Retrying The Acquitted In England Part Iii: Prosecution Appeals Against Judges' Rulings Of "No Case To Answer", David S. Rudstein
San Diego International Law Journal
The Order in Council permitting the prosecution appeal of "Mo" Courtney's acquittal and allowing him to be retried for the same offense of which he had previously been acquitted stems from the Criminal Justice Act 2003. That Act, which applies in England and Wales, grants the government the right to appeal certain rulings by the trial judge in criminal prosecutions on an indictment, including a ruling that there is no case to answer, i.e., a directed verdict of acquittal, and if the appeal is successful, allows the reviewing court to order that the acquitted defendant?s trial be resumed or that …

Wrongful Convictions And Punitiveness: Measuring Student's Attitudes On Erroneous Felony Convictions, Shayna Lancaster
Sociology & Criminal Justice Theses & Dissertations
The purpose of this study is to better understand the attitudes towards wrongful convictions and levels of punitiveness among college students who may work in the criminal justice field in the future. It attempts to replicate Robert Ramsey and James Frank's 2007 study "Wrongful Conviction - Perceptions of Criminal Justice Professionals Regarding the Frequency of Wrongful Conviction and the Extent of System Errors." Instead of surveying criminal justice professionals, this study's sample is on-campus undergraduate classes in criminal justice and political science for the spring 2010 semester at Old Dominion University using a survey that operationalizes punitiveness with a series …
Community College Student Learning In Phlebotomy Preceptor-Led Clinical Internship, Susan E. Phelan
Community College Student Learning In Phlebotomy Preceptor-Led Clinical Internship, Susan E. Phelan
Educational Leadership & Workforce Development Theses & Dissertations
The purpose of this study is to describe how allied health preceptor-led clinical internship improves or expands community college student learning. There is a significant gap of information in the literature related to the importance of this clinical internship experience for the learning, socialization, and professional development of allied health students in general and community college students in particular. The absence of relevant data for these internships as a situated learning experience is evident in the literature review. The majority of the allied health work force is prepared by community colleges. Therefore, community college leaders need data to make data-driven …
Alternative Elements, Jessica A. Roth
Alternative Elements, Jessica A. Roth

The U.S. Constitution provides a criminal defendant with a right to trial by jury, and most states and the federal government require criminal juries to agree unanimously before a defendant may be convicted. But what exactly must a jury agree upon unanimously? Well-established doctrine, pursuant to In re Winship, provides that the jury must agree that the prosecution has proven every element of the offense beyond a reasonable doubt. Yet what the elements of any given offense are is not as clear as one might expect. Frequently, criminal statutes—especially federal statutes—describe an array of prohibited conduct, leaving ambiguous whether …
What Would It Look Like If We Cared About Narcotics Trafficking? An Argument To Attack Narcotics Capital Rather Than Labor, Mark Osler
University of the District of Columbia Law Review
Law enforcement actions should be judged by a simple measure: are they solving a problem? After all, we Americans loathe the loss of freedom and the spending of tax dollars, and we should never take away citizens' freedom and money unless there actually is a problem being solved. Illegal narcotics are a problem, but we aren't solving it. Narcotics trafficking and use lead to violence, undermine productivity,' and rip apart the social fabric of families and communities. Despite much attention to these issues, drug use in this country continues at high levels, even among children.2 We have failed, and it …

Online College Laboratory Courses: Can They Be Done And Will They Affect Graduation And Retention Rates?, Eddy Van Hunnik
Higher Learning Research Communications
Online education has been steadily growing during the last decade. This growth has mainly taken place in the non-laboratory science fields. This essay describes some of the best practices to increase and maintain student retention, increase student engagement and increase graduation rates for college running online laboratory science courses. This article further discusses how to run successful, hands-on laboratory courses for your online students. The most common issues are being discussed and what can be done to provide the students with the same hands-on experience online as what they would experience in a more traditional classroom setting.DOI: 10.18870/hlrc.v5i4.289

The Police Caution As A Diversionary Mechanism. An Analysis Of The Garda Síochána Adult Caution Scheme, Graham Tolan
The Police Caution As A Diversionary Mechanism. An Analysis Of The Garda Síochána Adult Caution Scheme, Graham Tolan
Dissertations
The Garda Síochána Adult Caution Scheme was established in 2006. It is among a range of alternate methods which have been introduced in recent years that are designed to divert adults away from the criminal justice system. The scheme provides a mechanism by which individuals receive a formal police caution in lieu of prosecution before the courts. It is only available to certain persons against whom there is evidence of the commission of a scheduled criminal offence and where the prosecution of such an offence is not in the public interest (An Garda Síochána, 2006:2009). This thesis examines the scheme …
