Effects Of Sexual Assault Education On College Students' Rape-Supportive Attitudes, Jessica Ann Ueland Jan 2011

Effects Of Sexual Assault Education On College Students' Rape-Supportive Attitudes, Jessica Ann Ueland

Honors Program Theses

Few studies have measured the effectiveness of sexual assault programming is in decreasing acceptance of rape myths. This study examined two research questions. First, would students in a class that included a sexual assault education component be more likely to demonstrate a change in degree of rape myth acceptance than students who were not in a class that included sexual assault education? Second, within the treatment group, would males demonstrate a larger change in rape myth acceptance than females? At the end of the course, the treatment group showed a significant decrease in rape myth acceptance; there was not a …

Climate Torts And Ecocide In The Context Of Proposals For An International Environmental Court, Patrick Foster Jan 2011

Climate Torts And Ecocide In The Context Of Proposals For An International Environmental Court, Patrick Foster

Dissertations and Theses

"This thesis is an exploration of two questions that are neither novel nor lacking in exploration: Is an International Environmental Court (IEC) needed? Is such a court feasible? Proposals for an IEC have a rich history, are well founded and numerous. On the issue of necessity, this thesis attempts to pull together historical and current information on two distinct areas of international environmental law and use these analyses to contextualize the need for an international environmental tribunal. Arguments for and against an IEC are presented within a discussion of environmental diplomacy. This thesis begins with a legal discussion of potential …

From Archetypes To Architects: Re-Envisioning The Role Morality Of Trial Level Judges, Richard Devlin Frsc Jan 2011

From Archetypes To Architects: Re-Envisioning The Role Morality Of Trial Level Judges, Richard Devlin Frsc

Articles, Book Chapters, & Popular Press

In this article, I build upon the concepts of role-differentiated behaviour and role morality to reflect upon the privileges and responsibilities of being a trial judge. In particular, I will suggest there are at least two (potentially competing) professional archetypes for judicial role morality, which at this point I will tentatively describe as the mechanics and the innovators. Both of these archetypes agree that the governing principles should be integrity, honesty, independence, impartiality, fairness, et cetera, but they differ in their understanding of how best to put these ideals into effect in the real world. In due course, I will …

Thematic Analysis: Human Rights And The 2010/11 U.K. Supreme Court, Karinne Lantz, Fiona Roughley Jan 2011

Thematic Analysis: Human Rights And The 2010/11 U.K. Supreme Court, Karinne Lantz, Fiona Roughley

Articles, Book Chapters, & Popular Press

The efforts of the UK Supreme Court in the field of human rights during its first year reflected and informed a broader debate in society generally as to whether decisions of the European Court of Human Rights (hereafter "EurCtHR") in Strasbourg are appropriate for the domestic context. As the government mooted in Whitehall the merits of substituting the Human Rights Act 1998 (hereafter "HRA") with an autochthonous "British Bill of Rights", the newly-formed Supreme Court in the old Middlesex Guildhall struggled to articulate a framework for why, when and how the rights guaranteed by the European Convention on Human Rights …

African-American Grandmothers: Does The Gender-Entrapment Theory Apply? Essay Response To Professor Beth Richie, Jessica Dixon Weaver Jan 2011

African-American Grandmothers: Does The Gender-Entrapment Theory Apply? Essay Response To Professor Beth Richie, Jessica Dixon Weaver

Faculty Journal Articles and Book Chapters

Many African-American grandmothers are entrapped by the cycle of incarceration in poor black communities. This Essay explores whether the social and economic conditions that compel battered women to commit crimes also impact their mothers - who end up raising the children they leave behind. Professor Beth Richie's theory of gender entrapment as described in her book, “Compelled to Crime,” is not limited to incarcerated women who have been victims of domestic violence. African-American grandmothers who take on the role of kinship caregivers for their grandchildren are also entrapped by a complex interplay of race, gender, and class, making them vulnerable …

The Case Of Colonel Abel, Jeffrey D. Kahn Jan 2011

The Case Of Colonel Abel, Jeffrey D. Kahn

Faculty Journal Articles and Book Chapters

In June 2010, journalists for the Associated Press reported the arrest of ten Russian spies, all suspected of being “deep-cover” illegal agents in the United States. Seeking to convey the magnitude of this event, the journalists wrote in the first paragraphs of their article that this “blockbuster series of arrests” might even be as significant as the FBI’s “famous capture of Soviet Col. Rudolf Abel in 1957 in New York.” Colonel Abel’s story of American justice at a time of acute anxiety about the nation’s security is one that continues to resonate today. The honor, and error, that is contained …

Facilitating Crimes: An Inquiry Into The Selective Invocation Of Offenses Within The Continuum Of Criminal Procedures, Kyle Graham Jan 2011

Facilitating Crimes: An Inquiry Into The Selective Invocation Of Offenses Within The Continuum Of Criminal Procedures, Kyle Graham

Faculty Publications

Conventional wisdom holds that all crimes run a gauntlet of procedures that begins with an investigation and arrest, leads to charging and arraignment, and culminates (at least in successful prosecutions) with a conviction and the application of punishment. The reality is more nuanced. As this article's empirical study of the invocation and utilization of specific crimes contained within the United States Code indicates, there exist “detention crimes,” “charging crimes,” and “pleading crimes,” three types of offenses that, as applied, tend to implicate only portions of this sequence.

This article examines the three categories of “facilitating crimes” and the benefits and …

Domestic Violence: The Use Of Pro-Arrest Policies And Mandatory Prosecutions, Amy L. Beck Jan 2011

Domestic Violence: The Use Of Pro-Arrest Policies And Mandatory Prosecutions, Amy L. Beck

Senior Honors Theses

Domestic violence is a crime that affects millions of American families. Traditionally,
domestic violence was recognized by the general population and the courts as being a
private issue that should be handled within the boundaries of the family. Law
enforcement and the judicial system played a minimal role and generally maintained a
hands off policy in relation to domestic violence cases. Adding to this mentality of
privacy, the Fourth Amendment to the Constitution prohibits entering a residence without
probable cause. The Minneapolis domestic violence experiment attempted to measure
which police response was most beneficial. In order to empower victims and …

The Ethics Of Willful Ignorance, Rebecca Roiphe Jan 2011

The Ethics Of Willful Ignorance, Rebecca Roiphe

Articles & Chapters

The ABA ethical rules state that a lawyer may not assist a client in conduct that she “knows” is criminal or fraudulent. In this article, I argue that we ought to hold lawyers responsible when they remain willfully ignorant of their clients’ illegal activity. When a lawyer suspects that her client might be engaged in criminal or fraudulent activity, she should have an obligation to investigate. I disagree with prominent legal ethics scholar, David Luban, who has argued that lawyers should be able to turn a blind eye to signs of wrongdoing. I argue that rather than undermining the attorney …

Special Court For Sierra Leone: Achieving Justice?, Charles Chernor Jalloh Jan 2011

Special Court For Sierra Leone: Achieving Justice?, Charles Chernor Jalloh

Faculty Publications

The Sierra Leone war, which lasted between 1991 and 2002, gained notoriety around the world for “blood" or "conflict" diamonds and some of the worst atrocities ever perpetrated against civilians in a modern conflict. On January 16, 2002, the United Nations and the Government of Sierra Leone signed an historic agreement to establish the Special Court for Sierra Leone (SCSL). In setting up a new type of ad hoc criminal tribunal, the parties sought to achieve two key objectives. First, to dispense credible justice by enabling the prosecution of those bearing greatest responsibility for the wartime atrocities based on international …

Double-Edged Paring Knives: Human Rights Dilemmas For Special Populations, Giovanna Shay Jan 2011

Double-Edged Paring Knives: Human Rights Dilemmas For Special Populations, Giovanna Shay

Faculty Scholarship

The United States makes up only 5 percent of the world's population, but it incarcerates 25 percent of the globe's prisoners. This unprecedented level of incarceration has brought increased attention to the problems of particular subsets of prisoners sometimes called "special populations." These groups include female prisoners; lesbian, gay, bisexual, transgender (LGBT), and questioning inmates; older prisoners; and prisoners with mental illness and physical disabilities. This Article discusses human rights dilemmas in the treatment of special populations in prison.

The Article surveys ABA Standards and Resolutions that bear on special populations. While ABA Standards do not have the force of …

A Series Of Methods For The Systematic Reduction Of Phishing, Bradley Wardman Jan 2011

A Series Of Methods For The Systematic Reduction Of Phishing, Bradley Wardman

All ETDs from UAB

Phishing continues to expand as efforts to thwart attacks are ineffective and criminals behind these scams operate with apparent impunity. In order to address both issues, this research provides three steps towards the reduction of phishing: identifying phishing websites, collecting phishing evidence, and correlating the phishing incidents. The first step is to identify phishing websites automatically. Experimental results demonstrate that content-based algorithms can classify phishing websites with greater than 90% detection rates while maintaining low false-positive rates. Next, the development of custom software collects additional information and evidence about these phishing websites. In the final step, this research offers two …

Substance-Dependent Tasc Offenders Taking Psychotropic Pharmacotherapy--Associated Factors, Substance Use Outcomes, And Criminal Diversion Outcomes, Dorothy Octavia Jackson Jan 2011

Substance-Dependent Tasc Offenders Taking Psychotropic Pharmacotherapy--Associated Factors, Substance Use Outcomes, And Criminal Diversion Outcomes, Dorothy Octavia Jackson

All ETDs from UAB

Current evidence suggests that persons with co-occurring disorders (COD) are at risk for poorer treatment outcomes in terms of substance use and recidivism. Studies have examined this trend in incarcerated individuals, but few have examined COD offenders under community supervision. The purpose of this study was to develop a predictive model to identify offenders under community corrections supervision with substance use diagnoses who were actively taking psychotropic medications (SUPM) as an index of COD and to compare demographics, social histories, and sexual risk behaviors for SUPM offenders to offenders with a substance use disorder (SUD) only and those who met …

Padilla V. Kentucky: A New Chapter In Supreme Court Jurisprudence On Whether Deportation Constitutes Punishment For Lawful Permanent Residents?, Anita Maddali Jan 2011

Padilla V. Kentucky: A New Chapter In Supreme Court Jurisprudence On Whether Deportation Constitutes Punishment For Lawful Permanent Residents?, Anita Maddali

Faculty Articles, Papers, and Other Scholarship

In this Article, I argue that the deportation of lawful permanent residents on account of a criminal conviction is punitive, and therefore enhanced constitutional protections must be afforded to lawful permanent residents during removal proceedings. To support this argument I rely, in part, on the Supreme Court’s recent decision in Padilla v. Kentucky. The Padilla Court held that counsel must inform a client when a plea carries the risk of deportation. The Court’s analysis throughout the decision is groundbreaking in its recognition of the modern day realities of deportation - specifically the growing relationship between the immigration and criminal justice …
