Jurors’ Use Of Non-Statutory Aggravating And Mitigating Evidence In The Context Of Improper Prosecutor Argument, Alicia Serpa
Jurors’ Use Of Non-Statutory Aggravating And Mitigating Evidence In The Context Of Improper Prosecutor Argument, Alicia Serpa
Psychology Theses
The proposed research examined the affective and cognitive processes involved in jurors’ reactions to comparative value arguments and evidence of non-statutory aggravating and mitigating circumstances in the sentencing phase of a capital trial. The experiment utilized a 2 (Permissible Victim Impact Statements: Present v. absent) x 3 (Non-Statutory Mitigating Evidence: Social Value v. Troubled Life v. Both) x 2 (Comparative Value Argument: Life v. Worth) + 1 between-groups factorial design. Participants exposed to comparative worth arguments were more likely to vote for death than those exposed to comparative life arguments. In addition, participants were differentially influenced by comparative arguments. In …

Evidence Obtained By Cruel, Inhuman Or Degrading Treatment: Why The Convention Against Torture’S Exclusionary Rule Should Be Inclusive, Akmal Niyazmatov
Evidence Obtained By Cruel, Inhuman Or Degrading Treatment: Why The Convention Against Torture’S Exclusionary Rule Should Be Inclusive, Akmal Niyazmatov
Cornell Law School Inter-University Graduate Student Conference Papers
Convention against Torture (CAT) prohibits admissibility of evidence obtained by torture but fails to extend similar prohibition to evidence obtained by cruel, inhuman or degrading treatment (CIDT evidence). Manfred Nowak argues that CAT's failure to prohibit CIDT evidence can be resolved if in interpreting torture we take the purposive element, instead of severity, as the main element that distinguishes torture from CIDT. He argues that both torture and CIDT require infliction of severe pain and thus it must be the purpose for which severe pain was inflicted that distinguishes torture from CIDT. If the purposive element is key in distinguishing …

Universal Jurisdiction Not So Universal: A Time To Delegate To The International Criminal Court, Dalila V. Hoover
Cornell Law School Inter-University Graduate Student Conference Papers
The exercise of universal jurisdiction in cases involving crimes under international law remains highly debated and underlines a certain number of legal and political issues in its implementation. Because the principle of universal jurisdiction relies on national authorities to enforce international prohibitions, pivotal decisions are expected to reflect, to a greater or lesser extent, domestic decision-makers’ positions as to the interests of justice, the national interest and other criteria. In many States, the legal system lacks the means to investigate or prosecute on the basis of universal jurisdiction. Indeed, many legal systems do not define the term “crimes” that can …

The Demographics Of Healthcare Fraud In South Florida, Jennifer K. Pond
The Demographics Of Healthcare Fraud In South Florida, Jennifer K. Pond
Regis University Student Publications (comprehensive collection)
Health care fraud is a large problem in this country. Experts in the field estimate that 3-10% of all health care expenditures in the United States are fraudulent (National Health Care Anti-Fraud Association, n.d., Federal Bureau of Investigation, 2009). "Financial losses due to health care fraud are estimated to range from $70 billion to a staggering $234 billion a year" (The National Health Care Anti-Fraud Association, 2010). With this problem identified, it is important to identify and isolate possible influences and factors which perpetuate this type of fraud. Using South Florida as the subject area and health care fraud as …
Medical Marijuana Centers And Urban Resident's Perception Of Crime In Their Neighborhood, Maura L. Scherrer
Medical Marijuana Centers And Urban Resident's Perception Of Crime In Their Neighborhood, Maura L. Scherrer
Regis University Student Publications (comprehensive collection)
Due to the ambiguity of constitutional amendments, multiple state legislations, and municipal ordinances, medical marijuana has become quite a contentious subject. Despite the fact that many Americans approve the use of medical marijuana, they are opposed to medical marijuana centers opening in their own neighborhoods. People are concerned about the "element" that these centers bring into their neighborhoods as a result of increased pedestrian and vehicle traffic, loitering, open display of drug usage, and the fear of organized crime; comparable to the theory of broken windows, where crime is invited into a community when the wrong element is allowed to …
