A Right To Legal Aid: The Aba Model Access Act In International Perspective, James Maxeiner
A Right To Legal Aid: The Aba Model Access Act In International Perspective, James Maxeiner
All Faculty Scholarship
For over two centuries America has failed to fulfill its revolutionary ideals of bringing equal justice to all. In August 2010 the American Bar Association moved to bring the nation closer to its ideals when it proposed the ABA Model Access Act. The Act would do what the Supreme Court of the United States has refused to do: it would recognize that legal aid in civil litigation is a matter of right and not of charity. The Act is a framework law and leaves many details to be filled in by enacting bodies and by the institutions eventually charged with …

A Conflict Of Interests: Privacy, Truth, And Compulsory Dna Testing For Argentina’S Children Of The Disappeared, Elizabeth B. Ludwin King
A Conflict Of Interests: Privacy, Truth, And Compulsory Dna Testing For Argentina’S Children Of The Disappeared, Elizabeth B. Ludwin King
Cornell International Law Journal
From 1976 to 1983, Argentina was ruled by a military dictatorship that disappeared an estimated 30,000 suspected subversives, including parents of young children and pregnant women. Their children, either disappeared along with their parents or born in clandestine detention centers, were then taken from their parents and adopted, often by couples who were sympathetic with the government and knew of the children's origins. This Article addresses Argentina's newest effort to identify these now-adult children: compulsory DNA testing in cases where the raising parents are suspected of having knowingly adopted their children illegally. It argues that, although the mandatory testing permissibly …

Lochner V. New York (1905) And Kennedy V. Louisiana (2008): Judicial Reliance On Adversary Argument, Douglas E. Abrams
Lochner V. New York (1905) And Kennedy V. Louisiana (2008): Judicial Reliance On Adversary Argument, Douglas E. Abrams
Faculty Publications
Chief Justice William H. Rehnquist called Lochner v. New York (1905) “one of the most ill-starred decisions that [the Supreme Court ever rendered.” The Justices’ deliberations preceding the 5-4 decision demonstrate the courts’ reliance on advocacy in the adversary system of civil and criminal justice. The stark imbalance between the state’s “incredibly sketchy” brief and Joseph Lochner’s sterling submission may have determined Lochner’s outcome, and thus may have changed the course of constitutional history, by leading two Justices to join the majority on the central question of whether New York’s maximum-hours law for bakery workers was a reasonable public health …
Student Victims Or Student Criminals? The Bookends Of Sexting In A Cyber World, Todd A. Demitchell, Martha Parker-Magagna
Student Victims Or Student Criminals? The Bookends Of Sexting In A Cyber World, Todd A. Demitchell, Martha Parker-Magagna
Cardozo Public Law, Policy & Ethics Journal
The article argues that criminalizing sexting as child pornography unfairly victimizes adolescents, contradicting the purpose of laws intended to protect minors. It advocates for a balanced approach that addresses the harm caused by sexting without imposing felony charges, which can have lifelong consequences. The analysis emphasizes that zero-tolerance policies and strict legal responses are ineffective and unjust, as they fail to consider the context of adolescent behavior and the unintended consequences of criminalization.

Regulation For The Sake Of Appearance, Adam M. Samaha
Regulation For The Sake Of Appearance, Adam M. Samaha
Coase-Sandor Institute for Law & Economics Research Paper Series
Appearance is often given as a justification for decisions, including government decisions, but the logic of appearance arguments is not well theorized. This Article develops a framework for understanding and evaluating appearance-based justifications for government decisions. First, working definitions are offered to distinguish appearance from reality. Next, certain relationships between appearance and reality are singled out for attention. Sometimes reality is insulated from appearance, sometimes appearance helps drive reality over time, and sometimes appearance and reality collapse from the outset. Finally, sets of normative questions are suggested based on the supposed relationship between appearance and reality for a given situation. …

What Is The Impact Of Gender-Responsive Treatment On Women Offenders?, Melody N. Joiner
Professional Projects
This study uses research literature and results from a qualitative project to discuss how gender-responsive programming would be beneficial to women offenders, both while incarcerated and upon returning to the community. Research proves that women offenders are different from their male counterparts regarding life factors and pathways to crime. The literature identifies how female criminality is heavily influenced by the life circumstances and experiences of women offenders. Recent studies stress the importance of considering the demographics and history of the female offender population, as well as how life factors impact women’s patterns of offending. Most women in the criminal justice …
The Abuse Of Guaranteed Pending Trial In The Chinese Criminal Process: A Violation Of International Human Rights Law, Li Enshen
Indonesian Journal of International Law
Guaranteed pending trial (Qubao Houshen) is one of the coercive measures used by the Chinese authorities to release suspects on bail in the criminal process. Unlike the western general practices, this instrument is not characterized as a legal right of suspects, but an effective means to circumvent the procedural requirements of investigation and prosecution in the laws. Further, the abuse of guaranteed pending trial is in fragrant violation of minimal international standards of human rights protection in the criminal justice system. The article first examines the procedural and practical deficiencies of this measure in the Chinese context. It then argues …
