The Categorical Approach For Crimes Involving Moral Turpitude After Silva-Trevino, Pooja R. Dadhania Jan 2011

The Categorical Approach For Crimes Involving Moral Turpitude After Silva-Trevino, Pooja R. Dadhania

Faculty Scholarship

A conviction for a crime involving moral turpitude (CIMT) can result in harsh immigration penalties such as removal from the United States for noncitizens. The designation of a crime as a CIMT depends on whether moral turpitude inheres in its elements. Administrative adjudicators and federal courts have thus been using a categorical approach that focuses on the elements of a crime to determine whether it is a CIMT. Although variations in the categorical approach have developed among the circuits, the categorical approach has customarily employed two steps, both focusing on the elements of the conviction rather than the actions of …

An Examination Of The Catch Nurture Program In The Treatment Of Children's Mental Health Disorders, Jessica Avart

PCOM Psychology Dissertations

School-based mental health services are in high demand due to the increased prevalence of diagnosable mental health disorders among the pediatric population, Attention Deficit/Hyperactivity Disorder (ADHD) foremost among them. The majority of research examining school-based services has been conducted in highly controlled settings and there has been a lack of research investigating such services within the actual school environment. The purpose of this study was to investigate the Catch Nurture Program, a school-based intervention, in the treatment of school-aged children with behavioral and/or emotional disturbances in the real-world setting. This study also examined the impact of gender and diagnosis on …

Prosecutorial Discretion And The Neglect Of Juvenile Shielding Statutes, Andrea L. Dennis Jan 2011

Prosecutorial Discretion And The Neglect Of Juvenile Shielding Statutes, Andrea L. Dennis

Nebraska Law Review

This Article reviews the failure of juvenile shielding statutes to take hold in the prosecution of cases involving child witnesses because of prosecutors’ discretionary decisions not to use these statutes. The Article investigates prosecutors’ pragmatic and doctrinal justifications for not utilizing juvenile shielding statutes and concludes that the proffered reasons are legitimate. Building on these insights, the Article concludes by offering legislative reform designed to revitalize juvenile shielding statutes. The discussion that follows proceeds in three parts. Part II describes the development of juvenile shielding laws, particularly the circumstances sparking the public and academic demand for protection of juvenile witnesses …

Death And Texas: The Unevolved Model Of Decency, Patrick Metze Jan 2011

Death And Texas: The Unevolved Model Of Decency, Patrick Metze

Nebraska Law Review

Capital punishment practice in recent years has diverged from emphasis on guilt-innocence to dedicate virtually all resources to punishment issues. This Article attempts to avoid this myopic approach by taking stock of the current state of substantive capital law at its very foundation. After a brief history of modern death penalty jurisprudence and a restatement of the current rendition of Texas’s capital murder statute, this Article will focus first on two troubling themes in capital representation. First, how mens rea issues can address the lack of “diminished capacity” in Texas capital punishment law while suggesting a seldom used or understood …

Through community service activities, and ministries to members within their congregations, faith communities will encounter individuals with behavioral health needs. This article suggests that faith communities have inherent resources that can enhance the reach and effectiveness of behavioral health systems. A framework is presented that will create a bridge of understanding about how behavioral health can leverage faith organization assets and how faith organizations can actively assist adults, children and families with behavioral health needs within the context of their faith and their community.

The Rule Of Law Through Its Economies Of Appearances: The Making Of The African Warlord, Kamari Maxine Clarke Jan 2011

The Rule Of Law Through Its Economies Of Appearances: The Making Of The African Warlord, Kamari Maxine Clarke

Indiana Journal of Global Legal Studies

The global reach of international law is now becoming relevant to the micromanagement of daily life. In postcolonial African states, everyday actions and their meanings are being opened up by the expansion of national jurisdiction into international jurisdiction. In relation to these changing technologies of managing shifting regimes of power, this article explores the ways that the spectacle of the rule of law is linked to the spectacle of capitalism. By examining the workings of victim and witness testimonies in the Special Court of Sierra Leone, I examine the ways that spectacles of law and articulations of suffering displace the …

United States Army: Publications

I magine you are the warden of a prison or the administrator of a jail, you enter the facility, and the heavy metal door clangs shut behind you. A riot breaks out and several members of your staff are taken hostage. Fires are set in various locations. The rioting inmates, members of a gang, attack other inmates who want no part in the rebellion and are only concerned for their safety. The decisions you as a leader make are literally matters of life or death, not only for yourself, but also for your staff and those incarcerated. The dynamics of …

Storm Spotting And Amateur Radio: A Field Guide For Volunteer Storm Spotters, Michael Patrick Corey

Electronic Theses and Dissertations

Undocumented Criminal Procedure, Devon W. Carbado, Cheryl I. Harris Jan 2011

Undocumented Criminal Procedure, Devon W. Carbado, Cheryl I. Harris

Faculty Articles

For more than two decades, criminal procedure scholars have debated what role, if any, race should play in the context of policing. Although a significant part of this debate has focused on racial profiling, or the practice of employing race as basis for suspicion, criminal procedure scholars have paid little attention to the fact that the U.S. Supreme Court has sanctioned this practice in a number of cases at the intersection of immigration law and criminal procedure. Notwithstanding that these cases raise similar questions to those at the heart of legal and policy debates about racial profiling, they are largely …

Guns, Fruits, Drugs, And Documents: A Criminal Defense Lawyer's Responsibility For Real Evidence, Stephen Gillers Jan 2011

Guns, Fruits, Drugs, And Documents: A Criminal Defense Lawyer's Responsibility For Real Evidence, Stephen Gillers

Faculty Articles

A criminal defense lawyer may need to read a document, test a weapon, or analyze a substance in order to advise a client. Or there may be no such need but a client may show up at a law office with an illegal weapon, contraband, or stolen property. In either event, what should a lawyer do with the item following any evaluation? What should she do if her client reveals where a weapon, contraband, or stolen property is hidden? Some cases say that a lawyer who receives or retrieves an item of real evidence must give it to the authorities …

American Policing At The Crossroads: Unsustainable Policies And The Procedural Justice Alternative, Stephen J. Schulhofer, Tom R. Tyler, Aziz Z. Huq Jan 2011

American Policing At The Crossroads: Unsustainable Policies And The Procedural Justice Alternative, Stephen J. Schulhofer, Tom R. Tyler, Aziz Z. Huq

Faculty Articles

As victimization rates have fallen, public preoccupation with policing and its crime-control impact has receded. Terrorism has become the new focal point of concern. But satisfaction with ordinary police practices hides deep problems. The time is therefore ripe for rethinking the assumptions that have guided American police for most of the past two decades. This Article proposes an empirically-grounded shift to what we call a procedural justice model of policing. When law enforcement moves toward this approach, it can be more effective at lower cost and without the negative side effects that currently hamper responses to terrorism and conventional crime. …

Mentoring As A Professional Development Tool In Preparing The Next Generation Of Leaders In The North Carolina Community College System, Manuel C. Dudley Jan 2011

Mentoring As A Professional Development Tool In Preparing The Next Generation Of Leaders In The North Carolina Community College System, Manuel C. Dudley

Dissertations

The North Carolina community college is approaching 50 years of existence in 2013. It is a community college system that is respected both nationally and internationally. The economic downturn of the United States has created a period of record enrollment in the community college, as individuals seek upgrades in training, work skills, and educational attainment. This period of record enrollment is not without challenges. Budgetary constraints, a consumer demand for easier access to classes through online and distance learning, and an increase in the racial, ethnic, and cultural diversity of the student population has created a proverbial perfect storm. Many …

Community-Based Operations Research: Introduction, Theory And Applications, Michael P. Johnson Jr.

Public Policy and Public Affairs Faculty Publication Series

Community-based operations research is the name of a new sub-discipline within operations research and the management sciences. CBOR synthesizes previous practice and research traditions within OR/MS to address problems within the public sector that are often of a localized nature, that address the concerns of citizens affiliated through characteristics of race, ethnicity and class and other ties and that are solved using diverse qualitative and quantitative methods. Solutions to these problems are developed and implemented by formal and informal organizations, and embody a critical perspective towards traditional notions of decisionmakers, stakeholders and analytic methods. The most proximate antecedents of CBOR …

Risk Factors For Homelessness And Sex Trade Among Incarcerated Women: A Structural Equation Model, Seijeoung Kim, Timothy P. Johnson, Samir Goswami, Michael Puisis Jan 2011

Risk Factors For Homelessness And Sex Trade Among Incarcerated Women: A Structural Equation Model, Seijeoung Kim, Timothy P. Johnson, Samir Goswami, Michael Puisis

Journal of International Women's Studies

Incarcerated women are among the most vulnerable and perhaps the least studied populations in the US. Significant proportions of female inmates are substance users, and many living in unstable housing conditions or being homeless. Female inmates are often at high risk of engaging in sex exchange for drugs or housing needs. While a disproportionate number of incarcerated women have experienced childhood household adversities and maltreatments, the effects of these childhood experiences on psychosocial and behavioral outcomes of this population in later life. We apply a life course perspective to examine these pathways in a sample of incarcerated women in Cook …
