Elusive Empowerment: Compensating The Sex Trafficked Person Under The Trafficking Victims Protection Act, Theodore R. Sangalis Oct 2011

Elusive Empowerment: Compensating The Sex Trafficked Person Under The Trafficking Victims Protection Act, Theodore R. Sangalis

Fordham Law Review

Globally, hundreds of thousands-perhaps millions-are being forced or coerced into commercial sex acts. In the United States, this sex trafficking problem has become a lucrative illegal industry, and it is quickly growing. In response, Congress passed the Trafficking Victims Protection Act of 2000 (TVPA) to eradicate the industry by prosecuting the perpetrators, protecting the victims, and preventing the practice. Through several reauthorizations, one federal strategy that has emerged is compensating the victims through mandatory criminal restitution and civil remedies. Collection of restitution damages has been lacking, however, and no civil suit filed for sex trafficking survivors has reached the merits. …

Weaving Functional Brain Imaging Into The Tapestry Of Evidence: A Case For Functional Neuroimaging In Federal Criminal Courts, Adam Teitcher Oct 2011

Weaving Functional Brain Imaging Into The Tapestry Of Evidence: A Case For Functional Neuroimaging In Federal Criminal Courts, Adam Teitcher

Fordham Law Review

Recent advances in brain imaging technologies allow researchers to "peer inside" a defendant's brain. Although functional neuroimaging evidence is frequently used in civil litigation, federal courts have been hesitant to admit it into evidence in criminal trials. Scholars and commentators alike continue to debate the merits, detriments, and general admissibility of functional neuroimaging evidence in the criminal context. Meanwhile, federal judges repeatedly admit various forms of forensic science into evidence without evaluating them under the appropriate admissibility standards. This Note argues that this has created a double standard for evidence admissibility. Functional neuroimaging evidence may, in fact, be more scientifically …

Perspectives Of Resilience And Recidivism Among Hispanic Male Adolescents, Javier Montañez, Ralph Jasparro Oct 2011

Perspectives Of Resilience And Recidivism Among Hispanic Male Adolescents, Javier Montañez, Ralph Jasparro

NERA Conference Proceedings 2011

The purpose of this qualitative phenomenological study was to explore the barriers that urban, male Hispanic adolescents face and the interventions that may contribute to their behaviors. Participants (N = 10) were purposefully selected based on the following criteria: 1) Latino males between 18 and 23; 2) U.S. residents for no less than five years; 3) history of recidivist behaviors leading to incarceration; and 4) demonstration of a minimal pattern of two years of resilient behavior. The researcher employed a self-generated demographic questionnaire, a semi-structured interview protocol, and a group moderator’s guide in order to obtain data. Findings were …

Guantánamo Bodies: Law, Media, And Biopower, Cary H. Federman, Dave Holmes Oct 2011

Guantánamo Bodies: Law, Media, And Biopower, Cary H. Federman, Dave Holmes

Department of Justice Studies Faculty Scholarship and Creative Works

The idea of the Guantánamo detainee as a Muselmann, the lowest order of concentration camp inmates, contains within it important implications for the new understanding of sovereignty in the era of Guantánamo, in an age of exception. The purpose of this article is to explain the status of those who are detained at Guantánamo Bay. Stated broadly, in assessing that status, we will emphasize the connection between the altered meaning of sovereignty that has accompanied the placing of prisoners in an American penal colony in Cuba and the biopolitical status of the prisoners who reside there. More particularly, we …

Accuracy Of Educator Nominations In Identifying Students With Elevated Levels Of Anxiety And Depression, Jennifer Cunningham Oct 2011

Accuracy Of Educator Nominations In Identifying Students With Elevated Levels Of Anxiety And Depression, Jennifer Cunningham

USF Tampa Graduate Theses and Dissertations

Internalizing disorders, specifically depression and anxiety, affect up to 18% and 33% of youth, respectively (Costello, Egger, & Angold, 2005b). Schools have become a major provider of mental health services to children, primarily in attempts to overcome barriers to receiving community services (Farmer, Burns, Philip, Angold, & Costello, 2003). As such, it is important that schools have effective mechanisms in place to accurately identify students who may be in need of such services. The current study examined the accuracy of one such method, educator nominations (including from both teachers and school-based mental health professionals) in identifying students who self-report elevated …
