence grows in both volume and importance in criminal and civil courts, judges need to fairly and justly evaluate the merits of the offered evidence. To do so, judges need a general understanding of the underlying technologies and applications from which digital evidence is derived. Due to the relative newness of the computer forensics field, there have been few studies on the use of digital forensic evidence and none about judges’ relationship with digital evidence. This paper describes a recent study, using grounded theory methods, into judges’ awareness, knowledge, and perceptions of digital evidence. This study is the …

Adapting A Laboratory Research Group Model To Foster The Scholarship Of Teaching And Learning, Beth A. Fisher, Regina F. Frey
To Improve the Academy: A Journal of Educational Development
A multidisciplinary group of faculty and staff formed an education research group modeled on a laboratory research group to focus on the scholarship of teaching and learning (SoTL) in science, technology, engineering, and mathematics (STEM). This group has bridged the communication and knowledge gaps between STEM and social science faculty and science education specialists, fostered the development of collaborative SoTL projects, and laid the groundwork for broader institutional support of SoTL.

Two classes of 1,4-disubstituted 1,2,3-triazoles were synthesized using one-pot reaction of α-tosyloxy ketones/α-halo ketones, sodium azide, and terminal alkynes in the presence of aq. PEG (1:1, v/v) using the click chemistry approach and evaluated for Src kinase inhibitory activity. Structure-activity relationship analysis demonstrated that insertion of C6H5- and 4-CH3C6H4- at position 4 for both classes and less bulkier aromatic group at position 1 in class 1 contribute critically to the modest Src inhibition activity (IC50 = 32-43 µM) of 1,4-disubstituted 1,2,3-triazoles.
A Primer Of Swarm Equilibria, Andrew J. Bernoff, Chad M. Topaz
A Primer Of Swarm Equilibria, Andrew J. Bernoff, Chad M. Topaz
All HMC Faculty Publications and Research
We study equilibrium configurations of swarming biological organisms subject to exogenous and pairwise endogenous forces. Beginning with a discrete dynamical model, we derive a variational description of the corresponding continuum population density. Equilibrium solutions are extrema of an energy functional and satisfy a Fredholm integral equation. We find conditions for the extrema to be local minimizers, global minimizers, and minimizers with respect to infinitesimal Lagrangian displacements of mass. In one spatial dimension, for a variety of exogenous forces, endogenous forces, and domain configurations, we find exact analytical expressions for the equilibria. These agree closely with numerical simulations of the underlying …

The Cophylogeny Reconstruction Problem Is Np-Complete, Yaniv J. Ovadia '10, Daniel Fielder '11, Chris Conow, Ran Libeskind-Hadas
All HMC Faculty Publications and Research
The cophylogeny reconstruction problem arises in the study of host-parasite relationships. Specif- ically, we are given a host tree H, a parasite tree P, and a function ' mapping the leaves (extant taxa) of P to the leaves of H. Four biologically plausible operations are considered: cospeciation, duplication, host switching, and loss (Figure 1). A host switch is permitted in conjunction with a duplication event but not with a cospeciation event [1].

A Review Of The Evidence Germane To The Putative Protective Role Of The Macular Carotenoids For Age-Related Macular Degeneration, Sarah Sabour-Pickett, John Nolan, James Loughman, Stephen Beatty
Articles
There is a consensus that age-related macular degeneration (AMD) is the result of (photo)- oxidative-induced retinal injury and its inflammatory sequelae, the latter being influenced by genetic background. The dietary carotenoids, lutein (L), zeaxanthin (Z), and meso-zeaxanthin (meso-Z), accumulate at the macula, where they are collectively known as macular pigment (MP). The anatomic (central retinal), biochemical (anti-oxidant) and optical (short-wavelength- filtering) properties of this pigment have generated interest in the biologically plausible rationale that MP may confer protection against AMD. Level 1 evidence has shown that dietary supplementation with broad-spectrum anti-oxidants results in risk reduction for AMD progression. Studies have …

Urban Community Gardening The Impact On Fruit And Vegetable Intake, Christina Purcell
Urban Community Gardening The Impact On Fruit And Vegetable Intake, Christina Purcell
Students Learning with Communities
Urban community gardens are local projects managed for and by members of the local community. They may be run in partnership with local authorities or as part of community development or regeneration schemes (Hale et al., 2011). The gardens exist primarily in urban areas and are often established in response to a local community's lack of open green space (Viljoen et al., 2005). The scale and format of the gardens may vary. Depending on the available land and support, urban community gardening projects can be relatively small and in Dublin they range from small disused residential gardens (Cabra Park, See …
Understanding And Eliminating Discrimination Against Blacks, Douglas Parker
Understanding And Eliminating Discrimination Against Blacks, Douglas Parker
Societies Without Borders
This paper discusses the US history of discrimination against blacks which should be understood by students and others who are concerned with human rights and who want to participate in some form of civic engagement for the realization of these rights. The first part of this paper examines slavery, an extreme form of racial discrimination, and its repetition as involuntary servitude in earlier historical periods in the US. The second part of the paper examines recent and current severe, though not extreme, forms of racial discrimination such as residential segregation and the workfare and imprisonment imposed by the emerging US …

Tropical Salvage: From Recession To Expansion, Scott Marshall, Lisa Peifer, Erin Ferrigno
Business Faculty Publications and Presentations
Tim O’Brien, founder of Tropical Salvage, was preparing for another warehouse clearance sale of his unique, handcrafted hardwood furniture. It had been an enormously challenging year and it was important to reduce inventory before the next container arrived from Indonesia. The market for fine furniture had begun to decline steadily in early 2008 following the stock market crash of the prior September. The company survived a difficult period, but not without suffering a decline in sales. O’Brien had spent ten years building a sustainable business model based on environmental stewardship, worker empowerment and unique, high quality product. As the economy …

Variability In Short-Wavelength Automated Perimetry Among Peri- Or Postmenopausal Women: A Dependence On Phyto-Oestrogen Consumption?, Alvin Eisner, Shaban Demirel
Community Health Faculty Publications and Presentations
Purpose: To determine whether the hill of vision for Short-Wavelength Automated Perimetry (SWAP) is shallower for women who consume phyto-oestrogen-rich foods than for women who do not.
Methods: Visual field data were compared for two groups of healthy amenorrhoeic women 48–69 years-old with normal vision and not using hormone replacement: (1) 24 subjects who reported consuming soy and/or flax products and (2) 20 subjects who reported not consuming these products. Two types of 24-2 visual fields were measured: (1) Full Threshold SWAP and (2) a white-on-white (W/W) field obtained using a Swedish Interactive Threshold Algorithm (SITA Standard).
Results: The reduction …

The Story Of Kleppe V. New Mexico: The Sagebrush Rebellion As Un-Cooperative Federalism, Robert L. Fischman, Jeremiah Williamson
Articles by Maurer Faculty
The story of Kleppe v. New Mexico dramatizes how assertion of federal power advancing national conservation objectives collided with traditional, local economic interests on public lands in the 1970s. This article connects that history with current approaches to natural resources federalism. New Mexico challenged the Wild Free-Roaming Horses and Burros Act, which diminished both state jurisdiction and rancher influence over public rangelands. In response, the Supreme Court resoundingly approved federal authority to reprioritize uses of the public resources, including wildlife, and spurred a lasting backlash in the West. Further legislation passed in the wake of Kleppe transformed this unrest into …

Epidemic Spread Of Influenza Viruses: The Impact Of Transient Populations On Disease Dynamics, Karen R. Ríos-Soto, Baojun Song, Carlos Castillo-Chavez
Department of Applied Mathematics and Statistics Faculty Scholarship and Creative Works
The recent H1N1 ("swine u") pandemic and recent H5N1 ("avian u") outbreaks have brought increased attention to the study of the role of animal populations as reservoirs for pathogens that could invade human populations. It is believed that pigs acquired u strains from birds and humans, acting as a mixing vessel in generating new influenza viruses. Assessing the role of animal reservoirs, particularly reservoirs involving highly mobile populations (like migratory birds), on disease dispersal and persistence is of interests to a wide range of researchers including public health experts and evolutionary biologists. This paper studies the interactions between transient and …

Defining Torture And Cruel, Inhuman, And Degrading Treatment, David Weissbrodt, Cheryl Heilman
Defining Torture And Cruel, Inhuman, And Degrading Treatment, David Weissbrodt, Cheryl Heilman
Articles
Declaring a “war against terror,” the United States has detained foreign nationals suspected of terrorist activities and has interrogated them at various locations outside the United States. As the United States seeks to bring charges against the detainees, serious questions have arisen regarding the interrogation methods used to obtain evidence. Federal laws enacted to meet the United States' obligations under treaties prohibit the use of evidence obtained through torture or through cruel, inhuman, or degrading treatment. What legal standards should be applied to determine whether interrogation methods or conditions of confinement constitute torture or cruel, inhuman, or degrading treatment? Is …

The Case Against Preemption: Vaccines & Uncertainty, Mary J. Davis
Law Faculty Scholarly Articles
This article begins with a brief recap of the state of current preemption doctrine and how it governs the interaction of federal regulation of product manufacturers and state tort actions related to the actions of those manufacturers. Second, the article provides observations on how that doctrine might apply to vaccine injury litigation. Bruesewitz v. Wyeth, Inc. involves the preemptive scope of the Vaccine Act and the unique compensation system Congress created to respond to vaccine injuries. Bruesewitz was decided on February 22, 2011, and held that design defect claims are expressly preempted by the Vaccine Act. This article endeavors …

Women, Vulnerability, And Humanitarian Emergencies, Fionnuala Ní Aoláin
Articles
The catastrophic dimensions of humanitarian emergencies are increasingly understood and more visible to states and international institutions. There is greater appreciation for the social, economic and political effects that follow in the short to long term from such catastrophes whatsoever their causes. Rhetorically too, there is some recognition of the gendered dimensions of humanitarian emergencies in policy and institutional contexts. It is generally acknowledged that women are more visible in the refugee and internally displaced communities that typically result from many humanitarian crises. Women, because of their acute care responsibilities in most societies, also disproportionately bear the brunt of familial …

Retention Among First Year College Students: An Application Of The Theory Of Planned Behavior, Jose A. Cantt, Guillermo Wated
Modern Psychological Studies
It was proposed that attitudes toward college, subjective norms (pressure from family and important others) and perceived control over the ability to succeed in school influence students' intention to stay in school. Forty-seven students (39 females) completed an 88-item survey. Results indicated that students' attitudes and social pressure were the most important predictors of intention to stay in school. These findings suggest that active family involvement in students' education, as well as the incorporation of information regarding the value of a college education into programs such as freshman experience, could aid efforts in helping students succeed at staying in school.

Parts Of The Whole : Cognition, Schemas, And Quantitative Reasoning, Dorothy Wallace
Numeracy
Based loosely on ideas of Jean Piaget and Richard Skemp, this Parts of the Whole column considers the construction of knowledge in mathematics and quantitative reasoning. Examples are chosen that illustrate an important cognitive difference between quantitative numeracy and classical mathematics, and which illuminate the particular choices instructors must make in order to teach either or both of these.
